Prasad S. Patil, as "Special Public Prosecutor" for conducting the Sessions Case No. 138/2018, pending before Sessions Court, Alibag, Dist. Raigad (previously numbered as R.C.C. 184/2018, at First Class Judicial Magistrate, Alibag, Dist. Raigad) which is arising out of C.R. No.150/2018 registered at Karjat Police Station, District Raigad.

2. His appointment is strictly subject to the conditions of service laid down in the Maharashtra Law Officers (Appointment, Conditions of Service and Remuneration) Rules, 1984.

3. Lump sum fees of Rs. 50,000 (Rs. Fifty Thousand only) as quoted by Adv. Prasad S. Patil has been already deposited by the applicant Shri Rishikesh Vilas Dabhade to the Government, vide R. B. I. Challan No. 7610, dated 22nd February 2019. The amount will be paid to Adv. Prasad S. Patil after completion of the case.

4. The Government reserves the right to revoke/modify/annul the order without assigning any reasons.

Parimal K. Phale as "Special Public Prosecutor" to assist Adv. Ujjwal Nikam conducting Sessions Case No. 194/2018 in Sessions Court, Ahmednagar which is arising out of C.R.No.222/2013 registered with Newasa Police Station, Dist. Ahmednagar.

2. Adv. Ujjwal Nikam has already been appointed as Special Public Prosecutor vide Notification No. SPP.0116/A.S.15/D-XIV, dated 4th April 2016 for conducting the Sessions Case No. 105/2014 pending before Sessions Court, Newasa, which is arising out of C.R.No.222/2013 registered with Newasa Police Station, District Ahmednagar.

3. His appointment is strictly subject to the conditions of service laid down in the Maharashtra Law Officers (Appointment, Conditions of Service and Remuneration) Rules, 1984.

4. The fees of Adv. Parimal K. Phale will be directly paid by the applicant in the above mentioned case and there will be no claim of any Remuneration or fees from the Government. 5. The Government reserves the right to revoke/modify/annul the order without assigning any reasons.

क्रमांक ९१/वाचक-१/५३४/२०१९.------ ज्याअर्थी, जळगांव जिल्ह्यतून जाणारा राष्ट्रीय महामार्ग क्र. ०६ या महामार्गावर तारीख ६ मार्च २०१९ रोजी १३-०० वा. डॉ. बाबासाहेब आंबेडकर मैदान, भुसावळ (डि. एस.मैदान) येथून लोकसंघर्ष मोर्चा श्रीमती प्रतीभा शिंदे यांचे नेतृत्वाखाली सुशिक्षित बेरोजगारांचा पायी आक्रोश मोर्चा भुसावळ ते जळगाव असा काढणार आहे, मोर्चात सुमारे ३००० ते ४००० सशिक्षित बेरोजगार सहभागी होण्याची शक्यता आहे व सदर मोर्चा नशिराबाद येथे मुक्कामी राहणार आहे व दिनांक ७ मार्च २०१९ रोजी नशिराबाद येथून सकाळी ०७-०० वा. जळगांव करीता निघणार आहे.

त्याअर्थी, मी, डॉ. पंजाबराव उगले, पोलीस अधीक्षक, जळगांव, जि. जळगांव १९५१ च्या मुंबई पोलीस कायदा कलम ३३ (१) (बी) नुसार प्रदान करण्यात आलेल्या अधिकाराचा वापर करून जळगांव जिल्ह्यतील पुढील ठिकाणी आणि वेळी सर्व प्रकारच्या वाहनांच्या वाहतूक मार्गात बदल करणेबाबत व वाहनांच्या विनियमनासाठी आणि कायदा व सुव्यवस्था राखण्यासाठी पुढीलप्रमाणे आदेश देत आहे :----

(१) राष्ट्रीय महामार्ग क्र. ०६ मुंबई-नागपुर यावरील मुक्ताईनगर भुसावळ कडून जळगांवकडे जाणारी व यावल रावेर कडून जळगांवकडे जाणारी सर्व प्रकारची वाहतूक ही, दिनांक ६ मार्च २०१९ रोजी १४-०० वा. पासून १९-०० वा. पावेतो नहाटा चौफुली जामनेर नेरी मार्गे जळगांव असा मार्गात बदल करणेबाबत आदेश देत आहे.

(२) दिनांक ७ मार्च २०१९ रोजी सकाळी ०८-०० वाजता ते १३-०० वा. पावेतो मुक्ताईनगर कडून जळगांवकडे जाणारी सर्व प्रकारची वाहतूक नहाटा चौफुली-जामनेर नेरी मार्गे जळगांव असा मार्गात बदल करून पर्यायी मार्ग वापर होणेबाबत आदेश देत आहे.

(मल्टीस्टेट शेडयुल्ड बँक) या बहुराज्यीय सहकारी बँकेमध्ये विलीन होण्यापूर्वीच्या अदा केलेल्या कर्ज प्रकरणाच्या वसुलीसाठी महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १०१ व कलम ९१ अन्वये प्राप्त केलेल्या वसुली दाखल्यांची महाराष्ट्र सहकारी संस्था नियम, १९६१ चा नियम १०७ अनुसार वसुली अधिकायामार्फत अंमलबजावणी करणेसाठी, कसूरदाराची मालमत्ता जप्त करून तिची विक्री करून रकमा वसूल करण्याचे निबंधकांचे अधिकार, खालील अटीस अधीन राहून दिनांक ३१ मार्च २०१९ पयर्ंत प्रदान करीत आहेत :—

(मल्टीस्टेट शेडयुल्ड बँक) या बहुराज्यीय सहकारी बँकेमध्ये विलीन होण्यापूर्वीच्या अदा केलेल्या कर्ज प्रकरणापुरतेच वापरता येतील अन्यथा इतर प्रकारे सदर अधिकारांचा वापर करता येणार नाही.

(२) सदरचे अधिकार महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १०१ व कलम ९१ अन्वये प्राप्त वसुली दाखल्यांची अंमलबजावणी करण्याकरिता असतील.

(३) वसुली अधिकारी यांनी महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ व नियम १९६१ चे नियम १०७ मधील तरतुदीनूसार कर्ज वसुलीची कार्यवाही करावी. कर्ज वसुली करताना सहकार कायदा, नियम यातील तरतुदी व परिपत्रकीय सूचनांचे पालन न केल्याचे निदर्शनास आल्यास आवश्यक ती चौकशी करून आवश्यकता भासल्यास सदरचे प्रदान केलेले अधिकार तत्काळ काढून घेण्यात येतील.

(४) वसुली अधिकारी यांनी मालमत्तेच्या वाजवी किमतीस (अपसेट प्राईज) निबंधकाची पूर्व मान्यता घेणे आणि मालमत्तेची विक्री कायम करणे या कामी या कार्यालयाचे परिपत्रक जा.क्र. ना.बँका/डी-४/अपसेट प्राईज विक्री कायम/२०१५/८७०, दिनांक १७ एप्रिल २०१५ अनुसार संबंधित जिल्हा उप निबंधक, सहकारी संस्था यांची मान्यता घ्यावी संबंधित जिल्हा उप निबंधक, सहकारी संस्था यांनी उक्त बँकेच्या वाजवी किमतीस (अपसेट प्राईज) पूर्व मान्यता देणे आणि मालमत्तेची विक्री कायम करणे संबंधी प्रस्तावाबाबत महाराष्ट्र सहकारी संस्था नियम, १९६१ चे नियम १०७ मधील तरतुदीनुसार उचित कार्यवाही करावी.

(५) वसुली अधिकारी यांनी दरमहा या कार्यालयाचे परिपत्रक दिनांक २४ जून २०१६ अन्वये विहित केलेल्या नमुन्यात अ-३, अ-४, व ब कर्ज वसुलीची माहिती संबंधित जिल्हा उप निबंधक, सहकारी संस्था यांचे कार्यालयास सादर करावी.

(६) प्रदान केलेल्या व्यक्तीची बदली झाल्यास किंवा सदर व्यक्ती सेवानिवृत्ती झाल्यास सदर व्यक्तीस सेवेतून काढून टाकल्यास किंवा त्याचा मृत्यू झाल्यास, अशा अधिकायास प्रदान केलेले अधिकार आपोआप रद्द होतील.

(७) मा. उच्च न्यायालय, मुंबई यांनी रिट याचिका क्रमांक १९४२/२०१३, दि बेसिन कॅथोलिक को-ऑप. बँक विरूद्ध महाराष्ट्र राज्य व इतर या याचिकेमध्ये दिनांक ५ डिसेंबर २०१५ रोजी दिलेला आदेश विचारात घेऊन वसुलीची कार्यवाही करताना महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ अन्वये प्राप्त असलेल्या अधिकारानुसारच वसुलीची कार्यवाही करावी.

(८) वसुली अधिकारी यांनी नमूद केलेल्या कालावधीत वसुलीचे कामकाज समाधानकारक केले नसल्याचे निदर्शनास आल्यास किंवा प्रदान केलेल्या अधिकाराचा गैरवापर करीत असल्याचे निदर्शनास आल्यास, प्रदान केलेले अधिकार काढून घेतले जातील व भविष्यात असे कोणतेही अधिकार अशा व्यक्तीस प्रदान करण्यात येणार नाहीत.

(९) वसुली अधिकायास त्याच्या नावापुढे कोठेही ""महाराष्ट्र शासन नियुक्त"" आणि किंवा "" सिव्हील कोर्ट"", ""एक्झीक्युटीव्ह कोर्ट"" या शब्दांचा अथवा तत्सम शब्दांचा वापर करता येणार नाही. त्याऐवजी वसुली अधिकायंानी त्यांच्या नावापुढे ""वसुली अधिकारी (महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ चे नियम १०७ अन्वये )"" असे लिहावे.

(१०) वसुली अधिकायास वसुलीसाठी वापर करण्यात येणाया वाहनावर ""वसुली अधिकारी, नागपूर नागरिक सहकारी बँक लि.

(मल्टीस्टेट शेडयुल्ड बँक)"" असा फलक लावता येऊ शकेल.

(११) वसुली अधिकायाने पगार जप्तीची कार्यवाही करताना कर्जदाराच्या/जामीनदाराच्या पगार कपातीबाबत राष्ट्रीयीकृत बँका वा अन्य बँका यांचेकडे परस्पर वेतन कपातीचा आदेश देऊन परस्पर पगार कपात करता येणार नाही. संबंधित कर्जदार/जामीनदार ज्या आस्थापनेवर काम करीत आहे त्या आस्थापनेवरील आहरण व संवितरण अधिकारी/पगार करणारा अधिकारी यांचेमार्फत पगारातून कर्ज वसूल करण्याची कार्यवाही करावी.

(१२) वसुली अधिकायास, थकबाकीदाराकडून वसुली दाखल्यानुसार वसूलपात्र रक्कम या कार्यालयाचे कलम १५६ अन्वयेचे आदेश ६ एप्रिल २०१८ मध्ये नमूद केल्याप्रमाणे व दराने अंमलबजावणी खर्चाची रक्कम याशिवाय इतर कोणतीही रक्कम वसूल करता येणार नाही.

(१३) या कार्यालयाचे आदेश/परिपत्रक दिनांक १ जानेवारी २०१७ मधील क्र. ४ कलम १५६ व नियम १०७ अन्वये वसुली अधिकारी यांनी करावयाची कार्यवाही यामधील मार्गदर्शक सुचनांचे पालन करावे. बँकेचे मुख्य कार्यकारी अधिकारी यांनी दरमहा वसुली अधिकायांचे कामकाजाचा कर्जदारनिहाय आढावा परिपत्रकातील "प्रपत्र पाच" मध्ये नमूद केल्याप्रमाणे घ्यावा.

(१४) वसुली अधिकारी यांनी निर्गमित करावयाच्या नोटीस आदेश/यामध्ये त्यांना अधिकार प्रदान केलेल्या व आदेशाचा संदर्भ नमूद करावा.

(१५) एका वसुली अधिकायाकडे १०० पेक्षा जास्त वसुली प्रकरणे देण्यात येऊ नयेत.

(१६) वसुली अधिकारी यांना प्रदान केलेल्या अधिकारांची उपरोक्त मुदत संपणेपूर्वी तीन महिनेचे आत अधिकाराचे नूतनीकरण करणेसाठीचा प्रस्ताव, नूतनीकरणाच्या समर्थनार्थ आवश्यक त्या कागदपत्रांसह सादर करणे बंधनकारक राहील.

(६) वसुली अधिकारी यांनी नमूद केलेल्या कालावधीत वसुलीचे कामकाज समाधानकारक केले नसल्याचे निदर्शनास आल्यास किंवा प्रदान केलेल्या अधिकाराचा गैरवापर करीत असल्याचे निदर्शनास आल्यास, प्रदान केलेले अधिकार काढून घेतले जातील व भविष्यात असे कोणतेही अधिकार अशा व्यक्तीस प्रदान करण्यात येणार नाही.

(७) शासन निर्णय क्रमांक संकीर्ण १५०४/प्र.क्र.२३१/१५-स, दिनांक २३ नोव्हेंबर, २००६ अन्वये वसुली अधिकायांना तीन सिंहाच्या राजमुद्रेचा वापर करता येणार नाही.

(८) वसुली अधिकायास त्याच्या नावापुढे कोठेही ""महाराष्ट्र शासन नियुक्त"" आणि किंवा "" सिव्हील कोर्ट"", ""एक्झीक्युटीव्ह कोर्ट"" या शब्दांचा अथवा तत्सम शब्दांचा वापर करता येणार नाही. त्याऐवजी वसुली अधिकायंानी त्यांच्या नावापुढे "" वसुली अधिकारी (महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ चे नियम, १०७ अन्वये)"" असे लिहावे.

(९) वसुली अधिकायास वसुलीसाठी वापर करण्यात येणाया वाहनावर ""वसुली अधिकारी, दी पेण अर्बन को-ऑप. बँक लि., पेण"" असा फलक लावता येऊ शकेल.

(१०) वसुली अधिकायाने पगार जप्तीची कार्यवाही करताना कर्जदाराच्या/जामीनदाराच्या पगारकपातीबाबत राष्ट्रीयकृत बँका वा अन्य बँका यांच्याकडे परस्पर वेतन कपातीचा आदेश देऊन परस्पर पगार कपात करता येणार नाही. संबंधित कर्जदार/जामीनदार ज्या आस्थापनेवर काम करीत आहे त्या आस्थापनेवरील आहरण व संवितरण अधिकारी/पगार करणारा अधिकारी यांचेमार्फत पगारातून कर्ज वसूल करण्याची कार्यवाही करावी.

(११) वसुली अधिकायास, थकबाकीदाराकडून वसुली दाखल्यानुसार वसूलपात्र रक्कम व सरचार्ज रक्कम याशिवाय इतर कोणतीही रक्कम वसूल करता येणार नाही.

(१२) या कार्यालयाचे आदेश/परिपत्रक दिनांक १ जानेवारी २०१७ मधील क्र. ४ कलम १५६ व नियम, १०७ अन्वये वसुली अधिकायांनी करावयाची कार्यवाही यामधील मार्गदर्शक सुचनांचे पालन करावे. बँकेचे मुख्य कार्यकारी अधिकारी यांनी दरमहा वसुली अधिकायांचे कामकाजाचा कर्जदारनिहाय आढावा परिपत्रकातील प्रपत्र-पाच मध्ये नमूद केल्याप्रमाणे घ्यावा.

(१) वसुली अधिकारी यांनी महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ व नियम, १९६१ चे नियम १०७ मधील तरतुदीनुसार कर्ज वसुलीची कार्यवाही करावी. कर्जवसुली करताना सहकार कायदा, नियम यातील तरतुदी व परिपत्रकीय सूचनांचे पालन न केल्याचे निदर्शनास आल्यास आवश्यक ती चौकशी करून आवश्यकता भासल्यास सदरचे प्रदान केलेले अधिकार तत्काळ काढून घेण्यात येतील.
