ORDER

No. Hudkeshwar (Bk.) & Narsala-Sec. 30-Extension-TPV-2-782-2019.—

Whereas, Municipal Corporation of Nagpur (hereinafter referred to as "the said Municipal Corpora- tion") has published the Draft Development Plan of newly merged village Hudkeshwar (Bk.) & Narsala (hereinafter referred to as "the said Published Draft Development Plan") under sub-section (1) of Section 26 of Maharashtra Regional & Town Planning Act, 1966 (hereinafter referred to as "the said Act") on 28th November, 2016 & published a notice to that effect in the Government Gazette on 28th November 2016;

And whereas, in accordance with the provisions of sub-section (1) of Section 30 of the said Act, the said published Plan alongwith the list of modifications or changes made in the draft Development Plan under sub-section (4) of Section 28 is required to be submitted to the State Government for sanction by the Said Municipal Corporation, within a period of six Months from the date of publication of Notice under Section 26 in the Official Gazette or within such further period as may be extended by the State Government, but such extended period not to exceed more than 12 months in aggregate ;

And whereas, as per sub-section (1) of Section 30 of said Act, the said Published Draft Development Plan was required to be submitted by the said Municipal Corporation to Government for sanction within initial time limit of six months from publication i. e. up to 27th May, 2017. But the said Municipal Corporation has submitted the said Published Draft Development Plan to Government on 13th April, 2018 ;

And whereas, the Commissioner, Municipal Corporation of Nagpur has requested the Director of Town Planning to extend the said period upto 13th April, 2018, vide its letter No. 1655, dated 27th Novem- ber, 2018, along with the Resolution No. 279, dated 24th September, 2018 passed to that effect ;

And Whereas, Government in Urban Development Department vide Notification No. TPS-1813-3211- CR-508-UD-13, dated 1st December, 2016 has delegated powers, to extend the period under Section 30 of the said Act, to the Director of Town Planning, Maharashtra State, Pune ;

And Whereas, after considering reasons mentioned by the said Municipal Corporation, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is expendient to extend the period for the submission of the said publised Plan under sub-section (1) of Section 30 of the said Act, to Government up to and inclusive of dated 13th April, 2018 ;

Now therefore, in exercise of the powers delegated to him under Government Notification dated 1st December, 2016 the Director of Town Planning, Maharashtra State, Pune is pleased to extend the period for the submission of the said published Plan to Government under sub-section (1) of Section 30 of the said Act up to and inclusive of dated 13th April, 2018.

The development Plan of Gadchiroli (revised) has been sanctioned vide government Resolution No. TPS-2716-CR-28(A)-2016-UD-9, dated 20th December, 2016 and has come into force from 6th Febru- ary, 2017.

Whereas, the Revised Development Plan of Nagpur City prepared under the provisions of Maharashtra Regional and Town Planning Act, 1966, Section 31 (1) has been partially sanctioned by the Govt. vide Urban Development Department Notification No. TPS-2496-2643-CR-300(a)-97-UD-9, dated 7th January, 2000 and came into force from 1st March, 2000. Excluded part of Development Plan has been sanctioned vide Government Notification No. TPS-2400-1628-CR-200-2000-UD-9, dated 10th September, 2001 and came into force from dated 21st September, 2001. Also Nagpur Municipal Corporation has been declared as the 'Planning Authority' for Nagpur City except the areas covered under seven scheme vide Govt. And, Whereas, in the said Revised Sanctioned Development Plan, the Municipal Corporation is desirous of making some modification u/s 37 of Maharashtra Regional and Town Planning Act, 1966 as detailed below :—

In the Sanctioned Development Plan of Nagpur land bearing Khasara No. 63, 64/1-2 & 65/1-2, of Mouza Nari within Nagpur Municipal Corporation Limit is designated as "Primary School". This land is necessary for Public use and Nagpur Municipal Corporation is desirous to acquire. The land for Public use Hence, as per Section 37(1) of Maharashtra Regional and Town Planning Act, 1966, Nagpur Municipal Corporation has decided to modify the land use of the land bearing Khasara No. 63, 64/1-2 & 65/1-2, of Mouza Nari from 'Primary School' to 'Garden'.

Now, therefore, the Nagpur Municipal Corporation has passed the resolution vide Resolution No. 345, dated 29th January, 2019 to make the aforesaid modification.

The part plan of Development Plan of Nagpur City showing the aforesaid modification are kept open at the office of the Town Planning Deptt., Wing 'B' & 'C'. Third Floor, Shri Chhatrapati Shivaji Maharaj Administrative Building Mahapalika Marg. In the said 24.00 mtr. wide D.P. road is required to be reduced to 18.00 mtr. wide D.P. road from Ramesh Mamtani Sq. to Barakholi T-Point as per existing road development on Site.

And, whereas, as per Section 37 of Maharashtra Regional and Town Planning Act, 1966, Nagpur Municipal Corporation has decided to modify 24.00 mtr. wide D.P. road by reduce the width of road upto 18.00 mtr. wide D.P. road from Ramesh Mamtani Sq. to Barakholi T-Point for Mouza Jaripatka and for this Nagpur Municipal Corporation has passed the Resolution No. 344, dated 29th January, 2019 to make the aforesaid modification.

Also Nagpur Municipal Corporation has been declared as the 'Planning Authority' for Nagpur City except the areas covered under seven scheme vide Government Notification No. TPS- 2401-855-CR-76-UD-9, dated 27th February, 2002.

And Whereas, in the said Revised Sanctioned Development Plan, the Municipal Corporation is desirous of making some modifications under Section 37 of Maharashtra Regional and Town Planning Act, 1966 as detailed below—

"In the sanctioned development plan of the Nagpur City, on the land admeasuring 1378.750 sq.mt. of Mouza Nagpur, bearing City Survey Sheet No. 206, City Survey No. 272, is designated as a "School" under Public/Semipublic land use, which is proposed to be deleted and to be included in Nagpur "Municipal Corporation Office", as per Section 37 of the Maharashtra Regional and Town Planning Act, 1966. The ownership of the said land is of Nagpur Municipal Corporation, Nagpur. The Planning Authority for this area is Nagpur Municipal Corporation.

And Whereas, as per Section 37 of the Maharashtra Regional and Town Planning Act, 1966, Nagpur Municipal Corpo- ration, has decided to modify the land use for land bearing City Survey No. 206, City Survey No. 272, of Mouza Nagpur admeasuring 1378.750 sq. mt. which is designated as a "School" under Public/Semipublic Zone in sanctioned development plan of Nagpur City & to be included in "Municipal Corporation Office".

The Nagpur Municipal Corporation has passed the Resolution No. 346, dated 29th January, 2019 to make the aforesaid modification.

Now, therefore, the part plan of Development Plan of Nagpur City showing the aforesaid modification are kept open at the office of the Town Planning Department of Nagpur Municipal Corporation for inspection be public during office hours on all working days. The suggestions and objections which may be received to Municipal Corporation in respect of the said modifi- cation to the Development Plan within a period of one month from the date of publication of the notice, will be heard by the Municipal Commissioner before submitting the said modification proposal, to the State Government for sanction.

Whereas, the Revised Development Plan of Nagpur City prepared under the provisions of Maharashtra Regional and town Planning Act, 1966, Section 31(1) has been partially sanctioned by the Government vide Urban Development Department Notifi- cation No. TPS-2496-2643-CR-300(a)-97-UD-9, Dated 7th January, 2000 and came into force from 1st March, 2000. Excluded part of Development Plan has been sanctioned vide Government Notification No. TPS-2400-1628-CR-200-2000-UD-9, dated 10th September, 2001 and came into force from dated 21st September, 2001. "In the sanctioned development plan of the Nagpur City, the 30.00 mtr. wide D. P. road is proposed between Hotel Pride to Sonegaon Police Station (350.00 mtr.) (National Highway No. 7) for Mouza Ajni and Vivekanand Nagar Chowk to Paul Complex (340.00 mtr.) for Mouza Somalwada. Said 30.00 mtr. wide D.P. road is required to be widended to 38.00 mtr. as per requirement of Maharashtra Metro Rail Corporation/National Highway Authority of India for the construction of Metro via duct-cum-Four Lane Flyover & the proposal of modification for 30.00 mtr. wide D.P. road to be Modified for 38.00 mtr. width is received from the Maharashtra Metro Rail Carporation/National Highway Authority of India.
