MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.

Whereas, the Revised Development Plan of Buldana City, Dist. Buldana has been sanctioned by the Director of Town Planning, Maharashtra State, Pune, under Section 31 of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") videद्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, रू]क्ष्दन् २०-२६, २०१८ / २९-+ह्य ४, ॅ १९४० ३ Notification No. TPS D.P. Buldana (R) TPV-6-8486, dated 3rd November, 1990 and has come into force with effect from the 1st January, 1991. (hereinafter referred to as "the said Development Plan");
And whereas, in the said Development Plan, lands bearing Survey No. 22 admeasuring 0.60 ha.
(hereinafter referred to as "the said lands") is reserved for "Site No. 10-Primary School" (hereinafter referred to as "the said Development Plan");
And whereas, as per the provisions of Section 37(1) of the Maharashtra Regional and Town Plan- ning Act, 1966 (Mah. XXXVII of 1966), the Municipal Council, Buldana vide its General Body Resolution No. 24, dated 28-6-2017 has resolved to make modification in the sanctioned Development Plan of Buldana, so as to delete the said land from the said Site and to include the same in Residential Zone (hereinafter referred to as "The Proposed Modification") and accordingly submitted the proposal to Government for sanction;
And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune the Government is of the opinion that the proposed Modification should be sanctioned with certain conditions;
And whereas, the Land owners of the said lands deposited Rs. 9,78,630 towards the 50% Govern- ment share of 5% premium amount as per the rate of said land as prescribed in the Annual Statement of Rates (ASR) for the year 2017-18 in the Government Treasury vide Chalan dated 2-6-2018 through the Town Planner, Buldana Branch, Buldana and the remaining 50% of the 5% premium amount of Rs. 9,78,630 has been deposited with the Municipal Council, Buldana on dt. 2-6-2018;
Now, therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government of Maharashtra hereby sanctions the proposed Modification to the said Development Plan and for that purpose amends the aforesaid Notification dated the 3rd November, 1990 as follows:—
" In the Schedule of Modifications appended to the Notification sanctioning the said Development Plan the following new entry shall be added after the last entry" -
ENTRY
The lands bearing Survey No. 22 of mouje Buldana, Ta. & Distt. Buldana admeasuring 0.60 ha. is deleted from the "Site No. 10-Primary School" and land so released is included in the Residential Zone, subject to following Conditions:-
Condition No. 1:- As per the Sanctioned Development Control and Promotion Regulations, in addition 10% open space it is mandatory to provied 10% amenity space.
Condition No. 2:- It shall be the responsibility of the Land Owner /Developer to provide basic amenities in respect of the land under modification.
Condition No. 3:- If the said land is proposed to be developed by way of plotted lay-out then sale of plots shall be monitored by the Chief Officer, Buldana Municipal Council, Buldana in relation to development of civic amemities as per the stages given below.
i After final approval of layout - Sale of 25% of total plots shall be permissible i i After completion of 40% of Civic Amenities - Sale of 50% of total plots shall be permissible i i i After completion of 60% of Civic Amenities - Sale of 75% of total plots shall be permissible ४ द्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, रू]क्ष्दन् २०-२६, २०१८ / २९-+ह्य ४, ॅ १९४० If Group Housing Scheme is proposed in the lay-out then the Occupancy Certificate shall not be given unless civic amenities specified by the Chief Officer, Buldana Municipal Council, Buldana are fully developed.
Condition No. 4:- In case of non-compliance of above conditions, Layout Approval and Non Agricultural permission shall be liable to be cancelled.
A copy of the part plan showing the aforsaid sanctioned modification shall be available in the office of the Chief Officer, Buldana Municipal Council, Buldana during office hours on all working days for inspection of the general public for a period of one month.
This Notification shall also be available on the Govt. website www.maharashtra.gov.in By order and in the name of the Governor of Maharashtra.

Minor modification to the Sanctioned Development Plan of Buldana Town, under Section 37
of Maharashtra Regional and Town Planning Act, 1966.

The Revised Development Plan of Buldana Town has been sanctioned by Director of Town Planning, Maharashtra State, Pune under its Resolution No. D.P.-Buldana(R)-TPR-VI date 3rd November 1990 and has come into force with effect from 1st January 1991.
The following minor modification to the sanctioned Development Plan of Buldana Town under Section 37 of the Maharashtra Regional and Town Planning Act, 1966 sanctioned by Municipal Council, Buldana vide General Council Resolution No. 11, date 03-04-2018.
Minor modification : In Rev. Sr. No. 37/1 Total 2.42 Hectare Private land are reserved for Agricultural and allied user (No Development) Zone in Development Plan is deleted and to be included in Residential Zone.
The above mentioned modified Development Plan (Part Plan) duly signed by President is kept open in the office of Minicipal Council on working days during office hours for inspection for the public. In pursuance of Section 37 of Maharashtra Regional and Town Planning Act, 1966. It is hereby notify that any person having any objections/suggestions in respect of said proposed Minor modification to said Development Plan, may communicate the same in writing to President, Municipal Council, Buldana within 30(thirty) days from the date of publication of this nitice in Maharashtra Government Gazette, to that those can be considered before submitting the above proposal for sanction to Government.
