MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.

No. TPS-2418-205-CR-36-UD-9-2018.—

Whereas, the Development Plan of Mohpa has been sanctioned by the Government vide Urban Development Department's Notification No. TPS-2412-74-CR-31(B)-2012-UD-9, dated 21-3-2012 and has come into force with effect from the 15-05-2012 (hereinafter referred to as " the said Development Plan ") under Section 31 (1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as " the said Act ") ;

And whereas, in the said Development Plan, the land bearing Khasara No. 233/1 admeasuring area 1.10 Hectare, of Mouje Mohpa (hereinafter referred to as " the said Land "), is included in Agricultural Zone ;

And whereas, the Mohpa Municipal Council, being the Planning Authority (hereinafter referred to as " the said Planning Authority "), vide its General Body Resoution No. 01, dated 7-03-2015 has resolved to delete the said land from Agricultural Zone and to include the same in Residential Zone and accordingly submitted a modification proposal to the Government, for its sanction as per the provisions of sub-section (1) of Section 37 of the said Act, (hereinafter referred to as "the said Proposed Modification") ;

And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of the opinion that the proposed Modification should be sanctioned with some condition ;

And whereas, the Land Owners of the land bearing Khasara No. 233/1 admeasuring about 1.10 Hector have deposited Rs. 1,37,500 towards the 50% Government share of 5% premium amount as per the value of the said lands as prescribed in the Annual Statement of Rates (ASR) for the year 2018-19 in the Government Treasury on 05-07-2018 through the Assistant Director of Twon Planning, Nagpur Branch, Nagpur and remaining 50% of the 5% premium amount Rs. 1,37,500 payable to the Planning Authority has been deposited with the Chief Officer, Mohpa Municipal Council, Mohpa on 23-07-2018 ;

Now, therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government hereby, sanctions the Proposal Modification and for that purpose amends the aforesaid Notification dated 21-03-2012 as follows ;

" In the Schedule of Modifications appended to the Notification dated 21-03-2012 sanctioning the said Development

Plan, the following new entry shall be added after the last entry.—

ENTRY

The land bearing Khasara No. 233/1 admeasuring area 1.10 Hectare, of Mouje Mohpa is deleted from Agriculture Zone and is included in Residential Zone as shown on the plan, subject to the condition mentioned Specified below.—

Condition No. 1.—In addition to open space, necessary Amenity Space shall be provided in the layout of the said Land as per the prevailing Development Control Regulations of Mohpa.

Condition No. 2.—It is binding on the land owner/developer, to provide all Basic Amenities required for the land at his own cost." A copy of the Notification, along with the part plan showing the aforesaid sanctioned modification shall be available for inspection of the general public, in the office of the Chief Officer, Mohpa Municipal Council, Mohpa during office hours on all working days for a period of one month.

This Notification shall also be available on the Govt. web site www.maharashtra.gov.in

Whereas, the Government has sanctioned the revised + additional area Development Plan of Deoli Municipal Council vide Urban Development Department's Notification No. 2615-148-CR-86(A)-2015-UD-9, dated 03-05-2016 under sub-section (1) 31 of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) hereinafter referred to as 'the said Act') which came into force with effect from the 2-07-2016 (hereinafter referred to as "the said Development Plan") ;

And whereas, in the said Development Plan, land bearing Survey Nos. 10/1, 10/2 admeasuring area 2.08 Hector of Mouje Deoli is reserved as Site No. 41 " Cultural Center Library" (hereinafter referred to as "the said Reservation") ;

And whereas, the Deoli Municipal Council being the Planning Authority (hereinafter referred to as ' the said Planning Authority"), vide its General Body Resolution No. 05, dated 30-05-2016 has resolved to delete the said Reservation and include the same in Residential Zone and accordingly submitted a modification proposal to the Government, for its sanction as per the provisions of sub-Section (1)of Section 37 of the said Act, (hereinafter referred to as "the Proposed Modification") ;

And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune the Government is of opinion that the proposed Modification should be sanctioned with some conditions ;

And whereas, the Land Owners of the land bearing Survey Nos. 10/1, 10/2 admeasuring about 2.08 Hector have deposited Rs. 1,06,600 towards the 50% Government share of 5% permium amount as per the rate of the said lands as prescribed in the Annual Statement of Rates (ASR) for the year 2018-19 in the Government Treasury on 14-08-2018 through the Town Planner, Wardha Branch, Wardha and remaining 50% of the 5% premium amount Rs. 1,06,600 payable to the Planning Authority has been deposited with the Chief Officer, Deoli Municipal Council on 21-08-2018 ;

Now, therefore, in exercise of the powers conferred on it under sub-Section (2) of Section 37 of the said Act, the Government hereby, sanctions the Proposed Modification and for that purpose amends the aforesaid Notification dated 03-05-2016 as follows ;

"In the Schedule of Modifications appended to the Notification dated 03-05-2016 sanctioning the said Development Plan, the following new entry shall be added after the last entry .—

In exercise of the powers conferred on me by Order No. MNC-1101/CR-23/D-XI, dated 17th August, 2001 of the State Election Commissioner, Maharashtra, the Collector of Gadchiroli District proposes to make the following order under the sub-section (1) of the Section 10 of the Maharashtra Municipal Council Nagar Panchayat and Industrial Townships Act, 1965 (Mah. In exercise of the powers conferred on me, by Order ॅद्धहॅ द्ध-२००४-.ॅ.३४-ॅ-०६, ह्यहॅ १७-९-२००४ of the State Election Commissioner, Maharashtra, the Draft Order fixing the number of seats to be elected and the extent of the wards into which the said Municipal area of the Municipal Councils to be divided and wards to be reserved for Scheduled Castes, Scheduled Tribes, Backward Class of Citizens and Women (including women belonging to the Scheduled Castes, Scheduled Tribes and the Backward Class of Citizens) as the case may be, as shown in the Scheduled to the Draft Order, bearing ॅ-१२-द्धा-१-ॅह्यम् ५७१-२०१८, ह्यहॅ १७ रू]क्ष्दन् २०१८ was published as required by the proviso to sub-section (1) of Section 10 of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965, for information of the residents of the Mouda Nagar Panchayat.

After carefully considering the objections received by me in respect of the said draft order, I, Ashwin Mudgal, Collector of Nagpur District in exercise of the powers conferred on me by sub-section (1) of Section 10 of the said Act, hereby make the following order namely :—

XL of 1965) has fixed for Mouda Nagar Panchayat the number of Councillors to be elected and the number of seats to be reserved for the Scheduled Castes, Scheduled Tribes and Backward Class of Citizens and Women (including the number of Seats reserved for women belonging to the Scheduled Castes, the Scheduled Tribes and the Backward Class of Citizens) as shown below :—

2. Now, therefore, in exercise of the powers conferred on me. By Order ॅ.न्ह्य+--२०१८-ॅ१२-ॅ०६, ह्यहॅ ०८-०८-२०१८ of the State Election Commissioner, Maharashtra read with sub-section (1) of Section 10 of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965 (Mah. XL. of 1965). I, Ashwin Mudgal the Collector of Nagpur District hereby fixed the number and extent of the wards into which the said Municipal area shall be divided and specify the wards in which seats shall be reserved for the Scheduled Castes, Scheduled Tribes, the Backward class of Citizens and Women (including women belonging to the Scheduled Castes, Scheduled Tribes, the Backward class of Citizens) as the case may be, as shown in the Scheculed to this order.

3. This Order shall take effect for the purpose of the next General Elections held immediately following the date of this Order.
