क्रमांक खाक्षेस.२००८/प्र. क्र. ७९/भाग-७/रस्ते ९.-----ज्या अर्थी महाराष्ट्राचे राज्यपाल यांच्या वतीने सचिव, सार्वजनिक बांधकाम विभाग, मंत्रालय, मुंबई आणि मेसर्स कल्याण-केटी टोल प्रा. लि., ज्यांचे नोंदणीकृत कार्यालय विद्या दिप, १५/३, मनोरमागंज, इंदौर, मध्य प्रदेश ४५२ ००१, भारत येथे आहे, यांचेमध्ये " डी.बी.एफ.ओ.टी. " या तत्वावर नांदेड-नरसी रस्त्याचे (प्र.रा.मा.क्र. ६) कि.मी. २६४/००० ते ३०७/ ००० या लांबीमध्ये चौपदरीकरण आणि नरसी-देगलूर रस्ता ते जिल्हा हद्द कि.मी. ३०७/००० ते ३४१/७०० या लांबीमध्ये दुपदरीकरण (यापुढे " " म्हणून संबोधण्यात येईल) या प्रकल्पाचा करारनामा दिनांक १६ जून २०११ रोजी साक्षांकित करण्यात आलेला आहे;
आणि, ज्याअर्थी, सदर करानाम्यानुसार सदर रस्त्याचे बांधकाम, वापर व देखभाल दुरुस्तीकरिता उद्योजकास २५ वर्षे इतका सवलत कालावधी, २ वषार्ंचा बांधकाम कालावधीसह उद्योजकास दिनांक ३ नोव्हेंबर, २०११ या प्रकल्प सुरू होण्याच्या दिनांकापासून मंजूर करण्यात आलेला आहे ;
आणि ज्याअर्थी, महाराष्ट्र शासनातर्फे शासन अधिसूचना, सार्वजनिक बांधकाम विभाग, क्र. खाक्षेस.२००८/प्र. क्र. ७९/एल.बी.-२/रस्ते-९, दिनांक ३ जून, २०१३ अन्वये सदर अधिसूचनेसोबतच्या अनुसूचीच्या स्तंभ क्र. २ मध्ये विर्िनदिष्ट केलेल्या प्रकारांच्या मोटार वाहनांवर आणि रस्त्याचा वापर करणाया वाहनांकडून ओढून नेल्या जाणाया अनुयानांवर दिनांक ४ जून २०१३ ते ३ सप्टेंबर २०१३ या कालावधीकरिता तसेच तद्नंतर दिनांक ३ सप्टेंबर २०१३, १५ ऑक्टोबर २०१३, १३ मे २०१४, २८ ऑक्टोबर २०१४, २८ ऑक्टोबर २०१५, २८ ऑक्टोबर २०१६ आणि २८ ऑक्टोबर २०१७ अन्वये निर्गमित करण्यात आलेल्या शासन अधिसूचनांद्वारे २८ ऑक्टोबर २०१८ पयर्ंत पथकर आकारण्यात आला आहे;
आणि ज्याअर्थी, महाराष्ट्र शासनास सदर कालावधी दिनांक ३१ मार्च २०२२ पयर्ंत वाढविणे योग्य वाटत आहे ;

भाग चार--ब--३९७-१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, ऑक्टोबर २९, २०१८/कर्ातिक ७, शके १९४० आणि ज्याअर्थी, महाराष्ट्र शासनाची अशी धारणा आहे की, सदर रस्त्याचे बांधकाम, वापर आणि देखभाल दुरुस्ती ही जनतेला दिलेली विशेष सेवा आहे, आणि त्यामुळे सदर रस्त्यावर कि.मी. २८७/४०० (बरबडा) येथे आणि कि.मी. ३३१/४०० येथील पथकर स्थानकावर पथकर आकारणे व वसुली करणे महाराष्ट्र शासनास योग्य वाटत आहे ;
आणि त्याअर्थी, महाराष्ट्र मोटार वाहन कर अधिनियम, (१९५८ चा ६५) यांच्या कलम-२० ची पोटकलमे (१-अ), (१-ब), (१-क), (१-ड) आणि (१-इ) द्वारे प्रदान करण्यात आलेल्या आणि त्याला समर्थनीय करणाया अधिकारांचा वापर करून महाराष्ट्र शासन याद्वारे घोषित करते की, खाजगीकरणाच्या माध्यमातून " डी.बी.एफ.ओ.टी. " या योजनेतून कल्याण-केटी टोल प्रायव्हेट लिमिटेड, इंदौर, यांनी स्वखर्चाने नांदेड जिल्ह्यतील नांदेड ते नरसी किलोमीटर २६४/०० ते ३०७/०० चे चौपदरीकरण व नरसी ते देगलूर राज्यसीमा किलोमीटर ३०७/०० ते ३४१/७०० बांधलेल्या रस्त्याचा वापर करणाया व खालील अनुसूचीच्या स्तंभ (२) मध्ये अनुक्रमे विर्िनदिष्ट केलेल्या प्रकाराच्या मोटार वाहनांवर आणि वाहनांकडून ओढून नेल्या जाणाया, अनुयानांवर त्यांच्या समोर विर्िनदिष्ट केलेल्या दराने दिनांक २९ ऑक्टोबर २०१८ पासून दिनांक ३१ मार्च २०२२ पयर्ंतच्या कालावधीसाठी नांदेड नरसी या रस्त्यावरील किलोमीटर २८७/४०० (बरबडा) व किलोमीटर ३३१/४०० येथे बांधण्यात आलेल्या पथकर वसुली स्थानकावर पथकर शुल्क वसुली करण्याकरिता प्राधिकृत करण्यात येत आहे.
अनुसूची
१. वरील दर्शविलेल्या पथकर नाक्यावर पथकर शुल्क गोळा करण्याचा व पथकर शुल्काची संपूर्ण रक्कम ठेवून घेण्याचा हक्क मे. कल्याण-केटी टोल प्रायव्हेट लिमिटेड, इंदोर यांना प्रदान करण्यात आला आहे.
२. खालील वाहनांना पथकरातून सूट देण्यात येईल------
(१) भारताचे राष्ट्रपती, उपराष्ट्रपती, राज्यांचे राज्यपाल व वाहनांना लाल दिवा अनुज्ञेय असलेल्या अति महत्वाच्या लोकप्रतिनीधींची वाहने.
(२) लोकसभा व राज्यसभेचे विद्यमान सदस्य तसेच महाराष्ट्र विधानसभा व महाराष्ट्र विधानपरिषदेचे विद्यमान सदस्य प्रवास करीत असलेली वाहने.

(४) महाराष्ट्र राज्य रस्ते वाहतूक महामंडळाच्या (एसटी) प्रवासी बसेस.
(५) स्कूल बसेस.
(६) केंद्र व राज्य शासनाची वाहने.
(७) लष्कराच्या मालकीची वाहने.
(८) पोलीस विभागाची वाहने.
(९) टपाल आणि तार खात्याची वाहने.
(१०) रुग्णवाहिका.
(११) शववाहिका.
(१२) अग्निशमन दलाची वाहने.
३. पथकर दराचा फलक पथकर नाक्यावर सवार्ंना दिसेल अशा पद्धतीने लावण्यात यावा. तसेच वाहन धारकांस प्रत्येक वेळी पथकर शुल्क वसुलीची संगणकीकृत पावती देण्यात यावी.
४. पथकर नाक्यावर सवार्ंना दिसेल अशा पद्धतीने इलेक्ट्रॉनिक फलक लावण्यात यावा.
टीप :---
पथकर शुल्काच्या दरामध्ये खालीलप्रमाणे सूट देण्यात येईल.-----
(१) पथकराच्या ५० कुपन्सची पुस्तिका आगाऊ खरेदी करणायास पुस्तिकेच्या किंमतीमध्ये १० टक्के सवलत देण्यात येईल.
(२) पथकराच्या १०० कुपन्सची पुस्तिका आगाऊ खरेदी करणायास पुस्तिकेच्या किंमतीमध्ये २० टक्के सवलत देण्यात येईल.
(३) वारंवार प्रवास करणाया वाहनांसाठी परतीच्या प्रवासाचे व दैनिक पासाचे दर हे त्या वाहनाच्या एकेरी प्रवास दराच्या अनुक्रमे दीड पट व अडीच पट राहतील. परतीच्या प्रवासाचा पास व दैनिक पास हा ज्या दिवशी पास काढला जाईल त्या दिवशीच्या रात्री १२.०० वाजेपयर्ंत ग्रा राहील.
(४) मासिक पासाचे दर एकेरी प्रवास दराच्या ५० पट राहतील.
(५) पथकर स्थानकापासून ५ कि.मी. त्रिज्येमधील स्थानिक वाहनांना पथकराच्या एकेरी दराच्या १० पट मासिक पासची तरतूद (वरील वाहन प्रकार अ.क्र.३, ४ व ५ वगळून) करण्यात यावी. (ही सवलत फ स्वत:च्या मालकी वाहनांकरिता राहील) सदर सवलतीसाठी स्थानिक रहिवाशांची वाहने ठरविताना खालीलप्रमाणे निकष लावण्यात यावेत------
(अ) सदर वाहनाची नोंदणी त्या परिसरात केलेली असावी.
(ब) सदर वाहन त्या परिसरात नोंदणी केलेले नसल्यास ज्या व्यीच्या नावाने वाहन आहे तो त्या परिसरातील रहिवाशी असल्याबाबत रेशन कार्डाचा किंवा अन्य पुरावा देणे आवश्यक राहील.

NOTIFICATION
MAHARASHTRA MOTOR VEHICLES TAX ACT.
No. PSP-2008/CR-79/Part-7/Road-9.—Whereas the Governor of Maharashtra through Secretary, Public Works Department, Mantralaya, Mumbai and M/s Kalyan-Keti Toll Private Limited, having its registered office at "Vidya Deep, 15/3, Manoramaganj, Indore (M.P.) 452 001, India" have entered into Concession Agreement on the 16th June 2011, including all the subsequent agreements entered between them, for construction, operation and maintenance of four lanning of Nanded-Narsi Road (Major State Highway No. 6) in kilometers 264/000 to 307/000 and two lanning of Narsi-Degloor Road upto the State Border, in kilometers 307/00 to 341/700 (hereinafter referred to as "the said road"), under the Design, Build, Finance, Operate and Transfer (DBFOT) Scheme by M/s Kalyan-Keti Toll Private Limited, Indore ;
And whereas, as per the said agreement, the concession period of 25 years has been granted to the concessionaire to construct, operate and maintain the said road from the date of commencement of the work. i.e., on the 3rd Novermber 2011, which includes the period of construction of two years ;
And whereas, the Government of Maharashtra vide Government Notification, Public Works Department, No. PSP. 2008/CR-79/L.B. 2/Road-9, dated the 3rd June 2013, has levied the toll on the classes of motor vehicles specified in column (2) of the Schedule appended thereto and on the tailors drawn by such motor vehicles, passing over the said road with effect from the 4th June 2013 to the 3rd September 2013 and thereafter by the Government Notifications, dated the 3rd September 2013, 15th October 2013, 13th May 2014, 28th October 2014, 28th October 2015, 28th October 2016 and 28th October 2017 upto 28th October 2018 ;
And whereas, the Government of Maharashtra considers it expedient to extend the said period upto 31st March 2022 ;
And whereas, the Government of Maharashtra is of the opinion that the construction, operation and maintenance of the said road is special service to the public and, therefore, considers it expedient to levy and collect the toll on the said road at the toll collection centres constructed at kilometer 287/400 (Barbada) and at kilometer 331/400 ;
Now, therefore, in exercise of the powers conferred by sub-sections (1-A), (1-B), (1-C), (1-D) and (1-E) of section 20 of the Maharashtra Motor Vehicles Tax Act (LXV of 1958), the Government of Maharashtra hereby declares that the toll shall be levied on the classes of motor vehicles specified in column (2) of the Schedule appended hereto and on the tailors drawn by such motor vehicles, passing over the said road constructed under " Design, Built, Finance, Operate and Transfer (DBFOT) Scheme" by M/s Kalyan-Keti Toll Private Limited, Indore, at their expenses, at the toll collection centres constructed at kilometer 287/ 400 (Barbada) and at kilometer 331/400 on the said road for the period commencing from the 29th October 2018 and ending on the 31st March 2022.

3 Trucks (two axle), Buses.

in the Motor Vehicles Act, 1988(59 of 1988), such as three axle 210 250 except vehicles covered by the entry at serial number 3 above.
5 Heavy goods vehicles and heavy passenger motor vehicles as 320 380 defined in the Motor Vehicles Act, 1988 (59 of 1988), such as
Truck-Trailer combination, multi-axle vehicles having more than
three axles and except vehicles covered by the entries at serial
numbers 3 and 4 above.
1. For the purpose of this notification, M/s. Kalyan-Keti Toll Private Limited, Indore is authorized to collect and retain the amount of toll at the toll collection centres constructed at kilometer 287/400 (Barbada) and at kilometer 331/400 on above mentioned road.
2. The following types of vehicles are exempted from payment of toll, namely :—
(i) VVIP vehicles carrying President of India, Vice-President of India, Governor of State, Public Representatives entitled for red lamp on their vehicles.
(ii) Vehicles carrying sitting Members of Parliament, Maharashtra Legislative Assembly and Maharashtra Legislative Council.
(iii) Vehicles carrying Ex-Members of Maharashtra Legislative Assembly, Maharashtra Legislative Council and Parliament.
(iv) Buses of the Maharashtra State Road Transport Corporation (ST).
(v) School Buses.

(vii) Defence vehicles.
(viii) Police Department vehicles.
(ix) Post and Telegraph Department vehicles.
(x) Ambulances.
(xi) Hearses.
(xii) Fire fighting vehicles.
3. The above mentioned rates of toll shall be displayed on boards clearly visible to the people in the vicinity of the toll collection centre. A computerised toll receipt shall be passed on each and every occasion of recovery of toll.
4. Electronic Display Board shall be installed in vicinity of toll collection centre.
Notes.—Concessions in rates of toll are as given below, namely :—
(i) 10 per cent. rebate will be given to the purchaser of booklet containing 50 coupons in advance.
(ii) 20 per cent. rebate will be given to the purchaser of a booklet containing 100 coupons in advance.
(iii) For frequently traveling vehicles, return and daily pass will be 1.5 times and 2.5 times of their respective one way travel rates. Return journey pass and daily pass will be valid up to 12.00 hours at midnight for the day of issuing the pass.
(iv) Rate of monthly pass will be 50 times of their respective one way travel rates.
(v) The monthly pass concession shall be given to the local vehicles (except for types of vehicles mentioned in Sr.No.3, 4 and 5 of the schedule above within radius of 5.00 kilometer from the toll stations and shall be charged 10 times of single journey rate subject to the following conditions (this concession will be for valid only for own vehicles). For local vehicles, norms given below shall be adopted—
(a) The vehicle shall be registered within that area.
(b) If it is not so then the owner shall give proof of residence by producing ration card or any other proof of residence.
