THE MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
No. TPS-2218-CR-259-UD-9-2018.—
Whereas, Development Plan (Revised + Additional Area) of Ballarpur Dist. Chandrapur has been partly sanctioned by the Government vide Urban Development Department's Notification No. TPS-2202- 1260-CR-2(B)-2004-UD-9, dated 16th August 2005 has come into force with effect from Dated 1st October 2005, and Excluded part of Development Plan sanctioned by the Government vide Notification No. TPS- 2202-1260-C.R.2-C-2004-UD-9, Dated 18th June 2008. (hereinafter referred to as " the said Develop- ment Plan ") under Section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Maharashtra Act No. XXXVII of 1966) (hereinafter referred to as " the said Act ") ;
And whereas, in the said Development Plan, land bearing Survey Nos. 162/1, 163, 164 area 1.36 Hectare of Mouje Ballarpur (hereinafter referred to as " the said Land ") ; is included in Reservation No. 95 " Park " (hereinafter referred to as " the said Reservation ") ;
And whereas, the Ballarpur Municipal Council (hereinafter referred to as " the said Planning Authority ") ; vide its General Body Resolution No. 3(1), dated 7th March 2017, has resolved to delete the said Land from the said Reservation and to reserve the said land for " Housing for Dishoused " as per the provisions of sub-section (1) of Section 37 of the said Act, after following the legal procedure laid down under the said Act. (hereinafter referred to as " the said Proposed Modification ") ; The Planning Authority vide Resolution No. 3, Dated 30th June, 2017 has submitted the said proposed modification to the Government for sanction ;
And whereas, in view of above and after making necessary enquiries and after consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of opinion that the said Modi- fication needs to be rejected.
Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 37 of the said Act, the Government of Maharashtra hereby refuses to accord sanction to the said Modification ;
This Notification shall be kept open for inspection by the general public during office hours in the office of the Ballarpur Municipal Council, Ballarpur.
This Notification shall also be available on the Government website www.maharashtra.gov.in (Act & Rules).

Whereas, Development Plan of Kalmeshwar, Dist. Nagpur (Revised + Additional Area) has been sanctioned by the Director of Town Planning, Maharashtra State, Pune vide its Notification No. TPV-2/ 4287, dated 21st July 1992 has come into force with effect from dated 1st October 1992 (hereinafter referred to as " the said Development Plan ") under Section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Maharashtra Act No. XXXVII of 1966) (hereinafter referred to as " the said Act ") ;
४ द्धन्रु]क्ष् रू न् +रून् ॅ-+ न् ह्यम््र ान्म््र, म्न््र २८, २०१९/द्ध ८, ॅ १९४०And whereas, in the said Development Plan, land bearing Survey No. 911, area 1.78 hectare of Mouje Kalmeshwar (hereinafter referred to as " the said Land "), is included in Agriculture/No-Develop- ment Zone ;
And whereas, the Kalmeshwar Municipal Council (hereinafter referred to as " the said Planning Authority "), vide its General Body Resolution No. 6, dated 22nd February 2008, has resolved to delete the said Land from Agriculture/No-Development Zone and include in Residential Zone as per the provi- sions of sub-section (1) of Section 37 of the said Act, after following the legal procedure laid down under the said Act (hereinafter referred to as " the said Proposed Modification "). The Planning Authority vide Resolution No. 8, dated 24th June, 2008 has submitted the said proposed modification to the Government for sanction ;
And whereas, in view of above and after making necessary enquiries and after consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of opinion that the said Modification needs to be rejected.
Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 37 of the said Act, the Government of Maharashtra hereby refuses to accord sanction to the said Modification.
This Notification shall be kept open for inspection by the general public during office hours in the office of the Kalmeshwar Municipal Council, Kalmeshwar.
This Notification shall also be available on the Government website www.maharashtra.gov.in (Act & Rules).
