अधिसूचना
नियंत्रक व महालेखापरीक्षक (कर्तव्य, अधिकार व सेवेच्या शर्ती) अधिनियम, १९७१.
क्रमांक लेखाप. २०१२/१०२९/प्र.क्र. १३१/अर्थ व लेखा.----ज्याअर्थी, सार्वजनिक हितासाठी, महाराष्ट्र गृहनिर्माण व क्षेत्रविकास प्राधिकरण, मुंबई (यात यापुढे ज्याचा निर्देश, " उक्त प्रधिकरण " असा करण्यात आला आहे.) यांच्या लेख्यांची, भारताच्या नियंत्रक व महालेखापरीक्षकाकडून लेखापरीक्षा करणे आवश्यक आहे, याबाबत महाराष्ट्राच्या राज्यपालांची खात्री पटली आहे ;
आता, त्याअर्थी, नियंत्रक व महालेखापरीक्षक (कर्तव्ये, अधिकार व सेवेच्या शर्ती) अधिनियम, १९७१ (१९७१ चा ५६) याच्या कलम २० च्या पोट-कलम (१) द्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करुन, महाराष्ट्र गृहनिर्माण व क्षेत्रविकास प्राधिकरण अधिनियम,१९७६ मधील कलम ३९ च्या उप कलम (२) मध्ये नमूद केल्यानुसार, तसेच महाराष्ट्राचे राज्यपाल यांच्याद्वारे नियंत्रक व महालेखापरीक्षकांशी विचारविनिमय केल्यानंतर आणि अशा लेखापरीक्षेच्या प्रस्तावासंबंधात अभिवेदन सादर करण्याची उक्त प्राधिकरणास संधी दिल्यानंतर, याद्वारे यासोबत जोडलेल्या अनुसूचित नमूद केलेल्या अटी व शर्तीवर, दिनांक १ एप्रिल २०१८ रोजी सुरु होणा-या व दिनांक ३१ मार्च २०२३ रोजी संपणा-या पाच वषार्ंच्या कालावधीकरिता उक्त प्राधिकरणाच्या लेख्यांची लेखापरीक्षा करण्याची नियंत्रक व महालेखापरीक्षक यांना विनंती करीत आहेत.
अनुसूची
[नियंत्रक व महालेखापरीक्षक (कर्तव्ये, अधिकार व सेवेच्या शर्ती) अधिनियम, १९७१ (१९७१ चा ५६) याच्या कलम २० च्या पोट-कलम (१) अन्वये नियंत्रक व महालेखापरीक्षक यांच्याकडे लेखापरीक्षणाचे काम सोपविण्याबाबतच्या अटी व शर्ती ].
अटी व शर्ती
(१) लेखापरीक्षेसंबंधात केलेला कोणताही खर्च, उक्त प्राधिकरणाकडून भारताचे नियंत्रक व महालेखापरीक्षकांना देय होईल.
(२) भारताचे नियंत्रक व महालेखापरीक्षकांना किंवा लेखापरीक्षेसंबंधात त्यांनी नियुक्त केलेल्या कोणत्याही व्यक्तीस, शासकीय लेख्यांच्या लेखापरीक्षासंबंधात नियंत्रक व महालेखापरीक्षकांना जे अधिकार, विशेषाधिकार व प्राधिकार असतात तेच अधिकार, विशेषाधिकार व प्राधिकार असतील.
(१)
भाग चार-अ--१७५----१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, ऑगस्ट २४, २०१८/भाद्रपद २, शके १९४० (३) लेखापरीक्षेचे निष्कर्ष नियंत्रक व महालेखापरीक्षकांकडून किंवा त्यांनी नियुक्त केलेल्या कोणत्याही व्यक्तीकडून उक्त प्राधिकरणाला कळविण्यात येतील. उक्त प्राधिकरण, लेख्यांची एक प्रत व त्यावरील टिपणीसह अहवालाची प्रत शासनास सादर करील. नियंत्रक व महालेखापरीक्षक देखील अहवालातील एक प्रत थेट शासनाला पाठवतील.
(४) दिनांक १ एप्रिल २०१८ रोजी सुरु होणा-या व दिनांक ३१ मार्च २०२३ रोजी संपणा-या पाच वषार्ंच्या कालावधीच्या लेख्यांची, लोकहितार्थ लेखापरीक्षा करण्याचे काम, त्या कालावधीनंतर या व्यवस्थेचा फेर आढावा घेण्याच्या शर्तीस अधीन राहून, नियंत्रक व महालेखापरीक्षकांकडे सोपविण्यात आलेले आहे.
(५) नियंत्रक व महालेखापरीक्षकांच्या पूर्व मंजुरीशिवाय, उक्त प्राधिकरणाच्या लेख्यासंबंधात कोणत्याही प्रयोजनासाठी दुसरा लेखापरीक्षक नियुक्त केला जाणार नाही.
(६) लेखापरीक्षेची व्याप्ती, विस्तार व पद्धत नियंत्रक व महालेखापरीक्षक यांनी ठरवून दिल्याप्रमाणे असेल.
(७) भारताचे नियंत्रक व महालेखापरीक्षकांना आपल्या स्वेच्छानिर्णयाने, लेखापरीक्षेचे निष्कर्ष राज्य विधान मंडळाला कळविण्याचा अधिकार असेल.

NOTIFICATION
COMPTROLLER AND AUDITOR-GENERAL'S (DUTIES, POWERS AND CONDITIONS OF SERVICE) ACT, 1971.
No. Lekhap. 2012/1029/CR. 131/Bud and Accs.—Whereas, the Government of Maharashtra is satisfied that it is necessary, in the public interest, to audit the accounts of the Maharashtra Housing and Area Development Authority, Mumbai (hereinafter referred to as "the said Authority"), by the Comptroller and Auditor-General of India ;
Now, therefore, in exercise of the powers conferred by sub-section(1) of section 20 of the Comptroller and Auditor-General's (Duties, Powers and Conditions of Service) Act, 1971 (56 of 1971), read with sub- section (2) of section 39 of the Maharashtra Housing and Area Development Act, 1976 (Mah. XXVIII of 1977 ), the Governor of Maharashtra, after consultation with the Comptroller and Auditor-General and after giving the said Authority an opportunity to make representation with regard to the proposal for such audit, hereby requests the Comptroller and Auditor-General of India to audit the accounts of the said Authority for a period of five years, commencing from the 1st April 2018 and ending on the 31st March 2023, on the terms and Conditions mentioned in the Schedule appended hereto.
SCHEDULE
[Terms and Conditions for entrustment of audit of the Comptroller and Auditor-General under sub- section (1) of section 20 of the Comptroller and Auditor-General's (Duties, Powers and Conditions of Service) Act, 1971 (56 of 1971)].
Terms and Conditions
(1) Any expenditure incurred in connection with the audit shall be payable by the said authority to the Comptroller and Auditor-General of India.
(2) The Comptroller and Auditor-General, or any person appointed by him in connection with the audit, shall have the same rights, privileges and authority as the Comptroller and Auditor-General has in connection with the audit of the Government accounts.
(3) The result of audit shall be communicated by the Comptroller and Auditor-General or any person appointed by him, to the said Authority who shall submit a copy of accounts thereof with a copy of the report thereon along with the observations to the Government. The Comptroller and Auditor-General shall also forward a copy of the report directly to the Government.
(4) The audit is entrusted to the Comptroller and Auditor-General in the public interest for a period of 5 years accounts, commencing with accounts for the year 1st April, 2018 and ending with the accounts for the year 31st March, 2023 subject to review of the arrangement after that period.
४ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, ऑगस्ट २४, २०१८/भाद्रपद २, शके १९४०(5) No other auditor will be appointed for any purpose whatsoever inconnection with the accounts of the said Authority, except with the prior approval of the Comptroller and Auditor-General.
(6) The scope, extent and manner of conducting audit shall be as decided by the Comptroller and Auditor-General.
(7) The Comptroller and Auditor-General shall have the right to report to the State Legislature, the results of audit at his discretion.
