क्रमांक एफआरए २०१४/प्र.क्र.१७०/एसएम ६.---महाराष्ट्र शैक्षणिक संस्था (शुल्क विनियमन) अधिनियम, २०११ (२०१४ चा महा. ७) याच्या कलम २२ च्या पोट-कलम (१) द्वारे प्रदान करण्यात आलेल्या शक्तींचा वापर करून आणि यासंदर्भात प्रदान केलेल्या अन्य सर्व अधिकारांचा वापर करून आणि महाराष्ट्र शासन असाधारण राजपत्र, भाग-४-व, दिनांक २४ सप्टेंबर २०१५ मध्ये प्रसिद्ध झालेल्या शासन अधिसूचना, शालेय शिक्षण व क्रीडा विभाग, क्र. शाशैशु. २०१४/प्र.क्र.१७०/एसएम-६, दिनांक २३ सप्टेंबर २०१५ च्या अनुषंगाने प्राप्त झालेले आक्षेप व हरकतींचा विचार करून महाराष्ट्र शासन, याद्वारे, पुढीलप्रमाणे नियम करीत आहे, ते असे :---
नियम
१. संक्षिप्त नाव व प्रारंभ.---(१) या नियमांना, महाराष्ट्र शैक्षणिक संस्था, (शुल्क विनियमन) नियम, २०१६ असे म्हणावे.
(२) हे नियम, राजपत्रात प्रसिद्ध झाल्याच्या दिनांकापासून अंमलात येतील.
२. व्याख्या.---(१) या नियमांमध्ये, संदर्भानुसार दुसरा अर्थ अपेक्षित नसेल तर,----
(क) " अधिनियम " याचा अर्थ, महाराष्ट्र शैक्षणिक संस्था (शुल्क विनियमन) अधिनियम, २०११ (२०१४ चा महा.७) असा आहे;
(ख) " संघ " याचा अर्थ, अधिनियमाच्या कलम ४ च्या पोट-कलम (१) अन्वये घटित केलेला पालक-शिक्षक संघ, असा आहे;
(ग) " नागरीकांचा मागास वर्ग " याचा अर्थ शासनाने घोषित केलेला कोणताही सामाजिक आणि शैक्षणिकदृष्टया नागरीकांचा मागास वर्ग असा आहे आणि यात केंद्र शासनाने महाराष्ट्र राज्याशी संबंधाने घोषित केलेल्या अन्य मागास वर्गाचा समावेश होतो.
(घ) " शुल्क नियामक समिती " याचा अर्थ, नियम ९ च्या उप नियम (२) अन्वये घटित केलेली शुल्क नियामक समिती, असा आहे.
(च) "विद्यार्थी" याचा अर्थ, इयत्ता १ ली ते १२ वी मध्ये शिकत असलेला विद्यार्थी, असा आहे.
(छ) " कार्यकारी समिती " याचा अर्थ, अधिनियमाच्या कलम ४ च्या पोट-कलम (२) नुसार घटित केलेली समिती, असा आहे.
भाग चार--ब----१अ४ महाराष्ट्र शासन राजपत्र भाग चार-ब, गुरुवार ते बुधवार, जानेवारी ३१-फेब्रुवारी ६, २०१९/माघ ११-१७, शके १९४० (२) या नियमांमध्ये वापरलेले परंतु यात वरीलप्रमाणे व्याख्या न केलेले शब्द व शब्दप्रयोग यांचा अधिनियमामध्ये नेमून दिल्यानुसार अर्थ असेल.
३. पालक-शिक्षक संघाची बैठक घेण्यासाठीची कार्यपद्धती.---(१) अधिनियमाच्या कलम ४ च्या पोट-कलम (१) अन्वये घटित केलेल्या पालक-शिक्षक संघाचे अध्यक्ष, मुख्याध्यापक किंवा शाळा प्रमुख असतील. शाळेतील वरिष्ठ शिक्षक हे समितीचे सचिव असतील.
(२) संघाची बैठक, अध्यक्षाकडून आयोजित करण्यात येईल. बैठकीची नोटीस सचिवांकडून नमुना-एक मध्ये किमान १५ दिवस अगोदर काढण्यात येईल.
(३) नोटिशीमध्ये बैठकीचे ठिकाण, वेळ व कामकाजाची विषयपत्रिका यांचा समावेश असेल. ही नोटीस शाळेच्या सूचना फलकावर लावण्यात येईल, तसेच ती प्रत्येक वर्गात फिरविण्यात येईल, आणि शाळेमध्ये संकेतस्थळाची सुविधा उपलब्ध असल्यास, ती शाळेच्या संकेतस्थळावरही प्रसिद्ध करण्यात येईल.
(४) एकूण सदस्य संख्येपैकी किमान दहा टक्के सदस्य उपस्थित असतील तरच बैठक घेण्यात येईल. उपस्थिती कमी असेल तर, अध्यक्ष अर्धा तासासाठी बैठक स्थगित करतील. गणपूर्ती पूर्ण होत नसेल तर, बैठक रद्द करण्यात येईल व वरील कार्यपद्धतीचा अवलंब करून पंधरा दिवसानंतर बैठक आयोजित करण्यात येईल.
(५) अध्यक्ष हे प्रत्येक बैठकीचे अध्यक्ष म्हणून काम पाहतील आणि त्यांच्या अनुपस्थितीत, बैठकीस उपस्थित असलेल्या सदस्यांपैकी ज्यांची त्यावेळी अध्यक्ष म्हणून निवड करण्यात येईल, असा कोणताही एक सदस्य अध्यक्षस्थानी असेल.
(६) संघाचे सचिव बैठकीच्या दिनांकापासून पंधरा दिवसांच्या आत बैठकीचे कार्यवृत्त तयार करतील. सदर कार्यवृत्त शाळेच्या सूचना फलकावर लावण्यात येईल आणि संकेतस्थळाची सुविधा उपलब्ध असल्यास, ते शाळेच्या संकेतस्थळावर प्रसिद्ध करण्यात येईल. बैठकीच्या कामकाजाचे व्हिडिओ रेकर्ॉडिगदेखील करण्यात येईल आणि ते संघाच्या सदस्यांना उपलब्ध करून देण्यात येईल. बैठकीचे व्हिडिओ रेकर्ॉडिग आवश्यकता असेल तेव्हा, विभागीय शिक्षण उपसंचालक किंवा शिक्षणाधिकारी किंवा त्याने अथवा शासनाने नियुक्त केलेला इतर कोणताही प्रतिनिधी यांना उपलब्ध करून देण्यात येईल.
४. संघाची कर्तव्ये व कार्ये.---संघ, पुढील कर्तव्ये व कार्ये पार पाडील:---(एक) कार्यकारी समितीने ठरविल्याप्रमाणे, शिकवणी शुल्क, सत्र शुल्क व अभ्यासांतर्गत उपक्रमांसाठी शुल्क याविषयीची माहिती मिळविणे;
(दोन) नियोजनानुसार पाठयक्रम पूर्ण झाला आहे किंवा कसे याचे निरीक्षण करणे;
(तीन) शैक्षणिकदृष्टया मागे पडलेल्या विद्याथ्यार्ंसाठी उपाययोजना सुचविणे;
(चार) अभ्यासांतर्गत इतर उपक्रमांचे नियोजन करण्यासाठी शाळांना सहाय्य करणे;
(पाच) अभ्यासांतर्गत उपक्रमांची आवश्यकता तपासणे.
५. कार्यकारी समितीवर अनुसूचित जाती, अनुसूचित जमाती किंवा नागरीकांचा मागासवर्गातील व्यक्तींची आणि महिला सदस्यांची नियुक्ती करणे.---कार्यकारी समितीवर, अनुसूचित जाती, अनुसूचित जमाती किंवा नागरीकांचा मागासवर्ग या प्रवगार्ंना प्रतिनिधीत्व मिळेल यादृष्टीने या सर्व प्रवर्गातील कमीत कमी एका सदस्याची चक्रीय पद्धतीने नियुक्ती करण्यात येईल. सुरुवातीला अनुसूचित जाती प्रवर्गातील व्यक्ती व त्यानंतर अनुक्रमे अनुसूचित जमाती, विमुक्त जाती (अ), भटक्या जमाती (ब), भटक्या जमाती (क), भटक्या जमाती (ड), विशेष मागास प्रवर्ग, इतर मागासवर्ग आणि नागरीकांचा मागासवर्ग यातील व्यक्ती सदस्य राहील. एखाद्या वर्षी ज्या प्रवर्गासाठी पद आरक्षित असेल त्या प्रवर्गातील सदस्य उपलब्ध झाला नाही तर, पुढील प्रवर्गातील सदस्याची नियुक्ती करता येईल आणि किमान पन्नास टक्के सदस्य महिला असतील.
६. कार्यकारी समिती स्थापन करण्याची कार्यपद्धती.---(१) कार्यकारी समितीच्या स्थापनेसंदर्भातील कार्यपद्धतीबाबत शाळेच्या प्रत्येक वर्गात व्यापक प्रसिद्धी देण्यात येईल. कार्यकारी समिती स्थापन करण्याची नोटीस, पालक-शिक्षक संघाची स्थापना केल्यापासून दहा दिवसांच्या आत शाळेच्या सूचना फलकावर लावण्यात येईल आणि संकेतस्थळाची सुविधा उपलब्ध असल्यास शाळेच्या संकेतस्थळावर प्रर्दशित करण्यात येईल.
(२) प्रत्येक इयत्तेतील विद्याथ्यार्ंच्या इच्छुक पालकांकडून लेखी अर्ज किंवा ऑनलाईनची सुविधा उपलब्ध असल्यास ऑनलाईन अर्ज सोडतीच्या दिनांकापूर्वी मागविण्यात येतील.
(३) प्राप्त झालेल्या अजार्ंमधून सोडत काढण्यात येईल. सोडत काढलेल्या बैठकीचे तपशीलवार कार्यवृत्त सर्व पालकांमध्ये फिरविण्यात येईल. संपूर्ण प्रक्रियेचे व्हिडिओ रेकॉर्डिंग करण्यात येईल आणि प्रक्रियेच्या पारदर्शकतेची तपासणी करण्यासाठी, हे रेकॉर्डिंग सर्व संबंधितांसाठी खुले ठेवण्यात येईल.
महाराष्ट्र शासन राजपत्र भाग चार-ब, गुरुवार ते बुधवार, जानेवारी ३१-फेब्रुवारी ६, २०१९/माघ ११-१७, शके १९४० ५७. कार्यकारी समितीची कर्तव्ये व कार्ये.--- समिती, पुढील कर्तव्ये व कार्ये पार पाडील :--
(१) कार्यकारी समिती अधिनियम व नियमातील तरतुदींची काटेकोरपणे पालन करेल;
(२) शुल्क निश्चिती संदर्भात प्राप्त झालेले प्रस्तावावर विहित मुदतीत कार्यवाही पूर्ण करेल;
(३) व्यवस्थापनाने विभागीय शुल्क नियामक समितीकडे अपील केलेले असल्यास आवश्यक ते कागदपत्रे उपलब्ध करून देईल;
(४) विभागीय शुल्क नियामक समितीच्या निर्णयाने व्यथित होऊन व्यवस्थापनाने पुनरीक्षण समितीकडे अपील केले असल्यास सर्व प्रकारची कागदपत्रे उपलब्ध करून देईल;
(५) कार्यकारी समितीने मान्य केलेला शुल्क निश्चितीबाबतचा अभिलेख जतन करावा.
८. कार्यकारी समितीची बैठक आयोजित करण्याची कार्यपद्धती.--- (१) कार्यकारी समितीचा अध्यक्ष, कार्यकारी समितीची बैठक बोलावेल. सचिव हा सदर बैठकीची सूचना नमुना दोन मध्ये कार्यकारी समितीच्या सदस्यांना किमान पंधरा दिवस अगोदर देईल.
(२) सदर नोटीस कार्यकारी समितीच्या प्रत्येक सदस्याला, नोंदणीकृत डाकेने किंवा समितीकडून ठरविण्यात येईल अशा अन्य कोणत्याही इलेक्ट्रॉनिक माध्यमाद्वारे देण्यात येईल. त्याबाबतचा दस्तऐवज एका वर्षासाठी जतन करण्यात येईल.
(३) एकूण सदस्य संख्येपैकी किमान एक तृतीयांश सदस्य उपस्थित असतील तरच बैठक घेण्यात येईल, तथापि, कार्यकारी समितीच्या एकूण सदस्यांपैकी पन्नास टक्क्यांहून अधिक पालकांनी उपस्थित असणे आवश्यक राहील. बैठकीत गणपूर्ती पूर्ण होत नसल्यास, कार्यकारी समितीचे अध्यक्ष बैठक स्थगित करतील. गणपूर्ती पूर्ण होत नसल्यास, बैठकीत कोणतेही कामकाज करण्यात येणार नाही. गणपूर्ती अभावी बैठक रद्द करण्यात येईल आणि रद्द केलेल्या बैठकीच्या दिनांकापासून पंधरा दिवसांनंतर, या नियमामध्ये नमूद केलेल्या कार्यपद्धतीचा अवलंब करून, बैठक पुन्हा बोलविण्यात येईल.
(४) कार्यकारी समितीचे सचिव, बैठकीचे कार्यवृत्त तयार करतील आणि बैठकीच्या दिनांकापासून पंधरा दिवसांच्या आत ती सर्व सदस्यांना पाठवतील.
(५) बैठकीच्या कामकाजाचे व्हिडिओ रेकॉर्डिंग करण्यात येईल आणि ते शिक्षणाधिकारी किंवा विभागीय शिक्षण उपसंचालक किंवा समितीचे सदस्य यांना तपासणीसाठी आवश्यक तेव्हा उपलब्ध करून देण्यात येईल.
(६) एखादा सदस्य सलग तीन बैठकींना अनुपस्थित असेल तर त्याचे सदस्यत्व रद्द झाले असे समजण्यात येईल. नियम ७ नुसार, त्या शैक्षणिक वर्षासाठी प्राप्त झालेल्या अजार्ंमधून सोडत काढून सदर रिक्त जागा भरण्यात येईल.
९. अधिनियमाच्या कलम ६ नुसार स्थापन केलेल्या विभागीय शुल्क नियामक समिती आणि पुनरीक्षण समिती यांच्याकडे प्रस्ताव विचारार्थ पाठविण्याची कार्यपद्धती.--- (१) शाळा व्यवस्थापन, पुढील शैक्षणिक वर्ष सुरु होण्याच्या किमान सहा महिने अगोदर नमुना तीन मधील शुल्कासाठीचा प्रस्ताव कार्यकारी समितीला सादर करेल.
(२) कार्यकारी समितीने शुल्काबाबत कलम ६ च्या पोट-कलम (३) मध्ये विर्िनदिष्ट केलेल्या कालावधीत निर्णय दिला नाही तर, व्यवस्थापन कार्यकारी समितीला त्याबाबत माहिती देऊन त्यांच्याकडे सादर केलेल्या प्रस्तावाच्या प्रतीसह, प्रकरण विभागीय शुल्क नियामक समितीकडे नमुना चार मध्ये सादर करेल .
(३) व्यवस्थापनाने ठरविलेले शुल्क आणि कार्यकारी समितीने मान्यता दिलेले शुल्क यांच्यातील तफावत पंधरा टक्क्यांपेक्षा अधिक असेल तर, व्यवस्थापनास याबाबतची मान्यता प्राप्त झाल्याच्या दिनांकापासून तीस दिवसांच्या कालावधीत व्यवस्थापनाने सादर केलेला शुल्काबाबतचा प्रस्ताव आणि कार्यकारी समितीने दिलेला निर्णय याच्या प्रतीसह, कलम ६ च्या पोट-कलम ५ नुसार विभागीय शुल्क नियामक समितीकडे नमुना ५ मध्ये अपील करता येईल.
(४) विभागीय शुल्क नियामक समितीच्या निर्णयाने व्यथित झालेले व्यवस्थापन किंवा कार्यकारी समिती यांना या निर्णयाच्या दिनांकापासून तीस दिवसांच्या आत, व्यवस्थापनाकडून सादर केलेला प्रस्ताव आणि कार्यकारी समिती व विभागीय शुल्क नियामक समितीच्या निर्णयाची प्रत यासह कलम ६ च्या पोट-कलम (७) नुसार नमुना सहा मध्ये पुनरीक्षण समितीकडे अपील दाखल करता येईल.
१०. पुनरिक्षण समितीचे तसेच विभागीय शुल्क नियामक समितीचे अध्यक्ष व सदस्य यांचे वेतन व भत्ते.--- (१) पुनरिक्षण समितीचे तसेच विभागीय शुल्क नियामक समितीचे अध्यक्ष व सदस्य यांचे वेतन व भत्ते या संदर्भात शासनाकडून वेळोवेळी काढण्यात येणाया आदेशान्वये निश्चित केलेले वेतन व भत्ते अदा करण्यात येतील.
(२) सनदी लेखापाल अथवा व्यय व कामे लेखापाल यांना शासन वेळोवेळी काढण्यात येणाया आदेशान्वये निश्चित केलेले वेतन व भत्ते अदा करण्यात येतील.
११. कलम ९ च्या प्रयोजनार्थ शुल्क निश्चित करण्यासाठीचे अतिरिक्त घटक.--- शुल्क निश्चित करताना, अधिनियमाच्या कलम ९ च्या पोट-कलम (१) मध्ये नमूद केलेल्या घटकांव्यतिरिक्त पुढील घटक विचारात घेण्यात येतील :----
६ महाराष्ट्र शासन राजपत्र भाग चार-ब, गुरुवार ते बुधवार, जानेवारी ३१-फेब्रुवारी ६, २०१९/माघ ११-१७, शके १९४०(एक) शाळांकडून ई-गव्हर्नन्स देण्यात येणा-या सुविधा, म्हणजेच हार्डवेअर व सॉफ्टवेअर विषयक सुविधा;
(दोन) विद्याथ्यार्ंची पटसंख्या;
(तीन) विद्याथ्यार्ंना तरण तलाव, घोडेस्वारी, नेमबाजी, धनर्ुविद्या, प्रयोगनिष्ठ कला (Performing Arts) इत्यादी सारख्या उपलब्ध करून देण्यात आलेल्या अन्य सुविधा;
(चार) विद्याथ्यार्ंना पुरविण्यात आलेली पाठयपुस्तके, वह्य इत्यादीं व अन्य शैक्षणिक साहित्य;
(पाच) शालेय बसची क्षमता, शाळेचे अंतर आणि तुलनात्मक इंधन दर विचारात घेऊन निश्चित केलेले वाहतूक शुल्क;
(सहा) मध्यान्ह भोजन किंवा अल्पोपहाराची व्यवस्था;
(सात) कार्यकारी समितीच्या पूर्व मंजुरीने अन्य कोणतीही मान्य बाब.
१२. कलम १४ च्या प्रयोजनार्थ लेखे ठेवणे.--- (१) खाजगी शैक्षणिक संस्था खाली नमूद केल्याप्रमाणे लेखे ठेवतील :----
(क) प्रत्येक खाजगी शैक्षणिक संस्था, गोळा केलेले शुल्क, प्राप्त झालेले अनुदान, मिळालेले वित्तिय सहाय्य, कर्मचायांना देण्यात येणारे वेतन, यंत्रसामग्री व साधनसामग्री, प्रयोगशाळा साहित्य आणि रसायने, ग्रंथालयातील पुस्तके, लेखनसामुग्री यांची खरेदी, संगणक, सॉफ्टवेअर आणि केलेला अन्य खर्च अशा वेगवेगळया र्आथिक व्यवहाराकरिता स्वतंत्र लेखे ठेवतील.
(ख) प्रत्येक खाजगी शैक्षणिक संस्था त्यांच्या नोंदवह्य, लेखे व अभिलेख हे शैक्षणिक संस्थेच्या परिसरात ठेवेल, जेणेकरून ते योग्य वेळेमध्ये तपासणीकरिता उपलब्ध होऊ शकेल.
(ग) खाजगी शैक्षणिक संस्थेने ठेवलेले लेखे तसेच विविध बाबींशी अथवा जमा रकमा व खर्च यांच्याशी संबंधित सर्व प्रमाणके, लेख्यांची लेखापरीक्षा होईपयर्ंत आणि कोणतेही आक्षेप असल्यास त्यांचे निराकरण होईपयर्ंत, त्या शाळेकडून जतन करण्यात येतील.
(२) खाजगी शिक्षण संस्थेस, शासनाकडून वेळोवेळी निर्गमित करण्यात येणाया आदेशानुसार संस्थेचे अन्य अभिलेख देखील जतन करणे आवश्यक राहील.
(३) कलम १५ च्या प्रयोजनार्थ अभिलेख ठेवणे.---- (१) प्रत्येक खाजगी शैक्षणिक संस्थेस अधिनियमाच्या व नियमांच्या प्रयोजनांसाठी खालील नोंदवह्य व अभिलेख ठेवणे आवश्यक राहील.

NOTIFICATION
MAHARASHTRA EDUCATIONAL INSTITUTIONS (REGULATION OF FEE) ACT, 2011.
No. FRA2014/CR170/SM6.—In exercise of the powers conferred by sub-section (1) of section 22 of the Maharashtra Educational Institutions (Regulation of Fee) Act, 2011 ( Mah. VII of 2014), and of all other powers enabling it in that behalf, the Government of Maharashtra after considering the objections and suggestions pursuant to the Government Notification, School Education and Sports Department, No. Shashaishu 2014/ CR170/ SM6, dated the 23rd September 2015, published in the Maharashtra Government Gazette, Extra-ordinary, Part IV-B, dated the 24th September 2015, is hereby pleased to make the following rules, namely :—
RULES
1. Short title and commencement.—(1) These rules may be called the Maharashtra Educational Institutions (Regulation of Fee) Rules, 2016.
(2) They shall come into force with effect from the date of publication of these rules in the Official Gazette.
2. Definitions :—(1) In these rules, unless the context otherwise requires,—
(a) "Act" means the Maharashtra Educational Institutions (Regulation of Fee) Act, 2011 (Mah. VII of 2014);
(b) "Association" means the Parent-Teachers Association constituted under sub-section (1) of section 4 of the Act.
(c) " Backward Class of Citizens " means any Socially and Educationally Backward Classes of Citizens as declared by the Government and includes other Backward Classes declared by Government of India in relation to the State of Maharashtra;
(d) " Fee Regulation Committee" means the Fee Regulation Committee constituted under sub-rule (2) of rule 9 ;
(e) "student" means student studying in 1st to 12th standard.
(f) " Executive Committee" means the Executive Committee constituted under sub- section (2) of section 4 ;
(2) The words and expressions used in these rules but not defined hereinabove shall have the same meanings as respectively assigned to them.
3. Procedure for conducting meeting of Parent-Teachers Association.—(1) The Principal or Head of the school shall be the Chairperson of the Parent Teachers Association constituted under sub-section (1) of section 4 of the Act. The Secretary of the Association shall be a Senior Teacher of the School.
(2) The Chairperson of the Association shall call the meeting of the Association. The Secretary shall issue notice of the meeting in Format-I, to all the parents, fifteen days in advance.
(3) The notice shall contain the place, time and agenda of the meeting. The notice shall be displayed on school notice board. It shall also be circulated in each classroom and be uploaded on school's website, if such facility is available.
(4) The meeting shall be conducted only if at least ten percent of the members of total strength are present. If attendance is less, the Chairperson shall adjourn the meeting for half an hour. If quorum is not fulfilled, the meeting shall be cancelled and shall be recalled after fifteen days by following the above procedure.
(5) Every meeting shall be presided over by the Chairperson and in his absence, by any one of the members present as may be chosen in the meeting to be the Chairperson for the occasion.

The proceeding shall be displayed on school notice board and be uploaded on School's website if, such facility is available. The proceeding of the meeting shall also be video recorded and shall be made available to members of the Association. The video recording of the meeting shall also be made available to the Regional Deputy Director or Education Officer or any other representative appointed by him or Government as and when required.
4. Duties and functions of Association.—The Association shall discharge the following duties and perform the following functions, namely :—
(i) to get information about Tuition fees, Term fees and fees for co-curricular activities as decided by Executive Committee;
(ii) to observe completion of syllabus as per the planning ;
(iii) to suggest measures and steps to be taken for academically weaker students;
(iv) to assist school for planning other co-curricular activities ;
(v) to assess the need of co-curricular activities.
5. Appointment of Scheduled Caste, Scheduled Tribes or Backward Class of Citizens and Women members on Executive Committee.—On the Executive Committee, at least one member belonging to the Scheduled Castes, Scheduled Tribes or Backward Class of Citizens shall be appointed by rotation so that every category gets representation, in every year. The First member shall a person belonging to the Scheduled Caste, followed by Scheduled Tribes, Denotified Tribes, Vimukt Jatis (A), Nomadic Tribes (B), Nomadic Tribes (C), Nomadic Tribes (D), Special Backward class, Other Backward class and Backward Class of citizens, respectively. If a member belonging to the category for which post is reserved in the year is not available, then a member belonging to the next category may be appointed and at least fifty percent of the members shall be women.
6. Procedure to constitute Executive Committee.—(1) The wide publicity about the process of constitution of the Executive Committee shall be given in each class of the school. The notice of constitution of the Executive Committee shall be displayed on school's notice board and school's website, if such facility is available, within ten days of the formation of Parent-Teachers Association.
(2) The applications shall be invited from the willing parents of each Standard, in written or online, before the date of lottery draw, if such facility is available.
(3) A lottery shall be drawn from the applications received. The detailed proceeding of the meeting where lottery has been drawn shall be circulated to all the parents. The entire process shall be video recorded and the recording will be open for all concerned to examine the transparency of the process.
7. Duties and functions of Executive Committee.—The Committee shall discharge the following duties and perform the following functions, namely :—
(1) to oversee that provisions made in Act and Rules are implemented strictly ;
(2) to take decision on proposals received from Management, regarding determination of fee within prescribed time ;
(3) Where, appeal is made by Management to the Divisional Fee Regulatory Committee, make necessary documents available ;
(4) Where, appeal is made by Management to the Revision Committee, make necessary document available ;
(5) to grant approval as per provisions of rule 11 (vii).
8. Procedure to conduct meeting of Executive Committee.—(1) The Chairperson of the Executive Committee shall call the meeting of the Executive Committee. The Secretary shall issue notice of such meeting in Format II, to the members of the Executive Committee, fifteen days in advance.

The acknowledgement shall be preserved for a period of one year.
(3) The meeting shall be conducted only if at least one-third members of the total strength are present, however, more than fifty percent of the parents out of the total members of the Executive Committee should be present. If there is no quorum, the Chairperson of the Executive Committee shall adjourn the meeting. No business shall be transacted in the meeting unless there is a quorum. In the absence of the quorum the meeting shall be cancelled and recalled again after the lapse of fifteen days from the date of the meeting which is cancelled by following the procedure mentioned in this rule.
(4) The Secretary of the Executive Committee shall prepare proceedings of the meeting and circulate the same to all the members within fifteen days from the date of the meeting.
(5) The proceedings of the meeting shall be video recorded and will be made available for inspection to the Education Officers or Regional Deputy Director of Education or Committee members as and when required.
(6) If a member is absent for three consecutive meetings his membership shall be deemed to be cancelled. The vacancy shall be filled in by lottery, from amongst the applications received for that academic year under rule 7.
9. Procedure to refer proposal to Divisional Fee Regulatory Committee and Revision
Committee under section 6 of the Act.—
(1) The Management of the school shall submit fee proposal to the Executive Committee at least six months before the commencement of the next academic year in Format III.
(2) If the Executive Committee fails to decide the fees within the period specified in sub- section (3) of section 6, the management shall immediately refer the matter to the Divisional Fee Regulatory Committee for its decision under intimation to the Executive Committee along with the proposal so submitted to the Executive Committee, in Format IV.
(3) If the difference between the fees decided by the management and the fees approved by the Executive Committee is more than fifteen percent, then, the management may prefer an appeal to the Divisional Fee Regulatory Committee within a period of thirty days from the date of such communication under sub-section (5) of section 6 alongwith proposal of fees submitted by management and copy of decision of the Executive Committee, in Format V. (4) The management or the Executive Committee aggrieved by the decision of the Divisional Fee Regulatory Committee in appeal or reference may, within thirty days from the date of such decision prefer an appeal before the Revision Committee along with the proposal of fees submitted by management alongwith the copy of the decision of the Executive Committee and Divisional Fee Regulatory Committee, in Format VI.
10. Salaries and allowances of Chairperson and members of the Divisional Fee Regulatory
Committee and Revision Committee.-
(1) The salaries and allowances of the Chairperson and members of the Divisional Fee Regulatory Committee and Revision Committee shall be fixed by the Government by an order issued in this behalf from time to time.
(2) A Chartered Accountant or Cost and Works Accountant shall be paid such allowances, as may be decided by Government by an order issued, from time to time.
11. Additional factors for determination of fee for purpose of section 9.- The following factors shall be considered while deciding the fee in addition to the factors mentioned in sub-section (1) of section 9 of the Act, namely :—
(i) facilities given by schools under e-governance i.e. hardware and software facilities;
(ii) strength of students;

(iv) supply of books, notebooks, etc., and other educational material provided to students;
(v) transport fee considering capacity of school bus, distance of school and comparative fuel rates;
(vi) provision of Mid-Day Meal or snacks;
(vii) Any other factor approved by Executive Committee.
12. Maintenance of accounts under section 14.—(1) The private educational institutions shall maintain the accounts in the following manner, namely :—
(a) Every private educational institution shall keep separate accounts for different kinds of transactions, such as, fees collected, grants received, financial assistance received, payments of salary to staff, purchase of machinery and equipment, laboratory apparatus and consumables, library books, stationery, computers, software and other expenditure incurred.
(b) Every private educational institution shall keep the registers, accounts and records within the premises of their educational institution as they shall be made available at all reasonable time for inspection.
(c) The accounts maintained by the private educational institution together with all vouchers relating to various items or receipts and expenditure shall be preserved by that school until the audit of accounts is over and objection, if any, raised is settled.
(2) The private educational institution shall also maintain the other record of the institution as per the orders issued by the Government, from time to time.
(3) Maintenance of record for purposes of section 15.—(1) Every private educational institution shall maintain the following registers and records for the purposes of the Act and the rules :—
(a) General Register.
(b) Admission Registers.
(c) Fee receipt.
(d) Fee Collection Register.
(e) Cash Book.
(f) Library and Reading Room Account.
(g) Staff Attendance Register.
(h) Students Attendance Register.
(i) Voucher File.
(j) Cheque register.
(k) Acquaintance Roll.
(l) Stock Registers.
(m) Transfer Certificate Book.
(n) Examination Fees Collection Receipt.
(o) Contingency Expenditure Register.
(p) Asset register.
(q) Building rent register.

No. IDC 2013/(328)/Ind 14.- In exercise of the powers conferred by sub-section (3) of Section 1 of the Maharashtra Industrial Development Act, 1961 (Mah. III of 1962), the Government of Maharashtra hereby appoints 17th March 2016 to be the date from which the provisions Chapter VI of the said Act shall take effect in certain areas of Villages Hinganvedhe, Jakhori in Taluka Nashik of District Nashik, Pimpalgaon Nipani in Taluka Niphad of District Nashik and Deshvandi, Paatpimpri and Gulvanch in Taluka Sinnar of District Nashik mentioned in the Schedule appended hereto and declares the said area to be an industrial area under clause (g) of section 2 of the said Act, for the purposes of the said Act.

क्रमांक आयडीसी. २०१३/(३२८)/उद्योग-१४.---- ज्याअर्थी, अनुसूचीत उल्लेखिलेल्या क्षेत्रात महाराष्ट्र औद्योगिक विकास अधिनियम, १९६१ चे प्रकरण सहा, जे अधिसूचना क्रमांक आयडीसी २०१०/(८७३)/उ-१४, दिनांक २९ ऑक्टोबर २०१० अन्वये महाराष्ट्र शासनाने सदर अधिसूचनेच्या अनुसूचीत उल्लेखिलेल्या क्षेत्रात महाराष्ट्र औद्योगिक विकास अधिनियम, १९६१ (१९६२ चा महा. तीन) (यात यापुढे ज्याचा उल्लेख "उक्त क्षेत्र" असा करण्यात येईल) चे कलम सहा, दिनांक २९ ऑक्टोबर २०१० रोजी अंमलात आणले होते व उक्त अधिनियमाच्या आधारे उक्त अनुसूचीत नमूद केलेले क्षेत्र अधिनियमाच्या कलम २ खंड (ग) अन्वये औद्योगिक क्षेत्र म्हणून जाहीर केलेले आहे ;
आणि ज्याअर्थी, यासोबत जोडलेल्या अनुसूचीत उल्लेखिलेल्या हिंगणवेढे, जाखोरी, तालुका नाशिक, जिल्हा नाशिक, पिंपळगाव निपाणी, तालुका निफाड, जिल्हा नाशिक व देशवंडी, पाटप्रिंप्री, गुळवंच व जोगलटेंभी, तालुका सिन्नर, जिल्हा नाशिक येथील काही जमिनी अधिसूचनेच्या अनुसूचीत उल्लेखिलेल्या क्षेत्रात (यात यापुढे ज्याचा उल्लेख "उक्त क्षेत्र" असा करण्यात येईल) औद्योगिक क्षेत्राच्या विकासासाठी आवश्यक नाहीत असे महाराष्ट्र सरकारचे मत झाले आहे.
त्याअर्थी, उक्त अधिनियमाच्या कलम १ पोट-कलम (३) व कलम २, खंड (ग) अन्वये प्रदान केलेल्या शक्तींचा वापर करून व महाराष्ट्र जनरल क्लॉजेस अॅक्टच्या कलम २१ सह वाचावे (१९०४ चा १) चा संदर्भ घेऊन महाराष्ट्र शासन याद्वारे खालील उल्लेख केलेल्या क्षेत्रात ज्या गोष्टी झाल्या आहेत किंवा ज्या गोष्टी करावयाच्या ठरविल्या आहेत त्या सोडून महाराष्ट्र औद्योगिक विकास अधिनियम, १९६१ चे कलम प्रकरण सहा, दिनांक १७ मार्च २०१६ पासून रद्द करीत आहे आणि सदर क्षेत्र हे जाहीर केलेल्या औद्योगिक क्षेत्राचा भाग राहणार नाही.

NOTIFICATION
MAHARASHTRA INDUSTRIAL DEVELOPMENT ACT, 1961.
No. IDC. 2013/(328)/IND 14.—Whereas, by Government Notification, Industries, Energy and Labour Department, No. IDC. 2010/(873)/IND-14, dated the 29th October 2010, issued in exercise of the powers conferred by sub-section (3) of section 1 of the Maharashtra Industrial Development Act, 1961 (Mah. III of 1962) (hereinafter referred to as '' the said Act"), the Government of Maharashtra has appointed the 29th October 2010, to be the date from which the provisions of Chapter VI of the said Act shall take effect in the areas mentioned in the Schedule appended to the said notification and declared those areas as an industrial area under clause (g) of section 2 of the said Act ;
And whereas, the Government of Maharashtra is of the opinion that the certain areas of said Industrial area in the Villages Hinganvedhe, Jakhori in Taluka Nashik of District Nashik, Pimpalgaon Nipani in Taluka Niphad of District Nashik and Deshvandi, Paatpimpri, Jogeltembi and Gulvanch in Taluka Sinnar of District Nashik, mentioned in the Schedule appended hereto (hereinafter referred to as "the said area"), are not required for the purpose of development as an Industrial area.
Now, therefore, in exercise of the powers conferred by the first proviso to sub-section (3) to sub-section 1 and clause (g) of section 2 of the said Act read with section 21 of the Maharashtra General Clauses Act (I of 1904) and of all other powers enabling it in this behalf, the Government of Maharashtra hereby, with effect from the 17th March 2016 declares that the provisions of Chapter VI of the said Act shall cease to be in force in the said areas and the said areas shall not be the Industrial area so declared, except as respect things done or omitted to be done before that date.

क्रमांक आयडीसी. २०१३/(३२८)/उद्योग-१४.-----ज्याअर्थी, महाराष्ट्र शासनास महाराष्ट्र औद्योगिक विकास अधिनियम, १९६१ (१९६२ चा महा. ३) (ज्यास यापुढे '' उक्त अधिनियम '' संबोधण्यात येत आहे) च्या कलम १ उप कलम ३ अन्वये उद्योग, ऊर्जा व कामगार विभागाची अधिसूचना क्रमांक आयडीसी. २०१०/(८७३)/उद्योग-१४, दिनांक २९ ऑक्टोबर २०१० पासून खालील अधिसूचना व त्यासोबत जोडलेल्या परिशिष्टात नमूद केलेल्या जमिनींना प्रकरण ६ लागू झाले आहे असे समजण्यात येईल व सदर जमिनी उक्त अधिनियमाच्या कलम २ उप कलम (ग) नुसार औद्योगिक क्षेत्रासाठी अधिसूचित झाल्या आहेत असे समजण्यात येईल ;
आणि जर, मौजे हिंगणवेढे, जाखोरी, ता. नाशिक, जि. नाशिक, पिंपळगाव निपाणी, तालुका निफाड, जिल्हा नाशिक व देशवंडी, पाटपिंप्री, गुळवंच व जोगलटेंभी, तालुका सिन्नर, जिल्हा नाशिकमधील औद्योगिक क्षेत्रातील, सदर परिशिष्टात नमूद केलेल्या जमिनीच्या क्षेत्रफळामध्ये व प्रत्यक्ष संयुक्त मोजणीनंतर (महसुली अभिलेख नमुना क्रमांक ७ व १२) व संपादनासाठी निश्चित केलेल्या क्षेत्रफळामध्ये तफावत असल्याचे महाराष्ट्र शासनाच्या निदर्शनास आणले गेले व ज्यामुळे सदर अधिसूचनेत दुरूस्ती होणे महाराष्ट्र शासनास गरजेचे वाटत असेल ;
तर, महाराष्ट्र सामान्य कलमे कायदा, १९०४ च्या कलम २१ सोबत वाचण्यात येणाया उक्त अधिनियमाच्या कलम १, उप कलम ३ आणि कलम २ चे उप कलम (ग) अन्वये प्रदान करण्यात आलेल्या अधिकारांतर्गत महाराष्ट्र शासन असे जाहीर करते की, दिनांक १७ मार्च २०१६ पासून सदर अधिसूचनेत खालीलप्रमाणे बदल लागू झाले आहेत असे मानण्यात येईल.

AMENDMENT
No. IDC. 2013/(328)/IND-14.—Whereas, by the Government Notification, Industries, Energy and Labour Department, No. IDC. 2010/(873)/IND -14, dated 29th October 2010 (hereinafter referred to as "the said Act"), issued in exercise of the powers conferred by sub-section ( 3) of section 1 of the Maharashtra Industrial Development Act, 1961(Mah. III of 1962) (hereinafter referred to as "the said Act"), the Government of Maharashtra has appointed the 29th October 2010 to be the date from which the provisions of Chapter- VI of the said Act shall take effect in the areas mentioned in the Schedule appended to the said notification and declared those areas as an industrial area under clause (g) of section 2 of the said Act.
And Whereas, it is brought to the notice of the Government of Maharashtra that there is a difference in the measurements of certain areas of the said industrial area and in an areas confirmed for acquisition after actual joint measurement (revenue record in the forms VII and XII) of villages Hinganvedhe, Jakhori in Taluka Nashik of District Nashik, Pimpalgaon Nipani in Taluka Niphad of District Nashik and Deshvandi, Paatpimpri, Jogeltembi and Gulvanch in Taluka Sinnar of District Nashik, and the Government of Maharashtra considers it expedient to amend the said notification so as to mention the correct areas with respect to the said industrial area in the said notification.
Now, therefore, in exercise of the powers conferred by sub- section (3) of section 1 and clause (g) of section 2 of the said Act read with section 21 of the Maharashtra General Clauses Act (I of 1904), and of all other powers enabling it in this behalf, the Government of Maharashtra hereby, with effect from the 17th March 2016 amends the said notification, as follows, namely:—
