MAHARASHTRA REGIONAL & TOWN PLANNING ACT, 1966.

No. D.T.P.-D.P. Chikhali (R)-Site No. 59-Sec. 50-TPV-6-591-2019.—

Whearas, the Revised Development Plan of original limit of B-class Municipal Council Chikhali has been sanctioned by the Government Urban Development Department vide its Notification No. TPS-2600-102-CR-18B-2000-UD-30, dated 25-09-2003 and came into force with effect from 10-11-2003 (hereinafter referred to as "the said Development Plan");

And whereas, in the said Development Plan, Site No. 59 is reserved for "Stadium" admeasuing area 8.25 Hect. (hereinafter referred to as "the said reservation") and "District Sports Officer, Buldana" is the Appropriate Authority for the said reservation. (hereinafter referred to as "the said Appropriate Authority"). Out of the land bearing S. Nos. 145 (Part) & 120 (Part) of Village Chikhali, admeasuring area 42400 Sq. mtrs. (hereinafter referred to as "the said land") falls under the said reservation;

And whereas, the said Appropriate Authority vide its letter No. 1989/2016, dated 11-03-2016 has submitted the proposal of deletion of the land admeasuring 8.25 Hect. from S. Nos. 145 (Part), 147 (Part) and 120 (Part) of village Chikhali affected by the said reservation under Section 50 of Maharashtra Regional & Town Planning Act, 1966 (herein- after referred to as "the said Act") to the Directorate;

And whereas, the Chikhali Municipal Council vide its letter No. 252/2017 dated 27-01- 2017 has communicated that if the said Appropriate Authority has no objection for deletion of the said reservation under Section 50, Municipal Council has no objection for the said deletion of the said reservation;

And whereas, the owner of the said land Shri. Satish Khabutare & others have sub- mitted the proposal of dereserving the said reservation for their land & allow the residen- tial purpose to the District Sports Officer, Buldana vide letter dated 27-08-2014. Due to paucity of funds it is not possible to develop the said reservation & also there is one Taluka Krida Sankul is already developed on Government land admeasuring 2.13 Hect. Hence there is no necessity of the said reservation. So the said Appropriate Authority has given No Objection Certificate & submitted the proposal to the Directorate for deletion of the said reservation vide its letter No. 1989/2016, dated 11-03-2016. Therefore, it is now clear that the said reservation is no lnoger required to the said Appropriate Authority and the Director of Town Planning, Maharashtra State, Pune is of the opinion that the said proposal should be sanctioned;

And whereas, the Town Planner, Buldana Branch, Buldana and the Chief Officer Municipal Council, Chikhali vide their letters dated 07-12-2018 and 04-12-2018 respec- tively communicated to the Directorate, that as per the Government directives dated 20-04-2016, out of the said reservation on behalf of the land owner Shri. Satish Khabutare & others have deposited Rs. 46,81,250 towards the 50% Governement share of 5% premium amount of land value for an area 42400 sq. mtr. as per the rate prescribed in the Annual Statement of Rates (ASR) for the year 2018 in the Government Treasury on 04-12- 2018 through the Town Planner, Buldana Branch, Buldana and remaining 50% of the 5% premium amount Rs. 46,81,250 have deposited to the Planning Authority, on 03-12-2018. The owners of the remaining area under the said reservation have not deposited 5% specified premium to the Government & Municipal Council, Chikhali;

And whereas, the Government in Urban Development Department, vide Resolution No. TPS-1813-3211-CR-508-UD-13, dated 01-12-2016 has delegated the powers exercisable by it under Section 50 (2) of the said Act to the Director of Town Planning, Maharashtra State, Pune in respect of Development Plans of all Municipal Councils/Nagar Panchayat and for the development plans under taken by Zilla Parishad as a Planning Authority;

Now therefore, the Director of Town Planning, Maharashtra State, Pune hereby sanctions the part deletion of the said reservation in respect of the said land u/s 50 (2) of the said Act and for that purpose amends the notification of the said Development Plan, sanctioned dated 25-09-2003 as follows :—

After the last entry in the Schedule of Modifications accompanying the notification of the said sanctioned Development Plan, the following new entry shall be added.

An area from S. Nos. 145 (Part) and 120 (Part), Mouje Chikhali admeasuring 42400 sq.Mtr. from the Site No. 59 "Stadium" is deleted from the reservation, as shown on the Part Plan attached herewith.

The Part Plan showing the Modification is attached with this order.

Note : 1. The remaining part of the said reservation will be deleted after payment of premium at the rate of 5% of the land value, calculated as per rate prescribed in ASR of that year from the owners of remaining area under the said reservation. 2. A Copy of the Part Plan of the said Development Plan showing the aforesaid Modification shall be made available for inspection in the office of Municipal Council, Chikhali during office hours on all working days.

3. This Order shall also be published on the Directorate website www.dtp.maharashtra.govt.in.

In exercise of the powers conferred on him by Order No. SEC.-NP2016-P.K.07-KA-06, dated 7 May, 2016 of the State Election Commissioner, Maharashtra, the Chief Officer of the Municipal Council Sindkhedraja, proposes to make the following draft order under sub-section (1) (5) Section 10 of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965 (Mah. XL of 1965) (hereinafter referred to as the 'said Act') to fix for the the Sindkhedraja Municipal Council, the number and the extent of the wards into which the said Municipal Area shall be divided and to specify the wards reserved for Scheduled Castes, Scheduled Tribes, Backward Class of Citizens and Women (including women belonging to the Scheduled Castes, Scheduled Tribes, Backward Class of Citizens), as the case may be, as shown in the Schedule to the Draft Order bearing No. 3245-UDB-Desk-4-2018, dated 12 December 2018 was published as required by the proviso to sub-section (1) of Section 10 of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965 for information to the residents of the Sindkhedraja Municipal Council. After carefully considering the objections received in respect of the said draft, the Divisional Commissioner and Regional Director, Municipal Administration, Amravati accorded their sanctions to the Draft Order of Sindkhedraja Municipal Council by an Order No. VAA-PSNP-AK-KAVI-4-2019, dated 04-01-2019. Therefore, I, Collector of Buldana District in exercise of the powers conferred on me by sub-section (1) of Section 10 of the said Act, hereby make the following Order Namely.

In exercise of the powers conferred on him by Order No. SEC.-NP-2016-P.K.07-KA-06, dated 7 May, 2016 of the State Election Commission, Maharashtra, the Chief Officer of the Municipal Council Lonar, proposes to make the following draft order under sub-section (1) (5) Section 10 of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965 (Mah. XL of 1965) (hereinafter referred to as the said Act) to fix for the Lonar Municipal Council, the number and the extent of the wards into which the said Municipal Area shall be divided and to specify the wards reserved for Scheduled Castes, Scheduled Tribes, Backward Class of Citizens and Women (including women belonging to the Scheduled Castes, the Scheduled Tribes, the Backward Class of Citizens), as the case may be, as shown in the Schedule to the Draft Order bearing No. 3243-UDB-Desk-4-2018, dated 12 December, 2018 was published as required by the proviso to sub-section (1) of Section 10 of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965 for information to the residents of the Lonar Municipal Council.
