महाराष्ट्र भाडे नियंत्रण अधिनियम, १९९९.
क्रमांक भानिका-२०१८/प्र.क्र.१०९/गृनिधो-१.----महाराष्ट्र भाडे नियंत्रण अधिनियम, १९९९ (२००० चा महा.१८) याच्या कलम ५७ चे पोट- कलम (१) आणि पोट-कलम (२) चा खंड (ग) तसेच, कलम ४० यांद्वारे प्रदान करण्यात आलेल्या अधिकारांचा, आणि याबाबतीत त्यास समर्थ करणाया इतर सर्व अधिकारांचा वापर करून, महाराष्ट्र शासनाने, करण्याचे योजिलेल्या महाराष्ट्र भाडे नियंत्रण सक्षम प्राधिकारी, अधिकारी व कर्मचारी (नियुक्ती व सेवाशर्ती) नियम, २०१७ यांमध्ये सुधारणा करणा-या नियमांचा पुढील मसुदा हा, त्यामुळे बाधा पोहचण्याची शक्यता असलेल्या सर्व व्यक्तींच्या माहितीकरिता, उक्त अधिनियमाच्या कलम ५७ च्या पोट-कलम (१) द्वारे आवश्यक असल्याप्रमाणे याद्वारे प्रसिद्ध करण्यात येत आहे; आणि याद्वारे, अशी नोटीस देण्यात येत आहे की, उक्त मसुदा, महाराष्ट्र शासनाकडून दिनांक ३१ मार्च २०१९ रोजी किंवा त्यानंतर विचारात घेण्यात येईल.
२. उक्त मसुद्याच्या संबंधात कोणत्याही व्यक्तीकडून ज्या कोणत्याही हरकती किंवा सूचना, अपर मुख्य सचिव, गृहनिर्माण विभाग, मंत्रालय, मादाम कामा मार्ग, हुतात्मा राजगुरु चौक, मुंबई ४०० ०३२, यांचेकडे उपरोक्त दिनांकापूर्वी प्राप्त होतील, त्या शासन विचारात घेईल.
१. या नियमांना, महाराष्ट्र भाडे नियंत्रण सक्षम प्राधिकारी, अधिकारी व कर्मचारी (नियुक्ती व सेवाशर्ती) सुधारणा नियम, २०१९ असे म्हणावे.
२. महाराष्ट्र भाडे नियंत्रण सक्षम प्राधिकारी, अधिकारी व कर्मचारी (नियुक्ती व सेवाशर्ती) नियम, २०१७ (यात यापुढे ज्यांचा निर्देश "मुख्य नियम" असा करण्यात आला आहे) यांच्या नियम ३ मध्ये, खंड (ख) नंतर, पुढील परंतुक समाविष्ट करण्यात येईल, ते असे :--- " परंतु, खंड (क) अन्वये सक्षम प्राधिकारी म्हणून उप जिल्हाधिकायामधून प्रतिनियुक्तीवरील, बदलीद्वारे एखाद्या व्यक्तीची नियुक्ती करताना, ज्या व्यक्तीला,—
(एक) कायद्याचे ज्ञान आहे ; (दोन) भाडे नियंत्रण विषयक बाबी हाताळण्याचा अनुभव आहे ; आणि (तीन) जो अर्धन्यायिक कार्यवाही र्िनणित करील, अशा व्यक्तीला प्राधान्य देण्यात येईल."
३. मुख्य नियमांच्या नियम ४ ऐवजी, पुढील नियम दाखल करण्यात येईल :----
" ४. सक्षम प्राधिकायाचे वेतन, भत्ते व इतर सेवाशर्ती.--- नामनिर्देशनाद्वारे नियुक्त केलेल्या सक्षम प्राधिकायांंचे वेतन, भत्ते व इतर सेवाशर्ती ह्य उप जिल्हाधिकायाच्या वेतन, भत्ते व इतर सेवाशतर्ींप्रमाणेच असतील." महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, मार्च ५, २०१९/फाल्गुन १४, शके १९४० २ HOUSING DEPARTMENT Madam Kama Marg, Hutatma Rajguru Chowk, Mantralaya, Mumbai 400 032, dated the 2nd March 2019
NOTIFICATION
MAHARASHTRA RENT CONTROL ACT, 1999.
No. Bhanika. 2018/C.R.109/GND-1.—The following draft of rules to amend the Maharashtra Rent Control Competent Authority, Officers and Employees (Appointment and Service Conditions) Rules, 2017, which the Government of Maharashtra proposes to make in exercise of the powers conferred by sub- section (1) and clause (g) of sub-section (2) of section 57 read with section 40 of the Maharashtra Rent Control Act, 1999 (Mah. XVIII of 2000) and of all other powers enabling it in this behalf, is hereby published as required by sub-section (1) of section 57 of the said Act, for information of all persons likely to be affected thereby; and notice is hereby given that the said draft will be taken into consideration by the Government of Maharashtra on or after the 31st day of March 2019.
2. Any objections or suggestions which may be received by the Additional Chief Secretary, Housing Department, Mantralaya, Madam Cama Marg, Hutatma Rajguru Chowk, Mumbai 400 032, from any person with respect to the said draft before the aforesaid date will be considered by the Government. 1. These rules may be called the Maharashtra Rent Control Competent Authority, Officers and Employees (Appointment and Service Conditions) Amendment Rules, 2019.
2. In rule 3 of the Maharashtra Rent Control Competent Authority, Officers and Employees (Appointment and Service Conditions) Rules, 2017(hereinafter referred to as "the principal Rules"), after clause (b), the following proviso shall be inserted, namely :—
"Provided that, while appointing the person by transfer under clause (a), on deputation from Deputy Collector as a Competent Authority, preference shall be given to a person who,—
(i) is having knowledge of law ;
(ii) is having experience of conducting Rent Control matters ; and
(iii) decides the quasi-judicial proceedings.".
3. For rule 4 of the principal Rules, the following rule shall be substituted, namely :—
"4. Salaries, allowances and other conditions of service of Competent Authority.—The salary, allowances and other conditions of service of the Competent Authority appointed by nomination shall be equivalent to that of the Deputy Collector.".
