MAHARASHTRA REGIONAL & TOWN PLANNING ACT, 1966.

Whereas, the Director of Town Planning , Maharastra State, Pune has accorded a final sanction to the Shegaon Development Plan (Revised) vide Notification No. DP-Shegaon-TPV-6-2755, dated 26th April, 1994 (hereinafter referred to as "the said Devlopment Plan") and has come into force with effect from the 1st Agust, 1994 (hereinafter referred to as "the said Notification"); and whereas, the Shegaon Mu- nicipal Council is the Planning Authority for the said Development Plan ( hereinafter referred to as " the said Planning Authority");

And whereas, in the said Development Plan, land bearing Survey No. 251/1 of Mouje Shegaon, Tq.

Shegaon, Dist. Buldhana, admeasuring 0 64 ha. (hereinafter referred to as "the said land") is included in "Agriculture Zone" (hereinafter referred to as "the said zone");

And whereas, as per the provisions of Section 37(1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) the Municipal Council, Shegaon vide its General Body Resolution No. 11A, dated 16th August, 2014 has resolved to make modification in the sanctioned Development Plan of Shegaon, so as to delete the said land from the said Zone and to include the same in Residential Zone (hereinafter referred to as "the proposed modification") and accordingly submitted the proposal to Government for sanction ;

And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of the opinion that the proposed modification should be sanctioned with certain conditions ;

And whereas, the land owners of the said lands deposited Rs. 51,200 towards the 50% Government share of 5% premium amount as per the rate of said land as prescribed in the Annual Statement of Rates (ASR) for the year 2017-18 in the Government Treasury vide chalan dt. 05-07-2018 through the Town Planner, Buldana Branch, Buldana and the remaining 50% of the 5% premium amount of Rs. 51,200/- has been deposited with the Municipal Council, Shegaon on dt. 22-06-2018;

Now, therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government of Maharashtra hereby sanctions the proposed Modification in the said Develop- ment Plan with certain conditions and for that purpose amends the above said Notification dated the 26th April, 1994 as follows :-

ENTRY

"The land bearing Survey No. 251/1 of Mouje Shegaon, Tq. Shegaon, Dist. Buldhana, admeasuring 0 64 ha. is deleted from the Agriculture Zone and land so released is included in the Residential Zone, subject to following conditions :-

Condition No. 1 : As per the sanctioned Development Control and Promotion Regulations, in addition to open space it is mandatory to provide necessary amenity space.

Condition No. 2 : It shall be the responsibility of the Land Owner/Developer to provide basic amenities in respect of the land under modification.

Condition No. 3 : If the said land is proposed to be developed by way of plotted layout then sale of plots shall be monitored by the Chief Officer, Shegaon Municipal Council Shegaon in rela- tion to the development of civic amenities as per the stages given below.—

i. After final approval of layout - sale of 25% of total plots shall be permissible.

ii. After completion of 40% of Civic Amenities - sale of 50% of total plots shall be permissible.

iii. After completion of 60% of Civic Amenities - sale of 75% of total plots shall be permissible.

iv. After completion of 80% of Civic Amenities - sale of 90% of total plots shall be permissible.

v. After completion of 100% of Civic Amenities- sale of 100% of total plots shall be permissible.

If Group Housing Scheme is proposed in the layout, then the occupancy certificate shall not be given unless civic amenities specified by the Chief Officer, Shegoan Municipal Council, Shegaon are fully developed".

Condition No. 4 : In case of non-compliance of above conditions, Layout Approval and Non-Agricultural permission shall be liable to be cancelled.

A copy of the part plan showing the aforesaid sanctioned modification shall be available in the office of the Chief Officer, Shegaon Municipal Council, Shegaon during office hours on all working days for inspection of public for a period of one month.

This Notification shall also be published on the Govt. website www.maharashtra.gov.in./Act & Rules.

In exercise of the powers conferred by State Election Commissioner, Maharashtra, Mumbai vide its Order No. Sec./NP-2018/CR-12-Desl-06, Dated 8th August 2018 the draft order fixing the number of seats to be elected and the extent of the wards in to which the area of the Municipal Council, Risod is to be divided and wards reserved for Scheduled Castes, Scheduled Tribes, Backward Class of Citizens and Women (including Women belonging to the Scheduled Castes, Scheduled Tribes and the Backward Class of Citizens), as the case may be, as shown in the Schedule to the draft order bering No./Desk-13-Ak.(NPP)-WS-330-2018 Dated 04-09-2018 was published as required by the provision sub-section 10 of Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965, for information of the people resident of Risod Municipal Council. As no objection are received by me in respect of said draft order.
