Whereas, Development Plan (Revised + Additional Area) of Ballarpur, Distt. Chandrapur has been partly sanc- tioned by the Government vide Urban Development Department's Notification No. TPS-2202-1260-CR-2(B)-2004-UD-9, dated 16-08-2005 & has come into force with effect from dated 01-10-2005, and Excluded part sanctioned by the Government Notification No. TPS-2202-1260-CR-2-C-2004-UD-9, dated 18-06-2008. (hereinafter referred to as " the said Development Plan ") under Section 31 (1) of the Maharashtra Regional and Town Planning Act, 1966 (Maharashtra Act No. XXXVII of 1966) (hereinafter referred to as " the said Act ") ;

And whereas, in the said Development Plan, land Survey Nos. 31/53, 31/54 & 31/56 of Mouje Ballarpur, area 1.54 Ha. Site No. 48 " Garden " & area 1.61 Ha. Site No. 55 " Recreation Ground " are reserved (hereinafter referred to as " the said Reservations ") ;

And whereas, the Ballarpur Municipal Council (hereinafter referred to as " the said Planning Authority "),vide its General Body Resolution No. 03, dated 12-10-2017, has resolved to delete the said Reservations & include in Residential, Commercial & Public Semi-Public Zone (Educational purpose) as per the provisions of sub-section (1) of Section 37 of the said Act, after following the legal procedure laid down under the said Act. (hereinafter referred to asद्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, त्र्ॅाम्न््र ७-१३, २०१९/द्ध १८-२४, ॅ १९४० ३ " the proposed Modification "). The Planning Authority vide Resolution No. 11, dated 05-01-2018 has submitted the said proposal of modification to the Government for sanction ;

And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of opinion that the said Modification should be sanctioned with some condition ;

Now, therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government hereby, sanctions the said modification, out of that notification for Government land Survey No. 31/56 affected by the said Reservation is hereby issued and for that purpose amends the aforesaid Notification dated the 16-08-2005 as follows. The Notification for the private land bearing Survey No. 31/53 & 31/54 affected by the said Reservation shall be issued only after the premium as per the Government policy is paid, hence the deletion for Survey No. 31/53 & 31/54 are kept in abeyance ;

In the Schedule of Modifications appended to the Notification dated 16-08-2005 sanctioning the said Development Plan, the following new entry shall be added after the last entry.—

ENTRY

Government land bearing Survey No. 31/56 admeasuring 2.02 Ha. of Mouje Ballarpur is deleted from Site No. 48 Garden & Site No. 55 Recreation Ground and included in Residential, Commercial & Public / Semi-Public Zone (Educational purpose) as shown on the plan, subject to condition specified below–

Condition : Municipal Council shall provide 12.00 mt. approach road for the land shown Public / Semi-Public Zone (Educational purpose) and Commercial Zone.

A copy of the Notification, alongwith the part plan showing the aforesaid sanctioned modification, shall be available for inspection of the general public, in the office of the Chief Officer, Ballarpur Municipal Council, Ballarpur during office hours on all working days for a period of one month.

This Notification shall be available on the Government website www.maharashtra.gov.in

Minor Modification to the Development Plan under Section 37 (1) of

Maharashtra Regional & Town Planning Act, 1966.

The Develolpment Plan of Hinganghat Town (Revised + Extended) has been sanctioned by Govt. of Maharashtra State, Urban Department, Mantralaya, Mumbai & the Notification in this regard bearing Notification No. TPS-2905- 3248-.ॅ.-121 (B)-05-UD-9, Dated 26-04-2006 the said Development Plan has been implemented with effect from the date of 15-06-2006.

In the Town of Hinganghat, there is a vast stretch of irregularly measured plots to the old locality (Juni Basti) and in the areas coming under the Nazul Department Jurisdiction and these irregular stretch of plots are into existance even before the coming into force of the Maharashtra Regional & Town Planning Act, 1966. In the said areas, the constructed houses are attached to each other and are constructed haphazardly and due to which the said areas come automatically within the illegal parameters of the Gaothan area. However, the said areas have not been shown or described in the illegal parameters or the haphazardly constructed areas of the Gaothan area under the Nagar Parishadद्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, त्र्ॅाम्न््र ७-१३, २०१९/द्ध १८-२४, ॅ १९४० ७ Development Plan and due to which certain complications are arising at the time or giving the permission for making new construction in the said areas. Due to the reasons cited hereinabove, it is necessary to make the necessary amendments in the draft of the Development Plan of the areas coming under the Gaothan area for the aforesaid areas which have been in haphazard and irregular state since last many years by rectifying and amending the boundaries in the said areas under the Section 37 (1) of Maharashtra Regional & town Planning Act, 1966.

The areas coming under the haphazardly built and irregular within the parameters/areas of Gaothan Area are under :—

North :— Smashanghat Road Bridge (In front of Muslim Cemetry) to the house of Hari Pansare on the cast, from Chandsawali Baba Dargah by the cement road to house of Shankar Amge, from Juna Akhada to Raghatate Chowk and further from cement road towards Shitala Mata Temple till Jalaram Vatika and Pandurang Baba Math and further from Pili Masjid to house of Narayan Bawane by the Pumping Station Road.

East :— From the house of Narayan Bawane on the Pumping Station Road towards the Southern side Kabrastan till the square and further towards Nagpur Road till the house of Shri Mankar at the Dr. Ambedkar School Square, further from Nagpur Road towards the Western side till house of Shri Bhourao Bagale on the Southern corner of Bidkar College on the Southern side by the Bidkar College compound till house of Shri Dinkar Mashalkar on the Southern corner side further on the Western side till North- West corner side of Nutan Pry. School, till the house of Shri Upase, and further on the Southern side till house of Shri Diwakar Hiwanj adjacent to the D.P, road. Further on the Western side till the public lavatory situated at Labour Colony, leaving aside the house of Shri Dharkar further towards the South till office of Pothra Prakalp at BCC Grounds on the South-East corner and further towards the west till house of Shri Kubde (Sanjay Gandhi School North-West corner) and further till house of Shri Deorao Hiwanj on the Abdullah Nagar Colony Road.

South :— From the house of Shri Deorao Hiwanj to house of Shri Vijay Shinde on the Eastern side and further towards South till house of Shri Ajank and further towards West till house of Shankar Bawane and further towards North till house of Sitabai Borkute, further till Hindustan Bakery on Railway Station road and further on North from Railway Station road to Tahsil Square and further from Sant Tukdoji Square and Southern side of Nehru Primary School till Southern side of Kali Sadak and further from Kisan Gin Road till house of Shri Shambha Petkar.

West :— From the house of Shri Shambha Petkar situated on Kisan Gin. Ganga Mata Mandir Road till the gate of Gimatex on the Northern side, further till house of Shri Pravin Hatwar and further on the Eastern side till the house of Shri Naresh Bulle further by the road towards the Northen side till the house of Jayant Deshpande, further on the Eastern side of Kali Sadak till the South-East corner side of Mohota mill till the house of Shri Ganpat Kathalkar and further by the Kali Sadak towards the Northern side till the house of Shri Kunawar and further towards the Western side by the Kawadghat Road till the Oil Mill of ownership of Angarwar and further towards the Northern side till Samshanghat Road Bridge.

The Order in regard to aforesaid proposed amendment has been passed vide the Resolution No. 5, dated 22-7-2013. Minor Modification showing the Development Plan Map has been kept open for public information during the working hours at the Municipal Council Construction Department. As per the Section 37 (1) of the Maharashtra Regional and Town Planning Act, 1966, if any person has any objection whatsoever to the aforementioned minor modification and its notice and action thereof then he has to submit the same in written form within 30 days of the publication of this notice and it is also called upon that the Municipal Council shall consider all the pros and cons or the objection received before forwarding the same to the State Government for its approval thereof after thoughtful consider- ation by the Municipal Authorities.

Whereas, Development Plan (Revised + Additional Area) of Ballarpur Dist. Chandrapur has been partly sanctioned by the Government vide Urban Development Department's Notification No. TPS-2202- 1260-CR-2(B)-2004-UD-9, dated 16th August 2005 has come into force with effect from Dated 1st October 2005, and Excluded part of Development Plan sanctioned by the Government vide Notification No. TPS- 2202-1260-C.R.2-C-2004-UD-9, Dated 18th June 2008. (hereinafter referred to as " the said Develop- ment Plan ") under Section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Maharashtra Act No. XXXVII of 1966) (hereinafter referred to as " the said Act ") ;

And whereas, in the said Development Plan, land bearing Survey Nos. 162/1, 163, 164 area 1.36 Hectare of Mouje Ballarpur (hereinafter referred to as " the said Land ") ; is included in Reservation No. 95 " Park " (hereinafter referred to as " the said Reservation ") ;

And whereas, the Ballarpur Municipal Council (hereinafter referred to as " the said Planning Authority ") ; vide its General Body Resolution No. 3(1), dated 7th March 2017, has resolved to delete the said Land from the said Reservation and to reserve the said land for " Housing for Dishoused " as per the provisions of sub-section (1) of Section 37 of the said Act, after following the legal procedure laid down under the said Act. (hereinafter referred to as " the said Proposed Modification ") ; The Planning Authority vide Resolution No. 3, Dated 30th June, 2017 has submitted the said proposed modification to the Government for sanction ;

And whereas, in view of above and after making necessary enquiries and after consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of opinion that the said Modi- fication needs to be rejected.

Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 37 of the said Act, the Government of Maharashtra hereby refuses to accord sanction to the said Modification ;

THE MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.

No. TPS-2416-31-CR-72-UD-9-2018.—

Whereas, Development Plan of Kalmeshwar, Dist. Nagpur (Revised + Additional Area) has been sanctioned by the Director of Town Planning, Maharashtra State, Pune vide its Notification No. TPV-2/ 4287, dated 21st July 1992 has come into force with effect from dated 1st October 1992 (hereinafter referred to as " the said Development Plan ") under Section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Maharashtra Act No. XXXVII of 1966) (hereinafter referred to as " the said Act ") ;

And whereas, in the said Development Plan, land bearing Survey No. 911, area 1.78 hectare of Mouje Kalmeshwar (hereinafter referred to as " the said Land "), is included in Agriculture/No-Develop- ment Zone ;

And whereas, the Kalmeshwar Municipal Council (hereinafter referred to as " the said Planning Authority "), vide its General Body Resolution No. 6, dated 22nd February 2008, has resolved to delete the said Land from Agriculture/No-Development Zone and include in Residential Zone as per the provi- sions of sub-section (1) of Section 37 of the said Act, after following the legal procedure laid down under the said Act (hereinafter referred to as " the said Proposed Modification "). The Planning Authority vide Resolution No. 8, dated 24th June, 2008 has submitted the said proposed modification to the Government for sanction ;

Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 37 of the said Act, the Government of Maharashtra hereby refuses to accord sanction to the said Modification.

This Notification shall be kept open for inspection by the general public during office hours in the office of the Kalmeshwar Municipal Council, Kalmeshwar.

This Notification shall also be available on the Government website www.maharashtra.gov.in (Act & Rules).
