MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.

No. TPS-2218-553-CR-153-UD-9-2018.—

Whereas, the Government of Maharashtra vide Notification Urban Development department No. TPS-2284-1823- C.R. 105-UD-9, date 29-12-1988, appointed Maharashtra Housing and Area Development Authority (MHADA) to be "the Sepcial Planning Authority" under the provision of Section 40(1) (aa) of Mahrashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") to undertake planned and orderly development of notified area of New Chandrapur as proposed inthe sanctioned Regional Plan of Chandraput-Ballarpur Region & the Government vide Urban Development Department's Notification No. TPS-2294-471-CR-159-UD-9, dated 30-6-1998 has sanctioned Development Plan for the aforeside notified area and has come into force with effect from the 1-9-1998 (hereinafter referred to as "the said Development Plan") ;

And whereas, in the said Development Plan, lands bearing Survey No. 147(pt.), 148(pt.), 150(pt.), 151, 152, 154 & 157 admeasuring about 17.00 Hectare of Mouje Kosara (hereinafter referred to as "the said Lands") are shown as Social Forestry and Water Front Development (hereinafter referred to as "the said use") ;

And whereas, the Maharashtra Housing & Area Development Authority (MHADA) being the Planning Authority for the said Development Plan (hereinafter referred to as "the said Special Planning Authority"), vide its General Body Resolution No. 6733, dated 29-3-2017 & Resolution No. 6765, dated 12-10-2017 has resolved to delete the said lands from the said use and to include in Residential Zone. Accordingly after following all the legal procedure as per the provisions of sub-section (1) of Section 37 of the said Act, and submitted to the Government, for its sanction, a modification proposal (hereinafter referred to as "the said Modification Proposal") ;

And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune the Government is of opinion that the proposed Modification should be sanctioned ;

And whereas, out of the said lands the Land Owner of the Survey No. 148/1, 151/1, 151/2, 152/1, 152/2, 154/1 & 154/2A admeasuring about 10.45 hectare shown in the said use have as per the Government policy deposited Rs. 21,16,775 towards the 50% premium amount of Government share worked out as per the 5% rate of the said lands as prescribed in the Annual Statement of Rates (ASR) for the year 2018-19 in the Government Treasury on 21-9-2018 through the Town Planner, Chandrapur Branch, Chandrapur and remaining 50% premium amount Rs. 21,16,775 payable to the Planning Authority has been deposited with the Chief Officer, Nagpur Housing Area Development Author- ity, (MHADA), Nagpur on 1-10-2018. However, the owner of the land bearing Survey No. 147(pt.), 150(pt.) & 154 (pt.) have not paid the premium for said proposed modification, hence the deletion for survey No. 147 (pt.) & 150 are kept in abeyance ;

Now, therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government hereby, sanctions the Proposed Modification and for that purpose amends the aforesaid Notification dated the 30-6-1998 as follows ;

In the Schedule of Modification appended to the Notification dated 30-6-1998 sanctioning the said Development Plan, the following new entry shall be added after the last entry–

ENTRY

" The part of land from Survey No. 147(pt.), 151 & 152 of Mouje Kosara which are adjoining to the Water Front Development Reservation up to the Blue Flood Line are included in Water Front Development Reservation and reamaining land bearing Survey No. 148(pt.), 151, 152 & 154(pt.) from Social Forestry are deleted and included Residential Zone, as shown on the plan, subject to conditions mentions below. "–

Condition No. 1–In addition to open space, necessary Amenity Space shall be provided in the layout of the said Land as per the prevailing Development Control Regulations for New Chandrapur.

Condition No. 2–It is obligatory on the land owner/developer, to provide all the Basic Amenities such as Water and Sewage disposal required for the said land at has own cost.

Condition No. 3–Before given development permission of the said land, the MHADA shall be given fresh remark regarding flood water line and flood area from Irrigation Department and compliance of same.

A copy of the Notification, along with the part plan showing the aforesaid sanctioned modification, shall be available for inspection of the general public, in the office of the Chief Officer, Nagpur Housing Area Development Authority, (MHADA) Nagpur, Grihnirman Bhavan, Civil Lines, Nagpur during office hours on all working days for a period of one month.

This notification shall also be available on the Government web site www.maharashtra.gov.in (ॅ म् ह्यद्ध).

Whereas, Revised Development Plan of Nagpur has been sanctioned by the Government vide Urban Development Department's Notification No. TPS-2496-2643-CR-300(A)-97-UD-9m dated the 7th January, 2000 and 2nd Notification No. TPS-2400-1628-C.R.-200-2000-UD-9, dated 10th September, 2001 has come into force with effect from the 1st March, 2000 and 21st September, 2001. Also Nagpur Improvement Trust has been declared as "Planning Authority" for the seven Improvement Schemes being completed by the Nagpur Improvement Trust vide Government Notification No. TPS-2401-855-C.R.-76-UD-9, dated 27-2-2002 (hereinafter referred to as "the said Development Plan") ;

And whereas, in the said Development Plan, land bearing Kharsara No. 70/1(pt.), 71/1(pt.) are admeasuring 1.925 Hector of Mouje Manewada (hereinafter referred to as "the said Land") is shown as Existing Nursery Garden ;

And whereas, the Nagpur Improvement Trust, Nagpur being the Planning Authority (hereinafter referred to as "the said Planning Authority"), vide its Board of Trustee's Resolution No. 2-1126, dated 30-11-2013 has resolved to delete the said land from Existing Nursery Garden and to include the same in Residential Zone. Accordingly after following all the legal procedure as per the provisions of sub-section (1) of Section 37 of the said Act, submitted to the Government, for its sanction, a modification proposal (hereinafter referred to as "the said Modification Proposal") ;

And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of opinion that the said Modification proposal should be sanctioned with some conditions ;

And whereas, the Land Owners of the said lands have deposited Rs. 32,70,000 towards the 50% Government share of premium amount worked out as per 5% rate of the said land as prescribed in the Annual Statement of Rates (ASR) for the year 2016-17 in the Government Treasury on 15-12-2016 through the Assistant Director of Town Planning, Nagpur Branch, Nagpur and remaining 50% of the premium amount worked out 5% of revised land rates of Annual Statement of Rates (ASR) for the year 2017-18 Rs. 34,33,500 payable to the Planning Authority has been deposited with the Nagpur Improvement Trust, Nagpur on 31-1-2018 ;

Now, therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government hereby, sanctions the Proposed Modification and for that purpose amends the aforesaid Notification dated the 7-1-2000 as follows ;

In the Schedule of Modifications appended to the Notification dated 7-1-2000 sanctioning the said Development Plan, the following new entry shall be added after the last entry–

ENTRY

" The land bearing Khasara No. 70/1(pt.) & 71/1 of Mouje Manewada and admeasuring about area 1.925 Hectate is deleted from Existing Nursery Garden and the land thus released, is included in Residential Zone as shown on the plan, subject to the conditions mentioned specified below. "–

Condition No. 1–In the layout of the said Land, in addition to 10% compulsory open space, requisite Amenity Space shall be provided as per the prevailing Development Control Regulations for Nagpur.

Condition No. 2–It is compulsory for the land owner/developer, to provide all the Basic Amenities required for the said land at his own cost. Such as basic amenities includes Roads, Water Supply and Sewage disposal etc. Accordingly under taking shall be submitted with the Nagpur Improvement Trust.

Condition No. 3–The Existing grown up Tree must be intact or may be replanted at the appropriate place.

A copy of the Notification, along with the part plan showing the aforesaid sanctioned modification, shall be available for inspection of the general public, in the office of the Chairman, Nagpur Improvement Trust, Nagpur during office hours on all working days for a period of one month.

MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.

Whereas, the Pardi, Bharatwada, Punapur and Bhandewadi Draft Town Planning Scheme No. 1 (hereinafter referred to as " the said Draft Scheme") has been sanctioned by the Government in Urban Development Department vide Notification No. TPS-2418-Nag.-Camp.-9-C. R. 281-2018-UD-9, dated 6-10-2018 under sub-section (2) of Section 68 of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") ;

And whereas, as per the provisions of Section 72(1) of the said Act, it is necessary to appoint an Arbitrator, whithin one month from the date on which the sanction to the said Draft Scheme is published in the Maharashtra Government Gazette ;

Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 72 of the said Act, read with Rule No. 11 of the Maharashtra Town Planning Scheme Rules,1974 the Government of Maharashtra hereby appoints Assistant Director of Town Planning, Nagpur Branch, Nagpur as the Arbitrator for the said Draft Scheme with immediate effect and further directs the Nagpur Improvement Trust, Nagpur to extend all reasonable assistance to the Arbitrator and also provide other necessary perks to carry out duties cast upon him in the time bound manner and bear the cost on such items ;
