महाराष्ट्र कृ षि उत्पन्न पणन (विकास व विनियमन) अधिनियम, १९६३.

क्रमांक शि का ना . ० ७ १ ८ / प्र . क्र . ४ / २ १ - स . महाराष्ट्र कृ षि उत्पन्न पणन (विकास व विनियमन) अधिनियम, १९६३ (१९६४ चा महा. २०) याचे कलम ५ई तसेच कलम ६० चे पोट-कलम (१) आणि पोट-कलम (२) चे खंड (अ-३), (अ-४), (अ-५), (अ-६) व (ब-१) यां(cid:४६२)ारे प्रदान करण्यात आलेल्या अ धि का रां चा आणि याबाबतीत त्यास समर्थ करणाऱ्या इतर सर्व अधिकारांचा वापर करून, महाराष्ट्र शासनाने महाराष्ट्र कृ षि उत्पन्न पणन (विकास व विनियमन) नियम, १९६७ यांमध्ये आणखी सुधारणा करण्यासाठी, करण्याचे योजिलेल्या नियमांचा पुढील मसुदा हा, त्यामुळे बाधा पोचण्याची शक्यता असलेल्या सर्व व्यक्तींच्या माहितीकरिता, उक्त अधिनियमाच्या कलम ६० च्या पोट-कलम (३) (cid:४६२)ारे आवश्यक असल्याप्रमाणे या(cid:४६२)ारे प्रसिद्ध करण्यात येत आहे आणि या(cid:४६२)ारे अशी नोटीस देण्यात येत आहे की, उक्त मसुदा, महाराष्ट्र शासनाकडून दिनांक ४ मार्च २०१९ रोजी किंवा त्यानंतर विचारात घेण्यात येईल.

२. पणन संचालक, महाराष्ट्र राज्य, नवीन मध्यवर्ती इमारत, ३ रा मजला, पुणे ४११ ००१ यांच्याकडे उपरोक्त दिनांकापूर्वी, उक्त मसुद्यासंदर्भात कोणत्याही व्यक्तीकडून ज्या कोणत्याही हरकती व सूचना प्राप्त होतील त्या शासन विचारात घेईल.

नियमांचा मसुदा

१. या नियमांना महाराष्ट्र कृ षि उत्पन्न पणन (विकास व विनियमन) (पहिली सुधारणा) नियम, २०१९ असे म्हणावे.

२. महाराष्ट्र कृ षि उत्पन्न पणन (विकास व विनियमन) नियम, १९६७ (यात यापुढे ज्यांचा निर्देश "मुख्य नियम" असा करण्यात आला आहे) यांच्या नियम ४ मध्ये ,

प्रकरण - एक ब नंतर पुढील प्रकरण समाविष्ट करण्यात येईल :

" प्रकरणएक क

इलेक्ट्रॉनिक व्यापारा(cid:४६२)ारे पणन

४-प. इलेक्ट्रॉनिक व्यापार व्यासपीठ स्थापन करणे / त्याचे प्रचालन करणे. (१) राज्य शासन किंवा शासकीय अभिकरणे किंवा कोणतीही व्यक्ती, ई-व्यापाराकरिता सुरक्षित वेबआधारित पोर्टल (वेबआधारित सॉ(cid:१९६)टवेअर उपयोजन) व यथायोग्य (cid:२९३)मणध्वनी उपयोजन यांच्या स्वरूपात इलेक्ट्रॉनिक व्यापार व्यासपीठ (ईटीपी) विकसित करील व त्यावर जागा उपलब्ध करून देईल. या इलेक्ट्रॉनिक व्यापार व्यासपीठाची किमान वैशिष्(cid:५०३)े पुढीलप्रमाणे असतील :

(अ) वेब आधारित पोर्टल (दालन) आणि यथायोग्य (cid:२९३)मणध्वनी उपयोजन यांस माहिती तंत्रज्ञान अधिनियम, २००० (२००० चा २१) व त्याखाली के लेले नियम यांन्वये, आणि त्या त्या वेळी अंमलात असलेल्या इतर कोणत्याही कायद्यान्वये आवश्यक असल्याप्रमाणे सर्व सुरक्षाविषयक अनुपालने (जसे की, ई-प्रशासन धोरण, डब्ल्यू ३ सी, इनक्रिप्शन, एस एस एल प्रमाणपत्र, इत्यादी) असतील.

(ब) इतर इलेक्ट्रॉनिक व्यापार व्यासपीठांसोबत आंतर-कार्यशीलता.

(क) ऑनलाईन ई-प्रदानांसाठीचे एकात्मिक प्रदान गेटवे.

(ड) हितसंबंधित व्यक्तींना लघु संदेशा(cid:४६२)ारे माहिती प्रसारित करण्याकरिता एकात्मिक लघु संदेश गेटवे .

(ई) हितसंबंधित व्यक्तींना माहिती किंवा अहवाल प्रसारित करण्यासाठी ई-मेल सुविधा.

(फ) विषयसंबंधित व आलेखी अहवाल यांकरिता डॅशबोर्ड.

(ग) इलेक्ट्रॉनिक व्यापार व्यासपीठाशी संबंधित सहा(cid:२००)यासाठी मदतकक्ष सुविधा.

(ह) सर्व हितसंबंधितांसाठी प्रशिक्षण सुविधा.

(आय) इलेक्ट्रॉनिक व्यापार व्यासपीठविषयक कार्यचालनात्मक मार्गदर्शक सूचना किंवा प्रणाली प्रलेखन.

(२) ई-व्यापार करण्याकरिता सुरक्षित वेब आधारित पोर्टल (वेब आधारित सॉ(cid:१९६)टवेअर उपयोजन) आणि यथायोग्य (cid:२९३)मणध्वनी उपयोजन यांच्या स्वरूपातील इलेक्ट्रॉनिक व्यापार व्यासपीठामध्ये पुढील कृ तिकार्यक्रमही असतील :

(अ) हितसंबंधित व्यक्तींची नोंदणी ;

(ब) इलेक्ट्रॉनिक व्यापाराकरिता आगाऊ बुकिंग सुविधा ;

(क) कृ षि उत्पन्न आवकचा अभिलेख ठेवणे ;

(ड) मापदंड व प्रमाणपत्र निर्धारणाचा अभिलेख ठेवणे ;

(ई) कृ षि उत्पन्नाच्या गुणवत्तेनुसार यथोचित व्यवस्थापन (lot management) ;

(फ) कृ षि उत्पन्नाच्या इलेक्ट्रॉनिक व्यापारास प्रारंभ करण्याकरिता बोलीविषयक तयारी करणे ;

(ग) किंमत बोलीची सुविधा, जिच्यामध्ये खरेदीदार ब ँके ने संबंधित व्यापाऱ्यास किंवा खरेदीदारास बोलीच्या वेळी पुरविलेली ब ँक हमी-नि-गतिशील पत-कर्ज मर्यादा प्रदर्शित करण्याची व्यवस्था असेल ;

(ह) इलेक्ट्रॉनिक माध्यमांतून किंमतीची माहिती प्रसारित करणे [जसे दर्शकफलक (एल एफ डी), लघु संदेश (एस.एम.एस.) इ.] ;

(आय) एकात्मिक इलेक्ट्रॉनिक वजन मापन यंत्रा(cid:४६२)ारे कृ षि उत्पन्नाचे प्रत्यक्ष वजन मिळविणे ;

(जे) विक्री करार, विक्री देयक आणि इतर देयके किंवा बीजक किंवा पावत्या तयार करणे ;

(के ) एकात्मिक प्रदान (गेटवे) पद्धतीचा (जसे. डेबिट कार्ड, क्रे डिट कार्ड, नेटब ँकिंग, आरटीजीएस, एनईएफटी इ.) वापर करून हितसंबंधित व्यक्तींना ई-प्रदान करणे ; आणि

(ल) कृ षि उत्पन्न जावकचा अभिलेख ठेवणे.

४-क्यू. इलेक्ट्रॉनिक व्यापार व्यासपीठ स्थापन करण्यासाठी लायसन देणे. (१) कृ षि उत्पन्नाचा व्यापार करण्यासाठी इलेक्ट्रॉनिक व्यापार व्यासपीठ स्थापन करण्यास व चालवण्यास इच्छुक असलेली कोणतीही व्यक्ती, लायसन मिळण्यासाठी किंवा त्याचे नवीकरण करण्यासाठी, उप नियम (२) मध्ये नमूद के लेल्या लायसन फीसह, नमुना-जे मध्ये उक्त नमुन्यात विनिर्दिष्ट के लेल्या कागदपत्रासह संचालकाकडे किंवा त्याने प्राधिकृ त के लेल्या अधिकाऱ्याकडे लेखी स्वरूपात अर्ज करील.

(२) इलेक्ट्रॉनिक व्यापार व्यासपीठ स्थापन करण्यासाठीची लायसन फी रुपये ५०,००० इतकी असेल.

(३) इलेक्ट्रॉनिक व्यापार व्यासपीठ स्थापन करण्यासाठीच्या लायसनकरिता अर्ज करताना, रुपये २० लाख इतकी ब ँक हमी पतदारी प्रमाणपत्रासह जमा के ली जाईल.

अशा ब ँकहमीची मुदत संपण्यापूर्वी तिचे वेळोवेळी नवीकरण करण्यात येईल आणि नवीकरण के लेली ब ँकहमी संचालकाकडे सादर के ली जाईल. तसे न के ल्यास, इलेक्ट्रॉनिक व्यापार व्यासपीठ स्थापन करण्यासाठीचे लायसन निलंबित के ले असल्याचे मानण्यात येईल.

(४) इलेक्ट्रॉनिक व्यापार व्यासपीठ स्थापन करण्यास व चालविण्यास इच्छुक असलेली कोणतीही व्यक्ती, परीक्षण सुविधा, साठवण सुविधा, लॉजिस्टिक सुविधा यांसाठी पायाभूत सुविधांची तरतूद करील आणि तिने कृ षि उत्पन्नाचे इलेक्ट्रॉनिक पद्धतीने वजन, रकमेचे प्रदान व पोचवणी करण्याबाबतच्या सेवांची तरतूद के ली पाहिजे.

(५) उप-नियम (१) अन्वये के लेला अर्ज प्राप्त झाल्यानंतर, संचालक किंवा त्याने प्राधिकृ त के लेला अधिकारी, नमुना डी-१ मध्ये तयार के लेल्या नोंदवहीमध्ये असा अर्ज प्राप्त झाल्याचा दिनांक नमूद करील. अर्जाची तपासणी के ल्यानंतर आणि आवश्यक लायसन फी जमा के ली असल्याची निश्चिती के ल्यानंतर, संचालक किंवा त्याने प्राधिकृ त के लेला अधिकारी, अर्जासोबत सादर के लेल्या सर्व कागदपत्रांची पडताळणी करील आणि वरील उप नियम (४) मध्ये तरतूद के ल्यानुसार निर्माण के लेल्या पायाभूत सुविधांची पडताळणी के ल्यानंतर, अर्ज प्राप्त झाल्यापासून ३० दिवसांच्या कालावधीच्या आत अर्जदारास नमुना-के मध्ये लायसन जारी करील.

४-र. इलेक्ट्रॉनिक व्यापार व्यासपीठाच्या लायसनधारकाचे दायित्व.(१) इलेक्ट्रॉनिक व्यापार व्यासपीठ लायसन- धारक, वेळच्या वेळी सर्व व्यवहारांची नोंद करील आणि महाराष्ट्र राज्य कृ षि पणन मंडळाच्या पोर्टलवर, ॲगमार्क नेटवर किंवा संचालकाने विहित के लेल्या समतुल्य नमुन्यात बाजाराची माहिती प्रदर्शित करील.

(२) इलेक्ट्रॉनिक व्यापार व्यासपीठ लासनधारक, कोणताही भेदभाव न करता अथवा अनुग्रह न ठेवता, व्यापार लायसनसाठीचा अर्ज प्राप्त झाल्यापासून ७ दिवसांच्या आत, व्यापार लायसन सर्व पात्र व्यापाऱ्यांना निर्गमित करील. ४-स. कलम ५ह खालील अर्ज. भारत सरकारच्या ई-व्यासपीठाशी संलग्न होण्यास इच्छुक असणारा, नियम ४-क्यू खालील लायसनधारक, त्या शासनाकडून विहित करण्यात येईल अशा नमुन्यात व अशा रीतीने अर्ज करील." ३. मुख्य नियमांच्या नियम ६ नंतर, पुढील नियम समाविष्ट करण्यात येईल :

र्त असले तरी, "६अ. इलेक्ट्रॉनिक व्यापारासाठी व्यापार लायसन.(१) नियम ६ मध्ये काहीही अंतभू इलेक्ट्रॉनिक व्यापार व्यासपीठावरील व्यापारी म्हणून, काम करू इच्छिणारी कोणतीही व्यक्ती, नोंदणी प्रमाणपत्रासाठी किंवा, यथास्थिति, त्याच्या नवीकरणासाठी संचालक, पणन, याने विनिर्दिष्ट के लेल्या परंतु प्रती इलेक्ट्रॉनिक व्यापार व्यासपीठ रुपये ५०० पेक्षा अधिक असणार नाही इतक्या फीचे प्रदान करून नमुना-ल मध्ये ऑनलाईन अर्ज करील आणि नोंदणीसाठीची पुढील माहिती देखील संगणकावर (अपलोड) टाकील :

(अ) अर्जदाराचे आधार कार्ड क्रमांक (यूआयएडीआय कार्ड) ;

भाग चार-ब-३८१अ४ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, फेब्रुवारी ५, २०१९/माघ १६, शके १९४० (ब) भागीदारी संस्था / कं पनी / न्यास / सोसायटी यांच्याबाबतीत, नोंदणी प्रमाणपत्र आणि अर्जदाराचे प्राधिकार पत्र ;

(क) प ॅनकार्डची प्रत ;

(ड) त्याच्या व्यवसायाच्या ठिकाणाचा सर्वसाधारण पत्ता ;

(ई) व्यापार करावयाचे कृ षि उत्पन्न साठविण्याकरिता वखारीचा पत्ता ; आणि

(फ) वस्तू व सेवा कर नोंदणीचा (जीएसटी) पुरावा.

(२) खाजगी बाजारासह कोणत्याही बाजार समितीने लायसन दिलेले सर्व अडते (कमिशन एजंट) यांना बाजार समितीकडून, किंवा, यथास्थिति, खाजगी बाजाराकडून, इलेक्ट्रॉनिक व्यापार व्यासपीठासाठी सूचिबद्ध करण्यात येईल. तथापि, व्यापारी म्हणून सहभाग घेऊ इच्छिणाऱ्या अडत्याला (कमिशन एजंटला), या नियमाच्या उप-नियम (१) मध्ये नमूद के ल्याप्रमाणे स्वत:ची नोंदणी करून घ्यावी लागेल.

(३) इलेक्ट्रॉनिक व्यापार व्यासपीठावरील व्यापाराकरिता, बाजार समितीमधील किंवा खाजगी बाजारामधील दलालीची पद्धत, या(cid:४६२)ारे बंद करण्यात आली आहे.

(४) संचालक, पणन किंवा त्याने प्राधिकृ त के लेला अधिकारी हा व्यापाऱ्यांची नोंदणी करण्यासाठीचा सक्षम प्राधिकारी असेल.

(५) तीन वर्षांसाठी वैध असलेले डिजिटल स्वरूपात स्वाक्षरी के लेले नोंदणी प्रमाणपत्र व नोंदणीच्या नवीकरणाबाबतचे प्रमाणपत्र, नमुना-म मध्ये सक्षम प्राधिकाऱ्याकडून निर्गमित करण्यात येईल."

४. मुख्य नियमांच्या नियम २० मध्ये उप नियम (३) नंतर, पुढील उप नियम जादा दाखल करण्यात येईल :

"(४) (अ) ई-व्यासपीठामार्फ त व्यापार के ल्या गेलेल्या कृ षि उत्पन्नाच्या रकमेचे प्रदान हे, विक्रे त्याला वेळच्या वेळीच म्हणजे विक्रीचा व्यवहार के ला असेल त्याच दिवशी किंवा जास्तीत जास्त त्याच्या दुसऱ्या दिवशी इलेक्ट्रॉनिक व्यासपीठाच्या माध्यमातून करण्यात येईल.

(ब) विक्रे त्याला रक्कम प्रदानाची पद्धती ही, सुरक्षित प्रदान प्रवेश(cid:४६२)ार (गेटवे) अशा प्रकारची असेल, ती म्हणजे, (एक) शासकीय (cid:२९३)मणध्वनी (उपयोजन) ॲप(cid:४६२)ारे ;

(दोन) डेबिट किंवा क्रे डिट कार्डा(cid:४६२)ारे ; किंवा

(तीन) एनइएफटी / आरटीजीएस या(cid:४६२)ारे आधार प्रमाणीकरण पध्दतीने.".

५. मुख्य नियमांस जोडलेल्या नमुना-ड नंतर, पुढील नमुना समाविष्ट करण्यात येईल :

४. सर्व मालक किंवा भागीदार किंवा संचालक यांचे नाव, पत्ता व संपर्काचा तपशील ;

५. लायसन फी भरल्याच्या पुष्(cid:५०३)र्थ कोषागार चलान ;

६. प ॅन कार्ड ;

७. पतदारी प्रमाणपत्र ;

८. नियमांमध्ये तरतूद करण्यात आलेली ब ँक हमी ; आणि

९. अर्जदार अधिनियमाच्या आणि त्याखाली करण्यात आलेल्या नियमांच्या सर्व तरतुदींचे पालन करील आणि त्यांचा भंग के ल्यास लायसन रद्द होण्यासह अन्य कारवाईस तो पात्र असेल अशा आशयाचे हमीपत्र किंवा शपथपत्र.

(यात यानंतर ज्याचा निर्देश लायसनधारक असा करण्यात आला आहे) यास महाराष्ट्र कृ षि उत्पन्न पणन (विकास व विनियमन) अधिनियम, १९६३, महाराष्ट्र कृ षि उत्पन्न पणन (विकास व विनियमन) नियम,१९६७ यांच्या तरतुदींस अधीन राहून, पुढील शर्तीवर या(cid:४६२)ारे लायसन देण्यात येत आहे. त्या शर्ती म्हणजे,

१. लायसनधारक हा उक्त अधिनियमाच्या तरतुदींचे आणि त्याकरिता लागू असलेल्या नियमांचे आणि माहिती तंत्रज्ञान अधिनियम, २००० (२००० चा २१) याच्या तरतुदींचे त्याखाली के लेल्या नियमांचे तसेच त्या त्या वेळी अंमलात असलेल्या अन्य कोणत्याही कायद्याचे आणि लायसनधारकाने दिनांक .......... रोजी संचालक, पणन याच्याबरोबर के लेल्या कराराच्या शर्तीचे पालन करण्यास बांधील असेल. २. हे लायसन अहस्तांतरणीय असेल. ३. हे लायसन, उक्त अधिनियमाच्या तरतुदींनुसार आणि त्याखाली के लेल्या नियमांनुसार निलंबित किंवा रद्द के ले जाईल.

४. हे लायसन निलंबित किंवा रद्द करण्यात आल्यास, ते संचालक, पणन यांच्याकडे परत करण्यात यावे. ५. संचालक निदेश देईल अशा पद्धतीने लायसनधारक, पुस्तके , नोंदवह्या आणि अभिलेख ठेवील आणि तो, ती पुस्तके , नोंदवह्या आणि अभिलेख संचालकाला किंवा त्याने प्राधिकृ त के लेल्या व्यक्तीला तपासणीसाठी उपलब्ध करून देईल.

६. लायसनधारक, संचालकाकडून वेळोवेळी मागणी करण्यात येईल अशी माहिती व विवरणे त्याला सादर करील. ७. लायसनधारक कोणताही व्यापार भत्ता आकारणार नाही किंवा वसूल करणार नाही. ८. लायसनधारक, लायसनधारकाच्या रचनेतील कोणत्याही बदलाबाबत संचालकाला कळविल. लायसनधारक, वेळोवेळी ब ँक हमीकरिता के लेल्या नियमांनुसार तिचे नवीकरण करील.

(नाव) . (पत्ता) (यात यापुढे ज्याचा उल्लेख प्रमाणपत्रधारक असा करण्यात आला आहे) यास या(cid:४६२)ारे इलेक्ट्रॉनिक व्यापार व्यासपीठाचा व्यापारी म्हणून नोंदणी प्रमाणपत्र मंजूर करण्यात येत आहे.

त्या शर्ती पुढीलप्रमाणे आहेत :

१. प्रमाणपत्रधारक उक्त अधिनियमाच्या तरतुदींचे व नियमांचे आणि माहिती तंत्रज्ञान अधिनियम, २००० (२००० चा २१) याचे आणि त्याखाली के लेल्या नियमांचे व त्या त्या वेळी अंमलात असलेल्या इतर कोणत्याही कायद्याचे पालन करण्यास बांधील असेल.

२. हे प्रमाणपत्र अहस्तांतरणीय असेल.

३. हे प्रमाणपत्र, उक्त अधिनियमाच्या तरतुदीनुसार आणि त्याखाली के लेल्या नियमांनुसार निलंबित किंवा रद्द के ले जाईल.

४. हे प्रमाणपत्र निलंबित किंवा रद्द करण्यात आल्यास संचालक, पणन यांच्याकडे ते परत करण्यात येईल.

५. प्रमाणपत्रधारक, संचालक निदेश देईल अशा पद्धतीने पुस्तके , नोंदवह्या आणि अभिलेख ठेवील आणि तो, ती पुस्तके , नोंदवह्या आणि अभिलेख संचालकाला किंवा त्याने प्राधिकृ त के लेल्या व्यक्तीला तपासणीसाठी उपलब्ध करून देईल.

६. प्रमाणपत्रधारक, संचालकाकडून वेळोवेळी मागणी करण्यात येईल अशी माहिती व विवरणे त्याला सादर करील.

७. प्रमाणपत्रधारक, कोणताही व्यापार भत्ता आकारणार नाही किंवा वसूल करणार नाही.

८. प्रमाणपत्रधारक, प्रमाणपत्रधारकाच्या रचनेतील कोणत्याही बदलाबाबत संचालकास कळवील.

NOTIFICATION

MAHARASHTRA AGRICULTURAL PRODUCE MARKETING (DEVELOPMENT AND REGULATION) ACT,1963.

No. Shikana-0718/C.R.4/21-C.—The following draft of rules further to amend the Maharashtra Agricultural Produce Marketing (Development and Regulation) Rules, 1967, which the Government of Maharashtra proposes to make in exercise of the powers conferred by sub-section (1) and clauses (a- 3), (a-4), (a-5), (a-6) and (b-1) of sub-section (2) of section 60 read with section 5E of the Maharashtra Agricultural Produce Marketing (Development and Regulation) Act, 1963 (Mah. XX of 1964) and of all other powers enabling it in that behalf, is hereby published as required by sub-section (3) of section 60 of the said Act, for the information of all persons likely to be affected thereby; and notice is hereby given that, the said draft will be taken into consideration by the Government of Maharashtra on or after the 4th March, 2019.

2. Any objection or suggestion, which may be received by the Director (Marketing), Maharashtra State, New Central Building, 3rd Floor, Pune 411 001, from any person with respect to the said draft before the aforesaid date, will be considered by the Government.

DRAFT RULES

1. These rules may be called the Maharashtra Agricultural Produce Marketing (Development and Regulation), (First Amendment) Rules, 2019.

2. In rule 4 of the Maharashtra Agricultural Produce Marketing (Development and Regulation) Rules, 1967 (hereinafter referred to as "the principal Rules"), after Chapter-IB, the following Chapter shall be inserted, namely :—

"CHAPTER-IC

Marketing Through Electronic Trading

4-P. Establishment or promotion of Electronic trading platform.— (1) The State Government or the Government agencies or any person shall get developed and hosted Electronic trading platform (E.T.P.), in the form of secured web based portal (web based software application) and suitable mobile application therefor. This electronic trading platform shall have the following minimum features, namely :—

(a) web based portal and suitable mobile application therefor shall have all security compliances as required under Information Technology Act, 2000 (21 of 2000) and the rules made thereunder and any other law for the time being in force, (e.g. eGovernance policy, w3c, encryption, SSL certificate, etc.) ;

(b) interoperability with other electronic trading platforms;

(c) integrated payment gateway for online e-Payments;

(d) integrated SMS gateway for dissemination of information to stakeholders through SMS;

(e) e-mail facility for dissemination of information or reports to stakeholders;

(f) dashboard for textual and graphic reports;

(g) help desk facility for support related to electronic trading platform;

(h) training facility to all stakeholders; and

(i) operational Guidelines or system documentation of electronic trading platform.

(2) Electronic trading platform in the form of secured web based portal (web based software application) and suitable mobile application therefor shall also have the following functionality for conducting trading thereon, namely :—

(a) registration of stakeholders;

(b) advance Booking facility for electronic trading;

(c) record keeping of arrivals of agricultural produce;

(d) record keeping of assaying parameters and certificate;

(e) lot management as per the quality of agricultural produce;

(f) bid preparation to initiate electronic trading of agricultural produce;

(g) facility of price bidding which shall have feature of displaying (at the time of auction), Bank Guarantee-cum-dynamic Cash Credit limit provided by buyers Bank to the respective trader or buyer;

(h) dissemination of price information through electronic media (e.g. display boards (LFD), SMS, etc.);

(i) capturing actual weight of agricultural produce through integrated electronic weighing scale;

(j) generation of sale agreement, sale bill and other bills or invoice or receipts;

(k) e-Payment to stakeholder using integrated payment gateway (e.g. debit card, credit card, net banking, RTGS, NEFT, etc.); and

(l) record keeping of dispatch of agricultural produce.

4-Q Issuance of Licence to establish Electronic trading platform.— (1) Any person desiring to establish and run an Electronic trading platform for trading in agricultural produce shall make an application in writing to the Director or the officer authorized by him in FORM-J for grant of a License or renewal thereof, alongwith document specified in the said Form, with license fee as mentioned in sub-rule (2).

(2) The License fee for establishing an Electronic trading platform shall be Rs. 50,000.

(3) A Bank Guarantee worth Rs. 20 lakh shall be deposited with the Director, while applying for License to establish an Electronic trading platform alongwith solvency certificate.

Such Bank Guarantee shall be renewed, from time to time, before its expiry and the renewed Bank Guarantee shall be submitted to the Director. In case of failure to do so, the licence for E-trading platform shall be deemed to be suspended.

(4) Any person desiring to establish and run an Electronic trading platform shall provide the infrastructure for assaying facilities, storage facilities, logistic facilities and should provide for services of electronic weighing, payment and delivery of the agriculture produce.

(5) On receipt of the application made under sub-rule (1), the Director or the officer authorized by him shall record the date of receipt of such application in the Register maintained in FORM D-1.

On examination of the application and ascertaining that the necessary license fee has been deposited, the Director or the officer authorized by him shall verify all the documents submitted along with theमहाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, फेब्रुवारी ५, २०१९/माघ १६, शके १९४० १३ application and after verifying infrastructure which has been created as provided in sub-rule (4) above, shall issue the license in FORM-K to the applicant within a period of thirty days from the date of receipt of the application.

4-R. Obligation of Licensee of Electronic trading platform.— (1) The Electronic trading platform license-holder shall record all the transactions on real time basis and display market information on portal of the Maharashtra State Agricultural Marketing Board, Ag Mark Net or equivalent in the format prescribed by the Director.

(2) The Electronic trading platform license-holder shall issue trading licenses to all the eligible traders without discrimination or favour within a period of seven days from its receipt of an application therefor.

4-S. Application under section 5H.— The license-holder under rule 4Q desiring to link to the E-Platform of the Government of India shall make an application in the form and manner as may be fixed by that Government.".

3. After rule 6 of the principal rules, the following rule shall be inserted :—

" 6A. Trading Licences for Electronic trading.– (1) Notwithstanding anything contained in rule 6, any person desiring to operate as a trader on the Electronic trading platform shall make an online application for certificate of registration or renewal thereof, as the case may be, in FORM-L alongwith online payment of the fees specified by the Director of Marketing, but not being in excess of Rs. 500 per electronic trading platform and shall also upload the following information for registration, namely :—

(a) Aadhar Card Number (UIADI Card) of applicant;

(b) in case of a firm/company/trust/Society, the Certificate of Registration and Authority Letter to applicant;

(c) copy of PAN Card;

(d) address of ordinary place of his business;

(e) address of warehouse for storage of agriculture produce to be traded; and (f) proof of Goods and Services Tax Registration (GST) Number.

(2) All commission-agents licensed by any Market Committee including a Private Market shall be listed on Electronic trading platform by the Market Committee or the Private Market, as the case may be. However, a Commission Agent, who wants to participate as a trader shall have to register himself as mentioned in sub-rule (1) of this rule.

(3) The system of broker is hereby discontinued in Market Committee or Private Market for trading on Electronic trading platform.

(4) Competent Authority for registering traders shall be Director of Marketing or the officer authorized by him.

(5) Digitally Signed Certificate of Registration, valid for three years and also renewal of registration thereof, shall be issued by Competent Authority in FORM-M.

"(4) (a) The payment of agricultural produce traded on E- platform shall be made on the same day of the sale transaction to the seller on real time basis or in the maximum on next day through electronic platform.

(b) Mode of payment to the seller shall be through Secured Payment Gateway i.e.,—

(i) by Government Mobile APPs;

(ii) by Debit or Credit Card; or

(iii) with Aadhar Authentication mode by NEFT or RTGS.".

5. After FORM-D appended to the principal rules, the following FORM shall be inserted, namely: —
