MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.

ORDER

No. R.P.Amt- Sect-20-Meeting-C.R.A(3)-2017-JDTPAMT-486.—

Whereas, the Regional Plan of Amravati Region(hereinafter referred in as the "said Regional Plan") has been sanctioned vide Government Notification of the Urban Development Department under Section 15 (1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah.XXXVII of 1966) (hereinafter referred to as " the said Act'') vide Notification No. TPS 2887-CR-196/UD-13, Dated 29th May, 1993 and has come into force with effect from the 15th August, 1993.

And whereas, in the said Regional Plan, the land admeasuring 2.08 Ha. bearing Survey No. 2/6 and 2/8 of Mojue Surwadi, Tal. Tiwsa (hereinafter referred to as the "said land") is included in Agricultural Zone/No-Development Zone.

And whereas, as provided in sub-section (2) of Section 20 of the said Act. The Government of Maharashtra was of the opinion that the said Land, should be deleted from Agricultural Zone/ No-Development Zone and to be included in Residential Zone, subject to the following condition ( here- inafter referred to as the " Proposed Modification");

Condition No. 1 : While preparing the lay-out in respect of the said lands under modification, apart from the compulsory 10% open space, 10% space shall be kept for public amenities.(This amenity space can be developed by the Land owner/Developer for the same purpose).

Condition No. 2 : It shall be the responsibility of the concerned Land Owner/Developer to provide on basic infrastructure in the said lands under modification.

Condition No. 3 : It shall be the responsibility of the land owner/Developer to pay premium as decided by the Government vide order No. TPS-1815-C.R. 49-15-UD-13, dated 06th May, 2015 and dated 11th June, 2015.

Condition No. 4 : If the said lands under modification are proposed to be developed by way of plotted lay-out, then sale of plots shall be monitored by the Collector, Amravati, in relation to development of civic amenities as per the stages given below.—

(i) After final approval of lay-out Sale of 25 % of total plots shall be permissible (ii) After completion of 40% of Civic Amenities Sale of 50 % of total plots shall be permissible (iii) After completion of 60% of Civic Amenities Sale of 75 % of total plots shall be permissible (iv) After completion of 80% of Civic Amenities Sale of 90 % of total plots shall be permissible (v) After completion of 100% of Civic Amenities Sale of 100 % of total plots shall be permissible If Group Housing Scheme is proposed in the lay-out then the occupancy certificate shall not be given unless civic amenties specified by the Collector are fully developed.

In case of non-compliance, layout Approval and non agricultural permission shall be liable to be cancelled.

And whereas, the notice for the Proposed Modification, under the powers conferred by Section 20 (3) of the said Act, was published by the Government vide Urban Development Department Notice No. TPS- 2814-150-C.R. 75-2014-UD-30, dated 15th July, 2015 inviting objections and suggestions from the general public, and the Joint Director of Town Planning, Amravati Division, Amravati was appointed as the "officer" (hereinafter referred to as the "said Officer") to hear the suggestions/objections received within the stipulated period only and to submit his report on the same to the Government; And whereas, Government has constituted Zone Change Committee (hereinafter referred to as "said committee") vide Notification No. TPS-1815/C.R.49/15/UD-13, Dt. 06-05-2015 for Zone change proposals of sanctioned Regional Plans;

And whereas, said committee's meeting was held on 2-05-2017; and after consulting the commit- tee members "said committee" is of the opinion, that the said land should be deleted from Agricultural Zone and include in Residential Zone, subject to certain condition;

And whereas, Government by Order No. TPS-1815/C.R./49/15/UD-13, Dated 11-06-2015 has delegated power to the Joint Director of Town Planning of respective Division to notifiy under sub-section (4) of Section 20 of said act;

And whereas, as per Zone change policy of Government, the owners of S.No. 2/6 and 2/8 of Mouje Surwadi, Tal. Tiwasa, Dist. Amravati have deposited the premium on dated 02-01-2018 and therefore no need of Condition No. 3.

Now therefore, in exercise of the power conferred under sub-section (4) of Section 20 of the said act, the Joint Director of Town Planning, Amravati Division hereby sanctions the proposed Modification in respect of the said land and for that purpose amends the above referred Notification dated the 29th May, 1993 as follows.—

"in the Schedule of Modification appended to the Notification May 1993 sanctioning the said Regional Plan the following new entry shall be added after the last entry".

ENTRY

In the said Regional Plan land admeasuring 0.89 Ha. bearing Survey No. 2/6 and 119 Hq. bearing Survey No. 2/8 Total 2.08 Ha. of Mojue Surwadi, Tal. Tiwasa in the of Surwadi is deleted from Agricultural Zone and included in Residential Zone as shown in the part plan subject to the following conditions.-----

Condition No. 1 : While preparing the lay-out in respect of the said lands under modification, apart from the compulsory 10% open space, 10% space shall be kept for public amenities.(This amenity space can be developed by the Land owner/Developer for the same purpose)

Condition No. 2 : It shall be the responsibility of the concerned Land Owner/Developer to provide basic infrastructure and civic amenities like water supply, sewerage network, roads, solid waste management, waste water treatment plant etc. in the said lands under modification.

Condition No. 3 : If the said lands under modification are proposed to be developed by way of plotted lay-out, then sale of plots shall be monitored by the Collector, in relation to development of civic amenities as per the stages given below.—

(i) After final approval of lay-out Sale of 25 % of total plots shall be permissible (ii) After completion of 40% of Civic Amenities Sale of 50 % of total plots shall be permissible (iii) After completion of 60% of Civic Amenities Sale of 75 % of total plots shall be permissible (iv) After completion of 80% of Civic Amenities Sale of 90 % of total plots shall be permissible (v) After completion of 100% of Civic Amenities Sale of 100 % of total plots shall be permissible Condition No. 4 : While preparing the layout in respect of the said land under modification it is necessary to provide Retaing wall along the nalla for the area under modification and approach road to adjecent Gat No.

In case breach of any of the above conditions, layout Approval and Non Agricultural permission shall be liable to be cancelled.

02. The copy of part plan showing the above sanctioned modification shall be kept open for inspec- tion by general public during office hours on all working days for a period of one month at the following offices :—

Minor Modification under section 37 of the Maharashtra Regional and Town Planning Act, 1966

to Sanctioned Development Plan of Chandur Railway.

No. 375-M.C.C.R.-C.D.-2018.—

The Development Plan of Chandur Railway (Revised) has been sanctioned under Government of Maharashtra Notification No. TPS-2807-978-CR-204-2007-UD-30, dated 31st August, 2009, ammendment dated 13th April, 2010.

Considering the development of town and demand from Public Municipal Council has decided vide Special Meeting Resolution No. 1, dated 8th August, 2018 to effect the minor modification under Section 37 of Maharashtra Regional and Town Planning Act, 1966. The Development Plan of Chandur Railway (Revised) has been sanctioned under Government of Maharashtra Notification No. TPS-2807-978-CR-204-2007-UD-30, dated 31st August, 2009, ammendment dated 13th April, 2010.

In the Sanctioned Development Plan Reservation No. 14 is shown as Ashoka College measuring 2.20 Hectare. BY COLLECTOR

In exercise of the powers conferred on him by Order No. Sec./mmc-2018/CR-12-d-6 Dated 8th August 2018 of the State Election Commissioner, Maharashtra, the Collector of Yavatmal District proposes to make the following draft order under sub-section (1) of section 10 of Maharashtra Municipal Councils Nagar Panchayats and Industrial Townships Act, 1965 to fix for the Ner-Nababpur Municipal area shall be divided and to specify the wards reserved for schedule Castes, Schedule Tribes, Backward Classes of Citizens and Women (including Women belonging to the Scheduled Castes, the Scheduled Tribes and the Backward Classes of Citizens), as the case may be, as shown in the Schedule to this Order No. AK-MCA-WS-1079-2018, dated 4th August 2018 was published as required by the provision of sub-section (1) of Section 10 of said act for the information of all the residents of the Ner-Nababpur Municipal Councils. After carefully considering the objection are received by me in respect of the said Draft Order, I, the Collector of Yavatmal District in exercise of the powers conferred on me by sub-section (1) of Section 10 of the said Act, hereby make the following Order namely :—

Whereas, the Regional Director of Municipal Administration, Amravati Division, Amravati by his Order No. RDMA- RRM-281-2018, Dated 25-09-2018 issued under Sub-section (2) of Section 9 of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965 has fixed Ner-Nababpur Municipal Councillors to be elected and the number of seats to be reserved for the Scheduled Castes, Scheduled Tribes and Backward Classes of Citizens and Women (Including the number of seats reserved for Women belonging to the Scheduled Castes, Scheduled Tribes and Backward Classes of Citizens) as shown below :—
