क्रमांक खाक्षेस-२००५/प्र.क्र.६४/भाग-१/रस्ते-९.ज्याअर्थी महाराष्ट्राचे राज्यपाल यांच्या प्रदान के लेल्या शक्तींचा वापर करून सार्वजनिक बांधकाम विभाग, मंत्रालय, मु ंबई आणि मे. अशोका बिल्डकॉन लिमिटेड, नाशिक ज्यांचे नोंदणीकृ त कार्यालय "अशोका हाऊस, अशोका मार्ग, अशोका नगर, वडाळा, नाशिक ४२२०११" येथे आहे, यांचेमध्ये खाजगीकरणांतर्गत बांधा, वापरा व हस्तांतरीत करा (बी.ओ.टी.) या तत्त्वावर अहमदनगर ते घोडेगाव (किलोमीटर १२०/२०० ते १५५/६००) चे चौपदरीकरण आणि घोडेगाव ते वडाळा (किलोमीटर १५५/६०० ते १६२/०००) चे तीनपदरीकरण तसेच सदर रस्त्याचे परिरक्षण, देखभाल व दुरुस्ती करणे (यापुढे "सदर रस्ता" म्हणून संबोधण्यात येईल.) या कामाकरिता सदर प्रकल्पाचा करारनामा १८ डिसेंबर २००६ रोजी साक्षांकित करण्यात आलेला आहे व यानंतर यांचेमध्ये सर्व करारनामे झालेले आहेत ;

आणि ज्याअर्थी, सदर करारनाम्यानुसार सदर रस्त्याचे बांधकाम, वापर व देखभाल दुरुस्ती करता १० वर्षे ९ महिने इतका सवलत कालावधी २ वर्षांच्या बांधकाम कालावधीसह उद्योजकास दिनांक १८ डिसेंबर २००६ या प्रकल्प सुरू होण्याच्या दिनांकापासून मंजूर करण्यात आलेला आहे व तद्नंतर शासन मान्यतेने सवलत कालावधी १२ वर्षे १ दिवस इतका सुधारित करण्यात आला होता. आता, स्टेट बँक ऑफ इंडियाच्या व्याज दरातील बदलामुळे व तसेच उद्योजकाने के लेल्या अतिरिक्त कामापोटी सदर कालावधी १३ वर्षे ११ महिने ४ दिवस इतका सुधारित करण्यात आला आहे;

आणि ज्याअर्थी, महाराष्ट्र शासनाची अशी धारणा आहे की, सदर रस्त्याचे बांधकाम, वापर आणि देखभाल दुरुस्ती ही जनतेला दिलेली विशेष सेवा आहे, आणि त्यामुळे सदर रस्त्यावर कि.मी. १३२/००० (शेंडी गावाजवळ) येथे पथकर स्थानक उभारुन पथकर आकारणे व वसुली करणे महाराष्ट्र शासनास योग्य वाटत आहे ;

आणि ज्याअर्थी, महाराष्ट्र शासनाने शासन अधिसूचना, सार्वजनिक बांधकाम विभाग, क्रमांक खाक्षेस- २००८/प्र.क्र.५७/रस्ते-९, दिनांक ३ मे, २००८ अन्वये दिनांक ४ मे २००८ पासून दिनांक ७ सप्टेंबर २०१६ पय(cid:५२२)त, दिनांक

¦भाग चार-ब-४४८१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, डिसेंबर १७, २०१८/अग्रहायण २६, शके १९४० ९ सप्टेंबर २०१६, दिनांक ६ सप्टेंबर २०१७ व दिनांक ६ सप्टेंबर २०१८ अन्वये दिनांक ८ सप्टेंबर २०१८ पासून दिनांक १८ डिसेंबर २०१८ पय(cid:५२२)त अहमदनगर जिल्ह्यातील अहमदनगर-औरंगाबाद (भाग-अहमदनगर ते वडाळा) राज्य महामार्ग क्र.६० चे किलोमीटर १२०/२०० ते १५५/६०० या लांबीचे चौपदरीकरण व किलोमीटर १५५/६०० ते १६२/००० या लांबीचे तीन पदरीकरण के लेल्या रस्त्यावरुन जाणाऱ्या वाहनांवर पथकर शुल्क आकारण्यात आले होते ;

आणि ज्याअर्थी, महाराष्ट्र शासनास सदर कालावधी दिनांक १८ मे २०२० पय(cid:५२२)त वाढविणे योग्य असल्याचे वाटत आहे;

त्याअर्थी, महाराष्ट्र मोटार वाहन कर अधिनियम, (१९५८ चा ६५) यांच्या कलम-२० ची पोट-कलमे (१-अ), (१-ब), (१-क), (१-ड) आणि (१-इ) (cid:४६२)ारे प्रदान करण्यात आलेल्या आणि त्याला समर्थनीय करणाऱ्या अधिकारांचा वापर करून महाराष्ट्र शासन या(cid:४६२)ारे घोषीत करते की, खाजगीकरणाच्या माध्यमातून बांधा, वापरा व हस्तांतरीत करा (बी.ओ.टी.) या तत्त्वावर मे. अशोका बिल्डकॉन लिमिटेड, नाशिक यांनी स्वखर्चाने बांधलेल्या विषयांकित रस्त्याचा वापर करणाऱ्या व खालील अनुसूचीच्या स्तंभ (२) मध्ये अनुक्रमे विनिर्दिष्ट के लेल्या प्रकाराच्या मोटार वाहनांवर आणि वाहनांकडून ओढून नेल्या जाणाऱ्या, अनुयानांवर अनुसूचीच्या स्तंभ (३) मध्ये त्यांच्या समोर विनिर्दिष्ट के लेल्या दराने दिनांक १९ डिसेंबर २०१८ पासून दिनांक १८ मे २०२० पय(cid:५२२)तच्या कालावधीसाठी अहमदनगर-औरंगाबाद या राज्यमार्गावरील किलोमीटर १३२/००० (शेंडी गावाजवळ) येथे बांधण्यात आलेल्या पथकर स्थानकावर पथकर शुल्क वसुली करण्यास प्राधिकृ त करण्यात येत आहे :-----

अनुसूची

(१) या प्रयोजनाकरिता अहमदनगर- औरंगाबाद (भाग- अहमदनगर- वडाळा) राज्य महामार्ग क्रमांक ६० रस्त्यावरील वर नमूद के लेल्या पथकर नाक्यावर वर नमूद के लेल्या कालावधीकरिता पथकर गोळा करण्याचा व पथकराची संपूर्ण रक्कम ठेवून घेण्याचा हक्क मे. अशोका बिल्डकॉन लिमिटेड, नाशिक यांना प्रदान करण्यात आला आहे.

(२) खालील वाहनांना पथकरातून सूट देण्यात येईल :-----

(१) भारताचे राष्ट्रपती, उपराष्ट्रपती, राज्यांचे राज्यपाल व वाहनांना लाल दिवा अनुज्ञेय असलेल्या अति महत्त्वाच्या लोकप्रतिनीधींची वाहने.

(२) लोकसभा व राज्यसभेचे विद्यमान सदस्य तसेच महाराष्ट्र विधानसभा व महाराष्ट्र विधानपरिषदेचे विद्यमान सदस्य प्रवास करीत असलेली वाहने.

(३) लोकसभा व राज्यसभेचे माजी सदस्य तसेच महाराष्ट्र विधानसभा व महाराष्ट्र विधानपरिषदेचे माजी सदस्य प्रवास करीत असलेली वाहने.

(४) कें द्र व राज्य शासनाची वाहने.

(५) लष्कराच्या मालकीची वाहने.

(६) पोलीस विभागाची वाहने.

(७) टपाल आणि तार खात्याची वाहने.

(८) रुग्णवाहीका.

(९) शववाहीका.

(१०) अग्निशमन दलाची वाहने.

(११) महाराष्ट्र राज्य मार्ग परिवहन महामंडळाच्या बसेस.

(१२) स्कू ल बसेस.

(३) पथकर दराचा फलक पथकर नाक्यावर सर्वांना दिसेल अशा पद्धतीने लावण्यात यावा. तसेच वाहनधारकांस प्रत्येक वेळी पथकर वसुलीची संगणकीकृ त पावती देण्यात यावी.

(४) इलेक्ट्रॉनिक माहिती फलक पथकर नाक्यावर सर्वांना दिसेल अशा पद्धतीने लावण्यात यावा.

टीपा :- पथकराच्या दरामध्ये खालीलप्रमाणे सूट देण्यात येईल :-----

(अ) पथकराच्या ५० कु पन्सची पुस्तिका आगाऊ खरेदी करणाऱ्यास पुस्तिके च्या किमतीमध्ये १० टक्के सवलत देण्यात येईल.

(ब) पथकराच्या १०० कु पन्सची पुस्तिका आगाऊ खरेदी करणाऱ्यास पुस्तिके च्या किंमतीमध्ये २० टक्के सवलत देण्यात येईल.

(क) वारंवार प्रवास करणाऱ्या वाहनांसाठी परतीच्या प्रवासाचे व दैनिक पासाचे दर हे त्या वाहनाच्या एके री प्रवास दराच्या अनुक्रमे दीड पट व अडीच पट राहतील. परतीच्या प्रवासाचा पास व दैनिक पास हा ज्या दिवशी पास काढला जाईल त्या दिवशीच्या रात्री १२-०० वाजेपय(cid:५२२)त ग्राह्य राहील.

(ड) मासिक पासाचे दर एके री प्रवास दराच्या ५० पट राहतील.

NOTIFICATION

MAHARASHTRA MOTOR VEHICLES TAX ACT.

No. PSP-2005/CR-64/Part-1/Road-9.—Whereas, the Governor of Maharashtra in his executive capacity for the Government of Maharashtra, represented by the Public Works Department, Government of Maharashtra and M/s. Ashoka Buildcon Limited, Nashik having its registered office at Ashoka House, Ashoka Marg, Ashoka Nagar, Wadala, Nashik 422011 have entered into Concession Agreement on the 18th December 2006 including all the subsequent agreements entered between them, for four lanning of Ahmednagar to Ghodegaon (Kilometer120/200 to 155/600) and three lanning of Ghodegaon to Wadala (Kilometer 155/600 to 162/000) (hereinafter referred to as "the said road") under the "Built, Operate and Transfer (B.O.T.) Scheme" by M/s. Ashoka Buildcon Limited, Nashik;

And whereas, as per the said agreement, the concession period of 10 years and 9 months including the construction period of two years has been granted to the concessionaire for improvement of the Ahmednagar-Aurangabad Road, part Ahmednagar to Wadala for construction, operation and maintenance from the date of commencement of the work i.e. the 18th December 2006 and the same is revised to 12 years 1 day, now because of change in SBI PLR rate and extra work done by the concessionaire, concession period revised to 13 years 11 months 4 days ;

And whereas, the Government of Maharashtra is of the opinion that the improvement of the Ahmednagar-Aurangabad Road, part Ahmednagar to Wadala for construction, operation and maintenance thereof is the special service to the public and, therefore, for the work of improvement of four lanning of Ahmednagar to Ghodegaon (Kilometer 120/200 to 155/600) and three lanning of Ghodegaon to Wadala (Kilometer 155/600 to 162/000), considers it expedient to levy and collect the toll on the said road, at the toll collection centres constructed at kilometers 132/000 (near Shendi village) ;

And whereas, the Government of Maharashtra has, vide Government Notifications, dated the 3rd May 2008, the 9th September 2016, the 6th September 2017 and 6th September 2018 levied and collected toll on the vehicles passing through the Section of Ahmednagar- Aurangabad road (Section Ahmednagar to Wadala), State Highway Number 60, four laned from kilometer 120/200 to kilometer 155/600 and three laned from kilometer 155/600 to kilometer 162/000 in Ahmednagar District upto the 18th December 2018 ;

And whereas, the Government of Maharashtra considers it expedient to extend the said period upto the 18th May 2020 ;

Now, therefore, in exercise of the powers conferred by sub-sections (1-A), (1-B), (1-C), (1-D) and (1-E) of section 20 of the Maharashtra Motor Vehicles Tax Act (LXV of 1958), the Government of Maharashtra hereby declares that the toll shall be levied, on the classes of motor vehicles specified in column (2) of the Schedule appended hereto and on the trailors drawn by such motor vehicles,महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, डिसेंबर १७, २०१८/अग्रहायण २६, शके १९४० ५ passing over the said road improved under the "Built, Operate and Transfer (B.O.T.) Scheme" by M/s. Ashoka Buildcon Limited, Nashik at their expenses, and at the rates specified against each of the said vehicles in column (3) of the said Schedule, and collect at the toll collection centre constructed at kilometres 132/000 (near Shendi village) on the said road, for the period commencing from the 19th December 2018 and ending on 18th May 2020.

Schedule

(1) For the purpose of this notification, M/s. Ashoka Buildcon Limited, Nashik, is authorised to collect and retain the amount of toll at toll collection centre mentioned above.

(2) The following types of vehicles are exempted from payment of toll, namely :–

(i) VVIP vehicles carrying President of India, Vice-President of India, Governor of States, Public Representatives entitled for red lamp on their vehicles.

(ii) Vehicles carrying sitting Members of Parliament, Maharashtra Legislative Assembly and Maharashtra Legislative Council.

(iii) Vehicles carrying Ex-Member of Parliament, Maharashtra Legislative Assembly and Maharashtra Legislative Council.

(iv) State and Central Government vehicles.

(v) Defence vehicles.

(vi) Police Department vehicles.

(vii) Post and Telegraph Department vehicles.

(viii) Ambulances.

(ix) Hearses.

(x) Fire fighting vehicles.

(xi) Maharashtra State Road Transport Corporation Buses.

(xii) School Buses.

(3) The abovementioned rates shall be displayed on boards clearly visible to the people in the vicinity of the Toll collection centre. A computerised toll receipt shall be issued on each and every occasion of recovery of toll.

(4) Electronic Display Board shall be installed in the vicinity of toll collection centre.

Notes : Concessions in rates of toll are as given below, namely :—

(a) 10 per cent. rebate will be given to the purchase of booklet containing 50 coupons in advance.

(b) 20 per cent. rebate will be given to the purchase of a booklet containing 100 coupons in advance.

(c) For frequently travelling vehicles return and daily pass will be 1.5 times and 2.5 times of their respective one way travel rates. Return journey pass and daily pass will be valid up to 12.00 hours at midnight for the day of issuing the pass.

(d) Rate of monthly pass will be 50 times of their respective one way travel rates.
