महाराष्ट्र दिवाणी न्यायालय अधिनियम.

क्रमांक संकीर्ण-०११७/प्र.क्र. ४१/का-११.----- महाराष्ट्र दिवाणी न्यायालय अधिनियम (१८६९ चा १४) याच्या कलम १९ द्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून आणि याबाबतीत यापूर्वी काढलेल्या सर्व शासकीय अधिसूचनांचा, सोलापूर जिल्ह्यतील माढा व बार्शी या महसूल तालुक्यांशी जेथवर संबंध असेल तेथवर त्यामध्ये अंशत: फेरबदल करून, महाराष्ट्र शासन, याद्वारे पुढीलप्रमाणे निदेश देत आहे की, दिनांक १ सप्टेंबर २०१८ पासून,----

(क) सोलापूर जिल्ह्यतील प्रमुख जिल्हा न्यायाधीश, सोलापूर यांच्या न्यायालयाच्या आणि जिल्हा न्यायाधीश-१, बार्शी यांच्या न्यायालयाच्या अधिकारितेच्या सीमांमध्ये प्रमुख जिल्हा न्यायाधीश, सोलापूर यांच्या अधिकारितेतून महसूल तालुका माढा वगळण्यात येऊन आणि त्याचा सोलापूर जिल्ह्यतील जिल्हा न्यायाधीश-१, बार्शी यांच्या न्यायालयाच्या अधिकारितेत समावेश करण्यात येऊन, फेरबदल करीत आहे ;

(ख) सोलापूर जिल्ह्यतील जिल्हा न्यायाधीश-१, बार्शी यांच्या न्यायालयाच्या सर्वसाधारण अधिकारितेची स्थानिक सीमा विद्यमान अधिकारितेव्यतिरिक्त असेल, तसेच ती त्यासोबतच समव्यापी असेल आणि त्यात सोलापूर जिल्ह्यतील माढा महसुली तालुक्याचा अंतर्भाव असणा-या क्षेत्रांचा समावेश असेल ; आणि

(ग) सोलापूर जिल्ह्यतील माढा महसुली तालुक्यांच्या संबंधात प्रमुख जिल्हा न्यायाधीश, सोलापूर यांचे, उक्त अधिनियमाच्या कलम ९ अन्वये प्रमुख जिल्हा न्यायाधीश, सोलापूर यांच्याकडे विहित असलेल्या अधिकाराव्यतिरिक्त आणि त्यांना योग्य वाटतील अशी प्रकरणे जिल्हा न्यायाधीश यांना नेमून देण्याच्या किंवा स्वत:कडे काढून घेण्याच्या किंवा सक्षम अधिकारितेत असणा-या अन्य न्यायालयाकडे वर्ग करण्याच्या त्यांच्या अधिकाराव्यतिरिक्त, सर्व अधिकार जिल्हा न्यायाधीश वर्ग-१, बार्शी, जिल्हा सोलापूर यांच्याकडे विहित असतील.

NOTIFICATION

MAHARASHTRA CIVIL COURTS ACT.

No. SANKIRNA-0117/CR. 41/Desk-11.— In exercise of the powers conferred by section 19 of the Maharashtra Civil Courts Act (XIV of 1869) and in partial modification of all the earlier notification issued in this behalf, in so far as they relate to the revenue Talukas of Madha and Barshi in Solapur District, the Government of Maharashtra directs that, with effect from 1st September 2018,—

(a) the limits of jurisdication of Court of Principal District Judge, Solapur and Court of District Judge-1, Barshi, in District Solapur shall be altered by excluding revenue Taluka Madha from the jurisdication of Court of Principal District Judge, Solapur and including it in the jurisdiction of Court of District Judge-1, Barshi in District Solapur ;

(b) the local limits of the ordinary jurisdication of the Court of District Judge-1, Barshi, District Solapur shall, in addition to its existing jurisdication, also be co-extensive with and cover the areas compirising the revenue Taluka of Madha, in Solapur District ; and

(c) all the powers of the Principal District Judge, Solapur in respect of revenue Taluka of Madha, in Solapur District shall vest in the District Judge-1, Barshi, District Solapur except those vested in the Principal District Judge, Solapur under section 9 of the said Act and except his power to assign to the District Judge or withdraw unto himself or to assign to another Court of competent jurisdication, such matters as he thinks fit.

क्रमांक संकीर्ण. ०११७/प्र.क्र. ४१/का-११.----- फौजदारी प्रक्रिया संहिता, १९७३ (१९७४ चा २) महाराष्ट्र राज्याला लागू असताना, त्याच्या कलम ७ तसेच कलम ९ द्वारे प्रदान करण्यात आलेल्या अधिकारांचा आणि याबाबतीत त्यास समर्थ करणा-या सर्व अधिकारांचा वापर करून याबाबतीत यापूर्वी काढलेल्या सर्व अधिसूचनांचा सोलापूर येथील आणि सोलापूर जिल्ह्यतील बार्शी येथील सत्र विभागांचा जेथवर संबंध असेल तेथवर, त्यामध्ये अंशत: फेरबदल करून महाराष्ट्र शासन, मुंबई उच्च न्यायालयाशी विचार विनिमय करून याद्वारे, निदेश देत आहे की, दिनांक १ सप्टेंबर २०१८ पासून सोलापूर येथील व सोलापूर जिल्ह्यतील बार्शी येथील सत्र विभागांच्या सीमांमध्ये फेरफार करून सोलापूर येथील सत्र विभागांच्या अधिकारितेमधून सोलापूर जिल्ह्यतील माढा महसुली तालुक्याला वगळण्यात येऊन त्याचा समावेश सोलापूर जिल्ह्यतील बार्शी सत्र विभागाच्या अधिकारितेत करण्यात येत आहे.

CODE OF CRIMINAL PROCEDURE, 1973.

No. SANKIRNA. 0117/C.R. 41/Desk 11.— In exercise of the powers conferred by section 7 read with section 9 of the Code of Criminal Procedure, 1973 (2 of 1974), in its application to the State of Maharashtra and of all other powers enabling it in this behalf and in partial modification of all earlier notifications issued in this behalf, in so far as they relate to the sessions divisions at Solapur and Barshi in Solapur District, the Government of Maharashtra, in consultation with the High Court of Judicature at Bombay, hereby, with effect from 1st September 2018, alters the limits of the session divisions at Solapur and Barshi in the Solapur District, by excluding the revenue Taluka of Madha in the Solapur District from the jurisdiction of sessions division at Solapur and including it in the jurisdiction of sessions division at Barshi, in the Solapur District.
