महाराष्ट्र जमीन महसूल संहिता, १९६६ .
क्रमांक गौखनि-१०/०२१५/प्र.क्र. ९२/ख.—महाराष्ट्र जमीन महसूल संहिता, १९६६ (१९६६ चा महा.४१) याचे कलम ४८ चे पोट-कलम (९) व कलम ३२८ चे पोट-कलम (१) आणि पोट-कलम (२) चे खंड (एकोणीस) तसेच कलम ३२९ या अन्वये प्रदान करण्यात आलेल्या व त्याबाबतीत त्यास समर्थ करणाया इतर सर्व अधिकारांचा वापर करून, महाराष्ट्र शासन, याद्वारे, महाराष्ट्र जमीन महसूल (गौण खनिजांचे उत्खनन व ती काढणे) नियम, १९६८ यामध्ये आणखी सुधारणा करण्यासाठी जे नियम करण्याचे प्रस्तावित करीत आहे, त्या नियमांचा पुढील मसुदा उक्त संहितेच्या कलम ३२९ च्या पोट-कलम (१) द्वारे आवश्यक केल्याप्रमाणे यामुळे बाधित होण्याची शक्यता असलेल्या सर्व व्यक्तींच्या माहितीसाठी याद्वारे प्रसिद्ध करण्यात येत आहे व याद्वारे अशी नोटीस देण्यात येत आहे की, अधिसूचनेचा उक्त मसुदा ज्या दिनांकास महाराष्ट्र शासनाच्या राजपत्रात प्रसिद्ध होईल त्या दिनांकापासून ३० दिवसांच्या समाप्तीनंतर महाराष्ट्र शासनाकडून विचारात घेण्यात येईल.
२. उक्त मसुद्याच्या संदर्भात उपरोक्त कालावधीत कोणत्याही व्यक्तीकडून ज्या कोणत्याही हरकती किंवा सूचना अपर मुख्य सचिव (महसूल, नोदणी व मुद्रांक शुल्क), महसूल व वन विभाग, हुतात्मा राजगुरु चौक, मादाम कामा मार्ग, मंत्रालय मुंबई-४०० ०३२ यांचेकडे प्राप्त होतील त्या शासनाकडून विचारात घेण्यात येतील.
नियमाचा मसुदा

भाग चार--ब--३५३---१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, ऑक्टोबर ५, २०१८/आशि्वन १३, शके १९४० व ती काढणे) नियम, १९६८ यामध्ये आणखी सुधारणा करण्यासाठी याद्वारे पुढील नियम करीत आहे, त्या नियमांचा मसुदा उक्त संहितेच्या कलम ३२९ च्या पोट-कलम (१) द्वारे आवश्यक केल्याप्रमाणे पूर्वप्रसिद्ध करण्यात आलेला आहे :----
१. या नियमांस, महाराष्ट्र जमीन महसूल (गौण खनिजांचे उत्खनन व ती काढणे) ( दुसरी सुधारणा) नियम, २०१८, असे म्हणावे.
२. महाराष्ट्र जमीन महसूल (गौण खनिजांचे उत्खनन व ती काढणे), नियम, १९६८ मधील नियम ३ ऐवजी पुढील नियम दाखल करण्यात येईल,----
" ३. गावकयांनी त्यांच्या स्वत:च्या वापरासाठी वाळू काढणे:--- (१) या नियमाच्या तरतुदींच्या अधीनतेने, तहसीलदाराची लेखी पूर्व परवानगी घेऊन, जिल्हाधिकारी यांनी वाळू उत्खननासाठी पर्यावरण अनुमती घेऊन लिलावासाठी निश्चित केलेल्या मात्र यशस्वीरित्या बोली न लागलेल्या वाळूघाटांपैकी या प्रयोजनासाठी निश्चित केलेल्या वाळूघाटातून प्रचलित दरानुसार स्वामित्वधनाचे प्रदान करून, कोणत्याही गावातील कोणत्याही रहिवाशास, त्याच्या घरगुती किंवा शेतीच्या प्रयोजनासाठी (ज्यामध्ये विहीर बांधण्याचा समावेश असेल) पाच ब्रासपेक्षा अधिक नाही एवढी वाळू काढण्यास परवानगी देण्यात येईल :
परंतु, र्आथिकदृष्टया दुर्बल घटकांकरिता असलेल्या शासनाच्या कोणत्याही गृहनिर्माण योजनेअंतर्गत लाभ घेणाया व्यक्तीस, या नियमाच्या तरतुदींच्या अधीनतेने, तहसीलदारांची लेखी पूर्वपरवानगी घेऊन, जिल्हाधिकारी यांनी वाळू उत्खननासाठी पर्यावरण अनुमती घेऊन लिलावासाठी निश्चित केलेल्या मात्र यशस्वीरित्या बोली न लागलेल्या वाळूघाटांपैकी या प्रयोजनासाठी निश्चित केलेल्या वाळूघाटातून कोणतीही फी किंवा स्वामित्वधन न आकारता, स्वत:च्या घराच्या बांधकामासाठी पाच ब्रासपेक्षा अधिक नाही एवढी वाळू काढण्यास परवानगी देण्यात येईल.
(२) अशी लेखी परवानगी असा अर्ज प्राप्त झाल्याच्या दिनांकापासून पंधरा दिवसांच्या कालावधीच्या आत तहसिलदाराकडून देण्यात येईल."

NOTIFICATION
MAHARASHTRA LAND REVENUE CODE, 1966.
No. Gaukhani-10/0215/C.R. 92/Kh. — The following draft of the rules further to amend the Maharashtra Land Revenue (Extraction and Removal of Minor Minerals) Rules,1968, which the Government of Maharashtra proposes to make in exercise of the powers conferred by sub-section (9) of section 48 and sub-section (1) and clause (xix) of sub-section (2) of section 328 read with section 329 of the Maharashtra Land Revenue Code, 1966 (Mah. XLI of 1966), and of all other powers enabling it in that behalf, is hereby published as required by sub-section (1) of section 329 of the said Code, for the information of all the persons likely to be affected thereby ; and notice is hereby given that the said draft will be taken into consideration by the Government of Maharashtra after the expiry of thirty days from the date on which the draft Notification is published in the Maharashtra Government Gazette.
2. Any objections or suggestions which may be received by the Additional Chief Secretary (Revenue, Stamp Duty and Registration), Revenue and Forests Department, Hutatma Rajguru Chowk, Madam Cama Marg, Mantralaya, Mumbai - 400 032, from any person with respect to the said draft, within the aforesaid period, will be considered by the Government.
DRAFT RULES
No. Gaukhani-10/0215/C.R. 92/Kh.— In exercise of the powers conferred by sub-section (9) of section 48 and sub-section (1) and clause (xix) of sub-section (2) of section 328 read with sub-section (2) of section 329 of the Maharashtra Land Revenue Code, 1966 (Mah.XLI of 1966), and of all other powers enabling it in that behalf, the Government of Maharashtra hereby makes the following rules further to amend the Maharashtra Land Revenue (Extraction and Removal of Minor Minerals) Rules,1968, the same having been previously published as required by sub-section (1) of the section 329 of the said Code, namely :—
1. These rules may be called the Maharashtra Land Revenue (Extraction and Removal of Minor Minerals) (Second Amendment) Rules, 2018.
2. For rule 3 of the Maharashtra Land Revenue (Extraction and Removal of Minor Minerals) Rules, 1968, the following rule shall be substituted, namely :—
" 3. Removal of sand by villagers for their own use.—(1) Subject to the provisions of these rules, any resident of any village may, for his own domestic or agricultural purpose, including building of well, may be permitted to remove not more than five brass sand, with the prior permission of the Tahsildar in writing and on payment of royalty as per the prevailing rates from a sand ghat designated by the Collector for this purpose, which was put to auction, after obtaining environmental clearance but which was not successfully bid for :
Provided that, a person who is beneficiary of any housing scheme of the Government for the economically weaker sections may be permitted to remove not more than five brass sand for the construction of his own house under such housing scheme, with the prior permission of the Tahsildar in writing without payment of any fee or royalty from a sand ghat, designated by the Collector for this purpose, out of the sand ghats which were put to auction, after obtaining environmental clearance, but which were not successfully bid for.
४ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, ऑक्टोबर ५, २०१८/आशि्वन १३, शके १९४०(2) The Tahsildar, after examining such application for removal of sand, may grant permission to remove sand from such a sand ghat which is designated for this purpose within a period of fifteen days, from the date of receipt of such application."
