MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.—
No. TPS-2217-746-CR-359-UD-9-2017.—
Whereas, the Government has sanctioned the Development Plan of Bhadrawati Municipal Council vide Urban Development Department's Notification No. TPS-2211-2224-C.R.-258-UD-9, Dated 09-05-2012 under sub-section (1) of Section 31 of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as 'the said Act') which came into force with effect from the 20-06-2012 and excluded part of the Development Plan has been sanctioned by the Government vide Urban Development Department's Notification No. TPS-2211-2224-CR-258-2011-UD-9, dated 03-01-2015 (hereinafter referred to as "the said Development Plan") ;
And whereas, in the said Development Plan, land bearing Survey No. 134 admeasuring area 1.12 Hactare of Mouje Chichordi (hereinafter referred to as "the said Land") is included in Existing Water Body ;
And whereas, the Bhadrawati Municipal Council (hereinafter referred to as "the said Planning Authority"), vide its General Body Resolution No. 03, Dated 12-07-2013 had resolved to delete the saidद्धन्रु]क्ष् रू न् +रून् ॅ-+ न् ह्यम््र ान्म््र, +रू]क्ष् १६, २०१८/रम् २५, ॅ १९४० ३ Land from Existing Water Body and to include the same in Residential Zone and accordingly submitted to the Government, for its sanction, a modification proposal as per the provisions of sub-Section (1) of Section 37 of the said Act, (hereinafter referred to as "the Proposed Modification") ;
And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of the opinion that the proposed Modification should be sanctioned with some conditions ;
And whereas, the Land Owners of the said lands have deposited Rs. 3,44,400 towards the 50% Government share of 5% premium amount as per the rate of the said lands as prescribed in the Annual Statement of Rates (ASR) for the year 2018-19 in the Government Treasury on 03-07-2018 through the Town Planner, Chandrapur Branch, Chandrapur and remaining 50% of the 5%premium amount Rs. 3,44,400 payable to the Planning Authority has been deposited with the Chief Officer, Bhadrawati Municipal Council on 03-07-2018 ;
Now therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government hereby, sanctions the Proposed Modification and for that purpose amends the aforsaid Notification dated the 09-05-2012 as follows ;
" In the Schedule of Modification appended to the Notification dated 09-05-2012 sanctioning the said Development Plan, the following new entry shall be added after the last entry".—
ENTRY
"The land bearing Survey No. 134 (admeasuring about 1.12 Hactare) of Mouje Chichordi is deleted from Existing Water Body and is included in Residential Zone as shown on the plan, subject to the conditions mentioned below"—
Condition No. 1.—In addition to open space, necessary Amenity Space shall be provided in the layout of the said Land as per the prevailing Development Control Regulations of Bhadrawati.
Condition No. 2.—It shall be binding on the land owner/developer, to provide all Basic Amenities required for the land at his own cost.
A Copy of the Notification, along with the part plan showing the aforesaid sanctioned modification, shall be available for inspection of the general public, in the office of the Chief Officer, Bhadrawati Municipal Council, Bhadrawati during office hours on all working days for a period of one month.
