MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966. .—

No. TPS-2414-278-CR-191-UD-9-2018.—

Whereas, Revised Development Plan of Nagpur City has been partly sanctioned by the Government vide Urban Development Department's Notification No. TPS-2496-2643-CR-300(A)-97-UD-9, dated the 7th January, 2000 and finally sanctioned by the Government vide Notification No. TPS-2400-1628-CR-200-2000-UD-9, Dated 10th September, 2001 and has come into force with effect from 1st March 2000 and 21st September 2001 (hereinafter referred to as "the said Development Plan") under Section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereianafter referred to as "the said Act") Also Nagpur Improvement Trust has been declared as "Planning Authority" for the 7 Improvement Scheme being implemented by the Nagpur Improvement Trust Vide Government Notification No. TPS-2401-855-CR-76-2000-UD-9, dated 27th February, 2002;

And whereas, in the said Development Plan, the lands bearing Khasara No. 62(pt.), 65(pt.), 66(pt.), 68(pt.) of Mouje Ambazari admeasuring 2700 Sq.mt. is designated as Existing Open Space (hereinafter referred to as "the said Lands");

And whereas, the Nagpur Municipal Corporation, Nagpur being the Planning Authority in respect of the said Land (hereinafter referred to as "the said Planning Authority"), vide its Resolution No. 141, dated 20-11-2017 after following all the legal procedure stipulated under Section 37(1) of the said Act, has submitted to the Government for its sanction, modification proposal so as to delete the said land from Existing Open Space and to include the same in residential zone (hereinafter referred to as "the said Modification");

And whereas, in view of above and after making necessary enquiries and after consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of opinion that the said Modification needs to be rejected ;

Now therefore, in exercise of the power conferred by sub-section (2) of Section 37 of the said Act, the Government of Maharashtra hereby refuses to accord sanction to the said Modification ;

This Notification shall be kept open for insepection by the general public during office hours in the office of the Commissioner, Nagpur Municipal Corporation, Nagpur ;

URBAN DEVELOPMENT DEPARTMENT

MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966. .—

No. TPS-2718-894-CR-294-UD-9-2018.—

Whereas, Revised Development Plan of Desaiganj City has been partly sanctioned by the Government vide Urban Development Department's Notification No. TPS-2500-2378-CR-72-2012-UD-9, Dated the 8th March, 2000 and has come into force with effect from the 30th April 2002 and Excluded part of Development Plan has been sanctioned by the Government vide Urban Development Department's Notification No. TPS-2500-2378-CR- 72-2001-UD-9, Dated 16th August, 2006 (hereinafter referred to as "the said Development Plan") under Section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereianafter referred to as "the said Act");

And whereas, in the said Development Plan, the lands bearing Nazul Khasara No. 24 area admeasuring 1.52 Hector is reserved as Site No. 39 Extension to I.T.I. of Mouje Desaiganj (hereinafter referred to as "the said Reservation");

And whereas, the Desaiganj Municipal Council (hereinafter referred to as 'the said Planning Authority'), vide its General Body Resolution No. 77, dated 17th January, 2018 has resolved to delete the said Reservation and designate as Drama Theatre and Shopping Complex accordingly passed final Resolution No. 81, dated 28th March, 2018 and after following the procedure laid down under the said Act. and submitted to the Government, for its sanction, a modification proposal as per the provisions of sub-section (1) of Section 37 of the said Act, (hereinafter referred to as "the Proposed Modification");

And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of opinion that the proposed Modification should be sanctioned with some condition ;

Now therefore, in exercise of the powers conferred on it under sub Sectgion (2) of Section 37 of the said Act, the Government hereby, sanctions the Proposed Modification and for that purpose amends the aforesaid Notification dated the 8th March, 2002 as follows ;

"In the Schedule of Modifications appended to the Notification dated 8th March, 2002 sanctioning the said Development Plan, the following new entry shall be added after the last entry.—

ENTRY

"The land at Mouje Desaiganj bearing Nazul Khasara No. 24 area admeasuring 1.52 Hector Site No. 39 Extension to I.T.I. is deleted from the said reservation and designated as Drama Theatre and Shopping Complex as shown on the plan, subject to the condition mentioned below, the appropriate authority for this reservation shall be the Municipal Council Desaiganj"—

Condition :—Permission from Collector, Gadchiroli shall be necessary before the Development of the land.

A copy of the Notification, along with the part plan showing the aforesaid sanctioned modification, shall be available for inspection of the general public, in the office of the Desaiganj Municipal Council, Desaiganj City during office hours on all working days for a period of one month.
