महाराष्ट्र सहकारी संस्था अधिनियम, १९६०.
क्र.ससंनि.०५१८/प्र.क्र.५७/१३सी.—महाराष्ट्र सहकारी संस्था अधिनियम, १९६० (१९६१ चा महा. २४) याच्या कलम १६५ च्या पेाट-कलम (१) आणि (२) तसेच कलम १४४-२० अ याारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून, राज्य शासन महाराष्ट्र सहकारी संस्था नियम, १९६१ यामध्ये आणखी सुधारणा करण्याकरिता पुढील नियमाचा मसुदा, त्यामुळे बाधा पोचण्याची शक्यता असलेल्या सर्व व्यक्तींच्या माहितीकरिता, उक्त अधिनियमाच्या कलम १६५ च्या पोट-कलम (३) ारे आवश्यक असल्याप्रमाणे याारे प्रसिद्ध करण्यात येत आहे, आणि याारे अशी सूचना देण्यात येते की, उक्त मसुदा, महाराष्ट्र शासनाकडून दिनांक १० फे ब्रुवारी २०१९ रोजी किंवा त्यानंतर विचारात घेण्यात येईल.
२. उक्त कालावधीत उक्त मसुद्याच्या संबंधात ज्या कोणत्याही हरकती किंवा सूचना प्रधान सचिव (सहकार), सहकार, पणन व वस्त्रोद्योग विभाग, मादाम कामा मार्ग, हुतात्मा राजगुरू चौक, मंत्रालय (विस्तार), मु ंबई ४०० ०३२ यांच्याकडे प्राप्त होतील त्या, शासन विचारात घेईल.
२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, जानेवारी १०, २०१९/पौष २०, शके १९४०नियमाचा मसुदा
१. या नियमांना, महाराष्ट्र सहकारी संस्था (पहिली सुधारणा) नियम, २०१८, असे म्हणावे.
२. महाराष्ट्र सहकारी संस्था नियम, १९६१ यांच्या प्रकरण अकरा-नऊ नंतर, पुढील मजकू र समाविष्ट करण्यात येईल :-

नियामक मंडळाचे कामकाज चालविणे
१०६ब- महाराष्ट्र राज्य बिगर कृ षि सहकारी पतसंस्था नियामक मंडळाची बैठक, गणपूर्ती आणि त्यांचे कामकाज चालविण्यासंबंधीची कार्यपद्धती,–
(१) नियामक मंडळाची प्रत्येक दोन महिन्यांतून किमान एकदा बैठक होईल.
(२) नियामक मंडळाचा सचिव, त्या नियामक मंडळाच्या अध्यक्षाच्या सांगण्यावरून बैठक बोलावील.
(३) नियामक मंडळाच्या बैठकी ह्या साधारणपणे सहकार आयुक्त व निबंधक, सहकारी संस्था, महाराष्ट्र राज्य, पुणे यांच्या कार्यालयात किंवा नियामक मंडळाने निश्चित के लेल्या इतर कोणत्याही ठिकाणी घेण्यात येतील.
(४) (अ) नियामक मंडळाच्या बैठकीचा अध्यक्ष हा नियामक मंडळाचा अध्यक्ष किंवा त्याच्या अनुपस्थितीत, नियामक मंडळाने नियुक्त के लेला अधिकारी असेल किंवा त्याच्या अनुपस्थितीत कलम १४४-१४अ च्या (ब) या खंडान्वये निबंधकाने नियुक्त के लेला अधिकारी असेल, आणि अध्यक्ष व असे अधिकारी या दोघांच्या अनुपस्थितीत, नियामक मंडळाची बैठक रद्द करण्यात येईल.
(५) नियामक मंडळाची बैठक बोलावण्यासाठी त्यांच्या सदस्यांना साधारणत: सात दिवस अगोदर सूचना देणे सामान्यपणे आवश्यक असेल.
(६) नियामक मंडळाचा सचिव आपल्या स्वाक्षरीने, मंडळाच्या सदस्यांना नियामक मंडळाच्या बैठकीची सूचना पुढीलपैकी कोणत्याही एका पद्धतीने देईल.
(अ) सदस्याच्या पत्यावर नोंदणीकृ त टपालाारे किंवा शी टपालाारे ; किंवा
(ब) ई-मेलारे ; किंवा
(क) सदस्याच्या मणध्वनी क्रमांकावर लघुसंदेशाारे किंवा संदेशाारे ; किंवा
(ड) हात बटवाारे.
(७) नियामक मंडळाच्या बैठकीसाठी आवश्यक असलेली गणसंख्या ही पाच इतकी असेल. त्या गणसंख्येच्या प्रयोजनार्थ, नियामक मंडळाच्या सचिवाची उपस्थिती गणण्यात येणार नाही.
(८) गणपूर्ती होत नसेल तर, नियामक मंडळाची बैठक, अशा बैठकीच्या अध्यक्षपदी असलेल्या व्यक्तीकडून ठरविण्यात येईल अशा दिनांकापयत स्थगित करण्यात येईल.
(९) नियामक मंडळाच्या बैठकीचे कार्यवृत्त, त्या प्रयोजनार्थ ठेवावयाच्या कार्यवृत्त पुस्तिके मध्ये नियामक मंडळाच्या सचिवाकडून नेांदविण्यात येईल.
महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, जानेवारी १०, २०१९/पौष २०, शके १९४० ३(१०) नियामक मंडळाचा सचिव, प्रत्येक बैठकीच्या कार्यवृत्ताच्या मसुद्यास अशा बैठकीच्या दिनांकापासून सात दिवसांच्या आत अंतिम रूप देईल आणि त्यावर नियामक मंडळाच्या अध्यक्षाची स्वाक्षरी घेईल. नियामक मंडळ सदस्यांचे कोणतेही म्हणणे असेल तर ते विचारात घेतल्यानंतर त्यांच्या नंतरच्या बैठकीत नियामक मंडळाच्या सचिवाकडून कार्यवृत्त पुस्तिकामध्ये ते म्हणणे नोंदवून घेईल.
(११) नियामक मंडळाच्या बैठकीमधील सर्व विषय, उपस्थित सदस्यांच्या साध्या बहुमताने व बैठकीमधील मतदानाारे निश्चित करण्यात येतील. समसमान मते पडल्यास, त्याबाबतीत अशा बैठकीच्या अध्यक्षपदस्थ व्यक्तीस एक निर्णायक मत देण्याचा अधिकार असेल.
(१२) नियामक मंडळाच्या बैठकीत, नियामक मंडळाच्या प्रत्येक सदस्याला फक्त एकच मत देण्याचा अधिकार असेल आणि ते मत देण्याच्या अधिकाराचा वैयक्तिकरित्या वापर करण्यात येईल आणि प्रतिनिधीारा मत देण्याचा अधिकाराचा वापर के ला जाणार नाही.
(१३) जर कोणत्याही ठरावावर नियामक मंडळाच्या सदस्यांची मत विभागणी झाली असेल तर अशा बैठकीच्या अध्यक्षपदावरील व्यक्ती तो ठराव मतदानासाठी ठेवील. मतदान हात उंचावून करण्यात येईल.

NOTIFICATION
MAHARASHTRA CO-OPERATIVE SOCIETIES ACT, 1960.
No. Sansani 0518/C.R.57/13-C.—The following draft or rules further to amend the Maharashtra Co-operative Societies Rules, 1961, which the Government of Maharashtra proposes to make in exercise of the powers conferred by sub-section (1) and (2) of section 165 read with section 144-20A of the Maharashtra Co-operative Societies Act, 1960 (Mah. XXIV of 1961) is hereby published as required by sub-section (3) of section 165 of the said Act, for the information of all persons likely to be affected thereby; and notice is hereby given that the said draft will be taken into consideration by the Government of Maharashtra, on or after the 10th February 2019.
2. Any objection or suggestion which may be received, with respect to the said draft, by the Principal Secretary (Co-operation ) Co-operation, Marketing and Textile Department, Madam Cama Marg, Hutatma Rajguru Chowk, Mantralaya, (Annex), Mumbai 400 032, within the said period will be considered by the Government.
DRAFT RULES
1. These rules may be called the Maharashtra Co-operative Societies (First Amendment) Rules, 2018.
2. After CHAPTER-IX of the Maharashtra Co-operative Societies Rules, 1961, the following shall be inserted, namely:-
"CHAPTER XI A"
CONDUCT OF BUSINESS OF THE REGULATORY BOARD
106-B - The meeting, quorum and procedure regarding transaction of the business of the Maharashtra State Non-Agricultural Co-operative Credit Societies Regulatory Board,– (1) The Regulatory Board shall meet at least once in every two months.
(2) The Secretary of the Regulatory Board shall convene the meeting at the instance of the Chairman of the Regulatory Board.
(3) The meetings of the Regulatory Board shall normally be held at the office of the Commissioner for Co-operation and Registrar for Co-operative Societies, Maharashtra State, Pune or at any other place decided by the Regulatory Board.
(4) The meetings of the Regulatory Board shall be presided over by the Chairman of the Regulatory Board or in his absence by the officer appointed by the Regulatory Board or in his absence, by the officer appointed by the Registrar under clause (b) of section 144-14A and in the absence of both the Chairman and such officer, the meeting of the Regulatory Board shall be cancelled.
(5 ) Seven days prior notice to its members shall ordinarily be necessary for convening the meeting of the Regulatory Board.
महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, जानेवारी १०, २०१९/पौष २०, शके १९४० ५(6) The Secretary of the Regulatory Board by his signature shall issue the notice of meeting of the Regulatory Board to the members of the Board by one of the following modes :
(a) by Registered Post or Speed Post at the address given by the member; or (b) by e-mail; or
(c) by S.M.S. or message on the Mobile phone number given by the member ; or (d) by hand delivery.
(7) Necessary quorum for the meeting of the Regulatory Board shall be five. For the purpose of the quorum, the presence of the Secretary of the Regulatory Board shall not be counted.
(8) If there is no quorum, the meeting of the Regulatory Board shall be adjourned to such a date as decided by the person presiding such meeting.
(9) The proceeding of meetings of the Regulatory Board shall be recorded, by the Secretary of the Regulatory Board in the minute's book to be kept for this purpose.
(10) The Secretary of the Regulatory Board shall finalise the draft minutes of every meeting within seven days from the date of such meeting and get it signed by the Chairman of the Regulatory Board. The Regulatory Board, at its subsequent meeting after taking into consideration the observations, if any, made by the members, cause them to be recorded in the minute's book maintained by the Secretary of the Regulatory Board.
(11) All subjects in the meeting of the Regulatory Board shall be decided by a simple majority of members present and voting at the meeting.
In case of equality of votes, the person presiding such meeting shall have a casting vote.
(12) At the meeting of the Regulatory Board, every member of the Regulatory Board shall have only one vote and right to vote shall be exercised personally and not by proxy.
(13) When the members of the Regulatory Board are divided on any resolution, the person presiding such meeting shall put the resolution for voting. Voting shall be by show of hands.
