क्रमांक खाक्षेस.२००६/प्र.क्र.१८१(भाग-३)/रस्ते-९-अ.-----ज्याअर्थी, महाराष्ट्राचे राज्यपाल यांच्या प्रदान केलेल्या शक्तींचा वापर करून सार्वजनिक बांंधकाम विभाग, मंत्रालय, मुंबई आणि मे. सायन-पनवेल टोलवेज प्रा.लि. ज्यांचे नोंदणीकृत कार्यालय, " आय व्ही आर सी एल हाऊस, ३५, सुयोजना को. ऑप. हौ. सो., कोरेगाव पार्क, पुणे ४११ ००१ " येथे आहे, यांचेमध्ये खाजगीकरणांतर्गत बांंधा, वापरा व हस्तांतरित करा (बी.ओ.टी.) या तवावर सायन-पनवेल विशेष राज्यमार्ग या रस्त्याचे किलोमीटर १४०/६९० (बी ए आर सी जंक्शन) ते किलोमीटर ११५/८०० (कळंबोली जंक्शन) मजबुतीकरण व सुधारणा तसेच सदर रस्त्याचे परिरक्षण, देखभाल व दुरुस्ती करणे (यापुढे " सदर रस्ता " म्हणून संबोधण्यात येईल.) या कामाकरिता सदर प्रकल्पाचा करारनामा दिनांक १९ जानेवारी २०११ रोजी साक्षांकित करण्यात आला होता व या नंतर यांचेमध्ये सर्व करारनामे झालेले होते ;
आणि ज्याअर्थी, सदर करारनाम्यानुसार सदर रस्त्याचे बांंधकाम, वापर व देखभाल दुरुस्ती करता १७ वर्षे, ५ महिनेइतका सवलत कालावधी ३ वषार्र्ंच्या बांंधकाम कालावधीसह उद्योजकास ३० मे २०११ या प्रकल्प सुरू होण्याच्या दिनांकापासून मंजूर करण्यात आलेला होता ;
आणि ज्याअर्थी, महाराष्ट्र शासनाची अशी धारणा होती की, सदर रस्त्याचे बांंधकाम, वापर आणि देखभाल दुरुस्ती ही जनतेला दिलेली विशेष सेवा आहे, आणि त्यामुळे सदर रस्त्यावर कि.मी. ११८/०२५ (कामोठेजवळ पुणेकडील दिशेने) आणि कि.मी. ११९/४७५ (कोपरा—मुंुंबईकडील दिशेने) येथे पथकर स्थानके उभारून पथकर आकारणे व वसुली करणे महाराष्ट्र शासनास योग्य वाटते ;
आणि ज्याअर्थी, महाराष्ट्र शासनाने शासन अधिसूचना, सार्वजनिक बांंधकाम विभाग, क्रमांक खाक्षेस.२००६/प्र.क्र.१८१ (भाग-३)/रस्ते-९अ, दिनांक ३ जानेवारी २०१५ अन्वये दिनांक ६ जानेवारी, २०१५ पासून दिनांक ३० जून, २०१५ पयर्ंत सदर रस्त्यावरून जाणाया वाहनांवर पथकर शुल्क आकारले होते, त्यानंतर दिनांक ३० जून २०१५, दिनांक ३१ डिसेंबर २०१५, दिनांक २८ जुलै, २०१६, दिनांक १८ ऑक्टोबर २०१६, दिनांक ३० नोव्हेंबर २०१६, दिनांक ३ मार्च २०१७, २० मे २०१७, ७ ऑगस्ट २०१७, ८ नोव्हेंबर २०१७, ११ मे २०१८ व ३ ऑगस्ट २०१८ च्या अधिसूचनांन्वये ३० नोव्हेंबर २०१८ पयर्ंत पथकर शुल्क आकारले होते ;

भाग चार--ब--४३९----१महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, डिसेंबर १०, २०१८/अग्रहायण १९, शके १९४० २ आणि ज्याअर्थी, दिनांक २९ डिसेंबर २०१७ रोजी संध्याकाळी ६-०० वाजता उद्योजकामार्फत प्रकल्प एकतर्फी सोडून देण्यात येऊन पथकर वसुली थांबविण्यात आली होती ;
आणि ज्याअर्थी, सदरील पथकर वसुली बंद पडल्याने पथकर वसुलीच्या उत्पन्नातील होणारे शासनाचे नुकसान टाळण्यासाठी, सदरील पथकर नाक्यावर सा.बांं.विभागामार्फत तात्काळ पथकर वसुली सुरू करण्यासाठी तात्पुरत्या स्वरूपात कंत्राटदार नेमण्यात आलेला आहे व पथकर वसुली करण्यात येत आहे ;
आणि ज्याअर्थी, पथकर वसुलीसाठी नियमित कंत्राटदार नेमण्याची निविदा प्रक्रिया करण्यात येत आहे ;
आणि ज्याअर्थी, सदर नियमित कंत्राटदार नेमण्याची निविदा प्रक्रिया पूर्ण होईपयर्ंत सदर पथकर वसुलीचा कालावधी कार्यकारी अभियंता, बहुमजली इमारती बांंधकाम विभाग, कुर्ला यांचे नावाने वाढविणे योग्य असल्याने ;
आणि ज्याअर्थी, वरीलबाब विचारात घेता, पथकर वसुलीचा कालावधी महाराष्ट्र शासनाने ३१ मार्च २०१९ पयर्ंत विस्तार करणे योग्य वाटते.
आणि त्याअर्थी, महाराष्ट्र मोटारवाहन कर अधिनियम, (१९५८ चा ६५) यांच्या कलम-२० ची पोट-कलमे (१-अ), (१-ब), (१-क), (१-ड) आणि (१-इ) द्वारे प्रदान करण्यात आलेल्या आणि त्याला समर्थनीय करणाया अधिकारांचा वापर करून, महाराष्ट्र शासन याद्वारे घोषीत करते की, खाजगीकरणाच्या माध्यमातून बांंधा, वापरा व हस्तांतरित करा (बी.ओ.टी.) या तवावर कार्यकारी अभियंता, बहुमजली इमारती बांंधकाम विभाग, कुर्ला यांना तात्पुरत्या स्वरूपात नेमलेल्या कंत्राटदारामार्फ़त सायन-पनवेल विशेष राज्यमार्ग या रस्त्याचे किलोमीटर १४०/६९० (बी ए आर सी जंक्शन) ते किलोमीटर ११५/८०० (कळंबोली जंक्शन) या लांबीमध्ये मजबूतीकरण व सुधारणा केलेल्या रस्त्याचा वापर करणाया व खालील अनुसूचीच्या स्तंभ (२) मध्ये अनुक्रमे विर्िनदिष्ट केलेल्या प्रकाराच्या मोटारवाहनांवर आणि वाहनांकडून ओढून नेल्या जाणाया, अनुयानांवर अनुसूचीच्या स्तंभ (३) मध्ये त्यांच्यासमोर विर्िनदिष्ट केलेल्या दराने दिनांक १ डिसेंबर, २०१८ पासून ते दिनांक ३१ मार्च, २०१९ पयर्ंतच्या कालावधीसाठी सायन-पनवेल या विशेष राज्यमार्गावरील कि.मी. ११८/०२५ (कामोठेजवळ पुणेकडील दिशेने) व कि.मी. ११९/४७५ (कोपरा— मुंुंबईकडील दिशेने) येथे बांंधण्यात आलेल्या पथकर वसुली स्थानकावर पथकर शुल्क वसुली करण्याकरिता प्राधिकृत करण्यात येत आहे :—

पथकराचे प्रतिफेरीचे दर रुपये १ डिसेंबर २०१८ ते ३१ मार्च २०१९ (३) १ स्कूटर, मोटारसायकल किंवा इतर दुचाकी वाहने, वाहनचालक वगळून ३ आसनी प्रवासी रिक्क्षा, पथकर नाही ट्रॅक्टर व रिकाम्या ट्रॉलीसह ट्रॅक्टर.
२ मोटार वाहन अधिनियम, १९८८ (१९८८ चा ५९) मध्ये नमूद केल्याप्रमाणे हलकी मोटार वाहने— पथकर नाही (अ) कार, जीप, टाटासुमो, कमांडर, ट्रॅक्स, वाहनचालक वगळून सहा आसनी प्रवासी रिक्क्षा व इतर तत्सम (चालक वगळून १२ पयर्ंत प्रवासी क्षमता असलेली) वाहने ;
(ब) मिनी बस किंवा तत्सम वाहने (चालक वगळून १२ पेक्षा जास्त पण २० प्रवासी क्षमतेपयर्ंत) ६५ आणि क्र. ३, ४ व ५ येथे नमूद केलेल्या वाहनांव्यतिरिक्त मालवाहतूक करणारी वाहने.
३ ट्रक (दोन आसांचे) बस.
१३० ४ मोटार वाहन अधिनियम, १९८८ मध्ये व्याख्या केल्याप्रमाणे व अनुक्रमांक ३ मध्ये नमूद केलेले ट्रक २१० वगळून ३ आसांची अवजड वाहने.
५ मोटार वाहन अधिनियम, १९८८ मध्ये व्याख्या केल्याप्रमाणे आणि अनुक्रमांक ३ व ४ मध्ये नमूद २८० केलेली वाहने वगळून ३ पेक्षा अधिक आसांची वाहने. उदा. ट्रक-ट्रेलर, इत्यादी.
(१) वरील दर्शविलेल्या पथकर नाक्यावर पथकर शुल्क गोळा करण्याचा व पथकर शुल्काची संपूर्ण रक्कम ठेव खात्यात जमा करण्याचा हक्क कार्यकारी अभियंता, बहुमजली इमारती बांंधकाम विभाग, कुर्ला, मुंुंबई यांना प्रदान करण्यात आला आहे.
(२) खालील वाहनांना पथकरातून सूट देण्यात येईल :-----
(१) भारताचे राष्ट्रपती, उप राष्ट्रपती, राज्यांचे राज्यपाल व वाहनांना लाल दिवा अनुज्ञेय असलेल्या अतिमहवाच्या लोकप्रतिनिधींची वाहने ;

(३) महाराष्ट्र विधानसभा व महाराष्ट्र विधानपरिषदेचे माजी सदस्य व लोकसभा व राज्यसभेचे माजी सदस्ये ;
(४) कार, जीप, टाटासुमो, कमांडर, ट्रॅक्स, वाहनचालक वगळून सहा आसनी प्रवासी रिक्क्षा, व इतर तत्सम (चालकवगळून १२ पयर्ंत प्रवासी क्षमता असलेली) वाहने ;
(५) महाराष्ट्र राज्य रस्ते वाहतूक महामंडळाच्या (एसटी) प्रवासी बसेस ;
(६) स्कूल बसेस ;
(७) केंद्र व राज्य शासनाची वाहने ;
(८) लष्कराच्या मालकीची वाहने ;
(९) पोलीस विभागाची वाहने ;
(१०) टपाल आणि तार खात्याची वाहने ;
(११) रुग्णवाहिका ;
(१२) शववाहीका ;
(१३) अग्निशमन दलाची वाहने ;
(१४) तळोजा एम.आय.डी.सी.कडून येणाया रस्त्यावरील सर्व प्रकारची वाहने ;
(३) पथकर दराचा फलक पथकर नाक्यावर सवार्ंना दिसेल, अशा पद्धतीने लावण्यात यावा. तसेच वाहनधारकांस प्रत्येक वेळी पथकर शुल्क वसुलीची संगणकीकृत पावती देण्यात यावी.
(४) इलेक्ट्रॉनिक माहिती फलक पथकर नाक्यावर सवार्ंना दिसेल अशा पद्धतीने लावण्यात यावा.
टीपा :—
पथकर शुल्काच्या दरामध्ये खालीलप्रमाणे सूट देण्यात येईल—
(१) पथकराच्या ५० कूपन्सची पुस्तिका आगाऊ खरेदी करणायास पुस्तिकेच्या किमतीमध्ये १० टक्के सवलत देण्यात येईल.
(२) पथकराच्या १०० कूपन्सची पुस्तिका आगाऊ खरेदी करणायास पुस्तिकेच्या किमतीमध्ये २० टक्के सवलत देण्यात येईल.
(३) वारंवार प्रवास करणाया वाहनांसाठी परतीच्या प्रवासाचे व दैनिक पासाचे दर हे त्या वाहनाच्या एकेरी प्रवास दराच्या अनुक्रमे दीडपट व अडीच पट राहतील. परतीच्या प्रवासाचा पास व दैनिक पास हा ज्या दिवशी पास काढला जाईल, त्या दिवशीच्या रात्री १२-०० वाजेपयर्ंत ग्रा राहील.
(४) मासिक पासाचे दर एकेरी प्रवास दराच्या ५० पट राहतील.
(५) मासिक पास काढलेल्या दिनांकापासून ३० दिवस वैध राहील.

NOTIFICATION
MAHARASHTRA MOTOR VEHICLES TAX ACT.
No.PSP.2006/C.R.181(Part-3)/Road-9A.—Whereas the Governor of Maharashta in his executive capacity for the Government of Maharashtra, represented by the Public Works Department, Government of Maharashtra and M/s. Sion-Panvel Tollways Private Limited, Pune having its registered office at IVRCL House, 35, Suyojana CHS, Koregaon Park, Pune 411 001 had entered into Concession Agreement, on the 19th January 2011 including all the subsequent agreements entered between them, for improvement of the Sion-Panvel Special State Highway by construction, operation and maintenance thereof from kilometer 140/690 (BARC Junction) to kilometer 115/800 (Kalamboli Junction) (hereinafter referred to as " the said road ") under the "Built, Operate and Transfer (BOT) Scheme" by M/s. Sion- Panvel Tollways Private Limited ;
And whereas, as per the said agreement, the concession period of 17 years and 5 months including the construction period of three years was granted to the concessionaire for improvement of the Sion-Panvel Special State Highway for construction, operation and maintenance from the date of commencement of the work i.e. the 30th May 2011;
And whereas, the Government of Maharashtra was of the opinion that the improvement of the Sion-Panvel Special State Highway for construction, operation and maintenance thereof is the special service to the public and therefore after completion of the said work of improvement of the Sion-Panvel Special State Highway from kilometre 140/690 (BARC Junction) to kilometer 115/800 (Kalamboli Junction), considered it expedient to levy and collect the toll at the toll collection centres constructed at kilometers 118/025 (near Kamothe-towards Pune) and 119/475 (Kopra-towards Mumbai);
And whereas, the Government of Maharashtra had, vide Government Notification, Public Works Department, No. PSP. 2006/CR-181(Part-3)/Road-9A, dated the 3rd January 2015, levied toll on the vehicles passing over the said road, with effect from the 6th January 2015 to the 30th June 2015 and thereafter, vide Notifications dated the 30th June 2015, 31st December 2015, 28th July 2016, 18th October 2016, 30th November 2016, 3rd March 2017, 20th May 2017, 7th August 2017, 8th November 2017, 11th May 2018 and 3rd August 2018 upto 30th November 2018 ;
And whereas, M/s. Sion-Panvel Tollways Private Limited has unauthorizedly terminated the concession agreement and has abandoned the project and stopped the toll collection at 6-00 PM on 29th December 2017;
And whereas, the Public Works Department has appointed a temporary agency to collect toll on behalf of Government of Maharashtra in order to curb the losses to Government on account of stopage of toll collection ;
And whereas, the Public Works Department is processing tendering for appoinment of regular agency for toll collection ;
And whereas, Government of Maharashtra considers it expedient to extend the toll notification in the name of Executive Engineer, Multi-Storeyed Buildings Construction Division, Kurla for a period till such new regular agency is fixed for toll collection ;
And whereas, in view of the above, Government of Maharashtra considers it expedient to extend the said period upto the 31st March 2019 ;
Now, therefore, in exercise of the powers conferred by sub-sections (1-A), (1-B), (1-C), (1-D) and (1-E) of section 20 of the Maharashtra Motor Vehicles Tax Act (LXV of 1958), the Government of Maharashtra hereby declares that the toll shall be levied, on the classes of motor vehicles specified in column (2) of the Schedule appended hereto and on the trailors drawn by such motor vehicles, passing over the said road improved under the "Built, Operate and Transfer (BOT) Scheme" by Executive Engineer, Multi-Storeyed Buildings Construction Division, Kurla through the temporary toll collection agency appointed for this purpose, at the rates specified against each of the said motor vehicles, and collected at the toll collection centres constructed at kilometres 118/025 (near Kamothe- towards Pune) and 119/475 (Kopra-towards Mumbai) on the said road for the period commencing from the 1st December 2018 and ending on 31st March 2019.

(3) 1 Scooter, Motor Cycle, Moped or any other Two-Wheeler, Tractor and NIL Tractor with unladen trolley, Auto-Rickshaw permitted to carry three passengers excluding driver.
2 Light motor vehicles as defined in the Motor Vehicles Act, 1988(59 of
1988),—
(a) Car, Jeep such as Tata Sumo, Trax, Commander and any other NIL similar vehicles (having carriage capacity upto twelve passengers excluding driver) and Six Seater Auto-Rickshaw (Tum-Tum);
(b) Mini Bus or any other similar vehicles having carriage capacity 65 of more than twelve and upto twenty passengers excluding driver and goods carriage vehicles except vehicles covered by entries at serial numbers 3, 4 and 5.
3 Trucks (two axles), Buses.
130 4 Heavy goods vehicles and heavy passenger motor vehicle defined in 210 the Motor Vehicles Act, 1988(59 of 1988), such as three axle vehicles except vehicles covered by the entries at serial number 3 above.
5 Heavy goods vehicles and heavy passenger motor vehicles as defined 280 in the Motor Vehicles Act, 1988 (59 of 1988), such as Truck-Trailer combination, multi-axle vehicles having more than three axles and except vehicles covered by the entries at serial numbers 3 and 4 above.
1. For the purpose of this notification, Executive Engineer, Multistoreyed Building Construction Division, Kurla, Mumbai is authorized to collect at the toll and retain the amount in deposit head.
2. The following types of vehicles are exempted from payment of toll, namely :—
(i) VVIP vehicles carrying President of India, Vice-President of India, Governor of State, Public Representatives entitled for red lamp on their vehicles.
(ii) Vehicles carrying sitting Members of, Parliament, Maharashtra Legislative Assembly and Maharashtra Legislative Council.
(iii) Vehicles carrying Ex-Members of, Parliament, Maharashtra Legislative Assembly and Maharashtra Legislative Council.
(iv) Car, Jeep such as Tata Sumo, Trax, Commander and any other similar vehicles (having carriage capacity upto twelve passengers excluding driver) and Six Seater Auto-Rickshaw (Tum-Tum);
(v) Buses of the Maharashtra State Road Transport Corporation (ST).
(vi) School Buses.
(vii) State and Central Government vehicles.
(viii) Defence vehicles.
(ix) Police Department vehicles.
(x) Post and Telegraph Department vehicles.
(xi) Ambulances.
(xii) Hearses.
(xiii) Fire fighting vehicles.
(xiv) All vehicles coming from Taloja MIDC Road.

The abovementioned rates shall be displayed on boards clearly visible to the people in the vicinity of the toll collection centres. A computerised toll receipt shall be issued on each and every occasion of recovery of toll.
4. Electronic Display Board shall be installed in vicinity of toll collection centres.
Notes :—Concessions in rates of toll are as given below, namely :—
(i) 10 per cent. rebate will be given to the purchaser of booklet containing 50 coupons in advance.
(ii) 20 per cent. rebate will be given to the purchaser of a booklet containing 100 coupons in advance.
(iii) For frequently traveling vehicles, return and daily pass will be 1.5 times and 2.5 times of their respective one way travel rates. Return journey pass and daily pass will be valid up to 12-00 hours at midnight for the day of issuing the pass.
(iv) Rate of monthly pass will be 50 times of their respective one-way travel rates.
(v) The monthly pass will be effective till 30 days from the date of issue.
