आणि ज्याअर्थी, उक्त अधिनियमाचे कलम ३७ चे पोट-कलम (१कक) अन्वये प्राप्त अधिकारांचा वापर करून राज्य शासनाने सूचना क्रमांक टीपीबी-४३१८/प्र.क्र.२६/२०१८/नवि-११, दिनांक २९ जून २०१८ (यापुढे याचा उल्लेख " उक्त सूचना " असा करणेत आलेला आहे.) द्वारे उक्त सूचनेसोबतचे परिशिष्टामध्ये नमूद केलेल्या प्रस्तावित फेरबदलासंदर्भात जनतेकडून हरकती / सूचना मागविल्या आहेत ;
आणि ज्याअर्थी, उक्त सूचनेत काही टंकलेखनाच्या त्रुटी व चुका असल्याचे निदर्शनास आले आहे आणि त्याकरिता सोबत जोडलेले जोडपत्र-१ मध्ये नमूद केलेले शुद्धीपत्रक निर्गमित करणे आवश्यक आहे.

CORRIGENDUM TO NOTICE
No. TPB-4318/CR-26/2018/UD-11.—Whereas, the Government of Maharashtra, in Urban Development Department, vide its Notification No. TPB-4306/564/CR-55/06/UD-11, dated 12th December 2007, under sub-section (2) of section 37 of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as " the said Act ") sanctioned the Development Control Regulations for Navi Mumbai Municipal Corporation-1994 (hereinafter referred to as " the said Regulations ") as submitted under sub-section (1) of the section 37 of the said Act by Navi Mumbai Municipal Corporation (hereinafter referred to as " the said Corporation ") for its area by keeping some of the Regulations in abeyance and whereas the said Regulations have come into force with effect from 27th December 2007 ;
And whereas, in exercise of the powers conferred by sub-section (1AA) of section 37 of the said Act, the State Government vide Notice No. 4318 /CR- 26 /2018/UD-11, dated 29th June 2018 (hereinafter referred to as " the said Notice ") have invited objections and suggestions from any person in respect of the proposed modifications appended thereto to the said Notice ;
And whereas, it is noticed that there are some typographical errors and mistakes, certain corrections and additions area needed in the said Notice and for that purpose it is necessary to issue a Corrigendum for the same as mentioned in Annexure- I appended hereto ;
Now therefore, this Corrigendum is issued in respect of such corrections in Notice as mentioned in Annexure-I appended hereto.
Copy of this Corrigendum is kept open for the inspection of the public in the following office during office hours on all working days :—

आणि ज्याअर्थी, महाराष्ट्र शासनाने नगरविकास आणि सार्वजनिक आरोग्य विभागाकडील अधिसूचना क्रमांक आरपीबी. ११७५/६३५/बीयूडी-५, दिनांक १६ सप्टेंबर १९७६ (महाराष्ट्र शासन राजपत्रामध्ये प्रसिद्ध दिनांक २१ सप्टेंबर १९७६) अन्वये उक्त महामंडळाने नवी मुंबई नवनगरासाठी विर्िनदिष्ट करण्यात आलेल्या क्षेत्रासाठी तयार केलेल्या सर्वसाधारण विकास नियंत्रण नियमावलीस मंजुरी दिलेली असून (यापुढे ज्याचा उल्लेख ""उक्त विकास नियंत्रण नियमावली"" असा केलेला आहे.) ती अंमलात आलेली आहे. तसेच नगरविकास आणि सार्वजनिक आरोग्य विभागाकडील अधिसूचना क्रमांक आरपीबी. ११७५/६३५/बीयूडी-५, दिनांक १८ ऑगस्ट १९७९ सह नगरविकास आणि सार्वजनिक आरोग्य विभागाकडील अधिसूचना क्रमांक आरपीबी. ११७५/६३५/यूडी-५, दिनांक १८ जानेवारी १९८० अन्वये, उक्त महामंडळाने नवी मुंबई नवनगरासाठी विर्िनदिष्ट करण्यात आलेल्या क्षेत्रासाठी सादर केलेल्या प्रारुप विकास योजनेस मंजुरी दिलेली असून अधिसूचनेमध्ये नमूद असलेप्रमाणे ती दिनांक १ मार्च १९८० पासून अंमलात आलेली आहे. आणि कलम ३१ खालील तरतुदीनुसार त्यास ""अंतिम विकास योजना"" असे संबोधिण्यात आलेले आहे ;
आणि ज्याअर्थी, उक्त महामंडळाने उक्त अधिनियमाचे कलम ३७ मध्ये विहित केलेली कायदेशीर प्रक्रिया पार पाडून र्आथिकदृष्टया दुर्बल घटक / कमी उत्पन्न / मध्यम उत्पन्न गटाच्या गृहबांधणीसाठी २.५० चटई क्षेत्र निर्देशांक अनुज्ञेय करणेच्या अनुषंगाने उक्त विकास नियंत्रण नियमावलीमध्ये फेरबदल प्रस्ताव (यापुढे ज्याचा उललेख ""प्रस्तावित फेरबदल"" असा केलेला आहे.) राज्य शासनास दिनांक १३ मार्च २०१४ रोजीच्या पत्रान्वये मंजुरीसाठी सादर केलेला आहे.
आणि ज्याअर्थी, संचालक, नगररचना, महाराष्ट्र राज्य, पुणे यांचेशी सल्लामसलत केल्यानंतर प्रस्तावित फेरबदल भागश: काही बदलांसह मंजूर करणे आवश्यक आहे, असे शासनाचे मत झालेले आहे ;
आणि त्याअर्थी, उक्त अधिनियमाचे कलम ३७ पोट-कलम (२) अन्वये प्राप्त अधिकारांचा वापर करून शासन खालीलप्रमाणे :---
(अ) उक्त फेरबदलाचे प्रस्तावास यासोबत जोडलेल्या परिशिष्टामध्ये नमूद केलेप्रमाणे काही बदलांसह मंजुरी देत आहे. (ब) सदरची अधिसूचना शासकीय राजपत्रामध्ये प्रसिद्ध झालेचा दिनांक हा उक्त फेरबदल अंमलात आलेचा दिनांक असेल. (क) उक्त महामंडळास, उक्त विकास नियंत्रण नियमावली सोबतच्या फेरबदलाचे परिशिष्टामध्ये शेवटच्या नोंदीनंतर वरील नोंद (अ) समाविष्ट करणेचे निर्देश देत आहे.

(EWS) and Low Income Group (LIG) under Regulation 16.3 (1a)AB.
1. Area of the plot for undertaking Housing Schemes for EWS and LIG shall not be less than 4000 Sq.mt. and should derive vehicular access from the roads of 18 m. or wider right of way. However, the size of plot may be reduced by Managing Director, CIDCO considering the requirement and hardship.
2. Total permissible FSI shall be 2.5 on gross plot area, excluding 15% open space area.
3. For the purpose of this regulation the carpet areas for EWS and LIG tenements shall be determined by the Government from time to time.
4. 15% of the plot area shall be specifically designated for amenity space which is developed by the CIDCO for primary school, dispensary, library, vegetable market, gymnasium, creche etc. as per the need of neighborhood as decided by the M.D., CIDCO. 1/5th of the permissible FSI of amenity space may be utilized for other Commercial Purpose such as Convenience shopping.
5. The width of common passage normally shall be 1.80m. minimum and will not exceed 2.0m. in any case, it shall not be counted towards FSI.
6. Where the location of the plots abuts a watercourse, the marginal open space along such watercourse shall be minimum of 9m. and 15 m. from the edge of Nala and River respectively.
7. The site for such housing project shall be within 500 mts. from Metro Station and 300 mts. from Bus Stand / Bus Station.

No. TPB. 4318/CR-26/2018/UD-11.— Whereas, the Government of Maharashtra has in exercise of the powers conferred by sub-section (1) of section 113 of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as " the said Act ") designated by Notification, Urban Development, Public Health and Housing Department No.RPB 1171 /18124 / 113/IW, dated the 20th March 1971, as amended by Notification No. 1173/IRPC, dated the 16th August 1973, the area specified therein as the site for a new town of Navi Mumbai ;
Whereas, the Government of Maharashtra in exercise of the powers conferred by sub-section (3A) of the section 113 of the said Act, declared by Notification, Urban Development, Public Health and Housing Department, No. RPB. 1171/18124/113/IW, dated the 20th March, 1971 and by Notification Urban Development, Public Health and Housing Department No. RPB 1173-II RPC, dated the 16th August 1973, City and Industrial Development Corporation of Maharashtra Limited (being a company owned and controlled by the Government of Maharashtra) (hereinafter referred to as " the said Corporation ") as the New Town Development Authority for the said area comprised in the site of Navi Mumbai as specified therein ;
And whereas, the Government of Maharashtra vide Notification of Urban Development and Public Health Department No. RPB. 1175/635/BUD-5, dated 16th September 1976 ( Published in Maharashtra Government Gazette, dated 21st September 1976) sanctioned General Development Control Regulation for site of Navi Mumbai, prepared by the said Corporation and vide Notification Urban Development and Public Health Department No. RPB.1175/635/BUD-5, dated the 18th August 1979, read with Urban Development Department and Public Health Department's Notification No. RPB. 1175/635/UD-5, dated the 18th January 1980, sanctioned the Draft Development Plan submitted by the Corporation for the said area comprised in the site for the New Town and Navi Mumbai and such sanctioned Development Plan has come into effect on and from the 1st March 1980 (hereinafter referred to as " the said plan ") as stated in the foregoing Notification and is called " the Final Development Plan " under-section 31 of the said Act ;
And Whereas, the said Corporation has submitted a modification proposal vide letter dated 13th March 2014 to the Government for its sanction, after completing the legal procedure under Section 37(1) of the said Act, in respect of permitting 2.5 F.S.I. for Housing of Economically Weaker Section, Low Income Group, Middle Income Group (hereinafter referred to as " the proposed modification ") ;
And whereas, after consulting the Director of Town Planning, Maharashtra State, Pune the Government is of the opinion that the said modification shall be approved partly with some changes.
Now therefore, in exercise of the powers conferred by sub-section (2) of section 37 of the said Act, Government hereby :—
(a) Sanctions the said modification proposal with some changes as described in the Schedule attached herewith.
(b) Fixes the date of publication of this Notification in the Official Gazette, as the date on which the said modification shall come into force.
(c) Directs the said Corporation that in the Schedule of Modifications appended to the aforesaid modification sanctioning the said Plan after the last entry a new entry, the above (a) shall be added.
