महाराष्ट्र मोटार वाहन कर अधिनियम.
क्रमांक खाक्षेस-२००४/प्र.क्र. २०/एल.बी.३/रस्ते-९अ.-----ज्याअर्थी, महाराष्ट्राचे राज्यपाल यांनी प्रदान केलेल्या शक्तींचा वापर करून सचिव, सार्वजनिक बांधकाम विभाग, मंत्रालय, मुंबई आणि मे. अशोका ब्रिजवेज, पुणे ज्यांचे नोंदणीकृत कार्यालय, १/२, रीव्हर व्ु, घारपुरे घाट, अशोक स्तंभ, नाशिक ४२२ ०२२ आणि शाखा कार्यालय- प्लॉट नं. ४१७/४१८/४१९ मार्केट यार्ड, गुलटेकडी, पुणे ४११ ०३७ येथे आहे. (यापुढे ""उद्योजक"" म्हणून संबोधण्यात येईल) यांच्यामध्ये बांधा वापरा व हस्तांतरित करा या तत्वावर सोलापूर जिल्ह्यतील राज्यमार्ग क्र. ७६ ते टाकळी-कासेगाव-अनवली (प्रा.जि.मा. क्र. ७१) कि.मी. ०/००० ते ११/०० तसेच सदर रस्त्याचे परिक्षण, देखभाल व दुरुस्ती करणे (यापुढे ""सदर रस्ता"" म्हणून संबोधण्यात येईल.) या कामाकरिता सदर प्रकल्पाचा करारनामा दिनांक २७ नोव्हेंबर २००२ रोजी साक्षांकित करण्यात आलेला आहे व त्यानंतर यांचेमध्ये सर्व करारनामे झाले आहेत ;
आणि ज्याअर्थी, सदर करारनाम्यानुसार सदर रस्त्याचे बांधकाम, वापर व देखभाल दुरुस्तीकरीता १५ वर्षे, ५ महिने, १७ दिवस इतका सवलत कालावधी दोन वर्षाच्या बांधकाम कालावधीसह उद्योजकास दिनांक २९ नोव्हेंबर २००२ या प्रकल्प सुरू होण्याच्या दिनांकापासून मंजूर करण्यात आलेला आहे ;
आणि ज्याअर्थी, महाराष्ट्र शासनाची अशी धारणा आहे की, सदर रस्त्याचे बांधकाम, वापर आणि देखभाल दुरुस्ती ही जनतेला दिलेली विशेष सेवा आहे, आणि त्यामुळे सदर रस्त्यावर कि.मी. ३/४०० जवळ कासेगाव फाटा येथे व कि.मी. १०/४०० जवळ अनवली फाटा येथे पथकर स्थानक उभारुन पथकर आकारणे व वसुली करणे महाराष्ट्र शासनास योग्य वाटत आहे ;

(१)२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, नोव्हेंबर २२, २०१८/अग्रहायण १, शके १९४० आणि ज्याअर्थी, महाराष्ट्र शासनाचे सार्वजनिक बांधकाम विभाग, खाक्षेस-२००४/प्र. क्र. २०/रस्ते-९, दिनांक १६ मार्च २००४ रोजीच्या शासन अधिसूचनेद्वारे महाराष्ट्र मोटार वाहन कर अधिनियम, (१९५८ चा ६५) यांच्या कलम-२० ची पोट-कलमे (१-अ), (१-ब), (१-क), (१-ड) आणि (१-इ) द्वारे प्रदान करण्यात आलेल्या आणि त्याला समर्थनीय करणाया अधिकारांचा वापर करून सदर रस्त्याचा वापर करणाया व खालील अनुसूचीच्या स्तंभ (२) मध्ये अनुक्रमे विर्िनदिष्ट केलेल्या प्रकारच्या मोटार वाहनांवर आणि वाहनांकडून ओढून नेल्या जाणाया, अनुयांनावर अनुसूचीच्या स्तंभ (३) मध्ये त्यांच्यासमोर विर्िनदिष्ट केलेल्या दराने दिनांक १७ मार्च २००४ ते १५ नोव्हेंबर २०१८ पयर्ंतच्या कालावधीसाठी सदर रस्त्यावरील कि.मी. ३/४०० जवळ कासेगाव फाटा येथे व कि.मी. १०/४०० जवळ अनवली फाटा येथे उभारलेल्या पथकर वसुली स्थानकावर पथकर शुल्क वसुली करण्यात आलेली आहे ;
आणि ज्याअर्थी, उद्योजक महाराष्ट्र शासनाची अधिसूचना दिनांक २७ जुलै २०१४ च्या विरुद्ध व सदर प्रकरणी लवादाचा निर्णय लागू करण्यासाठी जिल्हा आणि सत्र न्यायालय, पंढरपूर येथे गेल्यावर जिल्हा आणि सत्र न्यायालयाने उद्योजकाचे अपील मान्य करून दिनांक ३० जून २०१४ रोजी दिलेल्या आदेशानुसार पथकर वसुली चालू ठेवण्याचे आदेश दिले आहेत ;
आणि ज्याअर्थी, जिल्हा आणि सत्र न्यायालयाच्या दिनांक ३० जून २०१४ च्या आदेशानुसार महाराष्ट्र शासनाने दिनांक १५ नोव्हेंबर, २०१८ पयर्ंत सदर कालावधी पथकर अधिसूचना दिनांक २० मे २०१७, २२ ऑगस्ट २०१७, १५ नोंव्हेबर २०१७, १५ मे २०१८ अन्वये वाढवून दिला आहे आणि आता सदर कालावधी दिनांक १५ मे, २०१९ पयर्ंत वाढविणे योग्य वाटत आहे.
आता त्याअर्थी, महाराष्ट्र मोटार वाहन कर अधिनियम, (१९५८ चा ६५) यांच्या कलम-२० ची पोट-कलमे (१-अ), (१-ब), (१-क), (१-ड) आणि (१-इ) द्वारे प्रदान करण्यात आलेल्या आणि त्याला समर्थनीय करणाया अधिकारांचा वापर करून महाराष्ट्र शासन याद्वारे घोषीत करते की, खाजगीकरणाच्या माध्यमातून " बांधा, वापरा व हस्तांतरित करा " (बी.ओ.टी.) या योजनेतून मे. अशोका ब्रिजवेज, पुणे यांनी स्वखर्चाने सोलापूर जिल्ह्यतील राज्यमार्ग क्र. ७६ ते टाकळी-कासेगाव-अनवली (प्रा.जि.मा. क्र. ७१) कि.मी. ०/००० ते ११/०० प्रकल्पाच्या रस्त्याचा वापर करणाया व खालील अनुसूचीच्या स्तंभ (२) मध्ये अनुक्रमे विर्िनदिष्ट केलेल्या प्रकाराच्या मोटार वाहनांवर आणि वाहनांकडून ओढून नेल्या जाणाया, अनुयानांवर अनुसूचीच्या स्तंभ (३) मध्ये त्यांच्यासमोर विर्िनदिष्ट केलेल्या दराने दिनांक १६ नोव्हेंबर, २०१८ पासून दिनांक १५ मे, २०१९ पयर्ंतच्या कालावधीसाठी सदर रस्त्यावर कि.मी. ३/४०० जवळ कासेगाव फाटा येथे व कि.मी. १०/४०० जवळ अनवली फाटा येथे बांधण्यात आलेल्या पथकर वसुली स्थानकावर पथकर शुल्क वसुली करण्याकरिता प्राधिकृत करण्यात येत आहे.

ऑटोरिक्षा, टॅ्रक्टर व रिकाम्या ट्रॉलीसह ट्रॅक्टर ;
२ मोटार वाहन अधिनियम, १९८८ (१९८८ चा ५९) मध्ये नमूद केल्याप्रमाणे हलकी मोटार वाहने :---
(अ) कार, जीप, जसे की, टाटा सुमो, कमांडर, ट्रॅक्स, वाहन चालक वगळून सहा आसनी प्रवासी २३.०० रिक्षा व इतर तत्सम (चालक वगळून १२ पयर्ंत प्रवासी क्षमता असलेली) वाहने ;
(ब) मिनी बस किंवा तत्सम वाहने (चालक वगळून १२ पेक्षा जास्त पण २० प्रवासी क्षमतेपयर्ंतची ३५.०० वाहने) आणि अ. क्र. ३ व ४ मध्ये नमूद केलेल्या वाहनाव्यतिरिक्त मालवाहतूक करणारी वाहने.
३. ट्रक्स, बसेस ;
७२.०० ४. उपरोक्त अ. क्र. ३ मध्ये नमूद केलेले वाहने वगळून, मोटार वाहन अधिनियम, १९८८ (१९८८ चा ५९) ११५.०० मध्ये व्याख्या केल्याप्रमाणे जडवाहने जसे की, ट्रक्स, ट्रेलर्स, बहुआसनीय वाहने इत्यादी.
३ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, नोव्हेंबर २२, २०१८/अग्रहायण १, शके १९४०१. वरील दर्शविलेल्या पथकर नाक्यावर पथकर शुल्क गोळा करण्याचा व पथकर शुल्काची संपूर्ण रक्कम ठेवून घेण्याचा हक्क मे. अशोका ब्रिजवेज, पुणे यांना प्रदान करण्यात आला आहे.
२. खालील अति महत्वाच्या व्यक्तींच्या वाहनांना पथकरातुन सूट देण्यात येईल :-----
(i) भारताचे राष्ट्रपती, उपराष्ट्रपती, राज्यांचे राज्यपाल व वाहनांना लाल दिवा अनुज्ञेय असलेल्या लोकप्रतिनिधींची वाहने.
(ii) लोकसभा व राज्यसभेचे विद्यमान सदस्य तसेच महाराष्ट्र विधानसभा व महाराष्ट्र विधानपरिषदेचे विद्यमान सदस्य प्रवास करीत असलेली वाहने.
(iii) महाराष्ट्र विधानसभा व महाराष्ट्र विधानपरिषदेचे माजी सदस्य तसेच लोकसभा व राज्यसभेचे माजी सदस्य.
(iv) केंद्र व राज्य शासनाची वाहने.
(v) लष्कराच्या मालकीची वाहने.
(vi) पोलीस विभागाची वाहने.
(vii) टपाल आणि तार खात्याची वाहने.
(viii) रुग्णवाहीका.
(ix) शववाहीका.
(x) अग्निशमन दलाची वाहने.
३. पथकर दराचा फलक पथकर नाक्यावर सवार्ंना दिसेल अशा पद्धतीने लावण्यात यावा. तसेच वाहन धारकांस प्रत्येक वेळी पथकर शुल्क वसुलीची संगणकीकृत पावती देण्यात यावी.
४. पथकर नाक्यावर सवार्ंना दिसेल अशा पद्धतीने इलेक्ट्रॉनिक फलक लावण्यात यावा.
टीप.----पथकर शुल्काच्या दरामध्ये खालीलप्रमाणे सूट देण्यात येईल :----
(i) एकाच वाहनास दिवसातून एकापेक्षा जास्त वेळा सदर पथकर स्थानकाचा वापर करावयाचा असल्यास वाहन मालकास दिवसातील पहिल्याच फेरीमध्ये उपरोक्त पथकराच्या दराचे १.९० पट रक्कम भरण्याचा विकल्प असावा किंवा सदर पथकर स्थानकाचा नियमितपणे वापर करणाया वाहनांसाठी वाहन मालक मासिक पास घेऊ शकेल. या मासिक पासाची किंमत पंचावन्न एकेरी फेरीस द्याव्या लागणाया दराएवढी असावी.
(ii) एकाच फेरीमध्ये दोन्ही पथकर स्थानके ओलांडणाया वाहनांना पहिला पथकर स्थानक ओलांडताना एकदाच पथकर शुल्क द्यावे लागेल.
महाराष्ट्राचे राज्यपाल यांच्या आदेशानुसार व नावाने.

NOTIFICATION
MAHARASHTRA MOTOR VEHICLES TAX ACT.
No. PSP-2004/CR-20/L.B. 3/Road-9A.—Whereas, the Governor of Maharashtra through Secretary, Public Works Department, Mantralaya, Mumbai and Messers Ashoka Bridgeways, Pune having its Registered Office at 1/2, River View, Gharpure Ghat, Ashok Stambh, Nashik 422 022 and Branch Office at Plot No. 417/418/419, Market Yard, Gultekdi, Pune 411 037, have entered into Concession Agreement, on the 27th November 2002, for construction, operation and maintenance of State highway No. 76 to Takali Kasegaon –Anwali Road, Major District Road No. 71, improved in kilometers 0/000 to kilometers11/ 000, in Solapur District (hereinafter referred to as "the said road"), under the Built, Operate and Transfer (BOT) Scheme by Messers Ashoka Bridgeways, Pune (hereinafter referred to as "the concessionaire") ;
And whereas, as per the said agreement, the total concession period of 15 years, 5 months and 17 days including the construction period of two years, was granted to the concessionaire to construct, operate and maintain the said road from the date of commencement of the work, i.e. from the 29th November 2002 ;
And whereas, the Government of Maharashtra was of the opinion that the improvement, operation and maintenance of the said road is the special service to the public and, therefore, after completion of the said road, considered it expedient to levy and collect the toll on the said road at the toll collection centres constructed at kilometer 3/400 near Kasegaon Phata and kilometer 10/800 near Anwali Phata ;
And whereas, the Government of Maharashtra has, vide Government Notification, Public Works Department, No.PSP-2004/Cr-20/Road-9, dated the 16th March 2004, issued in exercise of the powers conferred by sub-sections (1-A), (1-B), (1-C), (1-D) and (1-E) of section 20 of the Maharashtra Motor Vehicles Tax Act (LXV of 1958), levied and collected the toll on the classes of motor vehicles specified in column (2) of the Schedule appended thereto and on the tailors drawn by such motor vehicles, passing over the said road, at the rates and for the periods specified against each of the said vehicle in column (3) of the said Schedule, with effect from the 17th March 2004 to the 15th November 2018 at the toll collection centres situated at kilometer 3/400 near Kasegaon Phata and kilometer 10/800 near Anwali Phata on the said road ;
And whereas, the concessionaire approached the Honorable District and Sessions Court, Pandharpur, against the Government Notification, dated the 27th July 2014, for the implementation of arbitral award of the said Road. The District and Sessions Court has considered the concessionaire's request and ordered to continue the toll collection vide its order dated the 30th June 2014 ;
And whereas, in view of the order of the Court of District Judge, Pandharpur, dated the 30th June 2014, the Government of Maharashtra has extended the said period upto 15th November 2018 vide the Government Notifications, dated the 20th May 2017, 22nd August 2017, 15th November 2017, 15th May 2018 and now considers it expedient to extend the said period upto the 15th May 2019.
Now, therefore, in exercise of the powers conferred by sub-sections (1-A), (1-B), (1-C), (1-D) and (1-E) of section 20 of the Maharashtra Motor Vehicles Tax Act (LXV of 1958), the Government of Maharashtra hereby declares that the toll shall be levied on the classes of motor vehicles specified in column (2) of the Schedule appended hereto and on the tailors drawn by such motor vehicles, passing५ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, नोव्हेंबर २२, २०१८/अग्रहायण १, शके १९४० over the said road improved under the Built, Operate and Transfer (BOT) Scheme by Messers Ashoka Bridgeways, Pune, at their expenses, at the rates specified against each of the said vehicle in column (3) of the said Schedule, and collected at the toll collection centres constructed at kilometer 3/400 near Kasegaon Phata and kilometer 10/800 near Anwali Phata on the said road, for the period commencing from the 16th November 2018 and ending on the 15th May 2019.

3 Buses, Trucks.
72.00 4 Heavy Motor Vehicles as defined in the Motor Vehicles Act, 1988 (59 of 115.00 1988) such as Trucks, Trailers, Multi-axle vehicles, etc. except vehicles
covered by entry at serial number 3 above.
1. For the purpose of this notification, Messers Ashoka Bridgeways, Pune is authorized to collect and retain the amount of toll at the toll collection centers constructed at kilometer 3/400 near Kasegaon Phata and kilometer 10/800 near Anwali Phata on the abovementioned road.
2. The following types of vehicles are exempted from payment of toll, namely :—
(i ) VVIP vehicles carrying President of India, Vice-President of India, Governor of State, Public Representatives entitled for red lamp on their vehicles.
(ii ) Vehicles carrying sitting Members of, Parliament, Maharashtra Legislative Assembly and Maharashtra Legislative Council.
(iii ) Vehicles carrying Ex-Members of, Parliament, Maharashtra Legislative Assembly and Maharashtra Legislative Council.
(iv) State and Central Government vehicles.
(v) Defence vehicles.
(vi) Police Department vehicles.

(viii) Ambulances.
(ix) Hearses.
(x) Fire fighting vehicles.
3. The abovementioned rates shall be displayed on boards clearly visible to the people in the vicinity of the toll collection centre. A computerised toll receipt shall be issued on each and every occasion of recovery of toll.
4. Electronic Display Board clearly visible to the people shall be installed in vicinity of toll collection centre.
Notes.— Concessions in rates of toll are as given below, namely :—
(i ) When the same vehicle has to cross the toll Plaza more than once in a day, the users shall have the option to pay 1.90 times of the above toll rates while crossing the each toll station in the first trip itself for all trips in the day; or if the vehicle has to use the facility continuously and quite frequently for the entire month or even beyond that for much longer period, the vehicle owner can have a monthly pass, on the payment of charges equal to fifty-five single trips.
(ii) Vehicles passing through both the toll collection centres in the same trip, shall be required to pay toll charges only at the first crossing point.
