अन्न सुरक्षा व मानके (विक्रीवरील निबर्ंध आणि प्रतिबंध) विनियम, २०११.
क्रमांक असुका/अधिसूचना/प्र.क्र. ५७/२०१८/औषधे-२.----ज्याअर्थी, अन्न सुरक्षा व मानके (विक्रीवरील निबर्ंध आणि प्रतिबंध) विनियम, २०११ (यात यानंतर ज्यांचा निर्देश "उक्त विनियम" असा केला आहे) यांच्या विनियम २.३.१५ (१) नुसार, कोणतीही व्यक्ती, पुढील गोष्टींशिवाय, कोणत्याही खाद्यतेलाची विक्री करणार नाही किंवा ते विक्रीसाठी ठेवणार नाही किंवा वितरीत करणार नाही किंवा कोणत्याही खाद्यतेलाच्या विक्रीच्या प्रयोजनार्थ कोणत्याही व्यक्तीला त्याची विक्री करण्याचा किंवा ते पाठविण्याचा किंवा देण्याचा प्रस्ताव देऊ करणार नाही, ते असे,----
(अ) अन्न सुरक्षा व मानके अधिनियम, २००६ (२००६ चा ३४) आणि त्याखाली केलेले नियम व विनियम यांमध्ये तरतूद केलेल्या गुणवत्तेच्या मानकांना अनुरूप असणार नाही ; आणि
(ब) उक्त विनियमांत विर्िनदिष्ट केलेल्या रितीने डब्यात आवेष्टित, चिन्हीत व खूणचिठ्ठी लावून भरलेले नसेल ;
आणि ज्याअर्थी, उक्त विनियमांच्या विनियम २.३.१५ (१) च्या परंतुकात अशी तरतूद केली आहे की, राज्य शासन, लोकहितार्थ, शासकीय राजपत्रात, त्याबाबतची कारणे लेखी नमूद करून, उक्त अधिनियमाच्या तरतुदींमधून कोणत्याही खाद्यतेलास सूट देऊ शकते ;
आणि ज्याअर्थी, आवेष्टनासाठी येणारा खर्च व जनतेवर पडणारा भुदर्ंड, ग्रामीण भागातील घाण्यातील तेलाची छोटया प्रमाणात होणारी विक्री, राज्याच्या ग्रामीण भागातील बहुसंख्य जनतेची छोटया प्रमाणातील तेलाची गरज तसेच बाजारात नवीन टिनची कमतरता इत्यादी बाबी लक्षात घेऊन उक्त अधिनियमाच्या कलम २.३.१५ (१) (ब) मधून सूट देण्याची शासनाकडे केलेली मागणी योग्य आहे अशी शासनाची खात्री झाली आहे म्हणून व्यापक जनहिताच्या दृष्टीने राज्यात सुटया खाद्यतेलाची विक्री करणे राज्य शासनास इष्ट वाटते.

भाग चार--अ-----१८----१महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, जानेवारी १८, २०१९/पौष २८, शके १९४० २ त्याअर्थी, आता, उक्त अधिनियमातील विनियम २.३.१५ (१) च्या परंतुकाद्वारे प्रदान करण्यात आलेल्या अधिकारांचा व याबाबतीत त्यास समर्थ करणाया इतर सर्व अधिकारांचा वापर करून, महाराष्ट्र शासन याद्वारे, जनहिताच्या दृष्टीने, वर नमूद केलेल्या कारणांसाठी व परिस्थितीत ही अधिसूचना महाराष्ट्र शासनाच्या राजपत्रात प्रसिद्ध झाल्याच्या दिनांकापासून येणाया एक वर्षाच्या कालावधीसाठी, उक्त अधिनियमाच्या २.३.१५ (१) (ब) मधील तरतुदीप्रमाणे सर्व खाद्य तेलांना खुल्या स्वरूपात विक्री करण्यास सूट देत आहे.

NOTIFICATION
FOOD SAFETY AND STANDARDS (PROHIBITION AND RESTRICTION ON SALES) REGULATIONS, 2011.
No. FSSA/Notification/C.R. No. 57/2018/Drugs-2.—Whereas, as per the regulations 2.3.15 (1) of the Food Safety and Standards (Prohibition and Restriction on Sales) Regulations, 2011 (hereinafter referred to as "the said regulations") no person shall sell or expose for sell, or distribute, or offer for sale or Dispatch, or deliver to any person for the purpose of sale any edible oil,—
(a) which does not conforms to the standards of quality as provided in the Food Safety and Standards Act, 2006 (34 of 2006) and rules and regulations made thereunder ; and
(b) which does not packed in a container, marked and labelled in the manner as specified in said Regulations ;
And Whereas, provision to regulations 2.3.15 (1) of the said Regulations provides that the State Government may, in the public interest, for reasons to be recorded in writing, in specific circumstances and for a specific circumstances and for a specific period of notification in the Official Gazette, exempt may edible oils from the provisions of the said Act ;
And Whereas, after considering the cost of packaging, the financial burden on the public, the sale of oil extracted from the extraction machines in the rural areas, requirement of oil in small quantity from the people in large in rural area, scarcity of new tin in market etc., the Government considers it expedient to grant exemption from the provisions of section 2.3.15 (1) (b) of the said Act in the public interest, to sale loose oils.
Now, therefore, in exercise of powers conferred by proviso to regulations 2.3.15 (1) of the said Regulations and all other poweres enabling it in this behalf, the Government of Maharashtra hereby exempts all the edible oils from the provisions of section 2.3.15 (1) (b) of ths said Act for a period of one year commencing from the date of publication of this notification in the Maharashtra Government Gazette.
