क्रमांक खाक्षेस-२००५/प्र.क्र.१९३/एल.बी.६/रस्ते ९.— ज्याअर्थी, महाराष्ट्राचे राज्यपाल यांनी प्रदान केलेल्या शक्त्तींचा वापर करून सचिव, सार्वजनिक बांधकाम विभाग, मंत्रालय, मुंबई आणि मे. प्रांजल इन्फ्रास्ट्रक्चर प्रा.लि. (विशेष प्रयोजन संस्था मे. राम इन्फ्रास्ट्रक्चर लि.) ज्यांचे नोंदणीकृत कार्यालय, ६, श्रेयस बिल्डींग, गणेशवाडी, राधाकृष्ण मंगल कार्यालयासमोर, जळगाव येथे आहे यांच्यामध्ये दिनांक १९ एप्रिल २००७ रोजी " बांधा वापरा व हस्तांतरित करा " या तवावर अहमदनगर जिल्ह्यतील कोपरगाव अहमदनगर रस्ता राज्यमार्ग क्र.१०, कि.मी. ७८/ २०० ते १२०/००० चे चौपदरीकरण करणे व शिर्डी राहता बावळण रस्ता दुपदरीकरण करणे कि.मी. ०/००० ते २३/३०० (भाग-१) तसेच सदर रस्त्याचे परिक्षण, देखभाल व दुरुस्ती करणे (यापुढे सदर रस्ता म्हणून संबोधण्यात येईल.) या कामाकरिता करारनामा साक्षांकित करण्यात आलेला आहे ;
आणि ज्याअर्थी, सदर करारनाम्यानुसार सदर रस्त्याचे बांधकाम, वापर व देखभाल दुरुस्ती करीता १० वर्षे, १ महिने, १८ दिवस इतका सवलत कालावधी तीन वषार्र्ंच्या बांधकाम कालावधीसह उद्योजकास दि. १० मे २००७ या प्रकल्प सुरू होण्याच्या दिनांकापासून मंजूर करण्यात आलेला आहे ;
आणि ज्याअर्थी, सदर रस्त्याकरिता अर्थसहाय्य करणारे वित्तीय संस्थांनी (धनको-युको बँक) यांनी दिनांक १६ मार्च २००९ रोजी केलेल्या पुरवणी करारनाम्यातील अट क्र.४.१ नुसार इव्हेंट ऑफ डिफॉल्ट घडून आल्यावर मे. कोपरगाव-अहमदनगर टोलवेज (फेज-१) प्रा.लि. (विशेष प्रयोजन संस्था मे. सुप्रिम इन्फ्रास्ट्रक्चर इंडिया लि.), यांची संभाव्य उद्योजक म्हणून शासनास शिफारस केली व ती शासनाने स्वीकारली. त्यानुसार युनियन बँक ऑफ इंडिया यांनी, महाराष्ट्राचे राज्यपाल यांनी प्रदान केलेल्या शक्त्तींचा वापर करून सचिव सार्वजनिक बांधकाम विभाग, मंत्रालय, मुंबई आणि मे. कोपरगाव-अहमदनगर टोलवेज प्रा.लि. (फेज-१) (विशेष प्रयोजन संस्था मे. सुप्रिम इन्फ्रास्ट्रक्चर इंडिया लि.), ज्यांचे नोंदणीकृत कार्यालय ९०३-९०५, ९वा माळा, मिलेनियम टॉवर बी, इफको चौकासमोर, मेट्रो स्टेशन, एम.जी. रोड, गुरगाव हरियाना १२२ ००२ येथे आहे यांचेसोबत दि.२८ जुलै २०१४ रोजी अहमदनगर जिल्ह्यतील कोपरगाव अहमदनगर रस्ता राज्य मार्ग क्र. १०, कि.मी. ७८/२०० ते १२०/००० चे चौपदरीकरण करणे व शिर्डी राहता बावळण रस्ता दुपदरीकरण करणे कि.मी. ०/००० ते २३/३०० (भाग-१) या रस्त्याचे चौपदरीकरण करणेसाठी मूळ करारनाम्यातील अटी व शर्ती जशा आहेत तशा ठेऊन बांधा, वापरा व हस्तांतरित करा या तवावर पुरवणी करारनामा साक्षांकित करण्यात आलेला आहे व यानंतर यांचेमध्ये सर्व करारनामे समाविष्ट झालेले आहे; भाग चार--ब--३८३--१
(१)महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, ऑक्टोबर २०, २०१८/अशि्वन २८, शके १९४० २ आणि ज्याअर्थी, सदर करारनाम्यानुसार सदर रस्त्याचे बांधकाम, वापर व देखभाल दुरुस्तीसाठी प्रकल्प सुरू होण्याच्या दिनांकापासून म्हणजे ०३ मार्च २०१४ पासून ७ वर्ष, १ महिने, १८ दिवस इतका सवलत कालावधी मंजूर करण्यात आलेला आहे ;
आणि ज्याअर्थी, महाराष्ट्र शासनाची अशी धारणा आहे की, सदर रस्त्याचे बांधकाम, वापर आणि देखभाल दुरुस्ती ही जनतेला दिलेली विशेष सेवा आहे आणि त्यामुळे सदर रस्त्यावर कि.मी. ११०/००० बाभळेश्वर गावाजवळ पथकर स्थानक उभारून पथकर आकारणे व वसुली करणे महाराष्ट्र शासनास योग्य वाटत आहे ;
आणि ज्याअर्थी, महाराष्ट्र शासनाचे सार्वजनिक बांधकाम विभाग, खाक्षेस-२००५/प्र.क्र.१९३/एल.बी.६/रस्ते-९, दिनांक २० सप्टेंबर २०१७ रोजीच्या शासन अधिसूचनेद्वारे महाराष्ट्र मोटर वाहन कर अधिनियम, (१९५८ चा ६५) याच्या कलम-२० ची पोट-कलमे (१-अ),(१-ब), (१-क), (१-ड) आणि (१-इ) द्वारे प्रदान करण्यात आलेल्या आणि त्याला समर्थनीय करणाया अधिकारांचा वापर करून सदर रस्त्याचा वापर करणाया व खालील अनुसूचीच्या स्तंभ (२) मध्ये अनुक्रमे विर्िनदिष्ट केलेल्या प्रकाराच्या मोटार वाहनांवर आणि वाहनांकडून ओढून नेल्या जाणाया, अनुयानांवर अनुसूचीच्या स्तंभ (३) मध्ये त्यांच्या समोर विर्िनदिष्ट केलेल्या दराने दिनांक २१ सप्टेंबर २०१७ ते २० जानेवारी २०१८ पयर्ंतच्या कालावधीसाठी सदर रस्त्यावरील कि.मी. ११०/०० बाभळेश्वर गावाजवळ उभारलेल्या पथकर वसुली स्थानकावर पथकर शुल्क वसुली करण्यात आलेली आहे ;
आणि ज्याअर्थी, दिनांक २० जानेवारी २०१८ आणि दिनांक ९ मे २०१८ रोजीच्या शासन अधिसूचनेद्वारे सदर कालावधी दिनांक २० ऑक्टोबर २०१८ पयर्ंत वाढविला आहे ;
आणि ज्याअर्थी, उद्योजकाने कि.मी. ०/००० ते २३/३०० या लांबीतील शिर्डी-राहता बावळण रस्त्याच्या दुपदरीकरणाचे काम दिलेल्या १२० दिवसांच्या मुदतीत पूर्ण केलेले नसल्याने सदर काम सा.बां. विभागामार्फत स्वंतत्र निविदा काढून उद्योजकाच्या जबाबदारीवर व खर्चाने (Risk & Cost) करण्यात यावे व बावळण रस्ता पूर्ण करण्यासाठी येणाया खर्चाची रक्कम प्रकल्पासाठी कार, जीप व हलकी वाहने तसेच एस.टी. व स्कूल बसेस यांना पथकरातून सूट देण्यापोटी उद्योजकास देय असलेल्या नुकसानभरपाईतून वसूल करावी ;
आणि ज्याअर्थी, महाराष्ट्र शासनास, सदर पथकर वसुली कालावधी दिनांक ३० सप्टेंबर २०१९ पयर्ंत वाढविणे योग्य वाटत आहे.
त्याअर्थी, महाराष्ट्र मोटार वाहन कर अधिनियम, (१९५८ चा ६५) यांच्या कलम-२० ची पोट-कलमे (१-अ), (१-ब), (१-क), (१-ड) आणि (१-इ) द्वारे प्रदान करण्यात आलेल्या आणि त्याला समर्थनीय करणाया अधिकारांचा वापर करून महाराष्ट्र शासन याद्वारे घोषीत करते की, खाजगीकरणाच्या माध्यमातून "बी.ओ.टी." या योजनेतून कोपरगाव अहमदनगर टोलवेज प्रा. लि. (फेज-१) यांनी स्वखर्चाने जिल्ह्यतील कोपरगाव अहमदनगर रस्ता राज्य मार्ग क्र. १०, कि.मी. ७८/२०० ते १२०/००० चे चौपदरीकरण करणे व शिर्डी राहता बावळण रस्ता दुपदरीकरण करणे कि.मी. ०/००० ते २३/३०० (भाग-१) प्रकल्पाच्या रस्त्याचा वापर करणाया व खालील अनुसूचीच्या स्तंभ (२) मध्ये अनुक्रमे विर्िनदिष्ट केलेल्या प्रकाराच्या मोटार वाहनांवर आणि वाहनांकडून ओढून नेल्या जाणाया, अनुयानांवर अनुसूचीच्या स्तंभ (३) मध्ये त्यांच्या समोर विर्िनदिष्ट केलेल्या दराने दिनांक २१ ऑक्टोबर २०१८ पासून ते दिनांक ३० सप्टेंबर २०१९ पयर्ंतच्या कालावधीसाठी कोपरगांव अहमदनगर या रस्त्यावरील कि.मी. ११०/०० (बाभळेश्वर) येथे बांधण्यात आलेल्या पथकर वसुली स्थानकावर पथकर शुल्क वसुली करण्याकरिता प्राधिकृत करण्यात येत आहे.

(अ) कार, जीप, (चालक वगळून १२ प्रवासी क्षमता असलेली वाहने) जसे की, टाटा सुमो, पथकर नाही पथकर नाही कमांडर, ट्रॅक्स, सहा आसनी रिक्षा (टमटम) इत्यादी.
(ब) मिनी बस किंवा इतर तत्सम वाहने (चालक वगळून १२ पेक्षा जास्त परंतु २० प्रवासी ५५.०० ६५ क्षमतेपयर्ंतची वाहने) आणि अ. क्र. १, ३ व ४ मध्ये नमूद केलेल्या वाहनाव्यतिरिक्त्त माल वाहतूक करणारी वाहने.

१०५.०० १२५ ४. मोटार वाहन अधिनियम, १९८८ (१९८८ चा ५९) मध्ये व्याख्या केल्याप्रमाणे व उपरोक्त्त १८०.०० २१५ अ. क्र. ३ मध्ये नमूद केलेले ट्रक वगळून माल वाहतूक व प्रवासी वाहतूक करणारी अवजड
वाहने जसे ट्रक-ट्रेलर, दोन पेक्षा अधिक आसांची वाहने इत्यादी.
(१) वरील दर्शविलेल्या पथकर नाक्यावर पथकर शुल्क गोळा करण्याचा व पथकर शुल्काची संपूर्ण रक्कम Escrow Account मध्ये जमा करणेचा हक्क कोपरगांव अहमदनगर टोलवेज प्रायव्हेट लिमिटेड, (फेज-१) गुरगाव यांना प्रदान करण्यात आला आहे.
(२) खालील वाहनांना पथकरातून सूट देण्यात येईल.
१. भारताचे राष्ट्रपती, उप राष्ट्रपती, राज्यांचे राज्यपाल व वाहनांना लाल दिवा अनुज्ञेय असलेल्या अति महवाच्या लोकप्रतिनीधींची वाहने,
२. लोकसभा व राज्यसभेचे विद्यमान सदस्य तसेच महाराष्ट्र विधानसभा व महाराष्ट्र विधानपरिषदेचे विद्यमान सदस्य प्रवास करीत असलेली वाहने,
३. लोकसभा व राज्यसभेचे माजी सदस्य तसेच महाराष्ट्र विधानसभा व महाराष्ट्र विधानपरिषदेचे माजी सदस्य व लोकसभा व राज्यसभेचे माजी सदस्य,
४. केंद्र व राज्य शासनाची वाहने,
५. लष्कराच्या मालकीची वाहने,
६. महाराष्ट्र राज्य मार्ग परिवहन महामंडळाच्या बसेस व स्कूल बसेस,
७. पोलीस विभागाची वाहने,
८. टपाल आणि तार खात्याची वाहने,
९. रुग्णवाहिका,
१०. शववाहिका,
११. अग्निशमन दलाची वाहने.
(३) पथकर दराचा फलक पथकर नाक्यावर सवार्ंना दिसेल अशा पद्धतीने लावण्यात यावा. तसेच वाहनधारकांस प्रत्येक वेळी पथकर शुल्क वसुलीची संगणकिकृत पावती देण्यात यावी.
(४) पथकर नाक्यावर सवार्ंना दिसेल अशा पद्धतीने इलेक्ट्रॉनिक फलक लावण्यात यावा.
टीप :—
पथकर शुल्काच्या दरामध्ये खालीलप्रमाणे सूट देण्यात येईल :—
(१) पथकराच्या ५० कुपन्सची पुस्तिका आगावू खरेदी करणायास पुस्तिकेच्या किंमतीमध्ये १० टक्के सवलत देण्यात येईल.
(२) पथकराच्या १०० कुपन्सची पुस्तिका आगावू खरेदी करणायास पुस्तिकेच्या किंमतीमध्ये २० टक्के सवलत देण्यात येईल.
(३) वारंवार प्रवास करणाया वाहनांसाठी परतीच्या प्रवासाचे व दैनिक पासाचे दर हे त्या वाहनाच्या एकेरी प्रवास दराच्या अनुक्रमे दीड पट व अडीच पट राहतील. परतीच्या प्रवासाचा पास व दैनिक पास हा ज्या दिवशी पास काढला जाईल त्या दिवशीच्या रात्री १२-०० वाजेपयर्ंत ग्रा राहील.
(४) मासिक पासाचे दर एकेरी प्रवास दराच्या ५० पट राहतील.

NOTIFICATION
MAHARASHTRA MOTOR VEHICLES TAX ACT.
No.PSP-2005/CR-193/L.B.6/Road-9.—Whereas the Governor of Maharashtra through Secretary, Public Works Department, Mantralaya, Mumbai and M/s. Pranjal Infrastructure Private Limited (SPV- Ram Infrastructure Limited), having its Registered Office at 6, Shreyas Building, Ganeshwadi, Opposite Radhakrushna Mangal Karyalaya, Jalgaon 425 001, have entered into Concession Agreement, on the 19th April 2007, for four lanning of Kopargaon-Ahmednagar Road, State Highway No. 10, in Kilometers 78/200 to 120/000 and construction of two lane Shirdi-Rahata Bypass in Kilometers 0/000 to 23/230 (Phase I) (hereinafter referred to as "the said road"), under the "Built, Operate and Transfer (BOT) Scheme" by M/s. Pranjal Infrastructure Private Limited, Jalgaon ;
And whereas, as per the said agreement, the total concession period of 10 years, 1 months and 18 days including the construction period of three years was granted to the concessionaire to construct, operate and maintain the said road from the date of commencement of the work, i.e. from the 10th May 2007 ;
And whereas, the financial institution (Lender-UCO Bank) of the said project has, as per condition 4.1 of the supplementary agreement, dated the 16th March 2009 after occurrence of the Event of Default, by the original concessionaire M/s. Pranjal Infrastructure Private Limited, Jalgaon, recommended the prospective entrepreneur M/s. Kopargaon-Ahmednagar Tollways (Phase I) Private Limited, Gurgaon (SPV of M/s. Supreme Infrastructure India Limited) to the Government and the Government has accepted the said entrepreneur. Therefore, the Union Bank of India alongwith the Governor of Maharashtra through Secretary, Public Works Department, Mantralaya, Mumbai, has entered into the supplementary agreement with M/s. Kopargaon-Ahmednagar Tollways (Phase I) Private Limited, having its registered office at 903-905, Millenium Tower-B, 9th Floor, Opposite IFFCO Chowk, Metro Station, M.G. Road, Gurgaon 122 002, Haryana, on the 28th July 2014, including all the subsequent agreements entered between them, for replacing M/s. Pranjal Infrastructure Private Limited, Jalgaon, subject to the same terms and conditions, for four lanning of Kopargaon-Ahmadnagar Road, State Highway No. 10, in Kilometers 78/200 to 120/000 and construction of two lanned Shirdi-Rahata Bypass in Kilometers 0/000 to 23/230 (Phase I), under the Built, Operate and Transfer (BOT) Scheme ;
And whereas, as per the said agreement the concession period of 07 years 01 months and 18 days granted to the concessionaire to construct, operate and maintain the said road from the date of commencement of the work, i.e. 3rd March 2014 ;
And whereas, the Government of Maharashtra is of the opinion that the construction, operation and maintenance of the said road is the special service to the public and, therefore, after completion of the construction work of the said road, consideres it expedient to levy and collect the toll on the said road at the said toll collection centre constructed at Kilometer 110/000 near Babhaleshwar village on the said road ;
And whereas, the Government of Maharashtra has, vide Government Notification, Public Works Department, No. PSP-2005/CR-193/L.B.6/Road-9, dated the 20th September 2017, issued in exercise of the powers conferred by sub-sections (1-A), (1-B), (1-C), (1-D) and (1-E) of section 20 of the Maharashtra Motor Vehicles Tax Act (LXV of 1958), levied and collected the toll on the classes of motor vehicles specified in column (2) of the Schedule appended thereto and on the tailors drawn by such motor vehicles, passing over the said road, at the rates specified against each of the said vehicle in column (3) of the said Schedule, with effect from the 21st September 2017 to the 20th January 2018 at the toll collection centre situated at Kilometer 110/000 near Babhaleshwar village on the said road ;
And whereas, the Government of Maharashtra has, vide Government Notifications, dated the 20th January 2018 and 09th May 2018 extended the said period upto the 20th October 2018.
And whereas, M/s. Kopargaon-Ahmednagar Tollways (Phase I) Private Limited, Gurgaon as a concessionaire did not complete the work of construction of Shirdi-Rahata Bypass road inमहाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, ऑक्टोबर २०, २०१८/अशि्वन २८, शके १९४० ५ kilometers 0/000 to 23/300 within the given time period of 120 days from the date of starting of toll collection from 21st September 2017 to 20th January 2018. The Government of Maharashtra has decided to complete the balanced work departmentally at Risk and Cost of concessionaire by inviting seperate tender. The cost of construction of balanced work of Shirdi-Rahata Bypass road will be recovered from the compensation to be given to the concessionaire by the Government of Maharashtra for the exemption of toll to Car, Jeep, S.T. Buses and School Buses ;
And whereas, the Government of Maharashtra considers it expedient to extend the said period upto the 30th September 2019 ;
Now, therefore in exercise of the powers conferred by sub-sections (1-A), (1-B), (1-C), (1-D) and (1-E) of section 20 of the Maharashtra Motor Vehicles Tax Act (LXV of 1958), the Government of Maharashtra hereby declares that the toll shall be levied, on the classes of motor vehicles specified in column (2) of the Schedule appended hereto and on the tailors drawn by such motor vehicles, passing over the said road, constructed under the "Built, Operate and Transfer (BOT) Scheme" by M/s. Kopargaon-Ahmadnagar Tollways (Phase I) Private Limited, Gurgaon, at their expenses, at the rates specified against each of the said vehicle in column (3) of the said Schedule, and collected at the toll collection centre constructed at Kilometer 110/000 near Babhaleshwar village on the said road, with effect from the 21st October 2018 to 30th September 2019.

1. For the purpose of this Notification, M/s. Kopargaon-Ahmadnagar Tollways (Phase-I) Private Limited, Gurgaon, is authorized to collect the toll, at the toll collection centre constructed at Kilometer110/000 (Babhaleshwar) on the above mentioned road and deposite the same in the Escrow Account.
2. The following types of vehicles are exempted from payment of toll, namely:-
(i) VVIP vehicles carrying President of India, Vice-President of India, Governor of State, Public Representatives entitled for red lamp on their vehicles.
(ii) Vehicles carrying sitting Members of Parliament, Maharashtra Legislative Assembly and Maharashtra Legislative Council.
(iii) Vehicles carrying Ex-Member of Parliament, Maharashtra Legislative Assembly and Maharashtra Legislative Council.
(iv) State and Central Government vehicles.

(vi) Maharashtra State Road Transport Corporation Buses and School Buses.
(vii) Police Department vehicles.
(viii) Post and Telegraph Department vehicles.
(ix) Ambulances.
(x) Hearses.
(xi) Fire fighting vehicles.
3. The above mentioned rates shall be displayed on boards clearly visible to the people in the vicinity of the toll collection centre. A computerised toll receipt shall be issued on each and every occasion of recovery of toll.
4. Electronic Display Board clearly visible to the people shall be installed in vicinity of toll collection centre.
Notes.—Concessions in rates of toll are as given below, namely :—
(i) 10 per cent. rebate will be given to the purchaser of booklet containing 50 coupons in advance.
(ii) 20 per cent. rebate will be given to the purchaser of a booklet containing 100 coupons in advance.
(iii) For frequently traveling vehicles, return and daily pass will be 1.5 times and 2.5 times of their respective one way travel rates. Return journey pass and daily pass will be valid upto 12.00 hours at midnight for the day of issuing the pass.
(iv) Rate of monthly pass will be 50 times of their respective one way travel rates.
