NOTIFICATION

No. SPP.3818/1767/C.R.332/D-XIV.—In exercise of the powers conferred by sub-section (8) of the section 24 of the code of Criminal Procedure, 1973 (Act No. II of 1974), the Government of Maharashtra hereby appoints Adv. Sangita E. Phad as " Special Public Prosecutor " for conducting the Sessions Case No. 153/2016 pending before Sessions Court, Thane, which is arising out of C.R.No. I 297/2015 registered at Bhiwandi Police Station, Dist. Thane.

2. Her appointment is strictly subject to the conditions of service laid down in the Maharashtra Law Officers (Appointment, Conditions of Service and Remuneration) Rules, 1984.

3 . Lump sum fees of Rs. 25,000 (Rupees Twenty Five Thousand only) as quoted by Adv. Sangita E. Phad has been already deposited by the applicant Shri Srinath Chandrakant Gulvi to the Government, vide R.B.I. Challan No. 5739, dated 21st January 2019. The amount will be paid to Adv. Sangita E. Phad after completion of the case.

4. The Government reserves the right to revoke/modify/annul the order without assigning any reasons.

क्रमांक डीजीपी.२५१५/प्र.क्र.२६३/का.१४.----दिवाणी प्रक्रिया संहिता, १९०८ च्या ऑर्डर २७, फौजदारी प्रक्रिया संहिता, १९७३ चे कलम २४ (३) व महाराष्ट्र विधि अधिकारी (नियुक्ती, सेवेच्या शर्ती आणि मानधन) नियम, १९८४ च्या नियम १३ मधील तरतुदीनुसार लातूर जिल्हा व सत्र न्यायालयाकरिता अॅड. मीरा रावसाहेब कुलकर्णी यांची सहायक सरकारी वकील व अतिरिक्त सरकारी अभियोक्ता पदावर शासन अधिसूचना समक्रमांक दिनांक २८ जानेवारी २०१६ अन्वये पुढील २ वर्षे कालावधीसाठी नियुक्ती करण्यात आली होती. सदर नियुक्तीचा कालावधी संपल्याने शासन अधिसूचना समक्रमांक दिनांक २४ जानेवारी २०१८ अन्वये दिनांक २८ जानेवारी २०१८ पासून पुढील १ वर्ष कालावधीसाठी मुदतवाढ देण्यात आली आहे.

सदर नियुक्तीस दिनांक २८ जानेवारी २०१९ पासून पुढील एक वर्षाचा कालावधी अथवा त्यांच्या वयास ६२ वर्षे पूर्ण होतील तो दिनांक यापयर्ंतचा कालावधी, यापैकी जे अगोदर घडेल तोपयर्ंतच्या कालावधीकरिता मुदतवाढ देण्यात येत आहे.

२. सदर नियुक्ती महाराष्ट्र विधि अधिकारी (नियुक्ती, सेवाशर्ती व मानधन) नियम, १९८४ यामध्ये दिलेल्या सेवाशतर्ींच्या अधीन राहील.

३. वरील आदेश मागे घेण्याचा/त्यात दुरुस्ती करण्याचा/ते रद्द करण्याचा अधिकार शासन राखून ठेवीत आहे.

क्र.पो.आ/वा.अधिसूचना/२०१९/२४३.------ ज्या अर्थी औरंगाबाद शहरातील सार्वजनिक वाहतुकीचे विनिमय व नियमन करण्यासाठी तसेच, नागरिकांच्या सुरक्षितता, जिवीतास धोका, अडथळा किंवा गैरसोय होऊ नये म्हणून औरंगाबाद महानगरपालिका हद्दीत मोटार वाहनांची संख्या, रस्त्यांची स्थिती, वाढती लोकसंख्या, औरंगाबाद शहर हे ऐतिहासिक शहर असल्याने शहरामध्ये येणारे पर्यटक, सहली इतर नागरीक यांची मोठया प्रमाणात शहरामध्ये ये-जा असते त्यामुळे शहरातील रस्त्यावर वाहनांच्या जास्तीच्या वर्दळीमुळे व भरधाव वेगाने चालविल्याने होणारे प्राणांतीक, गंभीर अपघाताच्या संख्येत वाढ होत आहे. त्यामुळे शहरातील निष्पाप नागरिकांचा अपघातामध्ये बळी जात आहे. सदर प्राणातीक, गंभीर अपघातास आळा बसावा व अतिवेगाने वाहन चालविणारे वाहन चालकावर प्रतिबंधक करण्यासाठी, तसेच शहरातील नागरिकांच्या सुरक्षितता, जिवीतास धोका, अडथळा किंवा गैरसोय होऊ नये म्हणून शहरातील महानगरपालिका हद्दीतील वाहनांच्या वाहतुकीचे नियोजन करणे आवश्यक आहे, अशी माझी खात्री झालेली आहे.

त्या अर्थी, मी चिरंजीव प्रसाद, पोलीस आयुक्त, औरंगाबाद शहर, मला महाराष्ट्र पोलीस कायदा, १९५१ (१९५१ चा अधिनियम क्र.२२) चे कलम ३३(१)(ब), सह मोटार वाहन कायदा, १९८८ (१९८८ चा अधिनियम क्र. ५९) चे कलम ११५ व इतर प्राप्त अधिकारान्वये औरंगाबाद शहरात वाहतुकीसाठी खालीलप्रमाणे अधिसूचना जारी करीत आहे.

औरंगाबाद महानगरपालिका हद्दीतील रस्त्यावर ये-जा करणाया प्रत्येक वाहनांची (सर्व प्रकारच्या वाहनांची) वेग मर्यादा ही ४० कि.मी. प्रति तास एवढीच राहील.

सदर अधिसूचना ही पुढील आदेशा पावेतो लागू राहील.

सदरची अधिसूचना ही अत्यावश्यक सेवा उदा. पोलीस, रुग्णवाहीका, अग्निशामक वाहन व तत्सम अत्यावश्यक वाहनांना लागू असणार नाही.

या अधिसूचनांचा भंग करणारी व्यक्ती म.पो.कायदा कलम १३१ व अन्य फौजदारी कायद्यान्वये शिक्षेस पात्र राहील. तसेच प्रचलीत मोटार वाहन कायद्याप्रमाणे कार्यवाही करण्यात येईल.

सदरची अधिसूचना माझ्या सही व शिक्यानिशी दिनांक १ फेब्रुवारी २०१९ रोजी काढण्यात आली आहे.

No. SPP.1015/1786/C.R.454/D-XIV.—In exercise of the powers conferred by sub-section (8) of the section 24 of the code of Criminal Procedure, 1973 (Act No. II of 1974), the Government of Maharashtra hereby appoints Adv. Avadhut M. Chimalker, as " Special Public Prosecutor " for conducting the Court Case No. 172/PW/2008 and Court Case No.844/PW/2008 pending before, Chief Metropolitan Magistrate, Esplanade Court, Mumbai which is arising out of C.R.No.35/07 registered at E.O.W.,CB,C.I.D. Police Station Mumbai.

2. Lump sum fees of Rs. 50,000 (Rupees Fifty Thousand only) as quoted by Adv. Avadhut M. Chimalker has been already deposited by the applicant Shri Ashish G. Kamdar with the Government, vide R.B.I. Challan No. 9368, dated 31st January 2019. The amount will be paid to Adv. Avadhut M. Chimalker after completion of the case.

3. His appointment is strictly subject to the conditions of service laid down in the Maharashtra Law Officers (Appointment, Conditions of Service and Remuneration) Rules, 1984.

4. The Government reserves the right to revoke/modify/annul the order without assigning any reasons.

आणि ज्याअर्थी, उक्त समितीचे सदस्य म्हणजे डॉ. मनिषा शामसुंदर कायंदे, श्री. रविंद्र गजानन मिर्लेकर आणि श्री. अमोल गजानन कीर्तीकर हे, उक्त अधिनियमाच्या कलम ७ च्या पोट-कलम (३) द्वारे आवश्यक असल्याप्रमाणे उक्त समितीची परवानगी न घेता, उक्त समितीच्या लागोपाठच्या तीन सभांना अनुपस्थित राहिले असल्याने उक्त सदस्य हे उक्त समितीची सभा यथोचितरीत्या समाप्त झाल्याच्या वेळेपासून या समितीचे सदस्य असण्याचे बंद झाले आहे.

No.SSV-1017/1838/C.R.03/D-16. - Whereas the Government of Maharashtra has vide Government Notification, Law and Judiciary Department, No. SST.2011/175/22/D-16, dated the 28th July 2016, issued in exercise of the powers conferred by sub-section (1) read with sub-section (2) of section 5 of the Shree Sai Baba Sansthan Trust (Shirdi) Act, 2004 (Mah. XIV of 2004) (hereinafter referred to as "the said Act"), constituted "The Shree Sai Baba Sansthan Management Committee". (hereinafter referred to as "the said Committee") by appointing the members thereof ;

And whereas, as the three members of the said Committee viz. Dr. Manisha Shamsundar Kayande, Shri Ravindra Gajanan Mirlekar and Shri Amol Gajanan Kirtikar remained absent for the three consecutive meeting of the said Committee without obtaining leave from the said Committee as required by sub-section (3) of section 7 of the said Act, the said members ceased to be the members thereof from the time the third meeting of the said Committee is duly terminated;

Now therefore, in exercise of the powers conferred by the sub-section (1) read with sub-section (2) of section 5 and sub-section (3) of section 7 of the Shree Sai Baba Sansthan Trust (Shirdi) Act, 2004 (Mah. XIV of 2004) , the Government of Maharashtra hereby amends the said notification as follows, namely:-

Ltd., Plot No. A-80, H Block, Near Morwadi Court, MIDC, Pimpri, Pune 411 018, holder of Tin No.27794336700V under the MVAT Act, 2002 and R.C.No.27940336700C under the Central Sales Tax Act, 1956, that the declarations referred in sub-section (4) of section 8 of the Central Sales Tax Act- 1956, (LXXIV) of 1956 in form "C" issued to them bearing No. MH-11/0445239 (Total-1 "C" Forms) has been lost and to that effect the dealer has given the advertisement in Marathi Newspaper "Loksatta" Pune dated 24th February 2017 and in English Newspaper "The Indian Express" Pune, dated 24th February 2017 and forwarded the newspaper cutting to this office, also submitted Indemnity Bond of Rs. 1,39,600 respectively.

Therefore in view of the above I, shri Kiran Nandedkar, Joint Commissioner of Sales Tax, Pune-1 in exercise of the powers vested in me under sub-rule(7) of rule 4(A) of the Central Sales Tax (Bombay) Rules, 1957 hereby declare that the said "C" Forms declaration bearing No-MH-11/0445239 (Total-1 "C" Forms) are treated as invalid.

क्रमांक जिउनि-यवत/वि.२/क.१५६/१९४३/२०१८.--------महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६(१) अन्वये मला प्रदान करण्यात आलेल्या शक्तीचा वापर करून मी, जिल्हा उप निबंधक, सहकारी संस्था, यवतमाळ, या आदेशान्वये संत भोजाजी महाराज नागरी सहकारी पतसंस्था मर्या. राळेगाव या संस्थेच्या संचालक मंडळाची सभा दिनांक २० जानेवारी २०१७ रोजी चे ठरावामध्ये नमूद कर्मचारी/अधिकारी यांना त्यांच्या नावासमोर दर्शविलेल्या कार्यक्षेत्रासाठी महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १०१ व कलम ९१ अन्वये प्राप्त झालेल्या वसुली प्रमाणपत्राची अंमलबजावणी/कर्ज वसुली करण्याकरिता महाराष्ट्र सहकारी संस्था अधिनियम १९६० चे कलम १५६(१) व नियम १०७ अनुसार मालमत्ता जप्त करून व तिची विक्री करून रकमा वसूल करण्याचे निबंधकाचे अधिकार, खालील अटीस अधिन राहून या आदेशाच्या दिनांकापासून ३१ मार्च २०१९ या कालावधीकरिता प्रदान करीत आहे :—

(५) नुसार संस्थेच्या वसुली अधिकायांना याबाबत सुचित करण्यात येते की, त्यांनी जप्त केलेल्या मालमत्तेचा कर्जदाराकडील ताबा, जोपयर्ंत अशी मालमत्ता सार्वजनिक लिलावात विकली जाणार नाही तोपयर्ंत घेवू नये.

वरील प्रमाणे अधिकार खाली नमूद केलेल्या अटी व शर्तीस अधिन राहून प्रदान करण्यात आलेले आहेत.

(१) वसुली अधिकारी यांनी महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ व नियम, १९६१ चे नियम १०७ मधील तरतूदीनुसार कर्ज वसुलीची कार्यवाही करावी. कर्ज वसुली करताना सहकार कायदा, नियम यातील तरतुदी व परिपत्रकीय सूचनांचे पालन न केल्याचे निदर्शनास आल्यास, आवश्यक ती चौकशी करून आवश्यकता भासल्यास, सदरचे प्रदान केलेले अधिकार तत्काळ काढून घेण्यात येतील.

(२) सदरचे अधिकार सहकार कायदा कलम १०१ व कलम ९१ अन्वये प्राप्त वसुली दाखल्याची अंमलबजावणी करण्याकरिता असतील.

(३) वसुली अधिकारी यांनी दरमाहा सोबत जोडलेल्या विहीत नमुन्यात "अ-३", "अ-४", व "ब" कर्ज वसुलीची माहिती संबंधीत जिल्हा उप निबंधक, सहकारी संस्था यांचे कार्यालयास सादर करावी. ज्या सहकारी संस्थेचे कार्यक्षेत्र विभाग, दोन विभाग, अथवा राज्य कर्यक्षेत्र आहे त्या संस्थांनी देखील त्यांचे मुख्य कार्यालय ज्या जिल्ह्यमध्ये आहे त्या जिल्हा उप निबंधक यांचे कार्यालयास सादर करावी.

(४) अधिकार प्रदान केलेल्या वसुली अधिकारी असलेल्या व्यक्तीची बदली झाल्यास किंवा सदर व्यक्ती सेवानिवृत्त झाल्यास किंवा सदर व्यक्तीस सेवेतून काढून टाकल्यास किंवा त्याचा मृत्यू झाल्यास, अशा अधिकायांस प्रदान केलेले अधिकार आपोआप रद्द होतील.

(७) वसुली अधिकारी यांनी नमूद केलेल्या कालावधीत वसुलीचे कामकाज समाधानकारक केले नसल्याचे निदर्शनास आल्यास किंवा प्रदान केलेल्या अधिकाराचा गैरवापर करीत असल्याचे निदर्शनास आल्यास, प्रदान केलेले अधिकार काढून घेतले जातील व भविष्यात असे कोणतेही अधिकार अशा व्यक्तीस प्रदान करण्यात येणार नाहीत.

(८) शासन निर्णय क्रमांक संकीर्ण-१५०४/प्र.क्र.२३१/१५-स, दिनांक २३ नोव्हेंबर २००६ अन्वये वसुली अधिकायांना तीन सिंहाच्या राजमुद्रेचा वापर करता येणार नाहीत.

(९) वसुली अधिकायास त्याच्या नावापुढे कोठेही ""महाराष्ट्र शासन नियुक्त"" आणि/किंवा "" सिव्हील कोर्ट"", ""एक्झीक्युटीव्ह कोर्ट"" या शब्दांचा अथवा तत्सम शब्दांचा वापर करता येणार नाही. त्याऐवजी वसुली अधिकायंानी त्यांच्या नावापुढे ""वसुली अधिकारी (महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ चे नियम १०७ अन्वये )"" असे लिहावे.

(१०) वसुली अधिकायास वसुलीसाठी वापर करण्यात येणाया वाहनावर ""वसुली अधिकारी ....................... सहकारी बँक/ पतसंस्था ......................."" असा फलक लावता येऊ शकेल.

(११) वसुली अधिकायाने पगार जप्तीची कार्यवाही करताना कर्जदाराच्या/जामीनदाराच्या पगार कपातीबाबत राष्ट्रीयीकृत बँका वा अन्य बँका यांच्याकडे परस्पर वेतन कपातीचा आदेश देऊन परस्पर पगार कपात करता येणार नाही. संबंधित कर्जदार/जामीनदार ज्या आस्थापनेवर काम करीत आहे त्या आस्थापनेवरील आहरण व संवितरण अधिकारी/पगार करणारा अधिकारी यांचेमार्फत पगारातून कर्ज वसूल करण्याची कार्यवाही करावी.

(१२) वसुली अधिकायास, थकबाकीदाराकडून वसुली दाखल्यानुसार वसूलपात्र रक्कम व सरचार्ज रक्कम याशिवाय इतर कोणतीही रक्कम वसुली करता येणार नाही.

(१३) या कार्यालयाचे आदेश/परिपत्रक दिनांक १ जानेवारी २०१७ मधील क्रमांक ४ कलम १५६ व नियम १०७ अन्वये वसुली अधिकायांनी करावयाची कार्यवाही यामधील मार्गदर्शक सुचनांचे पालन करावे. बँकेचे/पतसंस्थेचे मुख्य कार्यकारी अधिकारी यांनी दरमहा वसुली अधिकायांचे कामकाजाचा कर्जदारनिहाय आढावा परिपत्रकातील प्रपत्र पाच मध्ये नमूद केल्याप्रमाणे घ्यावा.
