ORDER

Whereas, the Government of Maharashtra, Urban Development Department vide its Notification No. TPS- 2795-1600-CR-252-95UD-13, Dated 08-07-1998 has partly sanctioned the Revised Development Plan of Yavatmal (hereinafter referred to as "the said Development Plan") under Section 31(1) of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") and the same has came into force with effect from 04-09-1998;

And, whereas, in the said partly sanctioned Development Plan, the land of S. No. 14 (Part) & 15 (Part) of Yavatmal is reserved for Site No. 63 "Site for MHADA Housing Scheme" admeasuring 6.92 hect. (hereinafter referred to as "the said Reservation"); for which Appropriate Authority is MHADA (hereinafter referred to as "the said Appropriate Authority");

And, whereas, the land under said reservation have not been acquired by the said Appropriate Authority within ten years from the date on which the said Development Plan came into force;

And, whereas, the owners of land admeasuring 1.21 hect. from S. No. 15/4A & land admeasuring 1.21 hect. from S. No. 15/4B had served a Notice under Section 127(1) of the said Act, on the said Appropriate Authority vide their letter dated 03-10-2012;

And, whereas, land owner's full land admeasuring 2.42 hect. from S. No. 15/4A and 15/4B is affected by Site No. 63 " Site for MHADA Housing Scheme" (hereinafter referred to as "the said Land");

And, whereas, the said Appropriate Authority, has not acquired or no steps as contemplated in the Section 127(1) of the said Act, has commenced for its acquisition within the period of twelve months from the receipt of the aforesaid notice;

And, whereas, the Hon'ble High Court, Mumbai of Judicature at Nagpur Bench in Writ Petition No. 5752 of 2013 filed by the owners of the said land has passed the order dated 05-02-2015, that the said reservation to the extent of the said land have been lapsed under section 127 of the Said Act;

And, whereas, in accordance with the provision of Section 127(1) of the said Act, the said Reservation, pertain- ing to the said land, has lapsed partly and it is accordingly expedient to notify such lapsing under Section 127(2) of the said Act;

And, whereas, the Government in Urban Development Department under Section 151 of the said Act, vide Resolution No. TPS-1813-3211-CR-508-UD-13, dated 01-12-2016, has delegated the powers exercisable by it under Section 127(2) of the said Act, in respect of Development Plans of all Municipal Councils/Nagar Panchayat and for the Development Plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning Maharashtra State, Pune;

Now, therefore, in exercise of the powers delegated by the Government, in respect of sub-section (2) of Section 127 of the said Act and of all other powers enabling it in that behalf, the Director of Town Planning, Maharashtra State, Pune, hereby notifies that the said Reservation of Site No. 63 "Site for MHADA Housing Scheme" was lapsed partly only in respect of the said Land (as specified in "the Schedule" herein below) and the said land shall become available to the land owners for the purpose of Development as otherwise, permissible in the case of adjacent land, under the said Development Plan;

ORDER

No. DTP-DP Anjangaon Surji (OL)(R)-Site No. 18-Sec 50-TPV-6-7204.–

Whereas, the Revised Development Plan of original limit of Anjangaon Surji has been sanctioned by the Direc- tor of Town Planning, Maharashtra State, Pune vide its Notification No. D. P. Anjangaon Surji/TPV-6/7427, dated 18-12-1992 and came into force w. e. f. 01-03-1993 (hereinafter referred to as "the said Development Plan");

And, whereas, the said Development Plan, Site No. 18 is reserved for "Extention to Panchayat Samiti"having area 1.74 Hect. (hereinafter referred to as "the said reservation") and "Panchayat Samiti Anjangaon Surji" is the Appropriate Authority for the said reservation. (hereinafter referred to as "the said Appropriate Authority"). Out of the land bearing S. No. 125 of village Aivajpur, land admeasuring area 6533.50 Sq. mtr. (hereinafter referred to as "the said land") falls under the said reservation;

And, whereas, the said Appropriate Authority vide its letter No. 2443A, dated 29-05-2018 has submitted the proposal of deletion of the land admeasuring 0.81 Hect. from S. No. 125 of village Aivajpur from the said reservation under Section 50 of Maharashtra Regional Town Planning Act, 1966 (hereinafter referred to as "the said Act") to the Directorate;

And, whereas, though the said Appropriate Authority has no objection for deletion of the said reservation under Section 50, the Anjangaon Surji Municipal Council vide its letter No. 1153 dated 19-04-2018 has communicated its no objection for the said deletion of the said reservation;

And, whereas, Director of Town Planning, Maharashtra State, Pune has called a meeting of Chief Officer, Anjangaon Surji, Municipal Council, the said Appropriate Authority and the land owner on 05-09-2018 to get more clarity regarding deletion of the said reservation Due to programme of Scheduled Caste Welfare Committee the Block Development Officer, Panchayat Samiti, Anjangaon Surji has communicated regarding his absence in this meeting vide letter3996, date 04-09-2018. As per the report of Development Plan area of the said reservation is 1.74 Hect. The said Appropriate Authority has passed the resolution in the monthly meeting date 17-08-2010 and re- quested the Dierctorate for deletion of 0.81 Hect. out of 1.74 Hect. under Section 50 and also requested to keep the reservation as it is on the remaining land vide Letter No. 2443- A-2018, date 29-05-2018. The representative of the Chief Officer, Municipal Council has gave consent for the deletion as per the proposal of the said Appropriate Authority. Therefore, it is now clear that the land admeasuring 6533.50 Sq. mtr. under the said reservation is no longer required to the said Appropriate Authority and the Director of Town Planning, Maharashtra State, Pune is of the opinion that the said proposal should be sanctioned;

And, whereas, the Assistant Director of Town Planning, Amravati Branch, Amravati and the Chief Officer, Municipal Council, Anjangaon Surji vide their letter dated 28-11-2018 and 02-11-2018 respectively communicated that as per the Government directives dated 20-04-2016 out of the said reservation on behalf of the land owner Shri Dilip Mahavirprasad Agarwal have deposited Rs. 2,45,007 towards the 50% Government share of 5% premium amount of land value for an area 6533.50 sq. mtr., as per the rate prescribed in the Annual Statement of Rates (ASR) for the year 2018 in the Government Treasury on 01-11-2018 through the Assistant Director of Town Planning, Amravati Branch, Amravati and remaining 50% of the 5% premium amount Rs. 2,45,007 have deposited to the Planning Authority, on 30-10-2018;

And whereas, the Government in Urban Development Department, vide Resolution No. TPS-1813-3211-CR- 508-UD-13, dated 01-12-2016 has delegated the powers exercisable by it under Section 50(2) of the said Act to the Director of Town Planning, Maharashtra State, Pune in respect of Development Plans of all Municipal Councils/ Nagar Panchayat and for the Development Plans undertaken by Zilla Parishad as Planning Authority;

Now, therefore, the Director of Town Planning, Maharashtra State, Pune hereby sanctions the part deletion the said reservation in respect of the said land under Section 50(2) of the said Act and for the purpose amends the notification of the said Development Plan, sanctioned dated 18-12-1992 as follows :–

Whereas, the Government of Maharashtra, Urban Development Department vide its Notification No. TPS- 2702-601-CR-106(B)-UD-30, Dated 13-07-2005 has sanctioned the Revised Development Plan of Darwha (herein- after referred to as "said Development Plan") under Section 31(1) of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") and the same has come into force with effect from 01-09-2005;

And, whereas, in the said Development Plan, the land of S. No. 114/1 of Darwha is reserved for Site No. 8 "Primary School" admeasuring 1.23 hect. & Site No. 11 "Dispensary & Maternity Home" admeasuring 0.90 hect. (hereinafter referred to as "the said Reservation"); for which Appropriate Authority is Municipal Council, Darwha (hereinafter referred to as "the said Appropriate Authority");

And, whereas, the land under said reservations have not been acquired by the said Appropriate Authority within ten years from the date on which the said Development Plan came into force;

And, whereas, the owners of 2.02 hect. land from S. No. 114/1 had served a Notice under Section 127(1) of the said Act, on the said Appropriate Authority vide their letter dated 15-09-2015;

And, whereas, land owner's full land admeasuring 2.02 hect. from S. No. 114/1 is affected by Site No. 8 " Primary School" & Site No. 11 "Dispensary & Maternity Home" (hereinafter referred to as "the said Land");

And, whereas, the Government in Urban Development Department under Sections 151 of the said Act, vide Resolution No. TPS-1813-3211-CR-508-UD-13, dated 01-12-2016, has delegated the powers exercisable by it under Section 127(2) of the said Act, in respect of Development Plans of all Municipal Councils/Nagar Panchayat and for the Development Plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning Maharashtra State, Pune;

Now, therefore, in exercise of the powers delegated by the Government, in respect of Sub-section (2) of Section 127 of the said Act and of all other powers enabling it in that behalf, the Director of Town Planning, Maharashtra State, Pune, hereby notifies that the said Reservation of Site No. 8 "Primary School" & Site No. 11 "Dispensary & Maternity Home" are lapsed fully only in respect of the said Land (as specified in the Schedule herein below) and the said land shall become available to the land owners for the purpose of Development as otherwise, permissible in the case of adjacent land, under the said Development Plan;

And, whereas, in accordance with the provision of Section 127(1) of the said Act, the part of the said Reserva- tion, pertaining to the said land, has lapsed and it is accordingly expedient to notify such lapsing under Section 127(2) of the said Act;
