कारखाने अधिनियम, १९४८.
क्रमांक एफएसी. २०१८/प्र.क्र. २६२/कामगार-४.---- कारखाने अधिनियम, १९४८ (१९४८ चा ६३) याच्या कलम ४९ ची पोट-कलमे (१) व (२) तसेच कलम ११२ अन्वये प्रदान करण्यात आलेल्या अधिकारांचा आणि त्याबाबतीत त्यास समर्थ करणाया इतर सर्व अधिकारांचा वापर करून महाराष्ट्र शासनाने करण्याचे योजिलेल्या महाराष्ट्र कल्याण अधिकारी (कर्तव्ये, अर्हता आणि सेवाशर्ती) नियम, १९६६ यामध्ये आणखी सुधारणा करण्याचे योजिलेल्या नियमांचा पुढील मसुदा हा, त्यामुळे बाधा पोहचण्याची शक्यता असलेल्या सर्व व्यक्तींच्या माहितीकरिता, उक्त अधिनियमाच्या कलम ११५ द्वारे आवश्यक असल्याप्रमाणे, याद्वारे प्रसिद्ध करण्यात येत आहे आणि याद्वारे अशी नोटीस देण्यात येत आहे की, उक्त मसुदा महाराष्ट्र शासनाच्या राजपत्रात प्रसिद्ध झाल्याच्या दिनांकापासून पंचेचाळीस दिवसांच्या समाप्तीनंतर विचारात घेईल.
२. उपरोक्त कालावधी समाप्त होण्यापूर्वी, उक्त मसुद्याच्या संबंधात कोणत्याही व्यक्तीकडून ज्या कोणत्याही हरकती किंवा सूचना, संचालक, औद्योगिक सुरक्षा व आरोग्य संचालनालय, कामगार भवन, ५ वा मजला, ब्लॉक ई, सी-२०, वांद्रे-कुर्ला संकुल, वांद्रे (पूर्व), मुंबई ४०० ०५१, यांचेकडे प्राप्त होतील, त्या शासन विचारात घेईल.
नियमांचा मसुदा
१. या नियमांना, महाराष्ट्र कल्याण अधिकारी (कर्तव्ये, अर्हता आणि सेवाशर्ती) (पहिली सुधारणा) नियम, २०१८ असे म्हणावे.
२. महाराष्ट्र कल्याण अधिकारी (कर्तव्ये, अर्हता आणि सेवाशर्ती) नियम, १९६६ (यापुढे ज्याचा निर्देश " मुख्य नियम " असा केला आहे) च्या नियम ३ मध्ये पोटनियम (१) ऐवजी पुढील उप नियम दाखल करण्यात येईल :---
" (१)---एखादी व्यक्ती जर,
(एक) यासंबंधात राज्य शासनाने मान्यता दिलेली सामाजिक शास्त्रामधील पदवी किंवा पदविका मिळविली असल्याखेरीज, आणि

भाग चार-अ----२३७-१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, डिसेंबर २०, २०१८/अग्रहायण २९, शके १९४० (दोन) तिला मराठी भाषेचे पुरेसे ज्ञान असल्याखेरीज.
ती व्यक्ती कल्याण अधिकारी, अपर कल्याण अधिकारी किंवा सहायक कल्याण अधिकारी म्हणून नेमणूक होण्यास पात्र असणार नाही," ३. मुख्य नियमांतील नियम ३(अ) वगळण्यात येईल.
४. मुख्य नियमांतील नियम ५ वगळण्यात येईल.

NOTIFICATION
FACTORIES ACT, 1948.
No. FAC. 2018/C.R. 262/Lab-4.— The following draft of rules to amend the The Maharashtra Welfare Officers (Duties, Qualifications and Conditions of Service) Rules, 1966, which the Government of Maharashtra proposes to make in exercise of the powers conferred by Section 112 read with sub-section (1) and (2) of section 49 of the Factories Act, 1948 (63 of 1948) and of all other powers enabling it in that behalf, is hereby published as required by section 115 of the said Act, for information of all persons likely to be affected thereby ; and notice is hereby given that the said draft will be taken into consideration after expiry of a period of Forty-five days from the date of publication of this notification in the Maharashtra Government Gazette.
Any objection or suggestion which may be received by the Director, Industrial Safety and Health, Kamgar Bhavan, 5th Floor, Block ' E ', C-20, Bandra-Kurla Complex, Bandra (East), Mumbai 400 051, from any person with respect to the said draft, within the said period, will be considered by the Government.
Draft Rules
1. These Rules may be called the Maharashtra Welfare Officers (Duties, Qualifications and Conditions of Service) (1st Amendment) Rules, 2018.
2. In rule 3 of the Maharashtra Welfare Officers (Duties, Qualifications and Conditions of Service) Rules, 1966 (hereinafter referred to as " the principal Rules "), for sub-rule (1), the following sub-rule shall be substituted, namely :—
" (1) A Person shall not be eligible for appointment as a Welfare Officer, Additional Welfare Officer or Assistant Welfare Officer, unless he,—
(i) has obtained a degree or diploma in social science recognized by the State Government in this behalf ; and४ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, डिसेंबर २०, २०१८/अग्रहायण २९, शके १९४० (ii) has adequate knowledge of Marathi language. "
3. Rule 3(A) of the principal rules shall be deleted.
4. Rule 5 of the principal rules shall be deleted.
