क्रमांक विप /नरयो -१/०७-२०१७/प्र. क्र. ४५/शाखा-१/१३१ ९.--ज्याअर्थी, पुणे महानगर प्रदेश विकास प्राधिकरणाने , महाराष्ट्र प्रादेशिक नियोजन व नगर रचना अधिनियम , १ ९ ६६ ( यापुढे " उक्त अधिनियम " असे उल्लेखिलेले) चे कलम ६० ( १) अन्वये असलेल्या अधिकारांचा वापर करून पुणे महानगर प्रदेशातील क्षेत्रापैकी नकाशात दाखविलेल्या क्षेत्रासाठी , प्रारूप म्हाळुंगे- माण नगर रचना योजना क्रमांक १ (यापुढे " उक्त योजना " असे उल्लेखिलेली) तयार करावयाचा इरादा दिनांक ५ ऑगस्ट २०१७ रोजीच्या पुणे महानगर प्रदेश विकास प्राधिकरण सभा ठराव क्रमांक २ अन्वये जाहीर केलेला असून , त्यासंबंधीची उद्घोषणा दिनांक ऑगस्ट १७-२३ , २०१७ च्या महाराष्ट्र शासन राजपत्र , पुणे विभाग , भाग - एकमध्ये पृष्ठे १३४-१३५ वर तसेच दैनिक लोकमतमध्ये दिनांक ९ ऑगस्ट २०१७ रोजी व दि इंडियन एक्स्प्रेस या वृत्तपत्रांमध्ये दिनांक ९ ऑगस्ट २०१७ रोजी अनुक्रमे मराठी व इंग्रजीमध्ये प्रसिद्ध झालेली आहे ;

आणि ज्याअर्थी , पुणे महानगर प्रदेश विकास प्राधिकरणाने, उक्त अधिनियमाचे कलम ६२ अन्वये असलेल्या अधिकारांचा वापर करून उक्त योजनेची हद्द दिनांक ३० जानेवारी २०१८ रोजीच्या पुणे महानगर प्रदेश विकास प्राधिकरण सभा ठराव क्रमांक २ अन्वये सुधारित केली असून , त्या संबंधीची जाहीर सूचना दिनांक फेब्रुवारी १५-२१ , २०१८ च्या महाराष्ट्र शासन राजपत्र, पुणे विभाग , भाग -एकमध्ये पृष्ठे १०-११ वर तसेच दैनिक प्रभातमध्ये दिनांक ८ फेब्रुवारी २०१८ रोजी व दि इंडियन एक्स्प्रेस या वृत्तपत्रांमध्ये दिनांक ८ फेब्रुवारी २०१८ रोजी अनुक्रमे मराठी व इंग्रजीमध्ये प्रसिद्ध झालेली आहे ;

आणि ज्याअर्थी , उक्त अधिनियमाच्या कलम ४० (१) (घ) अन्वये शासन , नगर विकास विभागाची अधिसूचना क्रमांक टीपीएस-१८१७/प्र . क्र. १७३/ १७/नवि-१३ , दिनांक १८ जानेवारी २०१८ नुसार पुणे महानगर क्षेत्र अधिसूचित क्षेत्र म्हणून विनिर्दिष्ट करून सदर क्षेत्रासाठी पुणे महानगर प्रदेश विकास प्राधिकरणाची विशेष नियोजन प्राधिकरण म्हणून सदर प्राधिकरणाच्या स्थापनेपासून (दिनांक ३१ मार्च २०१५) नियुक्ती करण्यात आली आहे ;

आणि ज्याअर्थी, पुणे महानगर प्रदेश विकास प्राधिकरणाने संचालक , नगर रचना , महाराष्ट्र राज्य, पुणे यांचेशी विचारविनिमय करून उक्त नगर रचना योजना तयार केलेली आहे व संचालक , नगर रचना , महाराष्ट्र राज्य, पुणे यांनी उक्त अधिनियमातील कलम ६१ (१) अन्वये प्रारूप नगर रचना योजना प्रसिद्ध करण्याची कार्यवाही करण्यास पत्र क्रमांक १ ९९ ७ , दिनांक २३ मार्च २०१८ अन्वये हरकत नसल्याचे कळविलेले आहे ;

आणि ज्याअर्थी , उक्त अधिनियमाचे कलम ६१ (१) अन्वये उक्त प्रारूप नगर रचना योजना क्रमांक १ , पुणे महानगर प्रदेश विकास प्राधिकरण ठराव क्रमांक १ व क्रमांक २ , दिनांक २४ मार्च २०१८ अन्वये प्राधिकरण कार्यालयामध्ये प्रसिद्ध करण्यात आलेली असून त्यासंबंधीची जाहीर सूचना दिनांक एप्रिल ५-११ , २०१८ च्या महाराष्ट्र शासन राजपत्रात पृष्ठे २३-२४ वर तसेच दैनिक प्रभातमध्ये दिनांक २५ मार्च २०१८ व दि इंडियन एक्स्प्रेस या वृत्तपत्रांमध्ये दिनांक २६ मार्च २०१८ रोजी अनुक्रमे मराठी व इंग्रजीमध्ये प्रसिद्ध झालेली आहे ;

आणि ज्याअर्थी, प्रारूप नगर रचना योजना क्रमांक १ प्रसिद्ध झाल्यानंतर उक्त अधिनियमाच्या कलम ६७ (१) अन्वये विहित मुदतीत नागरिकांनी हरकती/ सूचना दाखल केलेल्या आहेत ;

(पु. वि. पु. ) १४ २ महाराष्ट्र शासन राजपत्र , असाधारण भाग एक पुणे विभागीय पुरवणी, २१ सप्टेंबर , २०१८ / भाद्र ३० , शके १ ९४० आणि ज्याअर्थी , उक्त अधिनियमाच्या कलम ६८ (२) अन्वये प्रारूप नगर रचना योजना मंजूर करण्याचे शासनाचे अधिकार उक्त अधिनियमाच्या कलम १५१ अन्वये शासन , नगर विकास विभाग अधिसूचना क्रमांक टीपीएस-१८१७/९७३/प्र . क्र. १०३/१७/नवि-१३ , दिनांक १३ सप्टेंबर २०१७ नुसार महानगर प्रदेश विकास प्राधिकरणाच्या महानगर आयुक्त यांना प्रदान केलेले आहेत ;

आणि ज्याअर्थी , उक्त योजना उक्त अधिनियमाच्या कलम ६१ (१) अन्वये महाराष्ट्र शासन राजपत्रात प्रसिद्ध झाल्यानंतर पुणे महानगर प्रदेश विकास प्राधिकरणाने उक्त अधिनियमाच्या कलम ६८ (२) अन्वये शासनाने प्रदान केलेल्या अधिकाराचा वापर करून उक्त म्हाळुंगे- माण प्रारूप नगर रचना योजना क्रमांक १ , अधिसूचना क्रमांक विप/ नरयो -१/ ०७-२०१७/प्र. क्र. ४५/शाखा-१/३०० , दिनांक २२ जून २०१८ रोजी मंजूर करण्यात आलेली आहे व सदरची अधिसूचना शासन राजपत्र दिनांक जुलै ५-११ , २०१८ मध्ये प्रसिद्ध झालेली आहे ;

आणि ज्याअर्थी, प्राधिकरणाने उक्त अधिनियमाच्या कलम ६१ (१) अन्वये प्रसिद्ध करण्यापूर्वी संचालक, नगर रचना , महाराष्ट्र राज्य, पुणे यांचेकडून अभिप्राय घेण्यात आलेला असल्याने पुनश्च कलम ६८ (२) अन्वये संचालक , नगर रचना यांचे अभिप्राय आवश्यक नाही , अशी धारणा पक्की करण्याबाबत प्राधिकरणाने पत्र क्रमांक ३७३ , दिनांक २८ मे २०१८ अन्वये शासनास विनंती केलेली असून त्यावर शासनाने पत्र क्रमांक टीपीएस -१८१८/१०३७/प्र. क्र. १८६/१८ /नवि-१३ , दिनांक २६ जुलै २०१८ अन्वये प्रारूप नगर रचना योजनेस मंजुरी देण्यापूर्वी संचालक , नगर रचना , महाराष्ट्र राज्य , पुणे यांचेशी विचारविनिमय करणे बंधनकारक असल्याचे प्राधिकरणास कळविलेले आहे ;

आणि ज्याअर्थी, शासनाने दिनांक २६ जुलै २०१८ च्या पत्राने कळविल्यानुसार प्राधिकरणाची प्रारूप नगर रचना योजना मंजुरीची अधिसूचना क्रमांक विप/नरयो-१ /०७-२०१७/प्र. क्र. ४५/शाखा-१/३०० , दिनांक २२ जून २०१८ रद्द करण्यात येत आहे ;

आणि ज्याअर्थी , पुणे महानगर प्रदेश विकास प्राधिकरणाने संचालक, नगर रचना , महाराष्ट्र राज्य, पुणे यांचेशी विचारविनिमय करण्याकरिता दिनांक ९ ऑगस्ट २०१८ च्या पत्राने कळविलेले आहे, आणि त्यावर नगर रचना संचालनालयाने पत्र क्रमांक ५५१९ , दिनांक १८ सप्टेंबर २०१८ च्या पत्राने उक्त नगर रचना योजनेमध्ये योग्य त्या दुरुस्त्या करून पुढील योग्य ती वैधानिक कार्यवाही करण्याबाबत प्राधिकरणास कळविलेले आहे.

त्याअर्थी , उक्त योजना उक्त अधिनियमाच्या कलम ६१ (१) अन्वये महाराष्ट्र शासन राजपत्रात प्रसिद्ध झाल्यानंतर प्राप्त झालेल्या हरकती/ सूचना/ आक्षेप , संचालक नगर रचना , महाराष्ट्र राज्य, पुणे यांनी दिलेल्या सूचना यांचा विचार करून आवश्यक तेथे दुरुस्ती/फेरफार करून उक्त अधिनियमाच्या कलम ६८ (२) अन्वये शासनाने प्रदान केलेल्या अधिकाराचा वापर करून उक्त म्हाळुंगे - माण प्रारूप नगर रचना योजना क्रमांक १ मंजूर करण्यात येत आहे.

उक्त योजनेचा नकाशा व अहवाल पुणे महानगर प्रदेश विकास प्राधिकरणाच्या कार्यालयात , कामकाजाच्या दिवशी , कार्यालयीन वेळेत नागरिकांच्या अवलोकनार्थ खुले ठेवण्यात आले आहेत. तसेच नागरिकांना उक्त योजनेच्या नकाशाची किंवा अहवालाची प्रत किंवा त्यातील भागाची प्रत निश्चित मूल्य (फार्म-१ च्या प्रत्येक पृष्ठाकरिता रुपये १० व प्रत्येक अंतिम भूखंडाकरिता भाग नकाशा रुपये १०० याप्रमाणे) प्राधिकरण कार्यालयात जमा केल्यानंतर विक्रीसाठी उपलब्ध राहील .

BY METROPOLITAN COMMISSIONER AND CHIEF EXECUTIVE OFFICER, PUNE PUNE METROPOLITAN REGION DEVELOPMENT AUTHORITY Notification of Sanction of Mhalunge - Maan Draft Town Planning Scheme No. 1 under Section 68 (2) of the Maharashtra Regional and Town Planning Act, 1966.

Notification

No. DP /TPS -1/07-2017/ CR - 45/Br . 1 / 1319.-Whereas the Pune Metropolitan Region Development Authority in accordance with the provisions of Section 60 ( 1 ) of the Maharashtra Regional and Town Planning Act, 1966 ( hereinafter referredto as " the said Act " ) declared its intention to prepare the Draft Mahalunge-Maan Town Planning Scheme No. 1 ( hereinafter referred to as " the said Scheme " ) by its Authority's resolution No. 2 , dated 5th August 2017 and published a declaration to that effect in the Maharashtra Government Gazette, Part - I , Pune Division supplement dated August 17th - 23nd , 2017 on pages 134-135 and in the newspapers daily Lokmat on 9th August 2017 and The Indian Express on 9th August 2017 in marathi and english respectively ;

३ महाराष्ट्र शासन राजपत्र , असाधारण भाग एक पुणे विभागीय पुरवणी, २१ सप्टेंबर , २०१८ / भाद्र ३०, शके १९४० and whereas the Pune Metropolitan Region Development Authority in accordance with the provisions of Section 62 of the said Act revised the boundary of the said Scheme by its Authority's Resolution No. 2 , dated 30th January 2018 and published a notice to that effect in the Maharashtra Government Gazette , Part- I , Pune Division Supplement , dated February 15th - 21st, 2018 on pages 10-11 and in the newspapers daily Prabhat on 8th February 2018 and The Indian Express on 8th February 2018 in marathi and english respectively.

and whereas in accordance with the provisions of Section 40 ( 1) ( d) the Government in Urban Development Department vide Notification No.TPS - 1817 / CR - 173/ 17 / UD - 13 , dated 18th January 2018 has declared the Metropolitan area as " Notified Area " from the date of its establishment (dated 31st March 2015) and appointed the Development Authority as Special Planning Authority for this notified area ;

and whereas , the Pune Metropolitan Region Development Authority after consulting the Director of Town Planning , Maharashtra State , Pune has prepared the said Town Planning Scheme and the Director ofTown Planning , Maharashtra State , Pune has given the No Objection to publish the said Town Planning Scheme under Section 61 ( 1) of the said Act . ;

and whereas , vide Resolution No. 1 and No. 2 on dated 24th March 2018 the Pune Metropolitan Region Development Authority has published the said Town Planning Scheme under Section 61 ( 1 ) of the said Act and the notice to that effect has been published in the Maharashtra Government Gazette dated April 5th - 11th , 2018 on pages 23-24 and also in the daily newspapers daily Prabhat and the Indian Express on 25th March 2018 and 26th March 2018 in marathi and english respectively.

and Whereas , after publication of the Draft Town Planning Scheme No. 1 , suggestions / objections were submitted by the persons within the prescribed limit as per Section 67 ( 1 ) of the said Act , and whereas , the Government in Urban Development Department in exercise of the powers conferred under Section 151 of the said Act , have delegated the power to sanction the Draft Town Planning Scheme under Section 68 (2) of the said Act to the Metropolitan Commissioners of the Metropolitan Region DevelopmentAuthorities vide Notification No. TPS - 1817/ 973/CR - 103/ 17 / UD - 13 , dated 13th September 2017.

and whereas , after publication of the said scheme under Section 61 ( 1) of the said Act , in the Government Gazette , the Metropolitan Commissioner, and Chief Executive Officer, Pune Metropolitan Region Development Authority sanction the said scheme under Section 68 (2) in exercise of the powers conferred by Government and Notification that effect bearing No. DP /TPS - 1 /07-2017/CR.45/ Br . 1/300 , dated 22nd June 2018 which is published in Government Gazette Dated July 5th 11th, 2018 ;

and whereas , Pune Metropolitan Region Development Authority as consulted the Director of Town Planning , M.S. Pune before the publication of the draft scheme under Section 61 ( 1) of the said Act and therefore it is not necessary again to consult the Director of Town Planning before the sanction of the said scheme under Section 68 (2) and for that Pune Metropolitan Region Development Authority has submitted letter No. 373 , dated 28th May 2018 to Government for approval , and Government vide letter No. TPS - 1818 /1037/CR-186/ 18/ UD - 13 , dated 26th July 2018 communicated Pune Metropolitan Region Development Authority that it is obligatory to consult director of Town Planning before the Sanction to the Draft Town Planning Scheme under Section 68 (2) of the said Act ;

and whereas , as per letter dated 26th July 2018 of the Government , Pune Metropolitan Region Development Authority's Notification No. DP /TPS - 1 / 07-2017/CR - 45/ Br. 1 / 300 , dated 22nd June 2018 regarding the sanctioning the said scheme stand canceled ;

and whereas , Pune Metropolitan Region Development Authority has send letter dated 9th August 2018 to Director of Town Planning , M. S. , Pune for the consultation of the said scheme and Director of Town Planning vide letter No. 5591 , dated 18th September 2018 ;

Now, therefore , after publication of the said Draft Town Planning Scheme in the Official Gazette under Section 61 ( 1) of the said Act and after considering the suggestions / objections received under Section 67 ( 1) the said Act taking into consideration of the Director of Town Planning M.S. , Pune and in exercise of the powers delegated under Section 151 ( 1) of the said Act , hereby accords sanction to the Mhalunge ४

महाराष्ट्र शासन राजपत्र , असाधारण भाग एक पुणे विभागीय पुरवणी, २१ सप्टेंबर , २०१८ / भाद्र ३० , शके १ ९४० Maan Draft Town Planning Scheme No.1 under Section 68 (2) of the said Act .

A copy of the said scheme and plan thereof are kept open for inspection by the public during office hours on all working days in the office of the Pune Metropolitan Region Development Authority. A copy of the plan and Scheme book of the said scheme or part thereof can be obtained after payment of prescribed fees ( Rs. 10 Per page for Form 1 and Rs . 100 per Final Plot Number for part plan) ;
