क्रमांक आयडीसी. २०१५/(१४१)/उद्योग-१४.------ज्याअर्थी, अनुसूचित उल्लेखिलेल्या क्षेत्रात महाराष्ट्र औद्योगिक विकास अधिनियम, १९६१ (१९६२ चा महा. तीन) चे प्रकरण सहा, जे अधिसूचना क्रमांक आयडीसी २१९४/(१२९६)/उ-१२, दिनांक ६ जानेवारी १९९६ महाराष्ट्र शासनाने सदर अधिसूचनेच्या अनुसूचित उल्लेखिलेल्या क्षेत्रात महाराष्ट्र औद्योगिक विकास अधिनियम, १९६१ (सन १९६२ चा महाराष्ट्र अधिनियम तीन) चे कलम सहा, दिनांक ७ जानेवारी १९९६ रोजी अंमलात आणले होते व उक्त अधिनियमाच्या आधारे मौजे कुंभेफळ, तालुका औरंगाबाद, जिल्हा औरंगाबाद येथील उक्त अनुसूचीत नमूद केलेले क्षेत्र अधिनियमाच्या कलम २, खंड (ग) अन्वये औद्योगिक क्षेत्र म्हणून जाहीर केलेले आहे ;
आणि ज्याअर्थी, उप विभागीय अधिकारी, औरंगाबाद विभाग, औरंगाबाद यांनी उक्त अधिनियमातील कलम ३२ च्या पोट-कलम १ नुसार, औरंगाबाद विभाग पुरवणी, पृष्ठ क्रमांक १४५३-१४५४ वर दिनांक ४ डिसेंबर १९९७ च्या महाराष्ट्र शासनाच्या राजपत्रात नोटीस क्रमांक १९९६/भूसंपादन/सीआर-४, दिनांक ४ डिसेंबर १९९७ प्रसिद्ध करून, उक्त औद्योगिक क्षेत्रासाठी भूसंपादन केलेले आहे आणि उक्त कलम ३२ च्या पोट-कलम ४ नुसार उक्त नोटीसीमध्ये नमूद केलेले क्षेत्र सर्व भार मुक्त होऊन राज्य शासनाच्या ठायी निहित झाले आहे ;
आणि ज्याअर्थी, या सोबतच्या अनुसूचीतील जमिनीचा (यापुढे जिचा उल्लेख ''उक्त जमीन '' असा करण्यात येईल) ताबा राज्य शासन किंवा त्यांच्यावतीने घेण्यात आलेला नाही आणि उक्त जमीन उक्त कायद्याच्या प्रयोजनासाठी आवश्यक नाही असे राज्य शासनाचे मत झाले आहे.

भाग चार--ब----१२ महाराष्ट्र शासन राजपत्र भाग चार-ब, गुरुवार ते बुधवार, डिसेंबर १३-१९, २०१८/अग्रहायण २२-२८, शके १९४० त्याअर्थी, आता उक्त अधिनियमाच्या कलम ३२ च्या पोट-कलम (४) मधील परंतुक व इतर अधिकारांचा वापर करुन राज्य शासन उक्त जमीन संपादनातून काढून घेत आहे आणि असे घोषित करीत आहे की, ही सूचना महाराष्ट्र शासन राजपत्रात प्रसिद्ध झाल्यानंतर कलम ३२च्या पोट-कलम (१) नुसार नोटीस प्रसिद्ध होण्याच्या लगतपूर्वी उक्त जमीन जिच्याकडे निहित होती त्या व्यक्तीकडे ती त्यावेळी अस्तित्वात असतील असे भारांना अधिन राहून पूर्वलक्षी प्रभावासह पुर्ननिहित होईल.

Notice
MAHARASHTRA INDUSTRIAL DEVELOPMENT ACT, 1961.
No. IDC 2015/(141)/IND 14.—Whereas, by Government Notification, Industries, Energy and Labour Department, No.IDC. 2194/(1296)/IND-12, dated the 6th January 1996 issued under sub-section (3) of section 1 of the Maharashtra Industrial Development Act, 1961 (Mah.III of 1962) (hereinafter referred to as "the said Act"), the Government of Maharashtra has appointed the 7th January 1996 to be the date from which the provisions of Chapter VI of the said Act shall take effect in certain areas in village Kumbhephal, in Taluka Aurangabad, District Aurangabad mentioned in the Schedule appended to the said notification and declared the said area as an industrial area under clause (g) of section 2 of the said Act;
And whereas, the Sub Divisional Officer, Aurangabad Division, Aurangabad has by issuing notice No. १९९६/भूसंपादन/सीआर-४, dated 4th December, 1997, published in the Maharashtra Government Gazette, Aurangabad divison Supplement, dated 4th December 1997, on pages 1453-1454, under sub-section (1) of section 32 of the said Act, acquired the lands in the said industrial area, and as such, the lands mentioned in the said notice have been vested absolutely in the State Government free from all encumbrances under sub-section (4) of said section 32 ;
And whereas, the actual possession of the land mentioned in the Schedule appended hereto (thereinafter referred to as " the said land") is not taken by or on behalf of the State Government and it has appears to the State Government that the said land is no more required for the purposes of the said Act. Now, therefore in exercise of the powers conferred by the proviso to sub-section (4) of section 32 of the said Act and of all other powers enabling it in this behalf, the Government of Maharashtra hereby withdraws the said land from acquisition and declares that, on the publication of this notice in the Maharashtra Government Gazette, the said land shall re-vest with retrospective effect in the person in whom it was vesting immediately before the publication of the notice under sub-section (1) of the said section 32,subject to such encumbrances, if any, as may be subsisting at that time.

MAHARASHTRA MANAGEMENT OF IRRIGATION SYSTEM BY FARMERS (MMISF) ACT, 2005.
No. CDA. 2016/(125/16)/CAD (Works).— In exercise of the powers conferred by section 1(३) of Maharashtra Management of Irrigation System by Farmers (MMISF) Act, 2005 (Mah. 23 of 2005) the Governor of the State of Maharashtra, hereby, notifies Areas, Irrigation Projects, Sections of the Act and Date of Applications as specified in columns (2), (3), (4), (5) and (6) of the table below for bringing in force the Act. In said notified area, as provided under sec. 7, no water shall be supplied by the Appropriate Authority to an individual holder or occupier of such land and the system of supply of water through Water Users Association shall be binding on all the holders and occupiers of the land under Management of Irrigation System by Farmers :—

No. CDA. 2016/(125/16)/CAD (Works).—To exercise the powers and discharging the duties allocated in Maharashtra Management of Irrigation System by Farmers Act, 2005, the powers are given to Government of Maharashtra to appoint appropriate Canal Officers as per MMISF Act section 2 (f).

No. CDA. 2016/(126/16)/CAD (Works).— In exercise of the powers conferred by section 1(३) of Maharashtra Management of Irrigation System by Farmers (MMISF) Act, 2005 (Mah. 23 of 2005) the Governor of the State Government of Maharashtra, hereby, notifies areas, Irrigation Projects, sections of the Act and Date of Applications as specified in columns (2), (3), (4), (5) and (6) of the table below for bringing in force the Act. In said notified area, as provided under section 7, no water shall be supplied by the Appropriate Authority to an individual holder or occupier of such land and the system of supply of water through Water Users Association shall be binding on all the holders and occupiers of the land under Management of Irrigation System by Farmers :—

त्यानुसार महाराष्ट्र पाटबंंधारे अधिनियम, १९७६ च्या कलम २ च्या खंड (४) अन्वये महाराष्ट्र सिंचन पद्धतीचे शेतकयांकडून व्यवस्थापन अधिनियम, २००५ अंतर्गत अधिकाराचा वापर करण्यासाठी आणि कर्तव्ये पार पाडण्यासाठी खाली नमूद केल्याप्रमाणे महाराष्ट्राचे राज्यपाल खालील तक्त्यात स्तंभ (३) व (४) मध्ये विर्िनदिष्टीत केल्याप्रमाणे कालवा अधिकायास अधिकार प्रदान करण्यात येत आहेत :------

क्रमांक सीडीए २०१६/(१२८/१६)/लाक्षेवि (कामे).----महाराष्ट्र सिंचन पद्धतीचे शेतकयांकडून व्यवस्थापन अधिनियम, २००५ मधील कलम १ चे उप कलम (३) अन्वये प्रदान करण्यात आलेल्या अधिकारांचा वापर करुन महाराष्ट्र राज्याचे राज्यपाल खालील तक्त्यात स्तंभ (२), (३), (४), (५) व (६) मध्ये विर्िनदिष्ट केल्याप्रमाणे उपरोक्त अधिनियम लागू करण्यासाठी पाटबंधारे प्रकल्पाचे नाव, क्षेत्र, अधिनियमातील कलमे, लागू करण्याच्या तारखा व इतर तपशील अधिसूचित करत आहेत. प्रस्तुत अधिनियमातील कलम ७ मधील तरतुदीनुसार अधिसूचित क्षेत्रात समुचित प्राधिकरण वैयक्तिक जमीनधारकास अथवा भोगवटाधारकास पाणीपुरवठा करणार नाही आणि पाणी वापर संस्थेतर्फेच पाणीपुरवठा करण्याची पद्धत सिंचन पद्धतीचे शेतकयांकडून व्यवस्थापन या योजनेखालील कार्यक्षेत्रातील सर्व जमीनधारक व भोगवटाधारकास बंधनकारक राहील.
