Modification under Section 37 of Maharashtra Regional And Town Planning Act, 1966
No. NMC-TPD-1576-2018.—
Whereas, the Revised Development Plan of Nagpur City prepared under the provisions of Maharashtra Regional and Town Planning Act, 1966. Under Section 31(1) has been partially sanctioned by the Govt. vide Urban Development Departments Notification No. TPS-2496-2643-CR-300(a)-97-UD-9, Dt. 7th January 2000 and came into force from 1st March 2000. Excluded part of Development Plan has been sanctioned vide Government Notification No.TPS-2400-1628-Cr-200-2000-UD-9, dt. 10th Septem- ber 2001 and Came into force from dt. 21st September 2001. Also Nagpur Municipal Corporation has been declared as the "Planning Authority" for Nagpur City except the areas covered under seven scheme vide Govt. Notification No. TPS-2401/855/CR-76/UD-9, dt. 27th Feb. 2002.
And Whereas, in the said Revised Sanctioned Development Plan, the Municipal Corporation is desirous of making some modification u/s 37 of Maharashtra Regional and Town Planning Act, 1966 as detailed below :-
"In the sanctioned Development Plan of the Nagpur City, on the land admeasuring 0.498 Hector of Mouza Ajni, bearing Khasara No. 3 is occupied by Laxminagar Zopadpatti and said land is designated as a "School" under Public/Semipublic land use. Which is proposed to be deleted and to be included in 'Residential zone' as per Section 37 of the Maharashtra Regional and Town Planning Act, 1966. The ownership of the said land is of Nagpur Improvement Trust, Nagpur. The letter received from Nagpur Improvement Trust, Nagpur No. ह्यम्.+.() 882, Dt. 29-05-2018 to change the use of said land which is designated as "School" under Public/Semipublic Zone to be deleted and to be included in 'Residential zone' as per Section 37 of the Maharashtra Regional and Town Planning Act, 1966. The said land is under the "Civil Station Expansion Scheme' of Nagpur Improvement Trust, Nagpur and the Planning Authority for this area is Nagpur Municipal Corporation.
And Whereas, as per Section 37 of the Maharashtra Regional and Town Planning Act, 1966, Nagpur Municipal Corporation, has decided to modify the land use for land bearing Khasara No. 3, of Mouza Ajni admeasuring 0.498 Hector which is designated as a "School" under Public/Semipublic Zone in sanctioned Development Plan of Nagpur City and to be included in "Residential Zone".
The Nagpur Municipal Corporation has passed the resolution vide Resolution No. 227, dt. 24-09- 2018 to make the aforesaid modification.
Now, therefore, the part plan of Development Plan of Nagpur City showing the aforesaid modification are kept open at the office of the Town Planning Deptt. of Nagpur Municipal Corporation for inspection by public during office hours on all working days. The suggestions and objections which may be received to Municipal Corporation in respect of the said modification to the Development Plan within a period of one month from the date of publicaion of this notice, in the " Maharashtra Government Gazette " will be heard by the Municipal Commissioner before submitting the said modification proposal, to the State Government for sanction.

And Whereas, as per Section 37 of the Maharashtra Regional and Town Planning Act, 1966, Nagpur Municipal Corporation, has decided to modify the land use for land admeasuring 1.22 Hectare of Mouza Jaitala, bearing Khasara No.7(P) Reservation No. MW-23 "Extention to NMC" which is to be deleted and to be included in "Public/Semipublic Zone".
The Nagpur Municipal Corporation has passed the resolution vide Resolution No. 264, dt. 24-09- 2018 to make the aforesaid modification.
Now, therefore, the part plan of Development Plan of Nagpur City showing the aforesaid modification are kept open at the office of the Town Planning Deptt. of Nagpur Municipal Corporation for inspection by public during office hours on all working days.
