क्रमांक टिपीबी. ४३१७/६८३/प्र.क्र.२२८/२०१७/नवि-११.-----ज्याअर्थी, महाराष्ट्र प्रादेशिक व नगररचना अधिनियम, १९६६ (यापुढे याचा उल्लेख '' उक्त अधिनियम '' असा करणेत आलेला आहे) चे कलम ३१, पोट-कलम (१) अन्वये प्राप्त अधिकारांचा वापर करून राज्य शासनाने अधिसूचना क्र. टिपीबी. ४३१७/६२९/प्र.क्र.११८/२०१७/वि.यो./नवि-११, दिनांक ८ मे २०१८ (यापुढे याचा उल्लेख '' उक्त अधिसूचना '' असा करणेत आलेला आहे) द्वारे बृहन्मुंबई प्रारुप विकास योजना-२०३४ (यापुढे याचा उल्लेख '' उक्त विकास योजना '' असा करणेत आलेला आहे) सह विकास नियंत्रण व प्रोत्साहन नियमावली-२०३४ ला उक्त अधिसूचनेसोबतचे परिशिष्ट-ब मध्ये दर्शविलेले सारभूत स्वरुपाचे फेरबदल (ई.पी.) वगळून उक्त अधिसूचनेसोबतचे परिशिष्ट-अ मध्ये दर्शविलेल्या सुधारणेसह मंजुरी दिली आहे ; आणि ज्याअर्थी शासनाने उक्त अधिसूचनेस समक्रमांकाचे शुद्धीपत्रक दिनांक २२ जून २०१८ रोजी निर्गमित केले असून त्यानुसार उक्त नियमावली दिनांक १ सप्टेंबर २०१८ पासून अंमलात आली आहे. आणि ज्याअर्थी, त्यानंतर शासनाने समक्रमांकाचे शुद्धीपत्रक व पुरकपत्र दिनांक २९ जून २०१८ रोजी पारित केले असून सदर शुद्धीपत्रक व पुरकपत्र महाराष्ट्र शासनाच्या राजपत्रात दिनांक ३० जून २०१८ रोजी प्रसिद्ध करण्यात आले आहे;
आणि ज्याअर्थी, उक्त विकास योजनेत, न.भू.क्र. ६/१ (पै) मौजे मंडाले व न.भू.क्र. १०(पै), मौजे तुर्भे, मुंबई ह्य जमिनी विविध सार्वजनिक प्रयोजनार्थ जशा मेट्रो/मोनो रेल कार शेड (RT ३.१), बगीचा/उद्यान (ROS १.५), सुधारगृह सुविधा (RPU ३.३), पोलीस चौकी (RPU ३.२), संमिश्र स्मशानभूमी (ESA ४.५) आणि विकास योजना रस्ता इ. करिता आरक्षित आहेत. (यापुढे याचा उल्लेख '' उक्त जमीन '' असा करणेत आलेला आहे) ;
आणि ज्याअर्थी, महानगर आयुक्त, मुंबई महानगर प्रदेश विकास प्राधिकरण (यापुढे याचा उल्लेख '' एमएमआरडीए '' असा करणेत आलेला आहे) यांचे दिनांक ६ जुलै २०१८ आणि दिनांक ५ मार्च २०१९ रोजीचे मेट्रो रेल्वे प्रकल्प, मंडळे कार डेपोसाठी अतिरिक्त जागेची आवश्यकता यासंबंधीचे पत्र नगरविकास विभागास प्राप्त झाले आहे. सदर पत्रात नमूद आहे की, मेट्रो/मोनो कार डेपो, अनुषंगिक व वाणिज्य वापर याकरिता आरक्षित जमीन ही मेट्रो/मोनो कार प्रकल्पांच्या भविष्यातील प्रस्तावित विस्ताराचे दृष्टीने अपुरी आहे. सदर कमतरता भरून काढण्यासाठी उक्त जमिनीचे आरक्षणात बदल करणेबाबत एमएमआरडीएने विनंती केली आहे. आणि ज्याअर्थी, आयुक्त, बृहन्मुंबई महानगरपालिका यांनी त्यांचेकडील दिनांक ४ जानेवारी २०१८ रोजीचे पत्राद्वारे त्यांचे अभिप्राय सादर केले असून उचित निर्णय घेणेबाबत शासनास विनंती केली आहे. आणि बृहन्मुंबई महानगरपालिकेच्या सार्वजनिक आरोग्य विभागाने दिनांक २ नोव्हेंबर २०१८ चे पत्रान्वये एमएमआरडीएला विद्यमान स्मशानभूमीपैकी जागा मेट्रो वापरासाठी हस्तांतरित करण्यासाठी मान्यता दिलेली आहे ;

भाग एक (को.वि.पु.)---३६२ महाराष्ट्र शासन राजपत्र असाधारण भाग एक---कोकण विभागीय पुरवणी, मार्च ९, २०१९/फाल्गुन १८, शके १९४० आणि ज्याअर्थी, एमएमआरडीएने केलेली विंनती आणि आयुक्त, बृहन्मुंबई महानगरपालिका यांचा अहवाल विचारात घेता सदर प्रकरणी उक्त जमिनीचे काही भागावरील आरक्षणात बदल करणे सार्वजनिक हिताचे दृष्टीने आवश्यक आहे, अशी शासनाची खात्री झाली आहे. (यापुढे याचा उल्लेख "प्रस्तावित फेरबदल" असा करणेत आलेला आहे) ;
आणि त्याअर्थी, उपरोक्त परिस्थिती आणि वस्तुस्थिती विचारात घेता आणि उक्त अधिनियमाच्या कलम ३७ च्या पोट-कलम (१कक) अन्वये प्राप्त अधिकार आणि त्या संदर्भातील सर्व शक्तींचा वापर करून, शासन याद्वारे प्रस्तावित फेरबदलाविषयी उक्त अधिनियमाच्या कलम ३७, पोट-कलम (१कक) चे खंड(क) नुसार कोणत्याही व्यक्तीकडून सदरची सूचना शासन राजपत्रा मध्ये प्रसिद्ध झालेल्या दिनांकापासून एक महिन्याचे मुदतीमध्ये हरकती/सूचना मागविण्यासाठी सदर सूचना प्रसिद्ध करीत आहे ;
शासनाकडून असेही कळविणेत येत आहे की, खालील परिशिष्टात नमूद प्रस्तावित फेरबदलाविषयी कोणत्याही हरकती/सूचना शासन राजपत्रात सदर सूचना प्रसिद्ध झाल्याच्या दिनांकापासून एक महिन्याच्या आत उप संचालक, नगररचना, बृहन्मुंबई यांचेकडे इन्साहटमेंटस, ई-ब्लॉक, आझाद मैदान, महापालिका मार्ग, मुंबई ४०० ००१ या कार्यालयाचे पयावर पाठविण्यात याव्यात. उप संचालक, नगररचना, बृहन्मुंबई यांच्याकडे सदरच्या कालावधीत प्राप्त होणाया हरकती/सूचना यावर उक्त अधिनियमाच्या कलम ३७ च्या पोट-कलम (१कक) अन्वये कार्यवाही करण्यात येईल ;
प्रस्तावित फेरबदल दर्शविणारा नकाशा जनतेच्या अवलोकनासाठी खालील ठिकाणी ठेवण्यात येईल :----
(१) महानगर आयुक्त, मुंबई महानगर प्रदेश विकास प्राधिकरण यांचे कार्यालय, वांद्रे-कुर्ला संकुल, वांद्रे (पूर्व), मुंबई ४०० ०५१. (२) प्रमुख अभियंता (विकास नियोजन), बृहन्मुंबई महानगरपालिका यांचे कार्यालय, महापालिका मार्ग, मुंबई ४०० ००१.
(३) उप संचालक, नगररचना, बृहन्मुंबई यांचे कार्यालय, इन्साहटमेंट, ई-ब्लॉक, आझाद मैदान, महापालिका मार्ग, मुंबई ४०० ००१.
परिशिष्ट
(1) The reservation of '' Correction Facilities '' (RPU 3.3) is shifted in reservation of '' Garden /Park (ROS1.5)'' on land bearing CTS No. 6/1 (Part) of Village Mandale with area admeasuring approximately 2.02 Ha. and remaining area of '' Garden / Park (ROS 1.5) '' along with area under original correction facilities (RPU 3.3) reservation. is proposed to be deleted and reserve for '' Metro/ Mono Car Depot, Allied users and Commercial ''.
(2) Width of D.P. Road is proposed to change from 36.6 m. to 27.45m. upto relocated Reservation of Correction Facilities and remaining area under 36.60 m. D.P. Road is proposed to be deleted and reserve for '' Metro/ Mono Car Depot, Allied users and Commercial '' as shown on plan.
(3) Reservation of '' Police Chowky (RPU 3.2) '' on land bearing CTS No. 10 (part) of Village Turbhe, Mumbai is proposed to be deleted and reserve the same for '' Metro/ Mono Car Depot, Allied users and Commercial. '' .
(4) Part area under Existing Cemetery (part of larger area) on land bearing CTS No. 10 (part) of Turbhe (Approximate 3447.49 sq. mt. ) is proposed to be deleted and reserve for '' Metro/ Mono Car Depot, Allied users and Commercial. '' (5) Existing Road in South West is proposed to be widened to 36.60 mtr. width.

Notice
MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
No. TPB. 4317/683/CR-228/2017/UD-11.––Whereas, in exercise of the powers conferred by sub-section (1) of Section 31 of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as " the Said Act "), the State Government vide Notification No. TPB. 4317/629/CR-118/2017/ DP/UD-11, Dated 8th May 2018 (hereinafter referred to as '' the said Notification '') has accorded sanction to the Draft Development Plan 2034 of Greater Mumbai (hereinafter referred to as '' the said Development Plan '') along with the Development Control and Promotion Regulations 2034 for Greater Mumbai with modifications shown in SCHEDULE-A appended to the said Notification excluding the substantial modifications as shown in SCHEDULE-B appended to the said Notification. And whereas, Government has issued corrigendum of even number dated 22nd June 2018 to the said Notification, as per which the said Development Plan has came into force from 1st September 2018. And whereas, thereafter Government has issued a Corrigendum and Addendum of even number dated 29th June 2018 to the said Notification, which is published in Government Gazette, dated the 30th June, 2018 ;
And whereas, as per the said Development Plan, land bearing CTS No. 6/1(Part), of village Mandale and CTS No. 10 (part) of Village Turbhe, Mumbai is reserved for various public purposes such as Metro/Mono Rail Car shed (RT 3.1), Garden/Park (ROS 1.5), Correction facility ( RPU 3.3), Police Chowky (RPU 3.2), Composite Cemetery (ESA 4.5) and Development Plan Road (hereinafter referred to as '' the said land '') ;
And whereas, Urban Development Department has received letters dated the 6th July 2018 and dated 5th March 2019 from Metropolitan Commissioner, Mumbai Metropolitan Region Development Authority (hereinafter referred to as '' MMRDA '') regarding Metro Rail Projects, requirement of additional land for Mandale Car Depot. It is stated in the said letter that keeping in view provisions for future expansion land reserved for Metro/Mono Car Depot, Allied users and Commercial is falling deficit to house the required components. To accommodate this deficit MMRDA has requested for change in reservations in respect of said land. And whereas, Commissioner Municipal Corporation of Greater Mumbai vide his letter dated 4th January 2018 has submitted his remarks and requested the Government to take appropriate decision and also Public Health Department of Municipal Corporation of Greater Mumbai vide letter dated 2nd November 2018 has communicated to MMRDA that they have granted permission to handover the part land required for metro out of larger Existing Cemetery ;
And whereas, considering the request of MMRDA and Report of the Municipal Corporation of Greater Mumbai, the Government is satisfied that in the public interest it is expedient to change reservations, land use in respect of portion of the said land (hereinafter referred to as " the proposed modifications " and more specifically described in the schedule given below) ;
Now, therefore, after considering the above facts and circumstances and in exercise of the powers vested in it under sub-section (1AA) of Section 37 of the said Act, and all other powers enabling it in this behalf, the Government hereby publishes a Notice for inviting objections/suggestions from any person with respect to proposed modification, as required by clause (a) of sub-section (1AA) of Section 37 of the said Act, within a period of one month from the date of publication of this Notice in the Maharashtra Government Gazette ;
४ महाराष्ट्र शासन राजपत्र असाधारण भाग एक---कोकण विभागीय पुरवणी, मार्च ९, २०१९/फाल्गुन १८, शके १९४०The Government is further pleased to inform that any objections/suggestions upon the proposed modification received before the expiry of one month from the date of publication of this notice in the Maharashtra Government Official Gazette be forwarded to the Deputy Director of Town Planning, Greater Mumbai, having his office at ENSA Hutments, E-Block, Azad Maidan, Mahapalika Marg, Mumbai 400 001.
Any objection or suggestions, which may be received by the Deputy Director of Town Planning, Greater Mumbai within the said period shall be dealt with in accordance with the provisions of the said sub-section (1AA) of section 37 ;
A plan showing the proposed modification shall be kept open for the inspection at the following places :––
(1) Office of the Metropolitan Commissioner, Mumbai Metropolitan Region Development Authority, Bandra-Kurla Complex, Bandra (East), Mumbai 400 051.
(2) Office of the Chief Engineer (Development Plan) Municipal Corporation of Greater Mumbai, Mahapalika Marg, Mumbai 400 001.
(3) Office of the Deputy Director of Town Planning, Greater Mumbai, having his office at ENSA Hutments, E-Block, Azad Maidan, Mahapalika Marg, Mumbai 400 001.
Schedule
