क्रमांक मावजसंका /१२८२ /२०१८ .--ज्याअर्थी, मौजे येवलेवाडी गावाचा पुणे महानगरपालिका हद्दीमध्ये महाराष्ट्र शासनाच्या क्रमांक पीएमसी -३०१२/ २३३/प्र.क्र. ३७५/ नवि -२२ , दिनांक २१ डिसेंबर २०१२ च्या अधिसूचनेनुसार समावेश करून पुणे महानगरपालिकेच्या हद्दीमध्ये वाढ केली आहे;
आणि ज्याअर्थी, महाराष्ट्र प्रादेशिक व नगररचना अधिनियम , १ ९ ६६ ( यापुढे " उक्त अधिनियम " असे संबोधण्यात येत आहे. ) चे कलम २१ अन्वये पुणे महानगरपालिकेच्या हद्दीमध्ये नव्याने समाविष्ट झालेल्या भागासाठी प्रारूप विकास आराखडा तयार करून उपरोक्त कलमामध्ये नमूद कालमर्यादेत महाराष्ट्र शासनाचे मंजुरीसाठी कलम ३० अन्वये सादर करणे आवश्यक आहे ;
आणि ज्याअर्थी, पुणे महानगरपालिकेच्या मुख्य सभेने ठराव क्रमांक ७१७ , दिनांक २४ जानेवारी २०१४ नुसार ( यापुढे " उक्त ठराव " असे संबोधण्यात येत आहे. ) महाराष्ट्र प्रादेशिक व नगररचना अधिनियम, १ ९ ६६ चे कलम २३ मधील तरतुदींनुसार नव्याने समाविष्ट झालेल्या येवलेवाडी या गावाच्या क्षेत्रासाठी प्रारूप विकास आराखडा ( यापुढे " उक्त प्रारूप विकास आराखडा" असे संबोधण्यात येत आहे) तयार करण्याचा इरादा जाहीर करण्यास मंजुरी दिली आहे ;
आणि ज्याअर्थी, उपरोक्त अधिनियमातील कलम २३ मधील तरतुदींनुसार येवलेवाडी गावाच्या नियोजित प्रारूप विकास योजनेसंबंधीचा इरादा दिनांक १२ जून २०१४ च्या अधिसूचनेद्वारे महाराष्ट्र शासन राजपत्रामध्ये व दैनिक वर्तमानपत्रामध्ये जाहीर करण्यात आला आहे ;
आणि ज्याअर्थी, उक्त ठरावान्वये मौजे येवलेवाडी गावाची प्रारूप विकास योजना तयार करणेकरिता श्री . प्रशांत वाघमारे , शहर अभियंता यांची उक्त अधिनियमाच्या कलम २४ अन्वये नगर रचना अधिकारी म्हणून नेमणूक करण्यास नियोजन प्राधिकरणाने मंजुरी दिली ;
आणि ज्याअर्थी, मा . सहसंचालक, नगर रचना , महाराष्ट्र राज्य, पुणे यांनी महाराष्ट्र शासनाच्या वतीने पत्र क्रमांक वियो पुणे/येवलेवाडी/ नगर रचना अधिकारी/ सहसंपुवि/९९ ६ , दिनांक २ जुलै २०१४ अन्वये शहर अभियंता श्री . प्रशांत वाघमारे यांची " नगर रचना अधिकारी " म्हणून नेमणूक करण्यास मंजुरी दिलेली आहे ;
आणि ज्याअर्थी, सहसंचालक, नगर रचना , पुणे यांनी आदेश क्र. प्रा.वि. यो. /येवलेवाडी/पुणे महानगरपालिका/ कलम २५/ सहसंपुवि/१५०७ , दिनांक १५ सप्टेंबर २०१७ नुसार उपरोक्त अधिनियमातील कलम २५ नुसार विद्यमान जमीन वापर सर्वेक्षणाचे नकाशे व अहवाल तयार करणेकरिता दिनांक २७ नोव्हेंबर २०१५ पर्यंत मुदतवाढ मंजूर केली आहे ;

(पु. वि. पु. ) १६ २ महाराष्ट्र शासन राजपत्र , असाधारण भाग एक पुणे विभागीय पुरवणी , ११ ऑक्टोबर , २०१८ / आश्विन १९ , शके १ ९४० आणि ज्याअर्थी, उक्त अधिनियमाच्या कलम २६ (१) नुसार पुणे महानगरपालिकेला उक्त प्रारूप विकास आराखडा कलम २३ नुसार इरादा जाहीर करण्याच्या दिनांकापासून दोन वर्षे मुदतीत तयार करून दिनांक ११ जून २०१६ पर्यंत महाराष्ट्र शासन राजपत्रात व विहित पद्धतीने प्रसिद्ध करावयाचा होता ;
आणि ज्याअर्थी, उक्त प्रारूप विकास आराखडा उक्त अधिनियमाच्या कलम २६ (१) अन्वये दिनांक ११ डिसेंबर २०१६ पर्यंत ( हा दिवस धरून) प्रसिद्ध करण्यास मुदतवाढ मिळणेबाबत ठराव क्रमांक ३३३ , दिनांक १० ऑगस्ट २०१६ नुसार महाराष्ट्र शासनाला विनंती केलेली आहे ;
आणि ज्याअर्थी, राज्य निवडणूक आयोगाकडून पुणे महानगरपालिका क्षेत्रासाठी विधान परिषद निवडणूक २०१६ , नगर परिषदा/नगर पंचायतींच्या सार्वत्रिका निवडणुका १६-१७ टप्पा २ , पुणे महानगरपालिका सार्वत्रिक निवडणूक २०१७ साठी आचारसंहिता लागू करण्यात आली असल्याने दिनांक १ ९ जुलै २०१४ रोजीच्या अध्यादेशानुसार उक्त अधिनियमाच्या कलम १४८ - अ मध्ये केलेल्या सुधारणांनुसार कोणत्याही निवडणुकीच्या आचारसंहितेचा कालावधी मुदतवाढीच्या कालावधीमधून वगळण्याची तरतूद आहे ;
आणि ज्याअर्थी, उक्त प्रारूप विकास आराखडा उक्त अधिनियमाच्या कलम २६ ( १) अन्वये २३ मार्च २०१७ पासून पुढे सहा महिन्यांपर्यंत प्रसिद्ध करण्यास मुदतवाढ मिळणेबाबत पुणे महानगरपालिका ठराव क्रमांक ६३ , दिनांक २७ जून २०१७ नुसार महाराष्ट्र शासनाला विनंती केलेली आहे ;
आणि ज्याअर्थी, संचालक, नगर रचना , महाराष्ट्र राज्य, पुणे यांनी आदेश क्रमांक वियो पुणे ( वा.क्षे . )/मौ.येवलेवाडी/मुदतवाढ / कलम २६ / टीपीव्ही-१ /४ ९ १६ , दिनांक १ ९ सप्टेंबर २०१७ च्या पत्रान्वये उक्त अधिनियमाच्या कलम २६ ( १) नुसार उक्त प्रारूप विकास आराखडा तयार करून त्याबद्दलची सूचना महाराष्ट्र शासनाच्या राजपत्रामध्ये आणि अन्य विहित मार्गांनी प्रसिद्ध करण्याचा कालावधी दिनांक २१ सप्टेंबर २०१७ हा दिवस धरून त्या दिवसापर्यंत वाढविण्यात आला ;
आणि ज्याअर्थी , पुणे महानगरपालिकेने ठराव क्रमांक ३१२, दिनांक १ ९ सप्टेंबर २०१७ या ठरावान्वये उक्त प्रारूप विकास आराखडा उक्त अधिनियमाच्या कलम २६ ( १) अन्वये प्रसिद्ध करण्यास मान्यता दिलेली आहे ;
आणि ज्याअर्थी, पुणे महानगरपालिकेकडून उक्त अधिनियमाच्या कलम २६ (१ ) अन्वये उक्त प्रारूप विकास आराखडा दिनांक २० सप्टेंबर २०१७ रोजी महाराष्ट्र शासन राजपत्रात व दैनिक वर्तमानपत्रामध्ये प्रसिद्ध करण्यात आला , तसेच सदर प्रसिद्ध दिनांकापासून ६० ( साठ) दिवसांपर्यंत नागरिकांकडून हरकती व सूचना मागविण्यात आल्या ;
आणि ज्याअर्थी, उक्त अधिनियमाच्या कलम २८ ( २) अन्वये पुणे महानगरपालिकेने ठराव क्रमांक ६०२ , दिनांक २७ नोव्हेंबर २०१७ व ठराव क्रमांक १ , दिनांक २३ एप्रिल २०१८ नुसार मा. स्थायी समितीतील तीन सदस्यांची व शासनाने दिनांक १३ मार्च २०१८ व दिनांक २ एप्रिल २०१८ च्या पत्रान्वये चार शासन नियुक्त सदस्यांची नियोजन समितीमध्ये नियुक्ती करणेत आली ;
आणि ज्याअर्थी, मा . महापालिका आयुक्त, पुणे महानगरपालिका यांनी दिनांक ७ मे २०१८ रोजी उक्त अधिनियमाच्या कलम २८ (२) अन्वये नियोजन समिती ( यापुढे " उक्त समिती " असे संबोधण्यात येत आहे. ) गठित केली ;
आणि ज्याअर्थी , उक्त समितीने उक्त अधिनियमाच्या कलम २६ (१) अन्वये प्रसिद्ध प्रारूप विकास आराखड्यावर विहित मुदतीत प्राप्त हरकती व सूचनांवर सुनावणी देऊन उक्त अधिनियमाच्या कलम २८ (३) अन्वये त्याबाबतचा आपला अहवाल (यापुढे " उक्त अहवाल " असे संबोधण्यात येत आहे. ) दिनांक ६ जुलै २०१८ रोजी मा. मुख्य सभेकडे सादर केला ;
आणि ज्याअर्थी , उक्त अहवालावर विचार करून , मा . मुख्य सभेने ठराव क्रमांक २०४ , दिनांक २८ ऑगस्ट २०१८ नुसार , उक्त अहवालाबाबत निर्णय घेऊन सदर मंजूर निर्णयानुसार उक्त प्रारूप विकास आराखडा उक्त अधिनियमाच्या कलम २८ ( ४) अन्वये शासन राजपत्रात व दैनिक वर्तमानपत्रामध्ये प्रसिद्ध करून उक्त अधिनियमाच्या कलम ३० अन्वये शासनाच्या मंजुरीसाठी सादर करण्यास मान्यता दिली आहे ;
आहे ; आणि ज्याअर्थी, उक्त अधिनियमाचे कलम ३० अन्वयेच्या सादरीकरणाचे मुदतवाढीत उक्त अधिनियमाचे कलम २१ अन्वयेची मुदतवाढ अंतर्भूत आणि ज्याअर्थी, उपसंचालक , महाराष्ट्र राज्य, पुणे यांचे आदेश क्रमांक प्रा.वि.यो. येवलेवाडी/ मुदतवाढ/कलम २१/ सहसंपुवि/१५६६ , दिनांक २४ सप्टेंबर २०१८ नुसार उक्त अधिनियमाच्या कलम २१ (३) अन्वये , कलम २१ चा कालावधी दिनांक २० डिसेंबर २०१५ ते ३० ऑक्टोबर २०१८ हा दिवस धरून त्या दिवसापर्यंत वाढविण्यात आला ;
आणि ज्याअर्थी, संचालक, महाराष्ट्र राज्य, पुणे यांचे आदेश क्रमांक प्रा.वि.यो. पुणे ( वा.ह. ) (मौ . येवलेवाडी)/कलम ३० /मुदतवाढ/टीपीव्ही-१/ ५६१४ , दिनांक २७ सप्टेंबर २०१८ च्या उक्त अधिनियमाच्या कलम ३० , पोट- कलम ( १) नुसार उक्त अधिनियमाच्या कलम २८ (४) अन्वये प्रसिद्ध प्रारूप विकास आराखडा शासनाकडे मंजुरीसाठी सादर करण्याकरिताची मुदत दिनांक ३० ऑक्टोबर २०१८ पर्यंत हा दिवस धरून त्या दिवसापर्यंत वाढविण्यात आला ;
महाराष्ट्र शासन राजपत्र , असाधारण भाग एक पुणे विभागीय पुरवणी , ११ ऑक्टोबर , २०१८ / आश्विन १९ , शके १९ ४० ३ आणि ज्याअर्थी, पुणे महानगरपालिका ठराव क्रमांक २०४ , दिनांक २८ ऑगस्ट २०१८ च्या मंजुरीनुसार , मौजे येवलेवाडी गावाचा प्रारूप विकास आराखडा उक्त अधिनियमाच्या कलम २८ (४) अन्वये शासन राजपत्रात व दैनिक वर्तमानपत्रामध्ये प्रसिद्ध करून उक्त अधिनियमाच्या कलम ३० अन्वये शासनाच्या मंजुरीसाठी दिनांक ३० ऑक्टोबर २०१८ पर्यंत सादर करावयाचा आहे;
त्याअर्थी, मौजे येवलेवाडी गावाचा प्रारूप विकास आराखडा उक्त अधिनियमाच्या कलम २८ (४) अन्वये जनतेच्या माहिती व अवलोकनासाठी, महाराष्ट्र शासन राजपत्रात व दैनिक वर्तमानपत्रामध्ये, तसेच नगर रचना अधिकारी तथा शहर अभियंता यांचे कार्यालयात, पुणे महानगरपालिका , मुख्य इमारत , पहिला मजला, शिवाजीनगर, पुणे ४११००५ येथे प्रसिद्ध करण्यात येत आहे . सदर प्रारूप विकास आराखडा पुणे महानगरपालिकेच्या www.pmc.gov.in या संकेतस्थळावर अवलोकनार्थ उपलब्ध आहे ;

Under Section 28 (4) of Maharashtra Regional and Town Planning Act, 1966
Public Notice
क्रमांक मावजसंका/१२८२/२०१८.- Whereas , Government has extended Pune Municipal Corporation's limit as per Government Notification No. PMC - 3012/ 233 /CR - 375 /UD - 22, dated 21st December 2012 by including village Yewalewadi ;
and whereas , Pune Municipal Corporation has to submit the Draft Development Plan for newly included area within the specified time limit as stipulated under Section 21 of the Maharashtra Regional and Town Planning Act 1966 ( hereinafter referred as " the said Act " ) to the Government of Maharashtra for the final approval as per Section 30 of the said Act ;
and whereas , the General Body of Pune Municipal Corporation has sanctioned the Resolution No. 717, dated 24th January 2014 ( hereinafter referred as " the said Resolution " ) to declare the intention to prepare the Draft Development Plan for the newly included village Yewalewadi as per Section 23 of the said Act ( hereinafter referred as " the said Development Plan " ) ;
and whereas , Pune Municipal Corporation has declared the intention to prepare the said Development Planas per Section 23 of the said Act in the Maharashtra Government Gazette and in Daily news papers ondated 12th June 2014 ;
andwhereas, Planning Authority vide said Resolution has appointed Prashant Waghmare , City Engineer as the Town Planning Officer under Section 24 of the said Act;
and whereas , the Joint Director of Town Planning , Maharashtra State , Pune on behalf of the State Government, vide letter No. DDP Pune/Yewalewadi / TPO / JDTP /996 , dated 2nd July 2014 has approved the appointment of Prashant Waghmare , City Engineer as Town Planning Officer for the said Development Plan;
and whereas , the Joint Director of Town Planning , Pune vide Order No.DDP/Yewalewadi/ PMC/Sec.25/ Extn./JDTP/1507 , dated 15th September 2017 has extended the time period for preparation of Existing Land use map and Report of said Development Plan vide Section 25 of the said Act up to and inclusive of dated 27th November 2015 ;
and whereas , vide Section 26 ( 1) , of the said Act , the Pune Municipal Corporation has to prepare the said plan and publish a notice of such preparation in the Maharashtra Government Gazette and in other ४ महाराष्ट्र शासन राजपत्र , असाधारण भाग एक पुणे विभागीय पुरवणी, ११ ऑक्टोबर , २०१८ / आश्विन १९ , शके १ ९ ४० prescribed manner not later than two years from the date of notice published under Section 23 i.e. up to and inclusive 11th June 2016 ;
and whereas , the General Body of the said PMC vide Resolution No. 333 , dated 10th August 2016 has requested the State Government to extend the time limit for publication of said Draft Development Plan vide Section 26 ( 1) of the said Act up to and inclusive of date 11th December 2016 ;
and whereas , the code of conduct for MLC Election 2016 , Nagarparishad / Nagarpanchayat Election 16-17 stage 2 and Pune Municipal Corporation Election 2017 was enforced by State Election Commission and vide amendment , dated 19th July 2014 in Section 148 - A of the said Act, the period for code of conduct enforced in respect of any election is to be excluded from the time extension ;
and whereas , the Director, Town Planning , Maharashtra State , Pune has vide Order No. DP Pune (AA) Yewalewadi / Extension u / s 26 /TPV- 1 /4916 , dated 19th September 2017 has extended the period for the preparation of the said Development Plan and publication of the notice of the such preparation in the Maharashtra Government Gazette and in other prescribed manner up to and inclusive of 21st September 2017 , under the provisions of Section 26 ( 1) of the said Act;
and whereas , the General Body of Pune Municipal Corporation vide Resolution No. 312 , dated 19thSeptember 2017 has sanctioned to publish the said Development Plan under Section 26 ( 1) of the said Act;
and whereas , Pune Municipal Corporation published the said Development Plan under Section 26 ( 1 ) of the said Act on 20th September 2017 in Maharashtra Government Gazette and in Daily News Papers , inviting Suggestions and Objections from the citizens within 60 ( sixty) days from the date of publication ;
and whereas , vide Section 28 (2) of the said Act , the General Body of Pune Municipal Corporation vide Resolution No. 602, dated 27th November 2017 and Resolution No. 1 , dated 23rd April 2018 appointed three members of the Standing Committee and State Government vide letters , dated 13th March 2018 and 2nd April 2018 , appointed four members of the Planning Committee ;
and whereas , vide letter, dated 7th May 2018 Municipal Commissioner of Pune Municipal Corporation constituted Planning Committee ( hereinafter referred as " said Committee " ) under Section 28 (2) of the saidAct,
and whereas , the said Committee gave hearing to suggestions and objections received within stipulated time , on the said Development Plan published under Section 26 ( 1 ) of the said Act and under Section 28 (3) of the said Act , the said Committee submitted its report ( hereinafter referred as " said Report " ) to the General Body on 6th June 2018 ;
and whereas , the General Body of Pune Municipal Corporation after considering the said report , vide Resolution No. 204, dated 28th August 2018 decided about the said report and as per the decision sanctioned to publish the said Development Plan under Section 28 (4) of the said Act in Maharashtra Government Gazette and in other prescribed manner and submit the said Development Plan under Section 30 of the said Act to the Government for sanction ;
and whereas , while extending the time limit under Section 30 of the said Act, it is necessary to extend the time limit under Section 21 of the said Act , as the same is built in ;
and whereas , Joint Director, Town Planning , Maharashtra State , Pune , vide Order No. D.D.P. Yewalewadi/ Extension / Section 21 / JDTP/ 1566, dated 24th September 2018 extended the period for Section 21 from 20th December 2015 to 30th October 2018 upto and inclusive of 30th October 2018 as provided under Section 21 (3) of the said Act ;
and whereas , Director , Town planning , Maharashtra State , Pune , vide Order No. D.D.P. Pune ( A.A) (Yewalewadi ) /Sec.30/Extension/TPV-1/5614, dated 27th September 2018 extended the period for the ५ महाराष्ट्र शासन राजपत्र , असाधारण भाग एक पुणे विभागीय पुरवणी , ११ ऑक्टोबर , २०१८ / आश्विन १९ , शके १९ ४० submission of the published plan under Section 28 (4) of the said Act to Government under Section 30 (1) ofthe said Act upto and inclusive of dated 30th October 2018 ;
and whereas , as per General Body Resolution No. 204 , dated 28th August 2018 , Pune Municipal Corporation has to publish the Draft Development Plan of village Yewalewadi under Section 28 (4) of the said Act in Maharashtra Government Gazette and in other prescribed manner for the information of the public, and submit the said Development Plan under Section 30 of the said act upto 30th October 2018 to the Government for sanction .
Now therefore , the Draft Development Plan of village Yewalewadi is being published under Section 28 (4) of the said Act for the information and inspection of the public , in Maharashtra Government Gazette and in other prescribed manner, and in the office of the Town Planning Officer and the City Engineer, Pune Municipal Corporation , main building , First floor, Shivajinagar , Pune - 411 005 on working days and in the working hours of the Pune Municipal Corporation . The said Draft Development Plan can also be viewed on the website www.pmc.gov.in
