महाराष्ट्र ठेवीदारांच्या (वित्तीय संस्थामधील) हितसंबंधाचे संरक्षण अधिनियम, १९९९.
क्रमांक एमपीआय-०२१८/प्र.क्र.१०१/पोल-१२.— ज्याअर्थी, विशाल इंटरप्राइजेस या वित्तीय संस्थेचे संचालक विशाल विजयकुमार कुंडगुलवार व त्यांची पत्नी श्रुतीका विशाल कुंडगुलवार (यात यापुढे आरोपी असा निर्देश करण्यात आला आहे.) उक्त आरोपींनी ठेवीदारांकडून स्वीकारलेल्या ठेवी मुदतीपुर्तीनंतर परत करण्यास कसूर केली आहे, अशा तक्रारी त्यांच्याविरुद्ध बहुतांश ठेवीदारांकडून प्राप्त झालेल्या आहेत ;
आणि ज्याअर्थी, आरोपींविरुद्ध पोलीस ठाणेे, भोकर, जि. नांदेड येथे गु.र.नं.१८१/२०१७ भा.दं.वि. कलम ४२०, ४०६, ३४ व महाराष्ट्र ठेवीदारांचे (वित्तीय संस्थामधील) हितसंबंधाचे संरक्षण अधिनियम, १९९९ च्या कलम ३अन्वये गुन्हा नोंदविण्यात आला आहे ;
आणि ज्याअर्थी, राज्य शासनाची अशी खात्री झाली आहे की, उक्त (वित्तीय संस्था) आरोपींनी ठेवीदारांना त्यांच्या ठेवी परत करण्याची शक्यता नाही आणि म्हणून, राज्य शासनाला अशा ठेवीदारांच्या हितसंबंधाचे रक्षण करावे लागेल ;
आणि ज्याअर्थी, यासोबत जोडलेल्या अनुसूचीत विर्िनदिष्ट केलेली मालमत्ता उक्त (वित्तीय संस्था) आरोपींनी गोळा केलेल्या ठेवींमधून आणि ठेवींतून संपादित करण्यात आलेली आहे असे अभिकथित आहे ;
ज्याअर्थी आता, महाराष्ट्र ठेवीदारांच्या (वित्तीय संस्थामधील) हितसंबंधी संरक्षण अधिनियम, १९९९ (२००० चा महा. १६) (यात यापुढे ज्याचा उक्त अधिनियम असा निर्देश करण्यात आला आहे) याच्या कलम ४ चे पोट-कलम (१) व कलम ५ आणि कलम ८ याद्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून महाराष्ट्र शासन याद्वारे-----
(क) अनुसूचीत विर्िनदिष्ट केल्याप्रमाणे, उक्त वित्तीय संस्थेची आणि त्यांचे संचालक यांच्या नावे असलेली मालमत्ता जप्त करीत आहे, आणि
(ख) उक्त वित्तीय आस्थापना आणि त्यांचे संचालक यांच्या जप्त केलेल्या मालमत्तेवर नियंत्रण ठेवण्यासाठी उप विभागीय अधिकारी, उप विभाग भोकर यांची सक्षम प्राधिकारी म्हणून नियुक्ती करीत आहे.

NOTIFICATION
MAHARASHTRA PROTECTION OF INTEREST OF DEPOSITORS (IN FINANCIAL ESTABLISHMENT) ACT, 1999.
No. MPI-0218/CR.101/Pol-12.— Whereas, complaints have been received from number of depositors against accused Vishal Vijaykumar Kundgulwar Director of Vishal Interprizes and his wife Shrutika Vishal Kundgulwar (hereinafter referred to as the said Accused) complaining that they have defaulted to return the said deposits made by the depositors after maturity;
And whereas, an offence has been registered against the accused at Bhokar Police Station, Dist. Nanded vide C.R. No. 181/2017 u/s 420, 406, 34 of Indian Penal Code r/w section 3 of Maharashtra Protection of Interest of Depositors (in Financial Establishment) Act, 1999;
And whereas, the State Government is satisfied that the said (Financial Establishment) Accused are not likely to return the deposits to the depositors and hence the Government has to protect the interest of depositors;
And whereas, the properties specified in the Scheduled appended hereto are alleged to have been acquired by the said (Financial Establishment) Accused from and out of the deposits collected by the said Accused;
Now, therefore in exercise of the powers conferred by sub-section (1) of section 4, sub-section (1) of section 5 and section 8 of the Maharashtra Protection of Interest of Depositors (in Financial Establishment) Act, 1999 (Mah. XVI of 2000) (hereinafter referred to as the said Act) the Government of Maharashtra hereby.
(a) attaches the properties of the said (Financial Establishment) Accused and their relatives as specified in the Schedule; and
(b) appoints the Sub-Divisional Officer, Sub-Division Bhokar, Dist. Nanded to be the Competent Authority to exercise control over the properties attached of the (Financial Establishment) Accused;
The Public Prosecutor in designated Court appointed under the said Act shall render necessary assistance to the Competent Authority in filing the application before the Special Court.
