क्रमांक एमआयएस ०११८/प्र.क्र २९(भाग-१)/रा.उ.शु-२.----- ज्याअर्थी महाराष्ट्र शासनास असे वाटते की, महाराष्ट्र पेय मद्य (किरकोळ विक्रीची कमाल किंमत) नियम, दारूबंदी, १९९६ मध्ये सुधारणा करण्यासाठी खालील नियम त्वरीत अंमलात आणावेत, आणि म्हणून महाराष्ट्र दारूबंदी अधिनियम (१९४९ चा पंचवीसवा) च्या कलम १४३ पोट-कलम (३) च्या परंतुकानुसार तरतूद केल्याप्रमाणे हे नियम आधी प्रसिद्ध न करता ते करण्यात यावेत.
आता, त्याअर्थी, महाराष्ट्र दारूबंदी अधिनियम (१९४९ चा पंचवीसवा) च्या कलम १४३ च्या पोट-कलम (१) व पोट-कलम (२) च्या खंड (एच १) च्या उप खंड (दोन) व त्याबाबतीत प्रदान करण्यात आलेल्या सर्व अधिकारांचा वापर करून, महाराष्ट्र शासन याद्वारे महाराष्ट्र पेय मद्य (किरकोळ विक्रीची कमाल किंमत) नियम, १९९६ मध्ये आणखी सुधारणा करण्यासाठी खालील नियम करीतआहे, ते असे :----
(१) या नियमांना महाराष्ट्र पेय मद्य (किरकोळ विक्रीची कमाल किंमत) (सुधारणा) नियम, २०१८ असे संबोधण्यात यावे.
(२) या नियमांची अंमलबजावणी दिनांक १ जानेवारी २०१९ पासून करण्यात येईल.
(३) महाराष्ट्र पेय मद्य (किरकोळ विक्रीची कमाल किंमत) नियम, १९९६ च्या नियम ५ च्या खंड (A) च्या उप खंड (ii) मधील परिच्छेद (a) व (b) व त्याखालील उदाहरणांऐवजी खालीलप्रमाणे मजकूर समाविष्ट करण्यात यावा.
"(a) भारतात बाटलीबंद केलेल्या आयात मद्यासह विदेशी मद्याचे (स्िपरीटस) प्रति बल्क लिटर र्िनमिती मूल्य रुपये २१० (रुपये दोनशे दहा फक्त) पेक्षा जास्त नसल्यास र्िनमिती मूल्याच्या ५ पट अधिक विक्रीकर प्रचलित दराने.
२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, डिसेंबर ३१, २०१८/पौष १०, शके १९४०(b) भारतात बाटलीबंद केलेल्या आयात मद्यासह विदेशी मद्याचे (स्पिरीटस) प्रति बल्क लिटर र्िनमिती मूल्य रुपये २१० (रुपये दोनशे दहा फक्त) पेक्षा जास्त असल्यास र्िनमिती मूल्याच्या ५ पट अधिक रुपये २१० (रुपये दोनशे दहा फक्त) पेक्षा जास्त असणारे र्िनमिती मूल्याच्या ४ पटीने वाढवून येणारी रक्कम अधिक विक्रीकर प्रचलित दराने.
उदाहरणे.----
(१) जर ७५० मि.ली. भारतीय बनावटीच्या विदेशी मद्याच्या र्िनमिती मूल्य रुपये १७५ घोषित केले तर किरकोळ विक्रीची कमाल किंमत रुपये [१७५ x ५ + (१७५-१५७.५०) x ४] + ३५% टक्के विक्रीकर म्हणजे रुपये ९४५ + ३३०.७५ = रुपये १२७५.७५ पेक्षा जास्त असणार नाही.
(२) जर १८० मि.ली. भारतीय बनावटीच्या विदेशी मद्याच्या बाटलीचे र्िनमिती मूल्य रुपये ४५ घोषित केले तर किरकोळ विक्रीची कमाल किंमत रुपये [४५ x ५+ (४५-३७.८०) x ४] +३५% टक्के विक्रीकर म्हणजेच रुपये २५३.८० + ८८.८३ = रुपये ३४२.६३ पेक्षा जास्त असणार नाही."
(३) महाराष्ट्र पेय मद्य (किरकोळ विक्रीची कमाल किंमत) नियम, १९९६ च्या नियम ५ च्या खंड (A१) च्या उप खंड (i) मधील परिच्छेद (a) व (b) ऐवजी खालीलप्रमाणे मजकूर समाविष्ट करण्यात यावा.
"(a) विदेशी मद्याचे (स्पीरीटस) प्रति बल्क लिटर र्िनमिती मूल्य रुपये २१० (रुपये दोनशे दहा फक्त) पेक्षा जास्त नसल्यास र्िनमिती मूल्याच्या ५ पट अधिक विक्रीकर प्रचलित दराने अधिक सीमा शुल्क.
(b) विदेशी मद्याचे (स्पिरीटस) प्रति बल्क लिटर र्िनमिती मूल्य रुपये २१० (रुपये दोनशे दहा फक्त) पेक्षा जास्त असल्यास र्िनमिती मूल्याच्या ५ पट अधिक रुपये २१० (रुपये दोनशे दहा फक्त) पेक्षा जास्त असणारे र्िनमिती मूल्याच्या ८ पटीने वाढवून येणारी रक्कम अधिक विक्रीकर प्रचलित दराने अधिक सीमाशुल्क."

NOTIFICATION
MAHARASHTRA PROHIBITION ACT.
No.MIS0118/CR-29(Part 1)/EXC-2 .- Whereas, the Government of Maharashtra is satisfied that the following rules further to amend the Maharashtra Potable Liquor (Fixation of Maximum Retail Prices) Rules, 1996, should be brought into force at once, and therefore, the rules should be made without previous publication as provided by the proviso to sub-section (3) of section 143 of the Maharashtra Prohibition Act (XXV of 1949).
Now, therefore, in exercise of the powers conferred by sub-section (1) and sub-clause (ii) of clause (h1) of sub-section (2) of section 143 of the Maharashtra Prohibition Act and of all other powers enabling it in this behalf, the Government of Maharashtra hereby makes the following rules further to amend the Maharashtra Potable Liquor (Fixation of Maximum Retail Prices) Rules, 1996, as follows namely :—
1. These rules may be called the Maharashtra Potable Liquor (Fixation of Maximum Retail Prices) (Amendment) Rules, 2018.
2. These rules shall come into force with effect from 1st January 2019.
3. In rule 5 of the Maharashtra Potable Liquor (Fixation of Maximum Retail Prices) Rules, 1996, (i) in clause (A), in sub-clause (ii), for the paragraphs (a) and (b) and the examples, the following shall be substituted namely:-
"(a) 5 times of the manufacturing cost, if manufacturing cost per bulk litre of Foreign Liquor (Spirits), including 'Imported liquor bottled in India', doesnot exceed Rs. 210. (rupees two hundred ten only) plus sales tax at the prevalent rate.
(b) 5 times the manufacturing cost increased by 4 times the manufacturing cost in excess of Rs. 210. (rupees two hundred ten only) per bulk litre, if manufacturing cost per bulk liter of Foreign Liquor (Spirits), including 'Imported liquor bottled in India', exceeds Rs. 210. (rupees two hundred ten only) plus sales tax at the prevalent rate.
Examples.— 1. If manufacturing cost of 750 ml. IMFL bottle is declared as Rs. 175 the Maximum Retail Price shall not exceed Rs. [175 X 5 + (175-157.50) X 4] +35% sales tax, i.e. Rs. 945 + 330.75 = 1275.75.
2. If manufacturing cost of 180 ml IMFL bottle is declared as Rs. 45 the Maximum Retail Price shall not exceed Rs. [45 X5 + (45-37.80) X 4] + 35% sales tax, i.e. Rs.253.80 + 88.83= 342.63"., (ii) In rule 5 of the Maharashtra Potable Liquor (Fixation of Maximum Retail Prices) Rules, 1996, in clause (A1), in sub-clause (i) for paragraphs (a) and (b) the following shall be substituted namely :—
"(a) 5 times of the manufacturing cost plus sales tax at the prevalent rate plus custom duty, if manufacturing cost per bulk litre of Foreign Liquor (Spirits), does not exceed Rs. 210. (rupees two hundred ten only) ;
(b) 5 times the manufacturing cost, increased by 8 times the manufacturing cost, in excess of rupees 210. (rupees two hundred ten only) per bulk litre of Foreign Liquor (Spirits), plus sales tax at the prevalent rate plus custom duty if manufacturing cost per bulk litre of Foreign Liquor exceeds rupees 210. (rupees two hundred ten only).

क्रमांक एमआयएस ०११८/प्र.क्र २९(भाग-१)रा.उ.शु-२.----- महाराष्ट्र दारूबंदी अधिनियम (१९४९ चा २५) याच्या कलम १०५ च्या पोट-कलम (१) द्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून, महाराष्ट्र शासन, शासन अधिसूचना, गृह विभाग, क्रमांक अेआरएएम. १०९६/२१/२/इएक्ससी-३, दिनांक १३ सप्टेंबर १९९६ मध्ये दिनांक १ जानेवारी २०१९ पासून याद्वारे पुढील सुधारणा करीत आहे :-
उक्त अधिसुचनेमधील, अनुसुचीमध्ये, नोंद ८ मधील रकाना (३) मधील शब्द व आकडे "रूपये ३००" ऐवजी पुढील शब्द व आकडे "रूपये ३५०" नोंद बदली दाखल करण्यात येईल.

NOTIFICATION
MAHARASHTRA PROHIBITION ACT.
No. MIS0118/CR-29(Part 1)/EXC-2.— In exercise of the powers conferred by sub-section (1) of section 105 of the Maharashtra Prohibition Act (XXV of 1949), the Government of Maharashtra hereby amends the Government Notification, Home Department, No. ARM 1096/21/2/EXC-3, dated the 13th September 1996, with effect from 1st January 2019, as follows, namely :-
In the said notification, in the Schedule, in entry 8, in column (3), for the word and figures "rupees 300" the word and figures "rupees 350" shall be substituted.
