क्रमांक एपीपी. ४२१५/प्र.क्र.५३/का.१४.---- दिवाणी प्रक्रिया संहिता, १९०८ च्या ऑर्डर २७, फौजदारी प्रक्रिया संहिता, १९७३ चे कलम २४ (१) व महाराष्ट्र विधि अधिकारी (नियुक्ती, सेवेच्या शर्ती आणि मानधन) नियम, १९८४ च्या नियम १३ मधील तरतुदीनुसार उच्च न्यायालय, अपील शाखा, मुंबई येथे अॅड. अरूणा शांताराम पै यांची अतिरिक्त सहायक सरकारी वकील व अतिरिक्त शासकीय अभियोक्ता या पदावर शासन अधिसूचना समक्रमांक दिनांक ३१ ऑगस्ट २०१६ अन्वये पुढील २ वर्षे कालावधीसाठी नियुक्ती करण्यात आली होती.
सदर नियुक्तीस दिनांक १ सप्टेंबर २०१८ पासून पुढील एक वर्षाचा कालावधी अथवा त्यांच्या वयास ६२ वर्षे पूर्ण होतील तो दिनांक यापयर्ंतचा कालावधी, यापैकी जे अगोदर घडेल तोपयर्ंतच्या कालावधीकरिता तात्पुरत्या स्वरूपात मुदतवाढ देण्यात येत आहे.
२. सदर नियुक्त्या महाराष्ट्र विधि अधिकारी (नियुक्ती, सेवाशर्ती व मानधन) नियम, १९८४ यामध्ये दिलेल्या सेवाशतर्ींच्या अधीन राहील.
३. वरील आदेश मागे घेण्याचा/त्यात दुरुस्ती करण्याचा/ते रद्द करण्याचा अधिकार शासन राखून ठेवीत आहे.

क्रमांक पीएमआर-३३१८/प्र.क्र.४९/(२)/नवि-७.---- ज्याअर्थी, महाराष्ट्र शासनाने पुणे महानगर प्रदेशासाठी महाराष्ट्र महानगर प्रदेश विकास प्राधिकरण अध्यादेश, २०१६ (सन २०१६ चा महा. अध्या.११) व महाराष्ट्र प्रादेशिक व नगररचना अधिनियम, १९६६ (१९६६ चा महा. ३७) अन्वये स्थापित केलेल्या पुणे महानगर प्रदेश विकास प्राधिकरणाच्या माध्यमातून सोबतच्या परिशिष्टामध्ये उल्लेख केलेला मेट्रो रेल्वे प्रकल्प (यात यापुढे, ज्याचा निर्देश ' उक्त प्रकल्प ' असा करण्यात आला आहे) हाती घेतला आहे ;
आणि, ज्याअर्थी, महाराष्ट्र महानगरपालिका अधिनियम, १९४९ (१९४९ चा महा. ५९) (यात यापुढे, ज्याचा निर्देश ' उक्त अधिनियम ' असा करण्यात आला आहे), च्या कलम १४९ ख च्या प्रयोजनार्थ उक्त प्रकल्प महवाकांक्षी नागरी परिवहन प्रकल्प म्हणून हाती घेण्याचा इरादा घोषित करणे इष्ट ठरले.
त्याअर्थी, आता, उक्त अधिनियमातील कलम १४९ ख च्या स्पष्टीकरणान्वये यासंदर्भात प्रदान केलेल्या शक्तीचा वापर करून, महाराष्ट्र शासन उक्त प्रकल्प उक्त अधिनियमाच्या कलम १४९ ख च्या प्रयोजनार्थ महवाकांक्षी नागरी परिवहन प्रकल्प म्हणून घोषित करीत आहे.

MAHARASHTRA MUNICIPAL CORPORATIONS ACT.
No. PRD-3318/C.R.49(2)/UD-7.—Whereas, the Government of Maharashtra has undertaken the Metro Rail Project mentioned in the Schedule appended hereto (hereinafter referred to as "the said project") in the Pune Metropolitan Region through Pune Metropolitan Region Development Authority established under Maharashtra Metropolitan Region Development Authority Ordinance, 2016 (Mah.Ord. XI of 2016) and the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966);
And, whereas, it is expedient to declare its intention to undertake the said project being Vital Important Urban Transport Project as notified project for the purposes of the section 149B of the Maharashtra Municipal Corporations Act (LIX of 1949) (hereinafter referred to as "the said Act"); Now, therefore, in exercise of the powers conferred by Explanation to section 149B of the said Act, the Government of Maharashtra hereby declares its intention to undertake the said project being Vital Important Urban Transport Project as notified project, for the purposes of the said section 149B.

३. या तद्र्थ पदोन्नतीमुळे त्यांना नियमित पदोन्नतीचे म्हणजेच ज्येष्ठतेचे कोणतेही हक्क प्राप्त होणार नाहीत.
४. सामान्य प्रशासन विभागाच्या दिनांक १५ जून १९९५ व दिनांक ३० जून २००४ च्या शासन निर्णयानुसार ज्यांना संरक्षण प्राप्त झाले असेल त्यांची सेवाज्येष्ठता सामान्य प्रशासन विभागाच्या दिनांक २४ जून २००४ व दिनांक ३० जून २००४ च्या शासन निर्णयानुसार निश्चित होण्याच्या तसेच सदर पदोन्नत्या तात्पुरत्या व मा. उच्च न्यायालयाच्या प्रलंबित असलेल्या याचिका क्र. ८४५२/२००४ च्या निर्णयाच्या अधीन तसेच महाराष्ट्र लोकसेवा आयोगाच्या मान्यतेच्या अधीन राहतील.
५. महाराष्ट्र प्रशासकीय न्यायाधिकरण, मुंबई येथे श्री. इ. आर. पाटील व श्री. नवनाथ शिंगटे, विक्रीकर निरीक्षक यांनी दाखल केलेल्या मूळ अर्ज क्रमांक १९२ व ५३८/२००९ वर मा. न्यायाधिकरणाने दिलेल्या निर्णयाविरोधात मा. उच्च न्यायालय, मुंबई येथे शासनाचे वतीने दाखल केलेल्या रिट पिटीशन क्र. ६१०४ व ६११३/२०१० वर मा. उच्च न्यायालय, मुंबई यांनी दिनांक १० ऑगस्ट २०१० च्या आदेशान्वये मा. न्यायाधिकरणाच्या निर्णयानुसार विक्रीकर निरीक्षकांना देण्यात आलेली ज्येष्ठता ही सदर अपिलाच्या निर्णयाच्या अधीन राहील असे अंतरिम आदेश दिले आहे. त्यामुळे सदर पदोन्नत्या सदर अपिलाच्या निर्णयाच्या अधीन देण्यात येत आहेत.

क्रमांक विकअ-१२१५/प्र. क्र. २३/विक्रीकर (प्रशा-२).---- विक्रीकर विभागातील श्री. एस. बी. पोलसाने, विक्रीकर निरीक्षक यांच्या प्रकरणी मा. उच्च न्यायालयात दाखल केलेली याचिका क्र. ८५०५/२०१३ या याचिकेचा दिनांक ७ मे २०१४ चा न्यायनिर्णय तसेच मा. महाराष्ट्र प्रशासकीय न्यायाधिकरण, मुंबई येथे दाखल केलेला मूळ अर्ज क्र.२७/२०१५ प्रकरणी दिनांक ८ ऑक्टोबर २०१५ रोजीचा न्यायनिर्णयाच्या अंमलबजावणी करण्याकरिता शासन असा आदेश देत आहे की, श्री. एस. बी. पोलसाने, विक्रीकर निरीक्षक यांना सन २००६-०७ च्या निवडसूचीवर खुल्या प्रवर्गातून रुपये ९३००-३४८०० अधिक ग्रेड वेतन रुपये ४४०० या वेतनसंरचनेत विक्रीकर अधिकारी पदी KAL-PTO-C-003 या पदावर ते ज्या दिवशी त्या पदाचा कार्यभार स्वीकारतील त्या दिनांकापासून निव्वळ तात्परत्या स्वरूपात खालील अटीच्या अधीन राहून पदोन्नती देण्यात येत आहे :-----
