महाराष्ट्र प्रादेशिक नियोजन व नगररचना अधिनियम, १९६६.
क्र. टिपीएस. टिपीएस-१८१८/२३६/१८/नवि-१३.----ज्याअर्थी, शासनाच्या नगरविकास विभागाने राज्यातील महानगरपालिका, नगरपरिषदा, नगरपंचायती, विशेष नियोजन प्राधिकरणे, नवनगर विकास प्राधिकरणे, महानगर प्रदेश विकास प्राधिकरणे (यापुढे "उक्त नियोजन प्राधिकरणे" उल्लेख केलेला आहे) यांच्या विकास योजनांना (यापुढे " उक्त विकास योजना" उल्लेख केलेला आहे) व विकास नियंत्रण व प्रोत्साहन नियमावलीस (यापुढे " उक्त विकास नियंत्रण नियमावली" उल्लेख केलेला आहे) महाराष्ट्र प्रादेशिक नियोजन व नगररचना अधिनियम, १९६६ (यापुढे " उक्त अधिनियम" उल्लेख केलेला आहे) च्या कलम ३१ (१) अन्वये मंजुरी दिलेली आहे;
आणि ज्याअर्थी, उक्त नियोजन प्राधिकरणांच्या उक्त विकास नियंत्रण नियमावली ह्य वेगवेगळ्या असल्याने केंद्र शासनाचे औद्योगिक धोरण व प्रोत्साहन विभागाच्या (DIPP) धोरणानुसार राज्यातील सर्व महानगरपालिका, नगरपरिषदा तसेच इतर नियोजन प्राधिकरणांकरिता सर्व समावेशक एकत्रिकृत विकास नियंत्रण नियमावली व्यवसाय सुलभतेच्या रुपरेषेनुसार असणे आवश्यक आहे;
आणि ज्याअर्थी, उपरोक्त बाब विचारात घेऊन शासनाच्या नगरविकास विभागाने महानगरपालिका, नगरपरिषदा , नगरपंचायती, विशेष नियोजन प्राधिकरणे, नवनगर विकास प्राधिकरणे, महानगर प्रदेश विकास प्राधिकरणे यांच्याकरीता एकत्रिकृत सर्व समावेशक विकास नियंत्रण व प्रोत्साहन नियमावली तयार करण्यासाठी शासन निर्णय क्र. टिपीएस-१८१८ /प्र.क्र.२३६/ २०१८/ नवि-१३, दिनांक ३ ऑक्टोबर २०१८ अन्वये द्विसदस्यीय समिती (या पुढे "उक्त कमिटी" असा उल्लेख केलेला) गठीत केली आहे;
आणि ज्याअर्थी, उक्त कमिटीने बैठकीमध्ये विचार करून या सर्व नियोजन प्राधिकरणांकरिता एकत्रिकृत सर्व समावेशक विकास नियंत्रण व प्रोत्साहन नियमावली तयार करून शासनास दिनांक ६ मार्च २०१९ रोजी सादर केली आहे;
आणि ज्याअर्थी, विद्यमान उक्त विकास नियंत्रण नियमावली बदलून त्याऐवजी राज्यातील बृहन्मुंबई वगळता सर्व महानगरपालिका, नगरपरिषदा, नगरपंचायती, विशेष नियोजन प्राधिकरणे, नवनगर विकास प्राधिकरणे, महानगर प्रदेश विकास प्राधिकरणांसाठी उक्त कमीटीने सादर केलेली एकत्रिकृत सर्व समावेशक विकास नियंत्रण व प्रोत्साहन नियमावली काही बदलासह अंतभर्ूत करण्याकरिता फेरबदल करणे आवश्यक आहे असे शासनाचे मत झाले आहे (यापुढे ज्याचा उल्लेख "प्रस्तावित फेरबदल" असा करण्यात आलेला आहे);
आणि ज्याअर्थी, लोक हिताचे दृष्टीने विचार करून प्रस्तावित फेरबदलासाठी उक्त अधिनियमातील कलम ३७ (१ कक) अन्वये कार्यवाही करणे आवश्यक आहे;

भाग एक (म.उ.वि.)--३०-१महाराष्ट्र शासन राजपत्र असाधारण भाग एक---मध्य उप-विभाग, मार्च ९, २०१९/फाल्गुन १८, शके १९४० २ त्याअर्थी, उक्त अधिनियमाच्या कलम ३७, पोट-कलम (१कक) चे खंड (क) मधील तरतूदीप्रमाणे शासनास प्राप्त अधिकारात राज्यातील बृहन्मुंबई वगळता सर्व महानगरपालिका, नगरपरिषदा, नगरपंचायती, विशेष नियोजन प्राधिकरणे, नवनगर विकास प्राधिकरणे, महानगर प्रदेश विकास प्राधिकरणांसाठी अस्तित्वात असलेल्या नियमावली ऐवजी एकत्रिकृत विकास नियंत्रण व प्रोत्साहन नियमावली (यापुढे "उक्त प्रस्तावित नियमावली" असे संबोधलेली) ;
अंर्तभूत करण्यासाठी प्रस्तावित फेरबदल करण्याचा हेतू शासन याद्वारे घोषित करीत आहे आणि त्याकरिता प्रस्तावित फेरबदलाच्या अनुषंगाने काही सूचना / हरकती द्यावयाच्या असतील, तर त्या नागरीकांनी प्रस्तुतची सूचना महाराष्ट्र शासन राजपत्रामध्ये प्रसिद्ध झाल्याच्या दिनांकापासून १ महिन्याच्या मुदतीत सादर कराव्यात.
उक्त प्रस्तावित फेरबदलाबाबत सदरची नोटीस महाराष्ट्र शासन राजपत्रात प्रसिध्द झाल्यापासून सूचना / हरकती १ महिन्याच्या विहीत मुदतीत नगररचना विभागाचे संबधित विभागीय सहसंचालक यांच्या नावे लेखी स्वरुपात, कारणासह, पाठवाव्यात. प्रस्तावित फेरबदलासंबंधात प्राप्त सूचना/ हरकतदारांना सुनावणी देऊन उक्त अधिनियमातील कलम ३७, पोट-कलम (१कक) मधील तरतुदीनुसार कार्यवाही पूर्ण करून त्यावरील अहवाल शासनास सादर करण्यासाठी उक्त अधिनियमाच्या कलम १६२ अन्वये नगररचना विभागाचे, संबंधित विभागीय सहसंचालक यांना अधिकारी म्हणून नियुक्त करण्यात येत आहे. उक्त फेरबदल शासनाने मंजूर केल्यानंतर लागू होईल.
ही सूचना महाराष्ट्र शासनाच्या राजपत्रात प्रसिद्ध झाल्यापासून ३० दिवसांचे आत प्राधिकृत अधिकारी यांच्याकडे प्राप्त झालेल्या सूचना / हरकतींचाच शासनाकडून विचार केला जाईल.
सदरहू सूचना उक्त प्रस्तावित नियमावलीसह नागरिकांच्या अवलोकनार्थ कामकाजाच्या दिवशी कार्यालयीन वेळेत खालील कार्यालयांत उपलब्ध ठेवण्यात यावी :---
(i) संचालक, नगररचना, महाराष्ट्र राज्य, मध्यवर्ती इमारत, पुणे -४११ ००१.
(ii) विभागीय सह संचालक, नगररचना, पुणे/कोकण/नाशिक/नागपूर/औरंगाबाद/अमरावती.
(iii) जिल्हाधिकारी, संबंधित जिल्हे.
सदरहू सूचना शासनाच्या www.maharashtra.gov.in (कायदे / नियम) या संकेतस्थळावर प्रसिद्ध करण्यात यावी.

Notice
MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
No. TPS-1818/CR-236/18/UD-13.—Whereas, the Government has sanctioned various Development Plans (hereinafter referred to as 'the said Development Plans') along with their Development Control and Promotion Rules (hereinafter referred to as 'the said Development Control Regulations') for Municipal Corporations, Municipal Council, Nagar Panchayat, SPA, NTDA, Metropolitan Region Development Authorities etc. (hereinafter referred to as 'the said Planning Authorities') in Maharashtra State under the provisions of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as 'the said Act) ;
And whereas, the said Development Control Regulations of the said Planning Authorities are different, the Department of Industrial Policy and Promotion (DIPP) of Central Government has stated a need for common Development Control Regulations for all Municipal Corporation, Municipal Councils and other Planning Authorities in the state as per the agenda of Ease of Doing Business;
And whereas, in view of the above, the Government in Urban Development Department, vide its resolution No. TPS-1818/CR-236/18/UD-13, dated the 3rd October 2018 has appointed a two member Committee (hereinafter referred to as 'the said Committee') for drafting Unified Development Control and Promotion Regulations for said Planning Authorities in the State;
And whereas, the said Committee after deliberating and meeting among themselves prepared the Unified Development Control and Promotion Regulations for said Planning Authorities in the State and submitted the same to the Government on date 6th March 2019;
And whereas, the Government felt it necessary to replace the existing said Development Control Regulations by the new set of Unified Development Control Regulations for all Municipal Corporations (except Municipal Corporation of Greater Mumbai) Municipal Council, Nagar Panchayat, SPA, NTDA, Metropolitan Region Development Authorities etc. in the State prepared by the said Committee with few Modifications (hereinafter referred to as the said proposed modification) ;
And whereas, the Government, found it expedient in the public interest to take recourse to the provision contained in section 37(1AA) of the said Act.
Now, therefore, in exercise of the powers conferred by Clause (a) of sub-section (1AA) of section 37 of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) and all other powers enabling in that behalf, the Govt. of Maharashtra hereby, in supersession of all the earlier existing Development Control Regulations of the said Planning Authorities declares its intention to replace them and newly insert the said proposed modification in respect of Unified Development Control Regulations for all Planning Authorities in Maharashtra except Municipal Corporation of Greater Mumbai, and for that purpose publishes a notice for inviting suggestions/objections from any person with respect to the said proposed regulations within a period of one month from the date of publication of this notice in the Maharashtra Government Gazette.
Any objections and suggestions upon the said proposed modifications be forwarded before the expiry of one month from the date of publication of this notice in Maharashtra Government Gazette to the concerned Divisional Joint Director of Town Planning who is hereby authorised as an officer under section 162 of the said Act to hear the objections or suggestions, which may be received by the concerned Officer appointed. The appointed officer shall submit his report with respect to the proposed modification to the Government after following and completing the procedure as per provisions of sub-section (1 A A) of section 37 the said Act. This said proposed modification will be made applicable after it's sanction by the Government;
महाराष्ट्र शासन राजपत्र असाधारण भाग एक---मध्य उप-विभाग, मार्च ९, २०१९/फाल्गुन १८, शके १९४० ४Suggestions and /or objections from any person within a period of one month from the date of publication of this Notice in the Maharashtra Government Gazette shall be considered;
This notice along with the said proposed regulations shall be kept open for inspection to the general public in the following offices for the above period on all working days.
(i) Director of Town Planning, Central Building, Pune;
(ii) Joint Director of Town Planning, Kokan, Pune, Nashik, Nagpur, Aurangabad, Amravati Division.
This Notice shall also be published on the Government website www.maharashtra.gov.in (कायदे/नियम).
