क्र.नोंदणी.२०१६/३०४८/प्र.क्र.७८०/म-१.-----ज्याअर्थी, महाराष्ट्र शासनाने, शासन निर्णय, सार्वजनिक बांधकाम विभाग, क्रमांक खाक्षेस. २०१६/प्र.क्र.४६७/रस्ते-८, दिनांक १९ ऑगस्ट २०१६ याद्वारे, महाराष्ट्र राज्य रस्ते विकास महामंडळ मर्यादित (यात ज्याचा उल्लेख यापुढे ""उक्त महामार्ग प्राधिकरण"" असा करण्यात आला आहे) यास, ""नागपूर-मुंबई शिघ्रसंचार द्रुतगती महामार्गा"" करीता ""कार्यान्वयीन यंत्रणा"" म्हणून घोषित करण्यात आले आहे ;
आणि ज्याअर्थी, महाराष्ट्र शासनाने, शासन निर्णय, सार्वजनिक बांधकाम विभाग क्रमांक खाक्षेस.२०१६/प्र.क्र.२५१/रस्ते-८, दिनांक २४ मार्च २०१७ याद्वारे, ""नागपूर-मुंबई शिघ्रसंचार द्रुतगती महामार्ग"" याचे ""महाराष्ट्र समृद्धी महामार्ग"" असे नामकरण केले आहे;
आणि ज्याअर्थी, महाराष्ट्र शासनाने, शासन निर्णय, सार्वजनिक बांधकाम विभाग, क्रमांक खाक्षेस.२०१६/प्र.क्र.२५१(एल.बी.२२)भाग-१/ रस्ते-८, दिनांक १ ऑक्टोबर २०१८ याद्वारे, महाराष्ट्र समृद्धी महामार्गाबाबत उक्त महामार्ग प्राधिकरण आणि नागपूर-मुंबई शिघ्रसंचार द्रुतगती महामार्ग मर्यादित (यात ज्याचा उल्लेख यापुढे ""उक्त द्रुतगती महामार्ग मर्यादित"" असा करण्यात आला आहे) यांच्या दरम्यान करण्यात आलेल्या, जमिनीच्या हस्तांतरणाच्या संलेखावर मुद्रांक शुल्क व नोंदणी फी माफ करण्याचे ठरविले आहे ;
आता, त्याअर्थी, नोंदणी अधिनियम, १९०८ (१९०८ चा १६) (यात ज्याचा उल्लेख यापुढे ""उक्त अधिनियम"" असा करण्यात आला आहे) तो, महाराष्ट्र राज्यास लागू असताना, त्याच्या कलम ७८ च्या खंड (क) द्वारे प्रदान करण्यात आलेल्या अधिकारांचा, आणि याबाबतीत त्यास समर्थ करणाया इतर सर्व अधिकारांचा वापर करून, महाराष्ट्र शासन, याद्वारे कलम ७८ अन्वये तयार केलेल्या आणि उक्त अधिनियमाच्या कलम ७९ द्वारे आवश्यक केल्याप्रमाणे, शासकीय अधिसूचना, महसूल व वन विभाग क्रमांक आरजीएन.१५५८/६७७३१-एन, दिनांक १७ जुलै, १९६१ (यात ज्याचा उल्लेख यापुढे ""उक्त अधिसूचना"" असा करण्यात आला आहे), अन्वये प्रसिद्ध केलेल्या शुल्क तक्त्यामध्ये पुढीलप्रमाणे सुधारणा करीत आहे :----

भाग चार-अ----२१३--१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, नोव्हेंबर १६, २०१८/कर्ातिक २५, शके १९४० उक्त अधिसूचनेतील शुल्क तक्त्यामधील अनुच्छेद-१ मध्ये टीप-६४ नंतर अनुक्रमे पुढील टीप समाविष्ट करण्यात येत आहे :---
""टीप ६५.---- शासनाने, ""महाराष्ट्र समृद्धी महामार्गा"" करीता वेळोवेळी काढलेले शासन आदेश किंवा निर्णय किंवा अधिसूचना याद्वारे विर्िनदिष्ट केलेल्या कोणत्याही शतर्ींचा भंग झाल्यास, ""उक्त द्रुतगती महामार्ग मर्यादित"" हे संपूर्ण नोंदणी फी आणि असल्यास शास्ती भरण्यास पात्र असले, या अटी तथा शर्तीच्या अधीनतेने, महाराष्ट्र समृद्धी महामार्गाबाबत, महाराष्ट्र राज्य रस्ते विकास महामंडळ मर्यादित आणि नागपूर-मुंबई शिघ्रसंचार द्रुतगती महामार्ग मर्यादित यांच्या दरम्यान निष्पादित होणाया जमिनीच्या अभिहस्तांतरणाच्या किंवा भाडेपट्टयाच्या संलेखावर कोणतीही नोंदणी फी आकारणीयोग्य असणार नाही.""

NOTIFICATION
REGISTRATION ACT, 1908.
No.RGN.2016/3048/C.R.No.780/M-1.—Whereas, the Government of Maharashtra has, vide Government Resolution, Public Works Department, No.PPP.2016/C.R.467/Roads-8, dated the 19th August 2016 declared the Maharashtra State Road Development Corporation Limited (hereinafter referred to as "the said Highway Authority") as the Implementing Agency for the "Nagpur-Mumbai Super- Communication Expressway" ;
And whereas, the Government of Maharashtra has, vide Government Resolution, Public Works Department, No.PPP.2016/C.R.251/Roads-8, dated the 24th March 2017 nomenclatured the "Nagpur- Mumbai Super-Communication Expressway" as the "Maharashtra Samruddhi Mahamarg" ;
And whereas, Government of Maharashtra has, vide the Government Resolution, Public Works Department, No.PPP.2016/C.R.251(L.B.22),Part-1/Roads-8, dated the 1st October 2018 decided to exempt the Stamp duty and Registration fees on the instrument of transfer of the land executed between the said Highway Authority and the Nagpur-Mumbai Super-Communication Expressway Limited (hereinafter referred to as "the said Expressway Ltd.")in respect of the Maharashtra Samruddhi Mahamarg ;
Now, therefore, in exercise of the powers conferred by clause (a) of section 78 of the Registration Act, 1908 (XVI of 1908) (hereinafter referred to as "the said Act"), in its application of the State of Maharashtra, and of all other powers enabling it in this behalf, the Government of Maharashtra hereby amends the Table of Fees prepared under section 78 and published under Government Notification, Revenue and Forests Department, No. RGN.1558/67731-N, dated the 17th July 1961 (hereinafter referred to as "the said Notification") as required by section 79 of the said Act, as follows :—
In the said Notification in the Table of Fees in Article-I, after Note 64, the following shall be added, namely:—
Note 65.—No Registration fees shall be chargeable on the instrument of conveyance or lease of the land executed, in respect of the Maharashtra Samruddhi Mahamarg, for the documents executed between the Maharashtra State Road Development Corporation Limited and Nagpur-Mumbai Super Communication Expressway Limited, subject to the condition that in case of breach of any of the conditions specified by the Government, vide the Government order or Resolution or Notification issued, from time to time, for the Maharashtra Samruddhi Mahamarg, "the said Expressway Ltd." shall be liable to pay the whole of the registration fee and penalty, if any.
