महाराष्ट्र नगरपरिषदा, नगरपंचायती व औद्योगिक नगरी अधिनियम, १९६५.
क्रमांक एमयुएन. २०१८/प्र.क्र. ५३३/नवि-१८.----ज्याअर्थी, शासन उद्घोषणा नगरविकास विभाग क्रमांक जीईएन १०२००१/२०९९/प्र.क्र. १५०/नवि-१६, दिनांक १८ जानेवारी २००८ (ज्याचा उल्लेख यापुढे ""उक्त उद्घोषणा"" असा केला आहे.) अन्वये महाराष्ट्र शासनाने कोल्हापूर जिल्ह्यतील गडहिंग्लज नगरपरिषदेमध्ये सदर अधिसूचने सोबतच्या अनुसूची " अ " मध्ये दाखविलेले क्षेत्र समाविष्ट करून ह्य नगरपरिषदेचे क्षेत्र बदलण्यासाठी महाराष्ट्र नगरपरिषदा, नगरपंचायती व औद्योगिक नगरी अधिनियम, १९६५ (१९६५ चा महा. ४०) च्या कलम ६, पोट-कलम (१) च्या खंड (क) अन्वये अधिसूचना काढण्याचा आपला हेतू घोषित केला होता ;
आणि ज्याअर्थी, दिनांक १८ जानेवारी, २००८ रोजीच्या उद्घोषणे ऐवजी नवीन उद्घोषणा निर्गमित करणे इष्ट आहे, असे वाटते आणि म्हणून उक्त उद्घोषणा विखंडीत करणे इष्ट आहे, असे वाटते.
त्यामुळे सर्वसाधारण वाक्खंड अधिनियम (१९०४ चा १) चे कलम २१ आणि त्यासंदर्भात शासनास समर्थ करणाया अधिकारांचा वापर करून, महाराष्ट्र शासन याद्वारे उक्त दिनांक १८ जानेवारी, २००८ ची उद्घोषणा तात्काळ विखंडीत करीत आहे.

MAHARASHTRA MUNICIPAL COUNCILS, NAGAR PANCHAYATS AND INDUSTRIAL TOWNSHIPS ACT, 1965.
No. MUN-2018/C.R.355/UD-18.—Whereas by the Government Proclamation, Urban Development Department No.GEN-102001/2099/C.R.74/UD-16, dated the 18th January 2008 (hereinafter referred to as "the said proclamation") the Government of Maharashtra had announced its intention to issue a notification under clause (a) of sub-section (1) of section 6 of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965 (Mah. XL of 1965), in order to alter the limits of the Municipal area of the Gadhinglaj Municipal Council, District Kolhapur by including therein the local area more particularly described in the Schedule "A" appended to the said Proclamation ;
And whereas, it is considered expedient to issue a fresh Proclamation instead of the said Proclamation dated the 18th January 2008 and as such it is considered expedient to rescind the said Proclamation;
Now, therefore in exercise of the powers conferred by section 21 of the Maharashtra General clauses Act (I of 1904) and of all other powers enabling it in that behalf, the Government of Maharashtra hereby rescinds the said Proclamation dated the 18th January 2008 with immediate effect.

उद्घोषणा
क्रमांक एमयुएन. २०१८/प्र.क्र. ५३३/नवि-१८.----महाराष्ट्र नगरपरिषदा, नगरपंचायती व औद्योगिक नगरी अधिनियम, १९६५ (१९६५ चा महा. ४०) (यात यापुढे ज्याचा उल्लेख " उक्त अधिनियम " असा करण्यात आला आहे.) याच्या कलम ६ चे पोट-कलम (२) व कलम ३ च्या पोट-कलम (३) च्या तरतूदीनुसार, महाराष्ट्र शासन याद्वारे कोल्हापूर जिल्ह्यतील गडहिंग्लज नगरपरिषदेची हद्दवाढ करण्याच्या दृष्टीने उक्त अधिनियमाच्या कलम ६ चे पोट-कलम (१) मधील खंड (क) अन्वये प्रदान केलेल्या अधिकारांचा वापर करून अनुसूची " अ " मध्ये नमूद स्थानिक क्षेत्र समाविष्ट करून उद्घोषणा काढण्याचा आपला हेतू घोषित करीत असून, तिचा मसूदा सोबत जोडला आहे.
२. उक्त अधिसूचनेला कोणताही आक्षेप घेणाया कोणत्याही व्यक्तीने ही उद्घोषणा महाराष्ट्र शासन राजपत्रात प्रसिद्ध झाल्याच्या दिनांकापासून ३० दिवसांच्या कालावधीत जिल्हाधिकारी, कोल्हापूर यांच्याकडे त्यांची लेखी स्वरूपात कारणासह सादर करणे आवश्यक असेल.
३. उक्त कालावधीत मिळालेल्या अशा कोणत्याही आक्षेपावर शासनाकडून विचार करण्यात येईल.

क्रमांक एमयुएन. २०१८/प्र.क्र. ३५५/नवि-१८.----ज्याअर्थी, महाराष्ट्र नगरपरिषदा, नगरपंचायती व औद्योगिक नगरी अधिनियम, १९६५ (१९६५ चा महा. ४०) (यात यापुढे ज्याचा उल्लेख " उक्त अधिनियम " असा करण्यात आला आहे.) याच्या कलम ६ चे पोट-कलम (२) व कलम ३ चे पोट-कलम (३) च्या तरतूदीनुसार व त्या अन्वये प्रदान करण्यात आलेल्या अधिकारानुसार नगरविकास विभाग क्रमांक एमयुएन २०१८/प्र.क्र. ३५५/नवि-१८, दिनांक २८ नोव्हेंबर २०१८ याद्वारे महाराष्ट्र शासन राजपत्र, असाधारण, भाग एक-अ मध्य उप-विभाग, दिनांक २८ नोव्हेंबर २०१८ यामध्ये उद्घोषणा प्रसिद्ध केली असून, महाराष्ट्र शासनाने कोल्हापूर जिल्ह्यतील गडहिंग्लज या नगरपरिषदेची हद्दवाढ करण्याच्या दृष्टीने उक्त अधिनियमाच्या कलम ६ चे पोट-कलम (१) मधील खंड (क) या अन्वये अधिसूचना काढण्याच्या आपल्या प्रस्तावावर आक्षेप मागविले आहेत ;
आणि ज्याअर्थी, उक्त उद्घोषणेस अनुलक्षून जिल्हाधिकारी, कोल्हापूर यांच्याकडे विहित कालावधीत प्राप्त हरकती व सूचनांचा शासनाने विचार केला आहे ;
आणि ज्याअर्थी, भारताचे संविधानाच्या अनुच्छेद २४३-थ च्या खंड (२) मध्ये नमूद केलेल्या बाबी विचारात घेऊन महाराष्ट्र शासनाला, यांसोबत जोडलेल्या अनुसूची " अ " मध्ये विर्िनदिष्ट केलेल्या क्षेत्राचा समावेश करून गडहिंग्लज नगरपरिषदेच्या सीमांमध्ये फेरफार करणे इष्ट वाटते.
त्याअर्थी आता, उक्त अधिनियमाचे कलम ६ चे पोट-कलम (१) मधील खंड (क) अन्वये प्रदान केलेल्या अधिकारांचा व इतर सर्व अधिकारांचा वापर करून, महाराष्ट्र शासन, याद्वारे उक्त अधिनियमाच्या कलम ६ चे पोट-कलम (१) मधील खंड (क) अन्वये अनुसूची " अ " मध्ये विर्िनदिष्ट केलेल्या क्षेत्राचा समावेश करून गडहिंग्लज नगरपरिषदेच्या सीमांमध्ये फेरफार करीत आहे. गडहिंग्लज नगरपरिषदेच्या सुधारित सीमा अनुसूची " ब " मध्ये विर्िनदिष्ट केल्याप्रमाणे असतील.

PROCLAMATION
MAHARASHTRA MUNICIPAL COUNCILS, NAGAR PANCHAYATS AND INDUSTRIAL TOWNSHIPS ACT, 1965.
No. MUN-2018/C.R.355/UD-18.—In pursuance of the provisions of sub- section (2) of section 6 read with sub-section (3) of section 3 of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Township Act, 1965 (Mah.XL of 1965) (hereinafter referred to as "the said Act") the Government of Maharashtra hereby announces its intention to issue a notification in exercise of the powers conferred by clause (a) of sub-section (1) of section 6 of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965 (Mah.XL of 1965), with a view to alter the limits of the Municipal area of the Gadhinglaj Municipal Council in Kolhapur District, so as to include therein the local areas specified in Schedule "A" the draft of which is appended hereto;
2. Any person who entertains any objection to the said Proclamation is hereby required to submit the same, in writing, with the reasons therefore, to the Collector, District Kolhapur within the period of 30 days, from the date of publication of this proclamation in the Maharashtra Government Gazette.
3. Any such objection which may be received during the said period will be considered by the Government.
DRAFT NOTIFICATION
No. MUN-2018/C.R.533/UD-18.—Whereas, by the Government Proclamation, Urban Development Department, No. MUN-2018/C.R.533/UD-18, dated 28th November 2018 Maharashtra Government Gazette, extraordinary Part 1-A Central Sub-Division, dated the 28th November 2018, issued in exercise of the powers conferred by sub-section (2) of section 6 read with sub-section (3) of section 3 of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965 (Mah.XL of 1965) (hereinafter referred to as "the said Act"), the Government of Maharashtra has invited the objections to its proposal to issue a notification under clause (a) of sub-section(1) of section 6 of the said Act, to alter the limits of the Municipal area of the Gadhinglaj Municipal Council in Kolhapur District, so as to include therein the local areas specified in Schedule "A" appended to the said Proclamation;
And whereas, the Government has considered the objections and suggestions so received by the Collector, Kolhapur District pursuant to the said Proclamation received within the period specified therein;
And whereas, having regards to the factors mentioned in clause (2) of article 243-Q of the Constitution of India, the Government of Maharashtra consideres it expedient to alter the limits of the Gadhinglaj Municipal Council in Kolhapur District so as to include therein the areas specified in Schedule "A" appended hereto :
Now, therefore, in exercise of the powers conferred by clause (a) of sub-section(1) of section 6 of the said Act, and of all other powers enabling it in that behalf, the Government of Maharashtra hereby, alters the limits of the Municipal area of the Gadhinglaj Municipal Council in Kolhapur District, so as to include therein the local areas specified in Schedule "A" appended hereto and declares that the revised boundaries of the Gadhinglaj Municipal Council so altered shall be such as shown in Schedule "B" appended hereto.
