MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.

Whereas, the Revised Development Plan of Akola City, has been sanctioned by the Government under Section 31 of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as " the said Act ") vide Notification No. TPS-2502-680-CR-129(B)-2002-UD-30, Dated 26th October, 2004 and it has come into force with effect from the 15st December, 2004 (hereinaf- ter referred to as " the said Development Plan ") ;
And whereas, in the said Development Plan, the land bearing Survey No. 55/1, Sheet No. 64 C, Plot No. 1/1 of Mouje Umari, Tq. & District Akola, area admeasuring 0.28 ha (hereinafter referred to as " the said land ") is reserved for " Site No. 137-Children Park " (hereinafter referred to as " the said Site ") ;
And whereas, the Akola Municipal Corporation has given layout permission and building permission for Hospital use as per sanctioned plan on land bearing Survey No. 55/1, Sheet No. 64 C, Plot No. 1/1 vide letter dated 26-09-1957 and dated 05-11-2012 respectively ;
And whereas, after making necessary enquiries and after consulting the Director of Town Planning, Maharashtra State, Pune, the Government was of opinion that the said land should be deleted from the said Reservation and hence Government vide Order dated 08-05-2017 issued directives underद्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, +रू]क्ष् ३०-रू]क्ष्दन् ५, २०१८/ ८-१४, ॅ १९४० ३ Section 37(1) of the said Act, to the Akola Municipal Corporation to initiate and submit a modification proposal to the Government under Section 37 of the said Act regarding the deletion of the said land from the said reservation (hereinafter referred to as "the said Modification ") ;
And whereas, as per the said directives, the Akola Municipal Corporation was required to publish a notice of the said modification in the Maharashtra Government Gazette within a period of 90 days from the date of the said directives ;
And whereas, the Akola Municipal Corporation has failed to publish the said notice under Section 37(1) of the said Act for inviting suggestions/objections in respect of the said Modification, within the stipulated time ;
Now, therefore, in exercise of the powers vested under Section 37(1A) of the said Act, the Government hearby publishes this notice for inviting suggestions/objections from the general public within a period of one month from the date of publication of this notice in the Official Gazette, with regard to the said modification described in the schedule below. Any suggestions/objections on the proposed modification be forwarded to the Joint Director of Town Planning, Amravati Division, " Nilgiri " Dr. Agrawal's Building, Congress Nagar Road, Amravati who has been appointed as the officer under Section 162(1) of the said Act to hear suggestions/objections and submit his report to the Government within 30 days after the expiry of the above mentioned period ;

" The Land bearing Survey No. 55/1, Sheet No. 64 C, Plot No. 1/1 of Mouje Umari, Tq. & District Akola, area admeasuring 0.28 ha. is proposed to be deleted from " Site No. 137-Children Park " and the land so deleted is proposed to be included in Residential Zone as shown on plan. "
2. The aforesaid proposed modification shall be available for inspection for the general public during Office hours on all working days at the following offices for the period of one month.

BY DIRECTOR, TOWN PLANNING
MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.—
ORDER
No. D.T.P.-D.P. Pandharkawda(R)-Sec-127(2)-Order-TPV-VI-4800-2018.—
Whereas, the Government of Maharashtra, Urban Development Department vide its Notification No. TPS-2795-1752-CR-284-1995-UD-13, Dated 02-12-1997 has sanctioned the Revised Development Plan of Pandharkawda (hereinafter referred to as the "Said Development Plan ") under Section 31 (1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") and the same has came into force with effect from 18-05-1998 ;
And whereas, in the said Development Plan, the land of S. No. 6 (Part) of Pandharkawda is reserved for Site No. 01 " Park " admeasuring 2.15 hect. (hereinafter referred to as " the said Reservation") ; for which Appropriate Authority is Municipal Council, Pandharkawda (hereinafter referred to as " the said Appropriate Authority ") ;
And whereas, the land under said reservation have not been acquired by the said Appropriate Authority within ten years from the date on which the said Development Plan came into force ;
And whereas, the owners of 1.98 hect. land from S. No. 6/1 and 1.56 hect. land from S. No. 6/2 had served a Notice under Section 127(1) of the the said Act, on the said Appropriate Authority vide their letter dated 29-09-2014 ;
And whereas, land owner's land admeasuring 1.59 hect. from S. No. 6/1 and 6/2 is affected by Site No. 01 "Park" (hereinafter referred to as "the said Land")
And whereas, the said Appropriate Authority, has not acquired or no steps as contemplated in the Section 127(1) of the said Act, has commenced for its acquisition within the period of twenty four months from the receipt of the aforesaid notice ;
And whereas, the Hon'ble High Court of Judicature of Nagpur Bench in Writ Petition No. 245 of 2017 and 246 of 2017 filed by the owners of the said land has vide its order dated 06-03-2017, held that the said reservation to the extent of the said land have been lapsed under Section 127 of the Said Act ;
And whereas, in accordance with the provision of Section 127(1) of the said Act, the said Reserva- tion, pertaining to the said land, has lapsed and it is accordingly expedient to notify such lapsing under Section 127(2) of the said Act ;
And whereas, the Government in Urban Development Department under Section 151 of the said Act, vide Resolution No. TPS-1813-3211-CR-508-UD-13, dated 01-12-2016, has delegated the powers ex- ercisable by it under Section 127(2) of the said Act, in respect of Development Plans of all Municipal Councils/Nagar Panchayats and for the Development Plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune ;
Now, therefore, in exercise of the powers delegated by the Government, in respect of sub-section (2) of Section 127 of the said Act and of all other powers enabling it in that behalf, the Director of Town Planning, Maharashtra State, Pune, hereby notifies that the said Reservation of Site No. 01 " Park" was lapsed only in respect of said Land (as specified in the schedule herein below) and the said land shall become available to the land owners for the purpose of Development as otherwise, permissible in the case of adjacent land, under the said Development Plan.
