अधिसूचना

महाराष्ट्र नगरपरिषदा, नगरपंचायती व औद्योगिक नगरी अधिनियम, १९६५.

क्रमांक एमसीओ.२०१२/प्र.क्र.१५१/नवि-१४.----महाराष्ट्र नगरपरिषदा, नगरपंचायती व औद्योगिक नगरी अधिनियम, १९६५ (महा.१९६५ चा ४०) चे कलम ७५अ चे पोट-कलम (२) आणि कलम ३२१ चे पोट-कलम (१) व (२) अन्वये प्राप्त झालेल्या अधिकारानुसार महाराष्ट्र राज्य नगरपरिषद मुख्याधिकारी सेवा (सेवा भरती व सेवेच्या शर्ती) नियम, १९८३ मध्ये सुधारणा करण्यासाठी खालील नमूद प्रारुप नियम तयार करून ते कलम ३२१ चे पोट-कलम (३) चे तरतुदीनुसार यामुळे बाधित होणाया व्यक्तींच्या माहितीसाठी प्रसिद्ध करीत आहे व नोटीस देण्यात येते की, ही अधिसूचना महाराष्ट्र शासनाच्या शासकीय राजपत्रात प्रसिद्ध झाल्यापासून १५ दिवसांचा कालावधी पूर्ण झाल्यानंतर सदर प्रारुप नियम शासन विचारात घेईल.

२. उपरोक्त कालावधी दरम्यान या प्रारुप नियमांशी संबंधित ज्या हरकती किंवा सूचना आयुक्त तथा संचालक, नगरपरिषद प्रशासन संचालनालय, वरळी, मुंबई ४०० ०३२ यांचेमार्फत प्राप्त होतील, त्या शासनाकडून विचारात घेतल्या जातील.

प्रारुप नियम

१. या नियमांना, "महाराष्ट्र राज्य नगरपरिषद मुख्याधिकारी सेवा (सेवा भरती व सेवेच्या शर्ती) (सुधारणा) नियम, २०१९" असे म्हणावे.

२. महाराष्ट्र राज्य नगरपरिषद मुख्याधिकारी सेवा (सेवा भरती व सेवेच्या शर्ती) नियम, १९८३ (ज्यास, यापुढे मूळ नियम म्हणून संबोधण्यात येईल.) मधील नियम २ खालील खंड (आय) नंतर खालील खंड समाविष्ट करण्यात येईल.

(१)

भाग एक----अ-(म.उ.वि.)--१२-१२ महाराष्ट्र शासन राजपत्र असाधारण भाग एक---अ-मध्य उप-विभाग, फेब्रुवारी ५, २०१९/माघ १६, शके १९४० "(आय-१) "मर्यादित विभागीय स्पर्धा परीक्षा" म्हणजे शासनाने सर्वसाधारण अथवा विशेष आदेशानुसार महाराष्ट्र नगरपरिषदा, नगरपंचायती व औद्योगिक नगरी राज्यसेवा (समावेशन, नेमणुका व सेवेच्या शर्ती) (सुधारणा) नियम, २००६ मधील नियम २ खंड (एन) मध्ये नमूद सेवांमधील कर्मचायांमधून वेळोवळी मुख्याधिकारी श्रेणी-२ या पदांवर पदोन्नतीसाठी आणि महाराष्ट्र लोकसेवा आयोग अशी जबाबदारी घेईपयर्ंत नियम ७अ नुसार गठीत केलेल्या समितीद्वारे घेण्यात येणारी परीक्षा होय."

३. मूळ नियमातील नियम ४ मध्ये,---

(ए) पोट-नियम (२) च्या खंड (बी) व (सी) ऐवजी खालील खंड अंतभर्ूत करण्यात येत आहे :---

"(बी) ५३ वर्षापेक्षा अधिक वय नसलेल्या व संवर्गामध्ये किमान ५ वर्ष सेवा पूर्ण केलेल्या कर्मचायांमधून मर्यादित विभागीय स्पर्धा परीक्षेतील गुणवत्तेनुसार निवडलेल्या सुयोग्य व्यक्तींच्या पदोन्नतीद्वारे."

"(सी) नामनिर्देशनाने व पदोन्नतीने करावयाच्या नेमणुकीचे प्रमाण ९०:१० असे राहील."

(बी) उप-नियम (५) ऐवजी खालील उप-नियम अंतभर्ूत करण्यात येत आहे :---

"(५) वरील नियमात काहीही अंतभर्ूत असले तरी, जेव्हा सुयोग्य उमेदवाराच्या अनुपलब्धतेमुळे नामनिर्देशनाने अथवा पदान्नतीद्वारे अथवा रजा किंवा तात्पुरत्या रिक्त जागांमुळे या सेवेतील पद भरले न गेल्यास, अशी पदे शासनाच्या समकक्ष संवर्गातील सुयोग्य अधिकायांमधून प्रतिनियुक्तीने भरता येतील."

४. मूळ नियमातील नियम ७ नंतर खालील नियम अंतभर्ूत करण्यात येत आहे :---

" ७अ. मर्यादित विभागीय परीक्षा आणि निवड यादी तयार करण्याच्या प्रक्रियेसाठी समितीचे गठन- (१) मुख्याधिकारी वर्ग-२ पदावर पदोन्नतीसाठी मर्यादित विभागीय परीक्षेच्या गुणवत्तेनुसार पात्र असणाया सुयोग्य व्यक्तींची निवड यादी तयार करण्यासाठी मर्यादित विभागीय स्पर्धा परीक्षा समिती खालीलप्रमाणे गठीत करण्यात येत आहे :---

१. आयुक्त तथा संचालक, नगरपरिषद प्रशासन संचालनालय, मुंबई अध्यक्ष २. सहसचिव/उप सचिव, नगरविकास विभाग, शासनाने नामनिर्देशित केलेले

सदस्य ३. शासनाने नामनिर्देशित केलेला अवर सचिवापेक्षा कमी दर्जाचा नसलेला मागासवर्गीय अधिकारी सदस्य ४. उप संचालक, नगरपरिषद प्रशासन संचालनालय, मुंबई.

सदस्य, सचिव.

(२) ही समिती निवड यादी तयार करण्यासंदर्भात नियम ७ मध्ये विहित केलेल्या पद्धतीचा अवलंब करेल."

NOTIFICATION

MAHARASHTRA MUNICIPAL COUNCILS, NAGAR PANCHAYATS AND INDUSTRIAL TOWNSHIPS ACT, 1965.

No. MCO.2012/C.R.151/UD-14.—The following draft of rules further to amend the Maharashtra State Municipal Chief Officers' Service (Recruitment and Conditions of Service) Rules, 1983, which the Government of Maharashtra proposes to make in exercise of the powers conferred by sub-sections(1) and (2) of section 321 read with sub-section (2) of section 75A of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act,1965 (Mah. XL of 1965), is hereby published, as required by sub-section (3) of the said section 321, for information of all the persons likely to be affected thereby; and notice is hereby given that the said draft will be taken into consideration by the Government of Maharashtra after expiry of a period of fifteen days from the date of publication of this notification in the Maharashtra Government Gazette;

Any objections or suggestions which may be received by the Director of Municipal Administration, Worli, Mumbai within the aforesaid period, will be considered by the Government.

DRAFT RULES

No. MCO.2012/C.R.151/UD-14.—In exercise of the powers conferred by sub-sections (1) and (2) of section 321 read with sub-section (2) of section 75A of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act,1965 (Mah. XL of 1965), and of all other powers enabling it in that behalf, the Government of Maharashtra hereby makes the following rules further to amend the Maharashtra State Municipal Chief Officers' Service (Recruitment and Conditions of Service) Rules, 1983, the same having been previously published, as required by sub-section (3) of said section 321, namely :– 1. These Rules may be called the Maharashtra State Municipal Chief Officers' Service (Recruitment and Conditions of Service) (Amendment) Rules, 2019.

2. In rule 2 of the Maharashtra State Municipal Chief Officers' Service (Recruitment and Conditions of Service) Rules, 1983 (hereinafter referred to as "the principal Rules"), after clause (i), the following clause shall be inserted, namely :–

"(i-1) "Limited Departmental Competitive Examination" means an examination prescribed by the Government, by general or special order, from time to time, for promotion to the post of Chief Officer, Grade II, from amongst the employees belonging to the Services prescribed in clause (n) of rule 2 of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships State Services (Absorption, Recruitment and Conditions of Service) Rules, 2006, and conducted by the Committee constituted under rule 7A,until such time the Maharashtara Public Service Commission takes on this responsibility;".

3. In rule 4 of the principal Rules,–

(a) in sub-rule (2),for clauses(b) and (c), the following clauses shall be substituted, namely :– "(b) by promotion of a suitable person, who has compieted regular service not less than 5 years in the cadre and his age is not more than 53 years, on the basis of the selection list prepared as per the merit determined by the Limited Departmental Competative Examination;

(b) for sub-rule (5),the following sub-rule shall be substituted, namely :–

"(5) Notwithstanding anything hereinbefore contained in this rule, where any post in the Service remains vacant due to non-availability of suitable candidates for recruitment to such post either by nomination or by promotion, as the case may be, or where there is any leave or other temporary vacancy of any post in the service, the post shall be filled in by appointment of a suitable officer from the equivalent cadre of the Government by deputation.".

4. After rule 7 of the principal Rules, the following rule shall be inserted, namely :– "7A. Constitution of the Committee for Limited Departmental Competitive Examination and procedure for prepation of select list.-(1)For the purpose of preparing select list of persons who are eligible for promotion to the post of Chief Officer,Grade II, as per the merit determined by the Limited Departmental Competative Examination, there shall be consititued a Limited Departmental Competative Examination Committee consisting of the following :–

(1) The Commissioner and Director, Directorate of Municipal - Chairman.

Administration, Maharashtra State.

(2) Joint Secretary or Deputy Secretary of Urban Development - Member.

Department, nominated by the Government

(3) An officer not below the rank of Under Secretary belonging to - Member.

backward classes nominated by the Government.

(4) The Deputy Director, Directorate of Municipal Administration - Member- Secretary.

(2) The Committee shall follow the procedure for preparation of select list as prescribed in rule 7.".
