कीटकनाशके अधिनियम, १९६८.

क्रमांक सीपीएस. १११७/प्र. क्र. २०४/१७-अे.---ज्याअर्थी,

(क) संपूर्ण महाराष्ट्र राज्यात, यासोबत जोडलेल्या अनुसूचीमध्ये विर्िनदिष्ट केलेल्या किटकनाशकाचा वापर केल्यानंतर शेतमजूरांना आणि शेतकयांना मोठया प्रमाणावर विषबाधा झाल्याचे वृत्त असून त्यापैकी ६३ जणांनी त्यांचे प्राण गमावले आहेत.

(ख) कीटकनाशाकांमुळे विषबाधा झाल्याच्या घटना राज्यात पुन्हा उघडकीस आल्या आहेत. या घटनांमध्ये, कीटकनाशकांमुळे झालेल्या विषबाधेच्या उपचारासाठी, विविध रूग्णालयांमध्ये, जुलै २०१८ पासून ३३ शेतमजूर व शेतकरी दाखल करण्यात आलेले आहेत.

(ग) ही किटकनाशके आत्यंतिक विषारी किंवा अति विषारी आहेत किंवा मध्यम विषारी आहेत, परंतू अनाधिकृत रीतीने संमिश्रणासाठी वापर करण्यात येत असल्यामुळे त्यांची अत्यंत विषारी बाधा होते.

(घ) महाराष्ट्र शासनाने, त्यांच्या दिनांक २७ मार्च २०१८ च्या प्रस्तावाद्वारे या कीटकनाशकांची विक्री, वितरण किंवा वापर यांवर कायमस्वरुपी बंदी घालण्याची विनंती केंद्रीय कीटकनाशक मंडळ व नोंदणी समिती, फरिदाबाद यांना केली आहे. केंद्र सरकार उक्त प्रस्तावाबाबत अजुनही आढावा घेऊन चौकशी करीत आहे. आणि ज्या अर्थी, या कीटकनाशकांचे धोकादायक स्वरुप तसेच कीटकनाशकांमुळे विषबाधा होण्याच्या वारंवार घडणाया घटना लक्षात घेता, राज्य सरकारने सादर केलेल्या प्रस्तावावर केंद्र सरकारकडून आढावा घेऊन चौकशी करण्याच्या कालावधी दरम्यान, या कीटकनाशकांची यापुढील विक्री, वितरण व वापर करण्यास तातडीने बंदी घालणे गरजेचे आहे.

आणि ज्याअर्थी उक्त अनुसूचीमध्ये विर्िनदिष्ट केलेल्या कीटकनाशकाचा किंवा त्यांच्या कोणत्याही गटांचा किंवा अशा कीटकनाशकांच्या कोणत्याही मिश्रणांचा वापर मनुष्यजातीस किंवा प्राण्यांना धोकादायक ठरु शकतो.

त्याअर्थी, आता कीटकनाशके अधिनियम १९६८ (१९६८ चा ४६) याच्या कलम २७ च्या पोटकलम (१) याद्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून महाराष्ट्र शासन याद्वारे या प्रकरणातील तपास पूर्ण होईपयर्ंत यासोबत जोडलेल्या अनुसूचीमध्ये विर्िनदिष्ट केलेल्या कीटकनाशकांची किंवा त्यांच्या कोणत्याही गटाची किंवा त्यांच्या कोणत्याही मिश्रणाची ही अधिसूचना प्रसिद्ध झाल्याच्या दिनांकापासून ६० दिवसाच्या कालावधीकरीता संपूर्ण महाराष्ट्र राज्यात विक्री, वितरण अथवा वापर करण्यास मनाई करीत आहे.

NOTIFICATION

INSECTICIDES ACT, 1968.

No. CPS. 1117/C.R. 204/17- A.--Whereas, the State Government is of the opinion, for the reasons such as--

(a) Large number of farm labourers and farmers have been reported to have been exposed to poisoning, out of which over 63 have lost their lives, after using insecticides, specified in the Schedule appended hereto, in the whole State of Maharashtra ;

(b) The occurrences of insecticides poisoning has again arise in the State. In these occurrences, 33 farm labourers and farmers are admitted in the various hospitals for the treatment of the insecticides poisoning since the month of July, 2018 ;

(c) These insecticides are either extremely or highly toxic or moderately toxic, but have highly toxic effect due to use for blending in an unauthorised manner;

(d) The Government of Maharashtra has requested Central Insecticides Board and Registration Committee, Faridabad by its proposal dated the 27th March 2018, to ban these insecticides to distribute, sale or use, permanently. The Central Government is still reviewing and enquiring the said proposal. And whereas in view of hazardous nature of these insecticides and repeated occurrences of insecticides poisoning, it is in urgent need to ban for further sale, distribution and use of these insecticides during the period of review and enquiry by the Central Government in the proposal which has submitted by the State Government ;

And whereas, the use of the insecticides specified in the said Schedule or any batches thereof or any combinations of such insecticides is likely to involve risk to human beings or animals.

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 27 of the Insecticides Act, 1968 (46 of 1968), the Government of Maharashtra hereby prohibits the sale, distribution or use of the insecticides or any batches thereof or any combinations thereof, as specified in the Schedule appended hereto, in the whole of the State of Maharashtra, for the period of sixty days, from the date of publication of the notification in the Official Gazette, pending investigation into the matter.
