क्रमांक विपता. २०१७/प्र.क्र.८८/सेवा-४.---- ज्याअर्थी, महाराष्ट्र शासनाने ''मालेगाव (जि. नाशिक) येथे सार्वजनिक बांधकाम विभाग, वेब मॅनेजमेंट ही बनावट कंपनी स्थापन करून खोटी नियुक्ती पत्रे देऊन १२० बेरोजगार तरुणांची कोटयवधी रुपयांची फसवणूक केल्याप्रकरणात सार्वजनिक बांधकाम खात्यातील कर्मचारी/अधिका-यांचा संबंध आहे किंवा कसे " याप्रकरणी चौकशी करून शिफारशीसह अहवाल सादर करण्याकरिता मा. श्री. संजीव न. पाठक, जिल्हा न्यायाधीश (सेवानिवृत्त), यांच्या अध्यक्षतेखाली क्रमांक विपता. २०१७/प्र.क्र.८८/सेवा-४, दिनांक २६ जून २०१८ रोजीच्या शासन निर्णयान्वये चौकशी समिती स्थापन करण्यात आली आहे तसेच दिनांक २७ जून २०१८ रोजी अधिसूचना निर्गमित करण्यात आली आहे ;
आणि ज्याअर्थी, उक्त प्रयोजनार्थ मा. श्री. संजीव न. पाठक, जिल्हा न्यायाधीश (सेवानिवृत्त) यांनी समितीचे कामकाज करण्याकरिता असमर्थता दर्शविली आहे ;
आणि ज्याअर्थी, उक्त प्रयोजनार्थ महाराष्ट्र शासनाने सार्वजनिक बांधकाम विभाग, शासन निर्णय क्रमांक विपता. २०१७/प्र.क्र.८८/सेवा-४, दिनांक २६ सप्टेंबर २०१८ अन्वये मा. सोपान गोविंदराव देशपांडे, जिल्हा न्यायाधीश (सेवानिवृत्त) यांची एक सदस्यीय चौकशी समिती नियुक्त करण्यात आली आहे ;
आणि ज्याअर्थी, सदर समितीला चौकशी आयोग अधिनियम, १९५२ (१९५२ चे ६०) च्या कलम ४ मधील तरतुदी लागू करणे आवश्यक असल्याचे महाराष्ट्र शासनाचे मत आहे ;
आणि त्याअर्थी, दिनांक २७ जून २०१८ ची अधिसूचना अधिक्रमित करून आणि चौकशी आयोग अधिनियम, १९५२ (१९५२ चे ६०) च्या कलम ११ नुसार प्रदान करण्यात आलेले अधिकार आणि त्या प्रयोजनार्थ प्रदान करण्यात आलेल्या इतर सर्व अधिकारांचा वापर करून महाराष्ट्र शासन आता असे निदेश देत आहे की, उक्त अधिनियमातील कलम ४ च्या तरतुदी मा. सोपान गोविंदराव देशपांडे, जिल्हा न्यायाधीश (सेवानिवृत्त) यांच्या समितीस लागू होतील व सदर समिती ही अधिसूचना राजपत्रात प्रसिद्ध झाल्याच्या दिनांकापासून एक महिन्याच्या आत आपला अहवाल शासनास सादर करेल.

NOTIFICATION
COMMISSIONS OF INQUIRY ACT, 1952.
No.VIPATA. 2017/C.R.88/Seva-4.— Whereas the Government of Maharashtra appointed the One Member Inquiry Committee of Hon'ble Shri Sanjeev Pathak, District Judge (Retired), vide Government Resolution, Public Works Department, No.VIPATA. 2017/C.R.88/Seva-4, dated 26th June 2018 and issued notification dated 27th June 2018 for the purpose of making an inquiry that "whether any of the officers or employees of the Public Works Department are involved into the matter of establishment of forged 'Public Works Department Web Management Company' at Malegaon, Nashik and issuance of bogus appointment letters to 120 unemployed youths, thereby defrauding them for crores of rupees," being the definite matter of public importance and to submit its report thereof with recommendations to the Government ;
And whereas, Hon'ble Shri Sanjeev N. Pathak, District Judge (Retired), expressed his inability to conduct the work of the said Committee ;
And whereas, the Government of Maharashtra has appointed the One Member Inquiry Committee of Hon'ble Shri Sopan Govindrao Deshpande, District Judge (Retired) vide Government Resolution, Public Works Department, No. VIPATA. 2017/C.R.88/Seva-4, dated 26th September 2018, for the above purpose ;
And whereas, the Government of Maharashtra is of the opinion that the provisions of section 4 of the Commissions of Inquiry Act, 1952 (60 of 1952), should be made applicable to the said Committee ;
Now, therefore, in exercise of the powers conferred by section 11 of the Commissions of Inquiry Act, 1952 (60 of 1952), and in supersession of the Government Notification, Public Works Department No. VIPATA. 2017/C.R.88/Seva-4, dated 27th June 2018, and of all other powers enabling it in this behalf, the Government of Maharashtra hereby directs that the provisions of section 4 of the said Act shall apply to the Committee of Hon'ble Shri Sopan Govindrao Deshpande, District Judge (Retired) and the said committee shall submit its report to the Government within one month from the date of publication of this notification in the Official Gazette.
