NOTIFICATION

No. SPP-3818/1595/C.R.300/D-XIV.—In exercise of the powers conferred by Sub-section (8) of the section 24 of the Code of Criminal Procedure, 1973 (Act No. II of 1974), the Government of Maharashtra hereby appoints Adv. Sangita Phad as "Special Public Prosecutor" for conducting the Sessions Case No. 261/2017 pending before Addl. Sessions Court, Kalyan, Dist. Thane, which is arising out of C.R.No. I 138/2017 registered at Dombivali Police Station, Dist. Thane.

2. Her appointment is strictly subject to the conditions of service laid down in the Maharashtra Law Officers (Appointment, Conditions of Service and Remuneration) Rules, 1984.

3. Lump Sum fees of Rs. 20,000 (Rs. Twenty Thousand Only) as quoted by Adv. Sangita Phad has been deposited by the applicant Shri Sachin Balkrishna Kene, with the Government, vide R. B. I. Challan No. 3816 dated 12th February 2019. The amount will be paid to Adv. Sangita Phad after completion of the case.

4. The Government reserves the right to revoke/modify/annul the order without assigning any reasons.

Ujjwal Nikam, as Special Public Prosecutor made vide Government Notification No.SPP 2016/UOR-42/D-XIV, dated 1st June 2016 with immediate effect.

क्रमांक डीजीपी.३४१५/प्र.क्र.३७४/का.१४.----दिवाणी प्रक्रिया संहिता, १९०८ च्या ऑर्डर २७, फौजदारी प्रक्रिया संहिता, १९७३ चे कलम २४ (३) व महाराष्ट्र विधि अधिकारी (नियुक्ती, सेवेच्या शर्ती आणि मानधन) नियम, १९८४ च्या नियम १३ मधील तरतुदीनुसार सांगली जिल्हा व सत्र न्यायालयाकरिता अॅड. उल्हास जयकुमार चिप्रे यांची जिल्हा सरकारी वकील व शासकीय अभियोक्ता या पदावर शासन अधिसूचना समक्रमांक दिनांक ८ फेब्रुवारी, २०१६ अन्वये पुढील २ वर्ष कालावधीसाठी नियुक्ती करण्यात आली होती. सदर नियुक्तीचा कालावधी समाप्त झाल्याने शासन अधिसूचना समक्रमांक दिनांक ६ फेब्रुवारी, २०१८ अन्वये दिनांक ८ फेब्रुवारी, २०१८ पासून पुढील १ वर्ष कालावधीसाठी मुदतवाढ देण्यात आली आहे.

सदर नियुक्तीस दिनांक ८ फेब्रुवारी, २०१९ पासून पुढील एक वर्षाचा कालावधी अथवा त्यांच्या वयास ६२ वर्षे पूर्ण होतील तो दिनांक यापयर्ंतचा कालावधी, यापैकी जे अगोदर घडेल तोपयर्ंतच्या कालावधीकरिता तात्पुरत्या स्वरूपात मुदतवाढ देण्यात येत आहे.

२. सदर नियुक्ती महाराष्ट्र विधि अधिकारी (नियुक्ती, सेवाशर्ती व मानधन) नियम, १९८४ यामध्ये दिलेल्या सेवाशतर्ींच्या अधीन राहील.

३. वरील आदेश मागे घेण्याचा/त्यात दुरुस्ती करण्याचा/ते रद्द करण्याचा अधिकार शासन राखून ठेवीत आहे.

क्रमांक पतसंस्था/स.आ.५/का.क.१५६/ज्ञानगंगा पत/२०१८/१४१७.-------- महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६(१) अन्वये मला प्रदान करण्यात आलेल्या शक्तीचा वापर करून मी, डॉ. पी. एल. खंडागळे, अपर निबंधक, सहकारी संस्था, महाराष्ट्र राज्य, पुणे या आदेशान्वये ज्ञानगंगा नागरी सहकारी पतसंस्था मर्या., मुंबई या संस्थेच्या खालील अधिकायांस त्यांच्या नावापुढे दर्शविलेल्या कार्यक्षेत्रासाठी महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १०१ व कलम ९१ अन्वये प्राप्त झालेल्या वसुली प्रमाणपत्राची अंमलबजावणी/कर्ज वसुली करण्याकरिता महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६(१) व नियम १०७ अनुसार मालमत्ता जप्त करून व तिची विक्री करून रकमा वसूल करण्याचे निबंधकाचे अधिकार, खालील अटीस अधीन राहून या आदेशाच्या दिनांकापासून ते दिनांक ३१ मार्च २०१९ या कालावधीकरिता प्रदान करीत आहे :—

(१) वसुली अधिकारी यांनी महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ व नियम, १९६१ चे नियम १०७ मधील तरतुदीनुसार कर्ज वसुलीची कार्यवाही करावी. कर्ज वसुली करताना सहकार कायदा, नियम यातील तरतुदी व परिपत्रकीय सूचनांचे पालन न केल्याचे निदर्शनास आल्यास, आवश्यक ती चौकशी करून आवश्यकता भासल्यास, सदरचे प्रदान केलेले अधिकार तत्काळ काढून घेण्यात येतील.

(२) सदरचे अधिकार सहकार कायदा कलम १०१ व ९१ अन्वये प्राप्त वसुली दाखल्याची अंमलबजावणी करण्याकरिता असतील.

(३) वसुली अधिकारी यांनी दर माहे सोबत जोडलेल्या विहित नमुन्यात प्रपत्र १, २, ३ व ५ प्रमाणे कर्ज वसुलीची माहिती संबंधित जिल्हा उप निबंधक, सहकारी संस्था यांचे कार्यालयास सादर करावी. ज्या सहकारी संस्थेचे कार्यक्षेत्र विभाग, दोन विभाग अथवा राज्य कार्यक्षेत्र आहे त्या संस्थांनी देखील त्यांचे मुख्य कार्यालय ज्या जिल्ह्यमध्ये आहे त्या जिल्हा उप निबंधक यांचे कार्यालयास माहिती सादर करावी.

(४) अधिकार प्रदान केलेल्या वसुली अधिकारी असलेल्या व्यक्तीची बदली झाल्यास किंवा सेवानिवृत्ती झाल्यास किंवा सेवेतून काढून टाकल्यास किंवा त्याचा मृत्यू झाल्यास, अशा अधिकायास प्रदान केलेले अधिकार आपोआप रद्द होतील.

(५) वसुली अधिकारी यांनी मा. सहकार आयुक्त व निबंधक, सहकारी संस्था, महाराष्ट्र राज्य, पुणे यांचे दिनांक ६ एप्रिल २०१८ रोजीचे आदेशामध्ये नमूद प्रमाणेच हुकूमनाम्यांच्या/वसुली दाखल्यांच्या आदेशिकेचा खर्च (Cost of process) थकबाकीदारांकडून वसूल करणेबाबत दक्षता घ्यावी आणि त्याचा प्रकरणनिहाय हिशोब ठेवावा.

भाग एक (म.उ.वि.)--१अ४ महाराष्ट्र शासन राजपत्र, भाग एक--मध्य उप-विभाग, गुरुवार ते बुधवार, फेब्रुवारी २८-मार्च ६, २०१९/फाल्गुन ९-१५, शके १९४० (६) मा. उच्च न्यायालय, मुंबई यांनी रिट याचिका क्रमांक १९४२/२०१३, दि बेसिन कॅथोलिक को-ऑप. बँक विरुद्ध महाराष्ट्र राज्य व इतर या याचिकेमध्ये दिनांक ५ डिसेंबर २०१५ रोजी दिलेला आदेश विचारात घेऊन वसुलीची कार्यवाही करताना महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ अन्वये प्राप्त असलेल्या अधिकारानुसारच वसुलीची कार्यवाही करावी.

(७) वसुली अधिकारी यांनी नमूद केलेल्या कालावधीत वसुलीचे कामकाज समाधानकारक केले नसल्याचे निदर्शनास आल्यास किंवा प्रदान केलेल्या अधिकाराचा गैरवापर करीत असल्याचे निदर्शनास आल्यास, प्रदान केलेले अधिकार काढून घेतले जातील व भविष्यात असे कोणतेही अधिकार अशा व्यक्तीस प्रदान करण्यात येणार नाहीत.

(८) शासन निर्णय क्रमांक संकीर्ण.१५०४/प्र.क्र.२३१/१५-स, दिनांक २३ नोव्हेंबर २००६ अन्वये वसुली अधिकायांना तीन सिंहाच्या राजमुद्रेचा वापर करता येणार नाही.

(९) वसुली अधिकायास त्याच्या नावापुढे कोठेही ""महाराष्ट्र शासन नियुक्त"" आणि किंवा "" सिव्हील कोर्ट"", ""एक्झीक्युटीव्ह कोर्ट"" या शब्दांचा अथवा तत्सम शब्दांचा वापर करता येणार नाही. त्याऐवजी वसुली अधिकायंानी त्यांच्या नावापुढे ""वसुली अधिकारी (महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम १९६१ चे नियम १०७ अन्वये )"" असे लिहावे.

(१०) वसुली अधिकायास वसुलीसाठी वापर करण्यात येणाया वाहनावर ""ज्ञानगंगा नागरी सहकारी पतसंस्था मर्या., मुंबई "" असा फलक लावता येऊ शकेल.

(११) वसुली अधिकायाने पगार जप्तीची कार्यवाही करताना कर्जदाराच्या/जामीनदाराच्या पगार कपातीबाबत राष्ट्रीयीकृत बँका वा अन्य बँका यांचेकडे परस्पर वेतन कपातीचा आदेश देऊन परस्पर पगार कपात करता येणार नाही. संबंधित कर्जदार/जामीनदार ज्या आस्थापनेवर काम करीत आहे त्या आस्थापनेवरील आहरण व संवितरण अधिकारी/पगार करणारा अधिकारी यांचेमार्फत पगारातून कर्ज वसूल करण्याची कार्यवाही करावी.

(१२) वसुली अधिकायास, थकबाकीदाराकडून वसुली दाखल्यानुसार वसूलपात्र रक्कम व दिनांक ६ एप्रिल २०१८ रोजीचे मा. सहकार आयुक्त व निबंधक, महाराष्ट्र राज्य, पुणे यांचे आदेशामध्ये निश्िचत केलेल्या हुकूमनाम्याच्या/वसुलीच्या दाखल्याच्या आदेशिकेचा खर्चाच्या (Cost of process) दराने वसूल करावयाची रक्कम याशिवाय इतर कोणतीही रक्कम थकबाकीदारांकडून वसूल करता येणार नाही.

(१३) वसुली अधिकायाने या कार्यालयाच्या दिनांक १ जानेवारी २०१७ च्या परिपत्रकातील सूचनांची काटेकोरपणे अंमलबजावणी करणेची आहे. सदर परिपत्रकातील सूचनांचे उल्लंघन झाल्यास, वसुलीचे अधिकार काढून घेण्यात येऊन भविष्यकाळात असे अधिकार प्रदान केले जाणार नाहीत, याची नोंद घ्यावी.

(१४) संस्थेने मा. सहकार आयुक्त व निबंधक, सहकारी संस्था, महाराष्ट्र राज्य, पुणे यांचे दिनांक ६ एप्रिल २०१८ रोजीचे आदेशानुसार निश्चित केलेल्या हुकूमनामा/वसुली दाखला अंमलबजावणीच्या आदेशिकेचा खर्च (Cost of process) याबाबत त्याची आकारणी व विनियोग करताना सदर आदेशाचे उल्लंघन होणार नाही याबाबत दक्षता घ्यावी. सदर खर्चाची आकारणी व विनियोग याबाबत प्रकरणनिहाय हिशोब ठेवावयाचा असून त्याची तपासणी संस्थेच्या वैधानिक लेखापरिक्षकांकडून करून घ्यावयाची आहे. सदर आदेशामध्ये नमूद दरानेच खर्चाची आकारणी करून वसूल करावयाची असून सदर आदेशामध्ये नमूद कारणांसाठीचा त्याचा विनियोग करावयाचा आहे. सदर आदेशाचे उल्लंघन केल्यास संचालक मंडळ/व्यवस्थापक/वसुली अधिकारी कायदेशीर कारवाईस पात्र राहील याची नोंद घ्यावी.

क्रमांक ना.बँका/१-सआ/का.क.१५६/मंगल बँक/वि.व.अ/१८/१२४४.-------- महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ अन्वये मला प्रदान करण्यात आलेल्या शक्तीचा वापर करून मी, डॉ. आनंद जोगदंड, अपर आयुक्त व विशेष निबंधक, सहकारी संस्था, महाराष्ट्र राज्य, पुणे या आदेशान्वये मंगल को-ऑप. बँक लि. मुंबई या बँकेच्या खालील अधिकायांना त्यांच्या नावापुढे दर्शविलेल्या कार्यक्षेत्रासाठी कलम १०१ व कलम ९१ अन्वये प्राप्त झालेली वसुली प्रमाणपत्रांची अंमलबजावणी व कर्ज वसुलीबाबत करावयाच्या कार्यवाहीपुरती महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ अन्वये व नियम, १९६१ चे नियम १०७ मधील तरतुदीनुसार खालील अटीस अधीन राहून या आदेशाच्या दिनांकापासून ते दिनांक ३१ मार्च २०१९ पयर्ंत शक्ती प्रदान करीत आहे :—

(१) वसुली अधिकारी यांनी महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ व नियम, १९६१ चे नियम १०७ मधील तरतुदीनुसार कर्ज वसुलीची कार्यवाही करावी. कर्ज वसुली करताना सहकार कायदा, नियम यातील तरतुदी व परिपत्रकीय सूचनांचे पालन न केल्याचे निदर्शनास आल्यास, आवश्यक ती चौकशी करून आवश्यकता भासल्यास, सदरचे प्रदान केलेले अधिकार तत्काळ काढून घेण्यात येतील.

(२) सदरचे अधिकार सहकार कायदा कलम १०१ व कलम ९१ अन्वये प्राप्त वसुली दाखल्याची अंमलबजावणी करण्याकरिता असतील.

(३) वसुली अधिकारी यांनी या कार्यालयाने दिनांक २४ जून २०१६ रोजी निर्गमित केलेल्या परिपत्रकानुसार दरमाह विहित नमुन्यात अ-३, अ-४ व ब कर्ज वसुलीची माहिती जिल्हा उप निबंधक, सहकारी संस्था, मुंबई यांना सादर करावी.

(४) वसुली अधिकार प्रदान केलेल्या व्यक्तीची बदली झाल्यास किंवा सदर व्यक्ती सेवा निवृत्ती झाल्यास किंवा सदर व्यक्तीस सेवेतून काढून टाकल्यास किंवा त्याचा मृत्यू झाल्यास, अशा अधिकायास प्रदान केलेले अधिकार आपोआप रद्द होतील.

(५) मा. उच्च न्यायालय, मुंबई यांनी रिट याचिका क्रमांक १९४२/२०१३, दि बेसिन कॅथोलिक को-ऑप. बँक विरुद्ध महाराष्ट्र राज्य व इतर या याचिकेमध्ये दिनांक ५ डिसेंबर २०१५ रोजी दिलेला आदेश विचारात घेऊन वसुलीची कार्यवाही करताना महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ अन्वये प्राप्त असलेल्या अधिकारानुसारच वसुलीची कार्यवाही करावी.

(६) वसुली अधिकारी यांनी नमूद केलेल्या कालावधीत वसुलीचे कामकाज समाधानकारक केले नसल्याचे निदर्शनास आल्यास किंवा प्रदान केलेल्या अधिकाराचा गैरवापर करीत असल्याचे निदर्शनास आल्यास, प्रदान केलेले अधिकार काढून घेतले जातील व भविष्यात असे कोणतेही अधिकार अशा व्यक्तीस प्रदान करण्यात येणार नाहीत.

(१०) वसुली अधिकायाने पगार जप्तीची कार्यवाही करताना कर्जदाराच्या/जामीनदाराच्या पगार कपातीबाबत राष्ट्रीयीकृत बँका वा अन्य बँका यांच्याकडे परस्पर वेतन कपातीचा आदेश देऊन परस्पर पगार कपात करता येणार नाही. संबंधित कर्जदार/जामीनदार ज्या आस्थापनेवर काम करीत आहे त्या आस्थापनेवरील आहरण व संवितरण अधिकारी/पगार करणारा अधिकारी यांचेमार्फत पगारातून कर्ज वसूल करण्याची कार्यवाही करावी.

(११) वसुली अधिकायास, थकबाकीदाराकडून वसुली दाखल्यानुसार वसूलपात्र रक्कम व या कार्यालयाचे कलम १५६ अन्वयेचे आदेश दिनांक ६ एप्रिल २०१८ मध्ये नमूद केलेप्रमाणे व दराने अंमलबजावणी खर्चाची रक्कम याशिवाय इतर कोणतीही रक्कम वसूल करता येणार नाही.

(१२) या कार्यालयाचे आदेश/परिपत्रक दिनांक १ जानेवारी २०१७ मधील क्र. ४ कलम १५६ व नियम १०७ अन्वये वसुली अधिकायांनी करावयाची कार्यवाही यामधील मार्गदर्शक सूचनांचे पालन करावे. बँकेचे मुख्य कार्यकारी अधिकारी यांनी दरमाह वसुली अधिकायांचे कामकाजाचा कर्जदारनिहाय आढावा परिपत्रकातील प्रपत्र पाच मध्ये नमूद केल्याप्रमाणे घ्यावा.

2. Her appointment is strictly subject to the conditions of service laid down in the Maharashtra Law Officers (Appointment, Conditions of Service and Remuneration) Rules, 1984.

3. Lump sum fees of Rs. 25,000 (Rupees Twenty Five Thousand only) as quoted by Adv. Sangita E. Phad has been already deposited by the applicant Shri Chimanbhai Patel to the Government, vide R.B.I. Challan No. 1790, dated 10th January 2019. The amount will be paid to Adv. Sangita E. Phad after completion of the case.
