MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.

Whereas, the Government has sanctioned the Second Revised Development Plan of Nagpur Municipal Corporation (hereinafter referred to as the "said Development Plan") vide Urban Development Departments Notification No. TPS-2496-2643-CR-300(A)-97-UD-9, dated the 7th January, 2000 under sub-section (1) of Section 31 of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as the "said Act") which has come into force with effect from the 1st March, 2000 ;

And whereas, the State Government has given its approval to the Nagpur Metro Rail Project (hereinafter referred to as " the said Metro ") vide the Government Resolution No. NIT-3313-CR-64-UD-7, dated the 30th January, 2014 and the Central Government also has conveyed its in-principle approval vide its letter No. K-1401-24-2013-MRTS-IV, dated the 11th February, 2014 and accorded its final approval vide its letter No. K-14011-(N-1)-2014-MRTS-III, dated the 21st August, 2014 ;

And whereas, the Government has published Notice dated 3rd July, 2017, under Section 37(1AA) (a) of the said Act, the land bearing Khasara No. 302, C. T. S. No. 1848, Mouze Sitabardi to include in Public/ Semi-Public Zone and the land over the road admeasuring 1662.328 Sq. Mt. thus total land admeasuring 3534.656 Sq. Mt. is proposed to be included in Commercial Zone for implementation of said Metro Project and Metro Rail Station and allied uses ;

And whereas, in the meantime the Nagpur Metro Rail Corporation Ltd., Nagpur on 3-08-2017 has requested to the Government to include the land bearing Khasara No. 302 & 303, CTS No. 1847 & 1848 of Mouje Sitabardi admeasuring about 12828.82 Sq. Mt. and the land over the 24.00 Mt. Development Road admeasuring 987.29 sq. mt. thus total land admeasuring 13816.126 Sq. Mt. in Comercial Zone for implementation of said Metro Project, inclusive of Metro Rail Station and allied uses (hereinafter referred to as the " said Proposal ") ;

And whereas, in exercise of the powers vested under Section 37 (1AA) (a) of the said Act, the Government has published Notice for inviting Suggestion/Objection from the general public in respect to the said Modification, in the Official Gazette Dated 05-11 April, 2018 as well as the news paper and appointed the Joint Director of Town Planning, Nagpur Division, Nagpur, as the officer under Section 162(1) of the said Act. for hearing suggestions/objections received in respect of the said modification ;

And whereas, the State Government has already sanctioned modification vide Notification dated 14th March 2018 on land admeasuring 3534.656 sq. mt. out of the said modification proposal under Section 37 (1AA) (C) of the said Act., and therefore now for remaining land, the Government is of opinion that, in public interest, it is necessary to modify the sanctioned Development Plan regarding the said proposal ;

And whereas, the appointed Officer has submitted his report to the Government on 15-09-2018, and after making necessary inquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government finds it expedient that the said modification be sanctioned.

Now, therefore, in exercise of the powers conferred on it under sub-section (1AA) (C) of Section 37 of the said Act. Government hereby, sanctions the said modification accordingly and for that purpose amends the said Development Plan as follows.—

MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.

Whereas, Revised Development Plan of Nagpur city has been sanctioned by the Government vide Urban Development Department's Notification No. TPS-2496-2643-CR-300(A)-97-UD-9, dated the 7th January, 2000 and finally sanctioned vide Government Notification No.TPS-2400-1628-CR-200-2000- UD-9, dated the 10th September, 2001 & has come into force with effect from the 1st March 2000 & 21st September 2001 respectively (hereinafter referred to as "the said Development Plan") under Section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as the "said Act") vide Government Notification No.TPS-2401-855-CR-76-2000-UD-9, dated 27th February 2002 Nagpur Improvement Trust has been declared as "Planning Authority" for the 7 Improvement Scheme being Implemented as per the provision of Nagpur Improvement Trust Act, (hereinafter referred to as "the Planning Authority");

And whereas, in the said Development Plan, the land admeasuring 1.20 Ha. bearing Khasara No. 119(pt.) of Mouje Bhandewadi is included in "Sewage Farm Area" (hereinafter referred to as "the said Land");

And whereas, the said Planning Authority, vide its Resolution No. 08-1176, Dated 21-02-2018 passed in the meeting of it's Board of Trustees has resolved to delete the said land from Sewage Farm Area and to reserve for Burial Ground and to appoint Nagpur Municipal Corporation as appropriate authority.

Accordingly after following all the legal procedure as per the provsions of sub-section (1) of Section 37 of the said Act, the said Planning Authority submitted a modification proposal to the Government, for its sanction, (hereinafter referred to as "the said Proposed Modification");

And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of opinion that the proposed Modification should be sanctioned.

Now, therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act. Government hereby, sanctions the said modification proposal and for that purpose amends the said Development Plan Notification as follows.—

In the Schedule of Modifications appended to the Notification sanctioning the said Development Plan, the following new entry shall be added after the last entry.

"The land admeasuring 1.20 Ha. bearing Khasara No. 119 (pt.) of Mouze Bhandewadi is deleted from Sewage Farm Area and is reserved for Burial Ground as shown on the Plan and appoints Nagpur Municipal Corporation, Nagpur as appropriate authority".

A copy of the part plan of the aforesaid sanctioned modification shall be available for public inspection in the office of the Chairman, Nagpur Improvement Trust, Nagpur & Commissioner, Nagpur Municipal Corporation, Nagpur during office hours on all working days for a period of one month.

This Notification shall also be available on the Government website www.maharashtra.gov.in (Act / Rules).

MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.

Whereas, the Regional Plan of Wardha Region (hereinafter referred to as " the said Regional Plan ") has been sanctioned by the Government vide Urban Development Department's Notification No. TPS- 1816-994-C.R.-516-16-UD-9, dated 1st January, 2018 under Section 15 of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as " the said Act ") and has come into force with effect from the 24th February, 2018 ;

And whereas, Government in Public Works Department vide its Resolution No. रू-२०१६-.ॅ. ४६७- न्रू-८, dated 19-08-2016 has declared Maharashtra State Road Development Corporation (MSRDC) as " Implementing Authority " for Nagpur-Mumbai Super Communication Expressway Project (Maharashtra Prosperity Corridor) ;

And whereas, MSRDC has submitted proposals to develop " New Towns " (Agro Prosperty Centres) for villages (hereinafter referred to as " said Notified Areas ") on 02-11-2018 as mentioned in Schedule-1 appended hereto ;

And whereas, as per " said Regional Plan " the areas of villages as mentioned in Schedule-1 appended herewith are included in No Development Zone/Agriculture Zone ;

And whereas, in order to carryout planned development of the said Notified Area as per proposal of MSRDC, it is necessary to delete the " said areas " from No Development Zone/Agriculture Zone and designate the same as " New Towns " :

And whereas, in view of above required changes and after making necessary enquiries, the Government of Maharashtra is of opinion that it is necessary, to show the areas under villages as mentioned in the Schedule-1 appended hereto as the " New Town " and accordingly decided to modify the " said Regional Plan " as per the provision of Section 20(2) of the said act (" hereinafter referred to as the said proposed modification ") ;

Now, therefore, as provided in sub-section (3) of Section 20 of the said Act, the Government of Maharashtra hereby declares its intention to make the proposed modification in the said Regional Plan and for that purpose invites suggestions and objections from any person with respect to the proposed modification. Any suggestions and objections shall be submitted to the Divisional Joint Director of Town Planning, Nagpur Division, Room No. 108/109, First Floor, Old Secretariat, Civil Lines, Nagpur- 440 001 who is hereby appointed as the ' Officer ' to give hearing in respect of the suggestions and objections received in this regard and to submit his report to the Government. ;

ii. Tree Plantation, Gardens, landscap- ing, Public Park Landscaping, For- estry and Nursery etc.

iii. River front development by Nagar Panchayat or any institution authorized on behalf on Nagar Panchayat.

clarified that the FSI of the land under green belt zone shall be permissible to be utilized on the land adjoining but outside such green belt zone.

The users and its extent shall be per- missible in such Recreational open space, as prescribed in the regulation of Green Belt as mentioned above.

If the land under green belt zone, excepting open space therein if any, is required by Chief Officer for the public purposes mentioned above, the owner shall hand over the possession of such land for the development and maintenance of public purposes. Thereafter, such land shall remain open and accessible to general public for recreational activities.

Provided that, FSI of such land under Green Belt Zone shall be permissible only after handing over such land to the Nagar Panchayat free of cost and free from encumbrances.

The Side/rear marginal distanes for the proposed building adjoining to river/Nala shall be maximum of side/rear marginal distance, to be measured from river/Nala, as required according to height of build- ing or 4.5 mt. from the dividing line between green belt zone and the other de- velopable zone.

Whereas, the Government of maharashtra in Urban Development vide its Notification No. MQN- 2012-C.R.95-Reconstruction-2-UD-18, Date 19-06-2013 excluded the area of Revenue village of Mouje Mahadula from Nagpur Metropolitian & Included in the Nagpur Panchayat, Mahadula & Urban Development Department vide Notification No. TPS-2413-405-C.R.-213-UD-9, Date 14-10-2013 declares the Nagar Panchayat, Mahadula being a Local Authority shall be Planning Authority for Nagar Panchayat area, Nagar Panchayat, Mahadula ( (hereinafter referred to as "the said Planning Authority") being the .-ॅ-+-६ (३१५३).

Planning Authority within its jurisdiction vide its Resolution No. 188, date 19-01-2016 declared its in- tention under Section 23, read with Section 38 of the Maharashtra Regional & Town Planning Act, 1966 (Mah.XXXVII of 1966) hereinafter referred to "the said Act") to prepare Draft Development Plan for the area within the limits of the Mahadula Nagar Panchayat (hereinafter referred to as "the said Draft Development Plan") and Notice of such declaration was published in the Maharashtra Government Gazette, Part 1-A Nagpur Divisional Supplement, dated the 08-14 September, 2016;

And whereas, the said Officer after carrying out survey of the entire land within the jurisdiction of the said Planning Authority as required under Section 25 of the said Act, published a Notice in Maharashtra Government Gazette, part I-A Nagpur Divisionnal Supplement dated the 10-16 August, 2017 for inviting objections or suggestions to the Draft Development Plan of Mahadula prepared by it under sub-section (1) of Section 26 of the said Act;

And whereas, after considering the suggestions and objections received on the said Draft Develop- ment Plan, the Planning Committee, set up under Section 28 (2) of the said Act has submitted its report to the said planning Authority on date 20-03-2018;

And whereas, "the Planning Authority" published the said Draft Development Plan so modified for information of the public under sub-section (4) of section 28 of the said Act by a notice published in the Maharashtra Government Gazette, Nagpur Divisional Supplement, date 07-05-2018 on page Nos. 1 to 3;

And whereas, in accordance with the provisions of sub-Section (1) of Section 30 of the said Act, the Planning Authority has submitted the said Draft Development Plan to the Government of Maharashtra for sanction vide its Marathi letter No. -ह.द्धा-.ह्यम्-.-ॅद्ध-३०-०६, dated the 22-05-2018;

And whereas, in accordance with the amended provision of Section 31(1) of the said Act, the State Government is required to Sanction the said Draft Development Plan for Mahadula within a period of six months, from the date of its submission under Section 30 of the said Act or within the extended period not exceeding twelve months in aggregate;

And whereas, in accordance with the amended provisions of Section 148-A of the said Act in computing the period, in relation to any Development Plan, Regional Plan or Scheme the period or periods during which any action could not be completed due to enforcement of any Code of Conduct by the Election Commission of India or the State Election Commission in respect of any Election shall be excluded ;

And whereas, in accordance with the provisions of sub-section (1) of Section 31 of the said Act, vide Notification No. TPS-2418-1053-C.R.321(A)-2018-UD-09, Date 31-01-2019, the State Government has sanctioned a part of the said Draft Development Plan of Mahadula with modifications as specified in SCHEDULE-A (SM-1, SM-2, ......... etc.), excluding the substantial modifications (EP-1, EP-2. ...... etc.) as specified in SCHEDULE-B appended with this Notice ;

And whereas, the substantial modifications proposed by the Government are excluded from the said Draft Development Plan and shown on the Plan verged in Pink Colour and marked as excluded part i. e. as EP-1, EP-2, ...... etc.

Now, therefore, in exercise of the powers conferred under Section 31(1) of the said Act and all other powers enabling it on that behalf, the Government of Maharashtra hereby :—

(a) Gives Notice for inviting suggestions and objections from any person in respect of the proposed substantial modifications as specified in the SCHEDULE-B appended hereto, within a period of one month from the date of publication of this Notice in the Official Gazette.

(b) Appoint the Joint Director of Town Planning, Nagpur Division, Nagpur as the " Officer " under Section 31(2) of the said Act, to hear all suggestion and objections as stated in (a) above and to submit his Report thereupon to the Government for further necessary action.

02. Only the suggestions or objections regarding substantial modifications mentioned in SCHEDLE-B, that may be received by the Joint Director of Town Planning, Nagpur Division, Nagpur within the stipulated period of one month from the date of publication of this Notice in the Official Gazette, shall be considered.

If the land under green belt zone, excepting open space therein if any, is required by Chief Officer for the public purposes mentioned above the owner shall hand over the possession of such land for the development and mainte- nance of public purposes. Thereafter, such land shall remain open and acces- sible to general public for recreational activities.

Provided that, FSI of sub land under Green Belt Zone shall be permissible only after handing over such land to the Nagar Panchayat free of cost and free from encumbrances.

The Side/rear marginal distances for the proposed building adjoining to river/ Nala shall be maximum of side/rear marginal distance, to be measured from river/Nala, as required according to height of building or 4.5 mt. from the dividing line between green belt zone and the other developable zone.

The development along the highways shall be subject to the provisions of State Highways Act, 1965 and National High- way Act, 1956 and orders issued by Public Works Development in this regards, from time to time.

A service road of 12 m. wide shall be provided along State and National High- ways on both sides. These service roads may not be provided in piecemeal where authorised development/construction have already taken place without the provisions of service road.

MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.

No. TPS-2418-1053-CR-321(A)-UD-09-2018.—

Whereas, the Government of Maharashtra in Urban Development Department vide its Notification No. MQN-2012-C.R.95-Reconstruction-2-UD-18, Dated 19-06-2013 excluded the area of Revenue village of Mouje Mahadula from Nagpur Metropolitian Area & included in the Nagpur Panchayat, Mahadula & Urban Development Department vide Notification No. TPS-2413-405-C.R.-213-UD-9, Date 14-10-2013 declares the Nagar Panchayat, Mahadula being a Local Authority shall be the Planning Authority for Nagar Panchayat area. Nagar Panchayat, Mahadula ( (hereinafter referred to as "the said Planning Au- thority") being the Planning Authority within its jurisdiction vide its Resolution No. 188, dated 19-01- 2016 declared its intention under Section 23, read with Section 38 of the Maharashtra Regional & Town Planning Act, 1966 (Mah.XXXVII of 1966) (hereinafter referred to "the said Act") to prepare Draft Development Plan for the area within the limits of the Mahadula Nagar Panchayat (hereinafter referred to as "the said Draft Development Plan") and Notice of such declaration was published in the Maharashtra Government Gazette, Part 1-A Nagpur Division Supplement, dated the 08-14 September, 2016;

And whereas, the said Officer after carrying out survey of the entire land within the jurisdiction of the said Planning Authority as required under Section 25 of the said Act, published a Notice in Maharashtra Government Gazette, part 1-A Nagpur Division Supplement dated the 10-16 August, 2017 for inviting objections or suggestions to the Draft Development Plan of Mahadula prepared by it under sub-section (1) of Section 26 of the said Act;

And whereas, after considering the suggestions and objections received on the said Draft Develop- ment Plan, the Planning Committee, set up under Section 28 (2) of the said Act has submitted its report to the said Planning Authority on date 20-03-2018;

And whereas, "the Planning Authority" published the said Draft Development Plan so modified for information of the public under sub-section (4) of Section 28 of the said Act by a notice published in the Maharashtra Government Gazette, Nagpur Division Supplement, dated 07-05-2018 on page Nos. 1 to 3;

And whereas, in accordance with the provisions of sub-section (1) of Section 30 of the said Act, the Planning Authority has submitted the said Draft Development Plan to the Government of Maharashtra for sanction vide its Marathi letter No. -ह.द्धा-.ह्यम्-.-ॅद्ध-३०-०६, dated the 22 May 2018;

And whereas, in accordance with the amended provision of Section 31(1) of the said Act, the State Government is required to Sanction the said Draft Development Plan for Mahadula within a period of six months, from the date of its submission under Section 30 of the said Act, or within the extended period not exceeding twelve months in aggregate;

And whereas, in accordance with the amended provisions of Section 148-A of the said Act in computing the period, in relation to any Development Plan, Regional Plan or Scheme the period or periods during which any action could not be completed due to enforcement of any Code of Conduct by the Election Commission of India or the State Election Commission in respect of any Election shall be excluded ;

And whereas, in accordance with the sub-section (1) of Section 31 of the said Act, after making necessary enquiries and after consulting the Director of Town Planning, Maharashtra State, the State Government has decided to sanction part of the said Draft Development Plan with modifications shown in SCHEDULE-A (As SM-1, SM-2, ......... etc.), excluding the substantial modifications shown in SCHED- ULE-B (As EP-1, EP-2. ...... etc.) appended with this Notice No. TPS-2418-1053-C.R.321(B)-2018-E. P. Publish-UD-09, Date 31-01-2019.

Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 31 of the said Act and of all other powers enabling it on that behalf, the Government of Maharashtra hereby :—

(a) Extends the period prescribed under Section 31(1) of the said Act, for sanctioning the said Draft Development plan from date 22-11-2018 up to and inclusive of the date of this notification.

(b) Sanction the said Draft Development Plan for Mahadula Nagar Panchayat along with modification as specified in Schedule of Modifications namely SCHEDULE-A appended hereto, excluding the proposals under substantial modifications as specified in SCHEDULE-B appended with Notice No.TPS- 2418-1053-CR-321(B)-2018-EP. Publish-UD-09, dated 31-01-2019;

(c) The date after 30 days of publication of this Notification in the Official Gazette will be the date on which the Development Plan (partly), called the Final Development Plan of Mahadula Nagar Panchayat shall come into force.

01. The aforesaid Part Final Development Plan of Mahadula sanctioned by the State Government shall be kept open for inspection by the public during office hours on all working days for a period of one month from the date of coming into force of this Notification, in the office of the Mahadula Nagar Panchayat, Dist. Nagpur.

02. The reservation/allocations/designations which do not appear in the Schedule-A and Schedule-B appended hereto, are hereby sanctioned for the respective purposes as designated in the Development Plan.

03. Areas of reserved sites metioned in the report of the Development Plan are approximate and subject to actual measurement on site as per boundaries shown on the Final Development Plan.

04. On cease of Existing Public/Semi Public use shown in the Development Plan on the private lands/ rented premises or the Public/Semi Public zone which had been shown inadvertently due to drafts- man error, the use as per adjoining major land use zone shall be permitted with prior approval of Divisional Joint Director of Town Planning.

05. Draftsman's errors which are required to be corrected as per actual situation on site or as per survey records, sanctioned layout, etc., shall be corrected by the Chief Officer, Mahadula Nagar Panchayat, Dist. Nagpur after due verification and with prior approval of the Director of Town Planning, Maharashtra State, Pune.

06. Those open spaces from sanctioned layouts that are earmarked as existing open spaces (in green color) on Development Plan are subject to changes if respective layouts are revised. If the layout is revised and if open space is shown elsewhere in Residential Zone, then the existing open space in the layout as shown on the Development Plan be treated as Residential Zone.

Whereas, Chandrapur City Development Plan (Extended Area) is approved by the Government Notification, No. TPS-2294-1315-CR-253-96-UD-9, Dated 02-6-1997 and comes into force from dated 15-08-1997. As per Maharashtra Regional and Town Planning Act, 1966 Sec 38, it is necessary to revise Development Plan atleast ones in 20 year from the date on which it comes into force.

Similarly, Revised Development Plan of Chandrapur (Old Municipal Limit) is approved by the Government Notification No. TPS-2112-520-(N)-RECON No. 56-CR 101-12-UD-9, Dated 21-12-2012 and comes into force from dated 01-02-2013.

However, As per the Government of Maharashtra Urban Development Department Government Resolution No. TPS-1818-1647-CR252-18-UD-13, Dated 15-10-2018 under Maharashtra Regional and Town Planning Act, 1966 Section 154, it is directed to revise both the Development Plan of city combinely, wherever two Development Plans are approved separately for old limit & extended limit of the city and work under process for revision of Development Plan of any one of them. Chandrapur City Municipal Corporation under its General Body Resolution No. 63, Dated 29-12-2018 has declared its intention to prepare the Revised Development Plan of Chandrapur City Municipal Corporation limit as per provision under Section 21(2), 23(1) & 38 of the Maharashtra Regional and Town Planning Act, 1966.

Copy of the plan showing the area for which the Development Plan is to be revise is displayed and kept open for inspection of the public on all working days during office hours at the Head Office & Zone Office of Chandrapur City Municipal Corporation, Chandrapur as required under Section 23(2) of the Maharashtra Regional and Town Planning Act, 1966.

Suggestions/Objections if any, which should be communicated in writing within 60 (sixty) days from the date of the publication of the intention in the Maharashtra Government Gazette, shall be considered by the Chandrapur City Municipal Corporation, Chandrapur for the consideration under Section 23(1) of the Maharashtra Regional and Town Planning Act, 1966.
