MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
No. TPS-2414-448-CR-40-UD-9-2016.—
Whereas, the Government of Maharashtra vide Notification Urban Development Department No. TPS-2284-1823-C.R.-105-UD-9, Dt. 29th December, 1988, appointed Maharashtra Housing and Area Development Authority (MHADA) to be the " Special Planning Authority " under the provision of Section 40(1) (aa) of Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as " the said Act ") to undertake planned and orderly development of notified area of New Chandrapur as proposed in the sanctioned Regional Plan of Chandrapur-Ballarpur Region & the Government vide Urban Development Department's Notification No. TPS-2294-471-CR-159-UD-9, dated 30th June, 1998 has sanctioned Development Plan for the aforesaid notified area and has come into force with effect from the 1st September, 1998. (hereinafter referred to as " the said Development Plan ") ;
And whereas, the Maharashtra Housing & Area Development Authority (MHADA) being the Planning Authority for the said Development Plan (hereinafter referred to as " the said Special Planning Authority "), vide its General Body Resolution No. 5811, dated 12th July, 2002 has resolved to remove the Policy regarding compulsory acquisition of 25% of the land from each land owner for various public purpose as mentioned in Chapter-IX of Land Acquisition of Development Plan Report. Accordingly after following all the legal procedure as per the provisions of sub-section (1) of Section 37 of the said Act, submitted to the Government, for its sanction, a modification proposal (hereinafter referred to as " the said Modification Proposal ") ;
And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of opinion that the proposed Modification should be sanctioned ;
Now therefore, in exercise of the powers conferred on it under sub-section (2 ) of section 37 of the said Act, the Government hereby, sanctions the Proposed Modification and for that purpose amends the aforesaid Notification dated the 30th June, 1998 as follws ;
" In the Schedule of Modifications appended to the Notifiction dated 30th June, 1998 sanctioning the said Development Plan, the following new entry shall be added after the last entry—
ENTRY
" The Policy regarding compulsory acquisition of 25% of the land from each land owner for various public purpose as mentioned in Chapter-IX of Development Plan Report i. e. Land Acquisition (page No. 20 & 21) is deleted. THE MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
No. TPS-2214-639-CR-89-UD-9-2014.—
Whereas, Development Plan (Revised + Additional Area) of Ballarpur Dist. Chandrapur has been partly sanctioned by the Government vide Urban Development Department's Notification No. TPS-2202- 1260-CR-2(B)-2004-UD-9, dated 16th August 2005 has come into force with effect from Dated 1st October 2005, and Excluded part by the Government Notification No. TPS-2202-1260-C.R.2-C-2004-UD-9, Dated 18th June 2008. (hereinafter referred to as " the said Development Plan ") under Section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as " the said Act ") ;
And whereas, in the said Development Plan, land bearing Survey Nos. 28 (part) of Mouje Ballarpur, area admeasuring 20.23 Hectare (hereinafter referred to as " the said Land ") ; Site No. 5 " Library ", Site No. 6 " Play Ground ", " Existing Play Ground ", " Children Garden ", Plantation, " Mery Park " & " Existing/ Proposed Residential Zone " are reserved (hereinafter referred to as " the said Reservation ") ;
And whereas, the Ballarpur Municipal Council (hereinafter referred to as " the said Planning Authority ") ; vide its General Body Resolution No. 09, dated 8th May 2008, has resolved to delete the said Reservation and Existing/Proposed Residential Zone and include in Industrial Zone as per the provisions of sub-section (1) of Section 37 of the said Act, after following the legal procedure laid down under the said Act. (hereinafter referred to as " the said Proposed Modification "). The Planning Authority vide Resolution No. 1, Dated 16th July, 2008 has submitted the said proposed modification to the Government for sanction ;
And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune the Government is of opinion that the said Modification should be partly sanctioned.
Now, therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government hereby, sanctions the said Modification and for that purpose amends the aforesaid Notification dated the 16th August 2005 as follws.—
In the Schedule of Modifications appended to the Notification date 16th August 2005 sanctioning the said Development Plan, the following new entry shall be added after the last entry.—
ENTRY
" Out of the land bearing Survey No. 28 (part) anmeasuring 20.23 Ha. of Mouje Ballarpur, part of land which are affected by Site No. 5 " Library ", " Children Garden ", Plantation, " Mery Park " & " Existing/ Proposed Residencial Zone " is deleted and included in Industrial Zone as shown on the Plan ".
