(ब) अर्हता व अनुभव

१. करार पद्धतीने नियुक्ती करावयाचा सेवानिवृत्त अधिकारी शारीरिक, मानसिक दृष्टीने सक्षम असावा, त्याला किमान ३ वर्षाचा अनुभव व मराठी भाषेचे ज्ञान असावे.

२. करार पद्धतीने नियुक्ती करावयाच्या सेवानिवृत्त अधिकायांविरुद्ध कोणतीही विभागीय चौकशीची कार्यवाही चालू/प्रस्तावित नसावी, अथवा कोणतीही शिक्षा झालेली नसावी.

३. सदर अधिकारी यांच्या निवृत्तीवेळेचा ग्रेड पे रु. ७,६०० पेक्षा कमी असावा (सहाव्या वेतन आयोगानुसार) आणि (सातव्या वेतन आयोगानुसार समकक्ष अधिकारी).

(क) वयोमर्यादा :--करार पद्धतीने नियुक्ती करण्यात आलेल्या व्यक्ती वयाच्या ६५ वर्षापयर्ंत कार्यरत राहू शकतील. तथापि, ज्या व्यक्तींच्या सेवा त्यानंतर चालू ठेवणे आवश्यक आहे, असे मत असेल त्यांच्या सेवा सक्षम प्राधिकायास एक स्तर वरिष्ठ अधिकायाच्या/प्राधिकायाच्या मान्यतेने पुढे चालू ठेवता येतील. मात्र कोणत्याही परिस्थितीत करार पद्धतीने नियुक्ती करण्यात आलेल्या व्यक्ती वयाच्या ७० वर्षापयर्ंतच कार्यरत राहू शकतील.

1. The retired Officer must be physically and mentally capable; he should have at least 3 years of experience and knowledge of Marathi language.

3. The grade pay at the time of retirement should be less than Rs. 7600 (As per sixth pay) and (According to the Seventh Pay Commission, equivalent officers)

आणि ज्याअर्थी, उक्त नियमावलीमध्ये विकास परवानगी व प्रारंभ प्रमाणपत्राबाबत तरतूदी असून त्यामध्ये काही प्राधिकरणांची विशिष्ट बांधकाम कार्ये ही विकास परवानगीमधून वगळण्यात आलेली आहेत. तथापि मेट्रो रेल्वेचे कार्यासंदर्भात उक्त नियमावलीमध्ये तरतूद नाही ;

आणि ज्याअर्थी, मेट्रो रेल्वेचे जाळे जलद गतीने विकसित होणेसाठी मेट्रो रेल्वेची कार्ये विकास परवानगीमधून वगळणे आवश्यक आहे. मुंबई मेट्रोच्या संदर्भात शासन नगरविकास विभागाकडून बृृहन्मुंबईच्या विकास नियंत्रण नियमावलीमध्ये त्याकरिता तरतूद अंतभर्ूत करणेचा निर्णय घेणेत आलेला आहे आणि त्यासाठी बृृहन्मुंबईचे विकास नियंत्रण व प्रोत्साहन नियमावलीत त्यासंबंधाने तरतूद अंतभूर्ंत करण्यात आली आहे.

आणि ज्याअर्थी, पुणे व नागपूर तसेच बृृहन्मुंबई क्षेत्राबाहेरील मेट्रो रेल्वेचे जाळे जलद गतीने विकसित करण्यासाठी समान तरतूद नवी मुंबई, ठाणे, कल्याण-डोंबिवली, भिवंडी-निजामपूर, मिरा-भाइर्ंदर, नागपूर, पुणे, पिंपरी-चिंचवड महानगरपालिका, पिंपरी-चिंचवड नवनगर विकास प्राधिकरण व नवी मुंबई अधिसूचित क्षेत्रासाठीचे सिडको हे नवनगर विकास प्राधिकरण यांच्या विकास नियंत्रण नियमावलीमध्ये करणे आवश्यक आहे, असे शासनाचे मत झालेले आहे ;

आणि ज्याअर्थी, वरील वस्तुस्थिती व परिस्थिती विचारात घेता शासनाचे असे मत झाले आहे की, मेट्रो रेल्वेच्या कार्यासंदर्भात विशेष तरतुद अंतभर्ूत करण्यासाठी उक्त नियमावलीमध्ये सार्वजनिक हितास्तव तातडीने सुधारणा करणे आवश्यक झालेले आहे आणि ज्याअर्थी, उक्त अधिनियमाच्या कलम ३७ च्या पोट-कलम (१कक) अन्वये प्राप्त अधिकाराचा वापर करुन, उक्त नियमावलीमध्ये मेट्रो रेल्वेच्या कार्यासंदर्भात विशेष तरतुद अंतभर्ूत करण्यासाठी उक्त अधिनियमाच्या कलम ३७, पोट-कलम (१कक) नुसार सदर प्रस्तावित फेरबदलावर सर्वसाधारण जनतेकडून हरकती/सूचना मागविण्यासाठी फेरबदलाची सूचना क्र. टिपीबी ४३१५/११६३/प्र.क्र.१८६/२०१५/नवि-११, शासनाने दिनांक १३ ऑक्टोबर, २०१७ रोजी निर्गमित करण्यात आली होती (यापुढे ज्याचा उल्लेख " उक्त फेरबदल " असा करण्यात आलेला आहे) आणि ज्याद्वारे प्रस्तावित फेरबदलाबाबत प्राप्त होणाया हरकती/सूचनांवर संबंधितांना सुनावणी देऊन अहवाल सादर करणेसाठी संबंधित विभागाचे सहसंचालक, नगररचना यांची नेमणूक (यापुढे ज्यांचा उल्लेख " उक्त अधिकारी " असा करण्यात आला आहे. ) करण्यात आली आहे ;

आणि ज्याअर्थी, प्रस्तावित फेरबदलावर जनतेकडून हरकती/सूचना मागविण्यासाठी शासन सूचना दिनांक १३ ऑक्टोबर २०१७ ही महाराष्ट्र शासन राजपत्रात, दिनांक २३ ऑक्टोबर, २०१७ रोजी प्रसिद्ध करण्यात आली होती आणि संबंंधित उक्त अधिकारी यांनी अधिनियमाचे कलम ३७(१कक) अन्वये वैधानिक कार्यवाही पूर्ण करुन त्यांचा अहवाल नगररचना संचालनालयामार्फत शासनाचे अंतिम मंजूरीसाठी सादर केला आहे;

आणि ज्याअर्थी, उक्त अधिकारी यांनी सादर केलेला अहवाल विचारात घेता व संचालक, नगररचना, महाराष्ट्र राज्य, पुणे यांचेशी सल्ला-मसलत केल्यानंतर उक्त फेरबदल जनहिताच्या दृष्टीने मंजूर करणे आवश्यक आहे, असे शासनाचे मत झाले आहे ;

आणि त्याअर्थी, उक्त अधिनियमाच्या कलम ३७ चे पोट-कलम (१कक) (ग) अन्वये प्रदत्त असलेल्या अधिकाराचा वापर करुन शासन याद्वारे.----

(अ) सोबतच्या परिशिष्टात नमूद केल्यानुसार प्रस्तावित फेरबदल प्रस्तावास सुधारणेसह मंजुरी देण्यात येत आहे.

(ब) सदरहू अधिसूचना शासन राजपत्रात प्रसिद्ध झाल्याचा दिनांकापासून सदर सुधारणा अंमलात येईल.

Notwithstanding anything contained in the existing regulation, the following constructions for operational purposes of new railway lines or tracks by the Metro Rail Administration (MRA) / Project Implementing Agency designated by the Government for the Metro rail and Mono rail/Light Rail Transit (LRT) Projects, the permission of the Municipal Commissioner/Chief Executive Officer of the Authority shall not be necessary:-

" Operation Control Centre, Playback Training Room, Administration Building, Stabling Yards, Maintenance Workshop and Training Centre, Auto Car Wash Plant and Auto Wash Plant, Auxiliary Rail Vehicle Building, Under Floor Wheel Lathe and Blow Down Plant, Cooling Tower, Generator Area, Auxillary Substation, Traction Substation, Transformer Area, Water Treatment Plant, Waste Water Treatment Plant, Depot Control Centre, sump area, Parking, Check post, Loading and unloading areas, Fouling Points, DG set Rooms, Metro and Mono stations (underground and elevated), Viaduct and tunnel, Ventilation Shaft, Entry / Exit Blocks, Passages, Underground passage to Station box, Lifts, Staircases, Escalators, Transit accommodation / Guest house / Guest rooms, Air Handling Unit, Fire staircase, Fire lift and fire passages, Refuge area, thereto."

NOTIFICATION

No. TPB 4315/1163/CR-186/2015/UD-11.—Whereas, the Development Control Regulations for Navi Mumbai, Thane, Kalyan, Dombivali, Bhiwandi-Nizampur, Mira-Bhayndar, Nagpur, Pune, Pimpri Chinchwad Municipal Corporations, Pimpri Chinchwad New Town Development Authority and CIDCO (New Town Development Authority for Navi Mumbai Notified Area) (hereinafter referred to as " the said Regulations ") have been sanctioned by the Government in the Urban Development Department, under Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as " the said Act ") and come into force ;

And whereas, the said Regulations, have provisions in respect of Development Permission and Commencement certificate, in which items of operational construction by some authorities are excluded from Development Permission, but there is no provision regarding Metro rail operational constructions in the said regulations ;

And whereas, for faster implementation of Metro network, Metro Rail operational constructions should be excluded from Development Permission, in case of Mumbai Metro, the State Government in the Urban Development Department has taken a decision to incorporate such provision in the Development Control Regulation of Municipal Corporation of Greater Mumbai, and for that purpose provision is incorporated in Development Control and Promotion Regulation of Greater Mumbai ;

And whereas, the Government in Urban Development Department is of opinion that for faster implementation of Pune and Nagpur Metro Rail Network and Metro Rail Network outside Greater Mumbai, the same provision should be incorporated in the Development Control Regulations for Navi Mumbai, Thane, Kalyan-Dombivali, Bhiwandi-Nizampur, Mira-Bhayndar, Nagpur, Pune, Pimpri Chinchwad Municipal Corporations, Pimpri Chinchwad New Town Development Authority and CIDCO (New Town Development Authority for Navi Mumbai Notified Area) ;

And whereas, the Government in the Urban Development Department has decided in the public interest to carry out urgently a suitable modification accordingly to the said Regulations and therefore, the Government, in exercise of the powers conferred under sub-section (1AA) of Section 37 of the said Act, had issued Notice No. TPB 4315/1163/CR-186/2015/UD-11, dated 13th October 2017 for inviting suggestions/objections from the general public with regard to certain modifications proposed in respect of Regulation to incorporate Special Provision for Metro Rail Constructions (hereinafter referred to as " the proposed modifications " ) as specifically described in the Schedule appended to the said Notice and appointed the concerned Joint Director of Town Planning as the Officer (hereinafter referred to as " the said Officer ") to submit a Report on the suggestions/objections received in respect of the proposed modifications to the Government, after giving hearing to the concerned persons and the said Authority ;

And whereas, the said Notice No. TPB 4315/1163/CR-186/2015/UD-11, dated 13th October 2017 was published in the Maharashtra Government Gazette (Extra-Ordinary Gazette), dated 23rd October 2017 and the said concerned Officers submitted their report through the Director of Town Planning, Maharashtra State, after completing the legal procedure stipulated under Section 37(1AA) of the said Act ;

And whereas, after considering the Report of the said Officer and after consulting the Director of Town Planning, Maharashtra State, the Government is of the opinion that the proposed modification is required to be sanction ;

Now, therefore, in exercise of the powers conferred upon it under section 37(1AA)(c) of the said Act, the Government hereby :—

(A) Sanctions the proposed modifications, with some changes as described more specifically in the Schedule appended hereto.

(B) Fixes the date of publication of this Notification in the Official Gazette as the date of coming into force of this sanctioned modification.

Special Provision for Metro Rail Constructions

(२) सदरचे अधिकार सहकार कायदा कलम १०१ व ९१ अन्वये प्राप्त वसुली दाखल्याची अंमलबजावणी करण्याकरिता असतील.

(३) वसुली अधिकारी यांनी दर माहे सोबत जोडलेल्या विहित नमुन्यात प्रपत्र १, २, ३ व ५ प्रमाणे कर्ज वसुलीची माहिती संबंधित जिल्हा उप निबंधक, सहकारी संस्था यांचे कार्यालयास सादर करावी. ज्या सहकारी संस्थेचे कार्यक्षेत्र विभाग, दोन विभाग अथवा राज्य कार्यक्षेत्र आहे त्या संस्थांनी देखील त्यांचे मुख्य कार्यालय ज्या जिल्ह्यमध्ये आहे त्या जिल्हा उप निबंधक यांचे कार्यालयास माहिती सादर करावी.

(४) अधिकार प्रदान केलेल्या वसुली अधिकारी असलेल्या व्यक्तीची बदली झाल्यास किंवा सेवानिवृत्ती झाल्यास किंवा सेवेतून काढून टाकल्यास किंवा त्याचा मृत्यू झाल्यास, अशा अधिकायास प्रदान केलेले अधिकार आपोआप रद्द होतील.

(५) वसुली अधिकारी यांनी मा. सहकार आयुक्त व निबंधक, सहकारी संस्था, महाराष्ट्र राज्य, पुणे यांचे दिनांक ६ एप्रिल २०१८ रोजीचे आदेशामध्ये नमूद प्रमाणेच हुकूमनाम्यांच्या/वसुली दाखल्यांच्या आदेशिकेचा खर्च (Cost of process) थकबाकीदारांकडून वसूल करणेबाबत दक्षता घ्यावी आणि त्याचा प्रकरणनिहाय हिशोब ठेवावा.

(६) मा. उच्च न्यायालय, मुंबई यांनी रिट याचिका क्रमांक १९४२/२०१३, दि बेसिन कॅथोलिक को-ऑप. बँक विरुद्ध महाराष्ट्र राज्य व इतर या याचिकेमध्ये दिनांक ५ डिसेंबर २०१५ रोजी दिलेला आदेश विचारात घेऊन वसुलीची कार्यवाही करताना महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ अन्वये प्राप्त असलेल्या अधिकारानुसारच वसुलीची कार्यवाही करावी.

(७) वसुली अधिकारी यांनी नमूद केलेल्या कालावधीत वसुलीचे कामकाज समाधानकारक केले नसल्याचे निदर्शनास आल्यास किंवा प्रदान केलेल्या अधिकाराचा गैरवापर करीत असल्याचे निदर्शनास आल्यास, प्रदान केलेले अधिकार काढून घेतले जातील व भविष्यात असे कोणतेही अधिकार अशा व्यक्तीस प्रदान करण्यात येणार नाहीत.

(८) शासन निर्णय क्रमांक संकीर्ण-१५०४/प्र.क्र.२३१/१५-स, दिनांक २३ नोव्हेंबर २००६ अन्वये वसुली अधिकायांना तीन सिंहाच्या राजमुद्रेचा वापर करता येणार नाही.

(९) वसुली अधिकायास त्याच्या नावापुढे कोठेही ""महाराष्ट्र शासन नियुक्त"" आणि किंवा "" सिव्हील कोर्ट"", ""एक्झीक्युटीव्ह कोर्ट"" या शब्दांचा अथवा तत्सम शब्दांचा वापर करता येणार नाही. त्याऐवजी वसुली अधिकायंानी त्यांच्या नावापुढे ""वसुली अधिकारी (महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ चे नियम १०७ अन्वये )"" असे लिहावे.

(१०) वसुली अधिकायास वसुलीसाठी वापर करण्यात येणाया वाहनावर "" एकलव्य युनिव्हर्सल सहकारी पतसंस्था मर्यादित, मुंबई "" असा फलक लावता येऊ शकेल.

(११) वसुली अधिकायाने पगार जप्तीची कार्यवाही करताना कर्जदाराच्या/जामीनदाराच्या पगार कपातीबाबत राष्ट्रीयीकृत बँका वा अन्य बँका यांचेकडे परस्पर वेतन कपातीचा आदेश देऊन परस्पर पगार कपात करता येणार नाही. संबंधित कर्जदार/जामीनदार ज्या आस्थापनेवर काम करीत आहे त्या आस्थापनेवरील आहरण व संवितरण अधिकारी/पगार करणारा अधिकारी यांचेमार्फत पगारातून कर्ज वसूल करण्याची कार्यवाही करावी.

(१२) वसुली अधिकायास, थकबाकीदाराकडून वसुली दाखल्यानुसार वसूलपात्र रक्कम व दिनांक ६ एप्रिल २०१८ रोजीचे मा. सहकार आयुक्त व निबंधक, महाराष्ट्र राज्य, पुणे यांचे आदेशामध्ये निश्िचत केलेल्या हुकूमनाम्याच्या/वसुलीच्या दाखल्याच्या आदेशिकेचा खर्चाच्या (Cost of process) दराने वसूल करावयाची रक्कम याशिवाय इतर कोणतीही रक्कम थकबाकीदारांकडून वसूल करता येणार नाही.

(१३) वसुली अधिकायाने या कार्यालयाच्या दिनांक १ जानेवारी २०१७ च्या परिपत्रकातील सूचनांची काटेकोरपणे अंमलबजावणी करणेची आहे. सदर परिपत्रकातील सूचनांचे उल्लंघन झाल्यास वसुलीचे अधिकार काढून घेण्यात येऊन भविष्यकाळात असे अधिकार प्रदान केले जाणार नाहीत याची नोंद घ्यावी.

(१४) संस्थेने मा. सहकार आयुक्त व निबंधक, सहकारी संस्था, महाराष्ट्र राज्य, पुणे यांचे दिनांक ६ एप्रिल २०१८ रोजीचे आदेशानुसार निश्चित केलेल्या हुकूमनामा/वसुली दाखला अंमलबजावणीच्या आदेशिकेचा खर्च (Cost of process) याबाबत त्याची आकारणी व विनियोग करताना सदर आदेशाचे उल्लंघन होणार नाही याबाबत दक्षता घ्यावी. सदर खर्चाची आकारणी व विनियोग याबाबत प्रकरणनिहाय हिशोब ठेवावयाचा असून त्याची तपासणी संस्थेच्या वैधानिक लेखापरीक्षकांकडून करून घ्यावयाची आहे. सदर आदेशामध्ये नमूद दरानेच खर्चाची आकारणी करून वसूल करावयाची असून सदर आदेशामध्ये नमूद कारणांसाठीचा त्याचा विनियोग करावयाचा आहे. सदर आदेशाचे उल्लंघन केल्यास संचालक मंडळ/व्यवस्थापक/वसुली अधिकारी कायदेशीर कारवाईस पात्र राहील याची नोंद घ्यावी.
