URBAN DEVELOPMENT DEPARTMENT

MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.

ORDER

No. TPS-2415-180-CR-96-UD-9-2015.—

Whereas, Revised Development Plan of Nagpur has been sanctioned by the Government vide Urban Development Department's Notification No. TPS-2496-2643-CR-300(A)-97-UD-9, dated the 7th January, 2000 and 2nd Notification No. TPS-2400-1628-CR-200-2000-UD-9, dated 10th September, 2001 has come into force with effect from the 1st March, 2000 and 21st Septemebr, 2001. Also Nagpur Improvement Trust has been declared as "Planning Authority" for the seven Improvement Schemes being completed by the Nagpur Improvement Trust vide Government Notification No. TPS-2401-855-CR-76-UD-9, dated 27th February, 2002 (hereinafter referred to as "the said Development Plan");

And Whereas, in the said Development Plan, the land bearing Khasara No. 82/1 of Mouze Babulkheda is reserved for "Telephone Exchange" (hereinafter referred to as "the said Reservation") ;

And whereas, the Department of Telecommunication being Acquiring Body, and Appropriate Authority (hereinafter referred to as "the said Appropriate Authority") since the said Appropriate Authority vide its letter, dated 23rd December, 2011 has commuinicated, that the acquisition proposal of land under of the said reservation has already been dropped and also there shall be no requirement of this land in future. Therefore, Department of Telecommunication has given no objection to delete the said reservation ;

And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of opinion that out of the said Reservation should be deleted (hereinafter referred to as "the said Proposal"), as per the provisions of Section 50 of the said Act ;

And whereas, the Land Owners of the said lands have deposited Rs. 3,09,398 towards the 50% Government share of premium amount worked out as per 5% rate of the said land as prescribed in the Annual Statement of Rates (ASR) for the year 2018-2019 in the Government Treasury on 6th November, 2018 through the Assistant Director of Town Planning, Nagpur Branch, Nagpur and remaining 50% of the premium amount worked out 5% of revised land rates of Annual Statement of Rates (ASR) for the year 2018-2019 Rs. 3,09,398 payable to the Planning Authority has been deposited with the Nagpur Municipal Corporation, Nagpur on 2nd November, 2018 ;

Now, therefore, in exercise of the powers conferred on it under sub-section (2) of Section 50 of the said Act, the Government hereby, sanctions the said Proposal and for that purpose amends the above referred Notification dated the 7th January, 2000 as follows ;

"In the Schedule of Modifications appended to the Notification sanctioning the said Development Plan, the following new entry shall be added after the last entry.

ENTRY

The land bearing Khasara No. 82/1 Mouja Babulkheda is deleted from Reservation No. MS-46, Telephone Exchange and included in the adjacent Zone as otherwise allowed to develop".

02. The above said sanctioned modification shall come into force after a period of one month from the date of publication of this Order in the Official Gazette.

03. A copy of the part plan of the aforesaid sanctioned modification shall be available for public inspection in the office of the Commissioner, Nagpur Municipal Corporation, Nagpur during office hours on all working days for a period of one month.
