MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.

Whereas, Development Plan of Umred (Revised and Additional Area) City has been partly sanctioned by the Government vide Urban Development Department's Notification No. TPS-2498-287-CR-25-1998-UD-9, dated 08-07-2003 and has come into force with effect from 25-08-2003 (hereinafter referred to as "the said Development Plan") under Section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Maharashtra Act, No. XXXVII of 1966) (hereinafter referred to as "the said Act") ;
And whereas, in the said Development Plan, land bearing Survey Nos. 510/1, 510/2, 515 (part) & 495 (part) of Mouje Umred are reserved for site No. 29 Sports Complex (hereinafter referred to as "the said Reservation") ;
And whereas, the Umred Municipal Council, Umred being the Planning Authority (hereinafter referred to as "the said Planning Authority") vide its General Body Resolution No. 62, dated 17-10-2007 has resolved to delete Survey No. 510/1 area admeasuring 3.08 Hectare from the said Reservation and to include the same in Residential Zone. Accordingly after following all the legal procedure as per the provisions of sub-section (1) of Section 37 of the said Act, Submitted a modification proposal to the Government, for its sanction, (hereinafter referred to as "the Proposed Modification") ;
द्धन्रु]क्ष् रू न् +रून् ॅ-+ न् ह्यम््र ान्म््र, म्दन् १४, २०१८/ॅॅ २३, ॅ १९४० ३And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune and after obtaining approval from Hon'ble Cabinet on 31-05-2018, the Government is of opinion that the proposed Modification should be sanctioned with some conditions ;
And whereas, the Land Owners of the Survey No. 510/1 of the said reservation as per the Government policy have deposited Rs. 18,47,850 towards the 50% Government share of premium amount as per 5% rate of the said lands rates prescribed in the Annual Statement of Rates (ASR) for the year 2018-19 in the Government Treasury on 30-08-2018 through the Assistant Director of Town Planning, Nagpur Branch, Nagpur and remaining 50% of the premium amount Rs. 18,47,850 payable to the Planning Authority has been deposited with the Chief Officer, Umred Municipal Council, Umred on 28-08-2018.
Now therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government hereby, sanctions the said Proposed Modification and for that purpose amends the aforesaid Notification dated the 08-07-2003 as follows ;
In the Schedule of Modifications appended to the Notification dated 08-07-2003 sanctioning the said Development Plan, the following new entry shall be added after the last entry.—
ENTRY
The land bearing Survey No. 510/1 of Mouje Umred area admeasuring 2.54 is deleted from Site No. 29 "Sports Complex" and included in Residential Zone, as shown on Plan, subject to the conditions mentioned below.—
Condition No. 1.—In addition to open space, necessary Amenity Space shall be provided in the layout of the said Land as per the prevailing Development Control Regulations for Umred.
Condition No. 2.—Amenity Space shall be developed by the Land Owner/Developer.
A copy of the Notification, alongwith the part plan showing the aforesaid sanctioned modification, shall be available for inspection of the general public, in the office of the Chief Officer, Umred Municipal Council, Umred during office hours on all working days for a period of one month.
This Notification shall also be available on the Government website www.maharashtra.gov.in
